Ensure Enforced Disappearances Bill Enacted: Human Rights Commission Tells President

The Human Rights Commission of Sri Lanka (HRCSL) urged the President, in his capacity as Minister of National Integration and Reconciliation, to provide leadership to ensure that the International Convention for the Protection of All Persons from Enforced Disappearances Bill is enacted and Sri Lanka sets an example not only for the region but globally on how to humanely respond to the grievances and pain of those who have suffered due to serious human rights violations.

We publish below the letter in full:

The International Convention for the Protection of All Persons from Enforced Disappearances Bill

The Human Rights Commission is writing to place before your Excellency its observations on the International Convention for the Protection of All Persons from Enforced Disappearances Bill (hereinafter the Bill).

The Commission believes the Bill is a positive step towards addressing the long history of disappearances in Sri Lanka and stemming impunity for gross violations of human rights. The Commission is of the view that enforced disappearance of a person is one of the most serious of human rights violations bringing untold sorrow to loved ones. As your Excellency is well aware, enforced disappearances have taken place in the Northern and Eastern as well as the Southern parts (during two insurrections) of the country, and affected all communities in Sri Lanka. It cannot be denied that these disappearances have had a devastating impact on families, sometimes resulting in families being torn apart following the enforced disappearance of the sole breadwinner.

Enforced disappearances have created thousands of women headed households in Sri Lanka that have struggled to meet the basic needs of their children, including access to education. Further, the emotional impact of not only losing a loved one but also of languishing for many years, even decades, not knowing the fate of the disappeared person has had a devastating psychological impact on family members. We have also witnessed many parents falling ill or passing away due to their inability to withstand the continuing sorrow and pain.

Hence, enforced disappearances is not only a legal and human rights issue but also a social issue that has devastated the lives of thousands of Sri Lankans. More importantly, the Bill would send the message that citizens are protected from this most cruel and inhumane crime. Enacting the Bill would most certainly contribute immensely towards re-building ethnic relations damaged by the ethnic conflict and strengthen the journey towards reconciliation.

Addressing this issue and enabling families to learn the truth about their disappeared loved ones is an important, courageous step Sri Lanka will be taking to re-affirm values of humanity, empathy and respect for the rule of law as a country. It would address the wounds caused by conflict in the country, including those caused by the recent civil war.

It is in this context and spirit, the Commission urges your Excellency, particularly in your capacity as Minister of National Integration and Reconciliation, to provide leadership to ensure that the Bill is enacted and Sri Lanka sets an example not only for the region but globally on how to humanely respond to the grievances and pain of those who have suffered due to serious human rights violations.

The Commission’s observations on specific provisions of the Bill are attached.

        UNP government is putting too much pressure on Sinhalese, especially Buddhists. ICPPED Bill, OMP, Tax Laws, e-ID and High-tech Number Plates breaching Privacy of Citizens, Federal Constitution, Privatization of State Institutions, fear of loss of jobs, suppression of freedom of expression in the Parliament, highhandedness in passing Bills, bribery racket in the Parliament, corruption and fraud at the highest governmental level and on top of that calumniation and denigration of Buddhist priests, Buddhism and Sinhalese society.

        I don’t think in the recent history, Sinhalese had to undergo so much pressure, fear, disgust and pain all at once. This is too much for people.

        The government should know that every volcano has a capacity and when it is exceeded it will erupt. This is natural law.

      I didn’t vote for you but I have more right to address this note to you than Chair/UNHRC.–

      There are so many lies in her statement. “Recent civil war” is a blatant lie. What happened in Syria in 2011 and what happened in Iraq in 2003 are examples for “civil war”. In Sri Lanka, it was a “War on Terror” and the Sri Lankan President used military force against terrorists same as USA did before him.–

      On the contrary to what PM says, Chair/UNHRC clearly says here: that “it would address the wounds caused by conflict in the country, including those caused by the recent civil war.” That means PM has lied to the nation when he said that ICPPED Bill is only for future disappearances.—

      Chair/UNHRC states “As your Excellency is well aware, enforced disappearances have taken place in the Northern/Eastern as well as the Southern parts (during two insurrections) of the country, and affected all communities in Sri Lanka.” I totally object to the mentioning “enforced disappearances in Southern parts” here as Sinhalese didn’t make such request. If the need arises, there is no need for a ICPPED Bill as there is local Batalanda Report.—

      Mr. President, if you have a wound what would you do? You will make sure it heals as fast as possible, right? If someone gives you a needle and tell you to prick your wound and keep it open stirring everyday for another 5 – 10 years, would you do that? UNHRC is pressing you to use the needle called ICPPED Bill “to prick and stir the wounds of war” and make “Sinhalese cry” paving the way for a future Sinhalese civil war.

      UNHRC says there is a long history of disappearances in Sri Lanka. Oh yeah, the war criminal – British Governor Robert Brownrigg annihilated Sinhalese razing entire villages in Wellassa. Babies were pulled from their mothers and dashed to the ground, women were raped, and let to die of starvation as there were no men to cultivate lands.—

      The second war criminal was Prabhakaran. The Saint Tiger was the world’s most cruelest murderer who raided villages and massacred Sinhalese in cold blood same as Brownrigg.—

      All those claimed to be disappeared are not actually disappeared. Other than dead terrorist cadre, 99% Tamils who are said to be disappeared live overseas in different names.—

      Mr. President, justice should be administered to both parties. There are many Sinhalese whose loved ones were disappeared during the war. Sinhalese were killed by individual suicide bombers, individual “LTTE Kurumbatti Pilots” and individual terrorists who hid bombs in railway stations, buses, buildings. Our soldiers were killed by individual terrorists too. How would you bring justice to them? ICPPED Bill is only for one side and it is not fair.—

      Mr. President, please reject the ICPPED Bill.

      Over 27,000 of our boys sacrificed their lives to end the war. A similar number ended up being disabled. Is it fair to punish those who are alive now? Who knows they might wish they were dead in the war than spending the rest of their lives in prison for protecting the country.—

      No soldier went to war as an individual and their acts during the war were either
      preemptive state-defence or preemptive self-defence. According to HR, in such an exercise, if the soldier died no problem, if the terrorist died, it is a war crime. What justice is there in this bloody claim of individual war crimes?

    It would be ideal if this call by Ms.Deepika Udagama is incorporated into the country’s constitution itself. For that to happen the citizens in the country should actively participate and come together and collectively pressure their parliamentary representatives. The print and electronic media should be used towards the realisation of that objective until the state is prepared to create the necessary institutional and constitutional structures for ensuring that all people irrespective of their race, religion, language, or region would be protected and safe from being disappeared.

    Sri Lankan Government is reluctant in implementing its own Resolution 30/1 in good faith and honestly and finding ways and means to delay, deviate and prolong the endless sufferings of the victims of war. As time goes on the frustration and anger of oppressed people will turn into uprising and end in separation /division of the country like Serbia, South Sudan,. The UN will be forced to hold referendum in the North and East for the people of the land to decide their future as in the UN Charter.     “Enforced disappearances” are not wanted in any country.
    Countries in which these occur are ‘uncivilised’ to say the least, and may even be labelled, as those practising ‘terrorism’.
    “His Excellency” whose name was mentioned as a strong contender for the Nobel Peace Prize, should not hesitate to enact legislation to ban these, and to investigate and punish the wrong doers.
    “Enforced segregation” of citizens without being charged for alleged offences, for long periods of time – some even in excess of 20 years – too, amounts to a “gross human rights crime” being perpetrated by all regimes, dating from the “war years” to the present day.
    Attempts are being made to have these cases taken up/transferred, not in courts where the trials can be conducted in Tamil which is understood by them, but by courts in the south where the prisoners, their lawyers, and relatives cannot attend and follow proceedings. Such transfers are illegal.
    If this is enforced, it would be a travesty of justice.
    These helpless protesting prisoners, are on hunger strike in prisons in the north.
    The condition of some of them is serious.
    It also appears that Tamils coerced by threats, by the armed forces to give false evidence in the southern courts, have been recruited and ‘held’ in readiness.
    His Excellency should instruct the Attorney General, that such transfers of cases are a violation of human rights of those to be charged.

    There are many Tamils in the North who involved in Murders. some Tamils ran away as soon as the war crimes investigations and arresting of escaped convicts were announced. Tamils first should give a list of those disappeared. Other than this is Wigneswaran’s ploy to fool Tamils to get votes.     The business of persons going missing, starting from kidnappings for murder or ransom is nothing new in Sri Lanka. It became very prominent during the 1988 JVP uprising where not only the insurgents but the agents of state or under the guise of exercising power caused persons to disappear. The result of this is a writ of Habeas Corpus is of no use as the person cannot be produced. The bill, in its present form looks controversial. But in my opinion let there be a simple amendment to the penal code be made, that is, if a court directs a person who in its judgement caused the disappearance of a human to produce the latter and the former does not produce the latter within the specified period then let it be presumed that the missing person was murdered by the person who caused the disappearance. The only relief given to next of kin of the disappeared was a special law to presume the death of such persons, instead of waiting for the usual seven years. It is important to give dignity to human life.

Right thinking folk will be able to discern this.There are ‘forces’ playing Politics on ALL issues in the hope of winning the hearts and minds of the majority and capturing power again. They are not ready to play by the Democratic norms where when a Government is formed, that government is given the opportunity to govern for the appointed period. Instead they are impatient to come to power again so their past misdeeds can be swept under the carpet and also to continue to loot the wealth of the country. They are hell bent to thwart all measures that the Government takes to bring about a semblance of decency in our practices, laws and regulations and to resuscitate the ailing Economy .So the bottom line is ‘Politics’ is in the way of ‘Good Governance’ and ‘Progress’.
