Ensure Enforced Disappearances Bill Enacted: Human Rights Commission Tells President

The Human Rights Commission of Sri Lanka (HRCSL) urged the President, in his capacity as Minister of National Integration and Reconciliation, to provide leadership to ensure that the International Convention for the Protection of All Persons from Enforced Disappearances Bill is enacted and Sri Lanka sets an example not only for the region but globally on how to humanely respond to the grievances and pain of those who have suffered due to serious human rights violations.

We publish below the letter in full:

His Excellency Maithripala Sirisena
President of the Democratic Socialist Republic of Sri Lanka Presidential Secretariat
Colombo 1.

Your Excellency,

The International Convention for the Protection of All Persons from Enforced Disappearances Bill

The Human Rights Commission is writing to place before your Excellency its observations on the International Convention for the Protection of All Persons from Enforced Disappearances Bill (hereinafter the Bill).

The Commission believes the Bill is a positive step towards addressing the long history of disappearances in Sri Lanka and stemming impunity for gross violations of human rights. The Commission is of the view that enforced disappearance of a person is one of the most serious of human rights violations bringing untold sorrow to loved ones. As your Excellency is well aware, enforced disappearances have taken place in the Northern and Eastern as well as the Southern parts (during two insurrections) of the country, and affected all communities in Sri Lanka. It cannot be denied that these disappearances have had a devastating impact on families, sometimes resulting in families being torn apart following the enforced disappearance of the sole breadwinner.

Enforced disappearances have created thousands of women headed households in Sri Lanka that have struggled to meet the basic needs of their children, including access to education. Further, the emotional impact of not only losing a loved one but also of languishing for many years, even decades, not knowing the fate of the disappeared person has had a devastating psychological impact on family members. We have also witnessed many parents falling ill or passing away due to their inability to withstand the continuing sorrow and pain.

Hence, enforced disappearances is not only a legal and human rights issue but also a social issue that has devastated the lives of thousands of Sri Lankans. More importantly, the Bill would send the message that citizens are protected from this most cruel and inhumane crime. Enacting the Bill would most certainly contribute immensely towards re-building ethnic relations damaged by the ethnic conflict and strengthen the journey towards reconciliation.

Addressing this issue and enabling families to learn the truth about their disappeared loved ones is an important, courageous step Sri Lanka will be taking to re-affirm values of humanity, empathy and respect for the rule of law as a country. It would address the wounds caused by conflict in the country, including those caused by the recent civil war.

It is in this context and spirit, the Commission urges your Excellency, particularly in your capacity as Minister of National Integration and Reconciliation, to provide leadership to ensure that the Bill is enacted and Sri Lanka sets an example not only for the region but globally on how to humanely respond to the grievances and pain of those who have suffered due to serious human rights violations.

The Commission’s observations on specific provisions of the Bill are attached.

Dr. Deepika Udagama

Chairperson

What are you asking woman? A massive public revolt against the government?

Yeah, the way things are unfolding, it is highly possible.

Government won’t be able to control the masses and even the security forces will defy government orders unless they want to be a part of genocide of Sinhalese.

      What are you blabbering about?

“A massive public revolt against the government?”

Is it Dayan’s fantasy the third “Nugegoda rising”? Please let us know the time and place of this massive revolt against government, I love to be there. Once again the minorities are going to be the target of your people’s revolt.

Dayan was so intoxicated with blind loyalty for the head crook, this is what he typed on 19 Feb 2015:

Throughout the meeting was the rising chant from the crowd, “Mahinda! Mahinda! Apata Oney Mahinda! (“We want Mahinda!”)”. So Wimal was probably right when he said to rapturous applause “Mahinda is not a name, Mahinda is a country!”

Your pimp thought Mahinda was the country. When did the country shrink and stoop to the crooks level?

The Mega family of plunders Mahinda & Bros. Co. plundered the country and the greed is urging him to come back to power by hook or by crook to plunder the left overs of Ranil/Srisena Govt. no one cares about the poor people who are forced to pay high taxes for these plunder’s commissions and omissions.. LORD BUDDHA/ LORD SHIVA/ALLAH THE GREAT/LORD JESUS save the country from these blood sucking leeches.

In 2019, everybody should get together to bring a new leader rejecting both Rajapaksa clan and Ranil + UNP. SLFP is already half settapochchi by Basil in favour of Ranil. So no point of talking about them.

Revolts erupt. They don’t give time frames. When it is leaderless, then it can be more harmful.

UNP government is putting too much pressure on Sinhalese, especially Buddhists. ICPPED Bill, OMP, Tax Laws, e-ID and High-tech Number Plates breaching Privacy of Citizens, Federal Constitution, Privatization of State Institutions, fear of loss of jobs, suppression of freedom of expression in the Parliament, highhandedness in passing Bills, bribery racket in the Parliament, corruption and fraud at the highest governmental level and on top of that calumniation and denigration of Buddhist priests, Buddhism and Sinhalese society.

I don’t think in the recent history, Sinhalese had to undergo so much pressure, fear, disgust and pain all at once. This is too much for people.

The government should know that every volcano has a capacity and when it is exceeded it will erupt. This is natural law.

“I don’t think in the recent history, Sinhalese had to undergo so much pressure, fear, disgust and pain all at once.”

I take it the period from 1983 to 2009 were golden age though LTTE was actively bombing left right and centre. It appears that you miss LTTE and VP’s fat bum.

What made you think I would leave Wimal? When did you last see pigs flying?

Wimal is the only politician who didn’t change his principles for exchange of power, positions, promises, rewards or other perks.

If not for Wimal’s patriotic movement, this country would have been divided between 2002-2004. Wimal reminds us our responsibility and obligation to protect our unitary state and preserve Buddhism which is an inescapable duty to the nation. I never withdraw my support to the only patriotic politician of all time who showed his undivided loyalty to the country beyond measure.

So is the ground reality with Champa or the like people. They would never sense the truths or facts, just hang supporting criminals.

I have a request to H.E. the President.

      Mr. President

I didn’t vote for you but I have more right to address this note to you than Chair/UNHRC.–

There are so many lies in her statement. “Recent civil war” is a blatant lie. What happened in Syria in 2011 and what happened in Iraq in 2003 are examples for “civil war”. In Sri Lanka, it was a “War on Terror” and the Sri Lankan President used military force against terrorists same as USA did before him.–

On the contrary to what PM says, Chair/UNHRC clearly says here: that “it would address the wounds caused by conflict in the country, including those caused by the recent civil war.” That means PM has lied to the nation when he said that ICPPED Bill is only for future disappearances.—

Chair/UNHRC states “As your Excellency is well aware, enforced disappearances have taken place in the Northern/Eastern as well as the Southern parts (during two insurrections) of the country, and affected all communities in Sri Lanka.” I totally object to the mentioning “enforced disappearances in Southern parts” here as Sinhalese didn’t make such request. If the need arises, there is no need for a ICPPED Bill as there is local Batalanda Report.—

Mr. President, if you have a wound what would you do? You will make sure it heals as fast as possible, right? If someone gives you a needle and tell you to prick your wound and keep it open stirring everyday for another 5 – 10 years, would you do that? UNHRC is pressing you to use the needle called ICPPED Bill “to prick and stir the wounds of war” and make “Sinhalese cry” paving the way for a future Sinhalese civil war.

UNHRC says there is a long history of disappearances in Sri Lanka. Oh yeah, the war criminal – British Governor Robert Brownrigg annihilated Sinhalese razing entire villages in Wellassa. Babies were pulled from their mothers and dashed to the ground, women were raped, and let to die of starvation as there were no men to cultivate lands.—

The second war criminal was Prabhakaran. The Saint Tiger was the world’s most cruelest murderer who raided villages and massacred Sinhalese in cold blood same as Brownrigg.—

All those claimed to be disappeared are not actually disappeared. Other than dead terrorist cadre, 99% Tamils who are said to be disappeared live overseas in different names.—

Mr. President, justice should be administered to both parties. There are many Sinhalese whose loved ones were disappeared during the war. Sinhalese were killed by individual suicide bombers, individual “LTTE Kurumbatti Pilots” and individual terrorists who hid bombs in railway stations, buses, buildings. Our soldiers were killed by individual terrorists too. How would you bring justice to them? ICPPED Bill is only for one side and it is not fair.—

Mr. President, please reject the ICPPED Bill.

Over 27,000 of our boys sacrificed their lives to end the war. A similar number ended up being disabled. Is it fair to punish those who are alive now? Who knows they might wish they were dead in the war than spending the rest of their lives in prison for protecting the country.—

No soldier went to war as an individual and their acts during the war were either
preemptive state-defence or preemptive self-defence. According to HR, in such an exercise, if the soldier died no problem, if the terrorist died, it is a war crime. What justice is there in this bloody claim of individual war crimes?

It would be ideal if this call by Ms.Deepika Udagama is incorporated into the country’s constitution itself. For that to happen the citizens in the country should actively participate and come together and collectively pressure their parliamentary representatives. The print and electronic media should be used towards the realisation of that objective until the state is prepared to create the necessary institutional and constitutional structures for ensuring that all people irrespective of their race, religion, language, or region would be protected and safe from being disappeared.

Sri Lankan Government is reluctant in implementing its own Resolution 30/1 in good faith and honestly and finding ways and means to delay, deviate and prolong the endless sufferings of the victims of war. As time goes on the frustration and anger of oppressed people will turn into uprising and end in separation /division of the country like Serbia, South Sudan,. The UN will be forced to hold referendum in the North and East for the people of the land to decide their future as in the UN Charter. The GENOCIDE OF TAMILS cannot be easily forgotten by the Tamils in Sri Lanka and Tamils living all over the world. I sense you are a terror supporting Tamil to believe Vedda’s “truths”! Did you as a “Sinhalaya” endorse killing of over 100,000 innocent SL civilians by the LTTE suicide murderers?
So, according to you smoke is what make you believe civilians were killed. Do you know any war that only killed terrorist sparing every civilian? Did Iraqi, Afghan and Siryan wars kill any civilians? I guess your answer is not! As a Sinhalya did you want the SL forces to stop the war and retreat to the barracks because the LTTE terrorists were holding civilians as human shields?
How many more innocent Sihalyas and Tamils will you think be dead by now if the SL gov. did not stop the terror war in 2009?
              Like to hear your input!

                3

Dont try to exaggerate it, even before the war came to end, CFA signed by RW led groups kept those killings so minimized. BUt just to hype up that Rajapakshes are the only ones to have the energies to eleminate terror should be a blant lie. Very same buggers in the aftermath of the war, to work on their agenda making their pocket thicker was what we were compelled to see or not ?
Just because I vehemently against Rajapkshe and their supporters you can call me a ANTI SINHALA.
I really dont commend the stupid rascals looking at the manner they ruined this country. It was not just Rajapakshe leberated the country from terrorists, but the collectivity.
But they are so cruel to fool the nation – making up of gulliable masses.
Those masses would do anything and everything if they are asked to do so. Most of them like over 90% are easy targets. They can easily be abused through media.
Media on the other hand painted the picture in favour of Rajapakshes.
All in all, even today, Dherana which came into being through black money of Rajapakshe cronies, continue their false but Raja-pro propaganda even today.
Not just LTTERs were murderers, but also JVPers looking at 89 insurgency are the same.
So, we cant point the finger only at LTTERs.
Going back the manner those SINAHLA Chegueras killed the innocient young men in 89 are no better.
Learn to differentiate it man, where there is discrimination, those minorities have no other means than stand that way. I am no pro WAR, but that is understandable.
I think we the sinahalyas should finally really that we are all these same, all srilankens to be treated equally. There are no majoratarian or minoratarian folks.
If not today, when would our people learn to tolerate.

What a statement! If that is what you promote you should also promote bearing the consequences. Please, don’t complain Tamils are not special people they are similar to Sinhalese. Look at the Blacks in the US. They were discriminated to the core. No right to educate, own land and even sit with the whites etc. etc. Did they resort to violence? How did they get most of their rights without terrorism? Even now they are still discriminated. Do they resort to violence? Minorities in SL face no where near that kind of discrimination. And you accept and promote their violence as legitimate???? people like you are the problem Tamils are eternally suffering!

“Enforced disappearances” are not wanted in any country.
Countries in which these occur are ‘uncivilised’ to say the least, and may even be labelled, as those practising ‘terrorism’.
“His Excellency” whose name was mentioned as a strong contender for the Nobel Peace Prize, should not hesitate to enact legislation to ban these, and to investigate and punish the wrong doers.
“Enforced segregation” of citizens without being charged for alleged offences, for long periods of time – some even in excess of 20 years – too, amounts to a “gross human rights crime” being perpetrated by all regimes, dating from the “war years” to the present day.
Attempts are being made to have these cases taken up/transferred, not in courts where the trials can be conducted in Tamil which is understood by them, but by courts in the south where the prisoners, their lawyers, and relatives cannot attend and follow proceedings. Such transfers are illegal.
If this is enforced, it would be a travesty of justice.
These helpless protesting prisoners, are on hunger strike in prisons in the north.
The condition of some of them is serious.
It also appears that Tamils coerced by threats, by the armed forces to give false evidence in the southern courts, have been recruited and ‘held’ in readiness.
His Excellency should instruct the Attorney General, that such transfers of cases are a violation of human rights of those to be charged.

Perhaps Dr. Deepika Udagama must add a postscript: The memory of the “disappeared” is very vivid and strong. This will not go away. The only way out is “Address the issue”. The Prageeth case was handled badly and damaged our reputation.

The President may be in support of Enacting the Enforced disappearance Bill , but the Destroyers of the country for their own Survival and greed will forever Oppose the Bill.

Does one need to put the country first or their own selfishness first ??? We have seen again and again since the the turn of the last century , the petty selfishness in the name of ONE religion and ONE language have Won over for the down fall of this Apeh Aanduwe!!
We jolly well know who leads the list of Destroyers of Srilanka??
I am asking these noble men to put the country first for the mere survival of all inhabitants namely Buddhists , Tamils, Moors, Burghers , and Malays instead of their own SELFISHNESS.
LORD BUDDHA WOULD HAVE NODDED IN APPRECIATION FOR ONCE !! SIRS!!!!!
LIVE AND LET LIVE THATS THE MANTRA OF LORD BUDDHA THE NOBLE MAN WHO WAS BORN A MAN NOT A GOD OF ANY RELIGIONS NOT EVEN FOR BUDDHISM.
HOLDING THIS HONOURABLE MAN’S PHYLOSOPHY FOR RANSOM IS PURE SELFISHNESS ..
We have seen more Poverty due to unemployment , A father unable provide for his children s food and education .
Famine and Malnourishment has become more common among the poor.
Clean water is not provided by the GOVERNMENT WHICH IS A BASIC REQUIREMENT OF ANY GOVERNMENT.
Look at the North and the East and the Central Provinces !! What kind of Industries had been created by this Good Governance , which came to power withe votes from those people .
These areas are affected very badly due to the STEP MOTHERLY TREATMENT.
These are the causes for Diversity and Resentment , which leads to Revolution.
We need to avoid these thoughts lurking among the Minority , then only one can expect a Future for this country.
Not avoiding by violence but by Kindness and Sharing ! By the Lord Buddhas way of Teachings and way of life.
NOT Self serving the wealth continuously to themselves is a terrible Sin.
    Karma is a BITCH.
EVEN CAN BITE THE NOBLE MEN .

There are many Tamils in the North who involved in Murders. some Tamils ran away as soon as the war crimes investigations and arresting of escaped convicts were announced. Tamils first should give a list of those disappeared. Other than this is Wigneswaran’s ploy to fool Tamils to get votes. Any forced disappearances should follow arresting those who finaced thos such as Tamils living in the west and who made plans to assassinate certain indivduals. wigneswaran is saying more things. CT is very biased, and has become a cheap blog.

        stupid vedda
Why don’t you terror supporting Tamils compile a list of Tamil LTTE terrorist first, so that we can find the authenticity of these disappearances. Every terror supporting tamil is talking about disappearances but no names of terrorists? Why???

“Please let me have the list containing their details. I will pass it on to the hanging Tamil judge M. Ilancheliyan , of Jaffna High Court”
Good, that is the reason I am asking for the list of LTTE terrorists!

The other day imbecile Namal and his mouth pieces were shouting India Out! China Out Out Out!!
When India and China is chased away ,no other nation will come to do business with Srilanka ! with Srilankan CROOKS.
SRILANKA is very well noted internationally that our Apeh Aanduwe is so crooked no one can do any business,
Srilankan Crooks of Sinhala majority , Tamils and Muslims are very well noted within the Business community internationally.
They come they then pull out, this had been the story for the last 2-3 decades.
It’s a Crooks Paradise along with the Rajaballa and his 5million thieves.
So chasing away India and China by the Frustrated Son MP of the past Thief President is a disgrace in the name of our country.
    Crooks breeds Crooks.
    Sans Intelligence.

The business of persons going missing, starting from kidnappings for murder or ransom is nothing new in Sri Lanka. It became very prominent during the 1988 JVP uprising where not only the insurgents but the agents of state or under the guise of exercising power caused persons to disappear. The result of this is a writ of Habeas Corpus is of no use as the person cannot be produced. The bill, in its present form looks controversial. But in my opinion let there be a simple amendment to the penal code be made, that is, if a court directs a person who in its judgement caused the disappearance of a human to produce the latter and the former does not produce the latter within the specified period then let it be presumed that the missing person was murdered by the person who caused the disappearance. The only relief given to next of kin of the disappeared was a special law to presume the death of such persons, instead of waiting for the usual seven years. It is important to give dignity to human life.

Instead of giving dignity to the human life cry infront of visitors and show Tamil women are idiots. That is a better way to show Tamils are eternal victims. Then they deserve Eelam.

“Ensure Enforced Disappearances Bill Enacted: Human Rights Commission Tells President”

He cannot enforce that bill. That is against his Nobel Peace Prize winning ideologies. That is out of question. Further, he too has election. He did not ask TNA to vote in 2015. TNA voted because Sampanthar wanted to please Chandrika and Sumanthiran wanted please Ranil. He has no obligation to anybody on that matter. But he can move to the next inch when his next War Crime accused diplomat come running home with one leg shoe.

The New Royals are just cut throat cheaters. This HRC-Lankawe is also Appe Aanduwa’s paid Coolies. They are not ready to ask the Royal King to arrest those were suspected of caused the disappearances and investigate them. The EDBE is a worthless bill, cannot help even one single family to get out the truth of what happened to their relatives. No criminal is going to self-incriminate. That is why these are hackling to have that bill installed. But we know what the Majesty did to Diskursi. .

Let’s face it, and let’s be honest. Right thinking folk will be able to discern this. There are ‘forces’ playing Politics on ALL issues in the hope of winning the hearts and minds of the majority and capturing power again. They are not ready to play by the Democratic norms where when a Government is formed, that government is given the opportunity to govern for the appointed period. Instead they are impatient to come to power again so their past misdeeds can be swept under the carpet and also to continue to loot the wealth of the country. They are hell bent to thwart all measures that the Government takes to bring about a semblance of decency in our practices, laws and regulations and to resuscitate the ailing Economy .So the bottom line is ‘Politics’ is in the way of ‘Good Governance’ and ‘Progress’.
