EU Linking Shariat Law To GSP+: Do Not Bring Europe’s War On Muslims To Sri Lanka

The government has appointed a committee to consider reforms to the Muslim Marriage and Divorce Act though there are many burning issues which needs immediate attention.

This new committee was appointed despite the fact that an earlier committee chaired by former Supreme Court Judge Saleem Marsoof has been involved in deliberating amendments for last 7 years. The delay being due to the controversial and sensitive nature of the issues involved and the need to consider very carefully any changes to shariat law which is divine law, and cannot be deviated at any costs.

According to cabinet co-spokesman Gayantha Karunathilaka “some provisions in the Muslim Law, including the minimum age of marriage, were not in conformity to the norms stipulated in international conventions, which Sri Lanka was holding membership, and thus it has become necessary to amend those provisions.

It is difficult to understand on what basis he compared divine Sharia laws to the norms of manmade international conventions enacted to suit western imperial powers’ agendas.

Justifying the move, Law and Order Minister Sagala Ratnayake who knows nothing about Sharia law, told media briefing that “the country had to obey the international conventions to get the GSP+. Amending of the Muslim Marriage and Divorce Act is also a part of international protocol, which is a requirement to obtain GSP +”.

Earlier Justice Minister Wijedasa Rajapaksa proposed to appoint a cabinet Sub-committee to make proposals regarding suitable amendments to the Muslim Marriage and Divorce Act.

This new committee was formed following Prime Minister Ranil Wickremasinghe’s recent visit to Belgium where he discussed the island’s efforts to regain the GSP+ facility with the European Parliament’s Foreign Affairs Committee. In response the European Union, EU, demanded Sri Lanka amends the Muslim Marriage and Divorce Act to grant GSP+.

Importance attached by EU to this demand is such that a four-member delegation from the European Parliament visited Sri Lanka and the Maldives from October 31 to November 3 to assess the ground situation as a precursor for a successful GSP Plus application

Now the question is what is the need for EU to demand changes in Islamic Sharia law? In fact GSP+ facility was cancelled due to the short sighted policies of Mahinda Rajapaksa racist regime which antagonized the EU without realizing the serious impact on the island’s economy.

GSP+ facility and Sharia law are two entirely different subjects.

For example the GSP, Generalized System of Preferences, is a preferential tariff system which provides for a formal system of exemption from the more general rules of the World Trade Organization- WTO. It’s a system of exemption from the most favored nation principle (MFN) that obliges WTO member countries to treat the imports of all other WTO member countries no worse than they treat the imports of their “most favored” trading partner. In essence, MFN requires WTO member countries to treat imports coming from all other WTO member countries equally, that is, by imposing equal tariffs on them, etc.

GSP exempts WTO member countries from MFN for the purpose of lowering tariffs for the least developed countries, without also lowering tariffs for rich countries.

On the other hand Muslim Marriage and Divorce law is based on the teachings of Holy Quran which is the divine law clearly specifying every aspect of marriage and divorce.

Muslim Marriage and Divorce law, revealed 1430 years ago, provides the right for a woman to choose her husband and to divorce in the event of incompatibility or other factors which prevent them from living in harmony together. Long before today’s man made laws even thought of women’s rights, Islam has given all rights including on how divorced woman should be treated.

Islam also has given women the right to property and evidence though being maligned, distorted and demonized today by United States, British, European, Russian and Israeli war mongers joined by anti-Muslim RSS racist regime in New Delhi.

Customs, traditions and culture of Muslims differ from country to country and society to society, yet Sharia laws were observed by all Muslims alike. Here in Sri Lankan child marriage is not a major issue as most Muslim girls marry in their late teens or early twenties.

Under such circumstance European Union demanding Sri Lanka to reform Muslim Marriage and Divorce Act to provide GSP + can only be described as ridiculous.

Sri Lanka’s foreign policy under this government has been blindly following US led western war mongers anti Muslim agendas dismissing the feelings of the island’s Muslims who played a crucial role in bringing this government to power.

Muslims suspect this as part of the overall global anti Muslim campaign unleashed by US led Europe which destroyed Muslim countries in the Middle East and turned them into killing fields and graveyards. They not only destroyed modern Muslim countries but also massacred millions of innocent Muslims who lived peacefully with all prosperity in their homes besides throwing millions of Muslims into refugee camps to suffer in abject poverty.

This is the very same Europe demanding Sri Lanka to change Sharia law to grant GSP+.

This is the reason why the government’s committee to temper with the Muslim marriage and divorce act is viewed with suspicion and likely to provoke Muslims. Already there were demonstrations near mosques in Colombo and other places after Friday noon prayers calling the government to dissolve this committee.

Is changing Muslim marriage and divorce act the top priority of the country which is passing through one of its worst political and economic crisis.

The government which came with the slogan of eliminating crime and corruption has become the defender of crime and corruption. People are angry and disillusioned. Under such circumstance need of the hour is to deal with burning issues and not to antagonize the Muslim community to please European war mongers.

Indian Prime Minister Narendra Modi, architect of Genocide of Muslims in Gujarat in February 2002, is also hell bent on changing Muslim personal law. Not because he likes Muslims but because he wanted to eliminate Islamic identity of the Indian Muslims.

BJP’s Cow Vigilante thugs subject Indian Muslims to medieval style persecutions. They rape and gang rape, kill and force feed Muslims with cocktails of cow dung and urine with police connivance.

Just five months after Burmese leader Nobel laureate Aung San Suu Kyi took over power Muslim villages in Northern Rakhine State were attacked on October 9 by government security forces. The U.N.’s special rapporteur on human rights in Burma, Yanghee Lee, said serious violations, including torture, summary executions, arbitrary arrests and destruction of mosques and homes, threaten the country’s fledgling democracy.

“The big picture is that the government does not seem to have any influence over the military,” said Chris Lewa, director of the Arakan Project, an advocacy group that focuses on the Rohingya.

On 20 October Aung san Suu Kyi visited New Delhi and signed several agreements with violent anti Muslim BJP government. Thus hostile forces are ganging up and violence against Muslims spreading towards South Asia.

Sri Lankan is not short of racist elements Myanmar’s Wirathu type racist elements. Under such environment, Sri Lankan government needs to reconsider tempering with Muslim Marriage and divorce Act as no one wants to bring EU’s war against Muslims to Sri Lanka.

    The relation between man and woman becomes lawful by contracting marriage. There are two kinds of marriages:

    In a permanent marriage, the period of matrimony is not fixed, and it isforever. The woman with whom such a marriage is concluded is called da’ima (i.e. a permanent wife).

    In a fixed time marriage (Mut’ah), the period of matrimony is fixed, for example, matrimonial relation is contracted with a woman for an hour, or a day, or a month, or a year, or more. However, the period fixed for the marriage should not exceed the span of normal lives of the spouses, because in that case, the marriage will be treated as a permanent one. This sort of fixed time marriage is called Mut’ah or Sigha.

    Issue 2377: * If a woman and a man themselves want to recite the formula of permanent marriage, the woman should first say: Zawwajtuka nafsi ‘alas sidaqil ma’lum (i.e. I have made myself your wife on the agreed mahr), and then the man should immediately respond thus: Qabiltut tazwij (i.e. I accept the marriage). In this way, the marriage contract will be in order. And if a woman and a man appoint other person to act as their representatives for pronouncing the formula of marriage, and if, for example, the name of the man is Ahmad and that of the woman is Fatimah, the representative of the woman should first say: Zawwajtuka muwakkilaka Ahmad muwakkilati Fatimah ‘alas sidaqil ma’lum (i.e. I have given to your client Ahmad in marriage my client Fatimah on the agreed mahr) and thereafter the representative of the man should immediately respond thus: Qabiltut tazwijali Muwakkili Ahmad ‘alas sidaqil ma’lum (that is, I accepted this matrimonial alliance for my client Ahmad on the agreed Mahr). Now the marriage contract is in order. And, on the basis of recommended precaution, it is necessary that the words uttered by the man should conform with those uttered by the woman; for example, if the woman says: Zawwajituka …… (i.e. I have made myself your wife) the man should also say: Qabituttazwija ……(i.e. I accept the matrimonial alliance) and not Qabitun Nikaha.

    Mut’ah (Temporary Marriage)

    Issue 2430: Contracting a temporary marriage with a woman is in order, even if it may not be for the sake of any sexual pleasure.

    Issue 2431: The obligatory precaution is that a husband should not avoid having sexual intercourse for more than four months with a wife of temporary marriage.

    Issue 2432: * If a woman with whom temporary marriage is contracted, makes a condition that her husband will not have sexual intercourse with her, the marriage as well as the condition imposed by her will be valid, and the husband can then derive only other pleasures from her. However, if she agrees to sexual intercourse later, her husband can have sexual intercourse with her, and this rule applies to permanent marriage as well.

    Issue 2433: A woman with whom temporary marriage is contracted, is not entitled to subsistence even if she becomes pregnant.

    Issue 2434: * A woman with whom temporary marriage is contracted, is not entitled to share the conjugal bed of her husband, and does not inherit from him, and the husband, too, does not inherit from her. However, if one or both lay down a condition regarding inheriting each other, such a stipulation is a matter of Ishkal as far as its validity is concerned, but even then, precaution should be exercised by putting it into effect.

    Issue 2435: If a woman with whom temporary marriage is contracted, did not know that she was not entitled to any subsistence and sharing her husband’s conjugal bed, still her marriage will be valid, and inspite of this lack of knowledge, she has no right to claim anything from her husband.

    Issue 2436: * If a wife of temporary marriage goes out of the house without the permission of her husband, and the right of the husband is in anyway violated, it is haraam for her to leave. And if the right of her husband remains protected, it is a recommended precaution that she should not leave the house without his permission.

    Issue 2437: * If a woman empowers a man that he may contract a temporary marriage with her for a fixed period, and against a specified amount of Mahr, and instead, that man contracts a permanent marriage with her, or contracts a temporary marriage with her without specifying the time or amount of Mahr, the marriage will be void. But if the woman consents to it on understanding the position, then the marriage will be valid.

    Issue 2438: In order to become Mahram (with whom marriage contract becomes haraam and is treated to be one of the close relatives), a father or a paternal grandfather can contract the marriage of his na-baligh son or daughter with another person for a short period, provided that it does not involve any scandal or moral lapse. However, if they marry a minor boy or a girl who is not in anyway able to derive any sexual pleasure during the period from the spouse, then the validity of such a marriage is a matter of Ishkal.

    Issue 2439: If the father or the paternal grandfather of an absent child, marry it to someone for the sake of becoming Mahram, not knowing whether the child is alive or dead, the purpose will be achieved only if during the period fixed for marriage, the child can become capable of consummating marriage. If it later transpires that it was not alive at the time the marriage was contracted, it will be considered void, and the people who had apparently become Mahram will all become Na-Mahram.

    Issue 2440: If a husband gifts the wife of Muta’h with the period of her temporary marriage, thus releasing her, and if he has had sexual intercourse with her, he should give her all the things he agreed to give her. And if he has not had sexual intercourse with her, it is obligatory on him to give her half the amount of Mahr, though the recommended precaution is that he should give her full amount of Mahr.

    Issue 2441: If a man contracted a temporary marriage with a woman, and the period of her Iddah has not ended yet, he is allowed to contract a permanent marriage with her or renew a contract for temporary marriage with her.
    Looking At Non-Mahram

    Issue 2442: * It is haraam for man to look at the body or hair of the Non-Mahram women, regardless of whether it is with the intention of pleasure or not, and whether there is a fear of falling into sinful act or not. It is also haraam to look at the faces and the arms, upto the wrists, of such women with the intention of pleasure, or if there is fear of falling into sinful act, and the recommended precaution is that one should not look at their faces or arms even without such an intention. Similarly, it is haraam for a woman to look at the body of Non-Mahram man, except places which are customarily not covered, like, his face, hands, head, neck and feet. She can look at these parts of a man without the intention of deriving any pleasure, or if there is no fear of being entrapped in any sinful act.

    Issue 2443: * To look at the body of a woman who would not care for Hijab, even if she were advised, is not haraam, provided that it does not lead to sinful act or sexual pleasure, and excitement, nor is it with that intention; and in this rule, there is no distinction between a Muslim and a non-Muslim woman; and also between those parts, like their faces, their hands which they normally do not cover, and other parts of their bodies.

    Issue 2444: * Woman should conceal her body and hair from a man who is non-Mahram, and as an obligatory precaution, she should conceal herself even from a Na-baligh boy who is able to discern between good and evil, and could probably be sexually excited. But she can leave her face and hands upto wrists uncovered in the presence of Na-Mahram, as long as it does not lead him to casting a sinful, evil glance or her to doing something forbidden; for in both these cases, she must cover them.

    Issue 2445: It is haraam to look at the private parts of a baligh Muslim, even if it is seen behind the glass or reflected in the mirror, or clean water etc. As an obligatory precaution, it is also haraam to look at the genitals of a non-Muslim, and of a discerning Na-baligh child. However, wife and her husband can look at the entire body of each other.

    Issue 2446: If a man and woman who are Mahram of each other, do not have the intention of sexual pleasure, they can see the entire body of each other excepting the private parts.

    2.Women to be treated as a Chattel, property of men.

    3. Allow legal rape of girls under MMDA.

    4. Women have no choice their husbands bringing 2, 3, or 4 wives?

    5. Allow a man to divorce his wife by sating Talaq, Talsq, Talaq 3 times.

    6. To inherit parental property unequally.

    7. Be subject to domestic abuse by husband.

    9. Prevented from going to the Mosque for socializing with other women.

    10. Do not have the freedom to cloth according the one’s own culture, but need to follow desert Arab culture.

    11.Cannot go out of the house without a male guardian, Mahharam.

    12. Cannot drive a car, or go on a bicycle, as in Saudi Arabia. Is Wahhabi Saudi Arabia following Sharia Law? Turkey? Bangla Desh.

    Today article by Latheef farook is completely different from what he talked about Sri lanka before this. He always talked how bad Sri lanka is to Muslims and how racist the Sinhala people towards muslims are.

    Today, he says, Sri lanka is good for muslims and is not like Burma. But, European Union is trying to make it bad for muslims in Sinhale.

    On the other hand, another article in CT itself says that Muslims are outnumbering Tamils in Sri lanka by the time of the next census.

    So, we can understand why muslims are always talking double talk and screaming about muslims resettlements in the North.

      Their birth rate is very high compared to Sinhalese and Tamils. Also they get married at a much younger age. On the pretext of settling these displaces Muslims a Muslim Shaitan from Mannar with the blessing of the Muslim community, settled thousands of out of area Muslims along the Wilpattu corridor,to created new Muslim majority enclacves along the strategic north west coast that were never there, using funds obtained from certain Gulf states. When many Tamil MPs questioned them,they were aggressively accused of being LTTE stooges. Now they are coming here and aggressively demanding the resettlement of the displaces northern Muslims, so that they can double or treble the Muslim population in the north. These Muslims should have been resettled in the first place by the Shaitan from Mannar instead of the thousands of out area Muslims.

        What Latheef Farook said is true and it is a divine law for Muslims and not for non-Muslims. One should study Islam to understand what is divine law. No Muslim will ever support another Muslim who thinks that he can kill others in the name of religion. It is all political game with the support of super-power nations.There are Buddhist terrorists, Hindu terrorists, Christian terrorist and Muslim terrorists in the world.

    I find it refreshing how the EU encourages Sri Lanka to get some things done when it comes to human rights. And Sharia law is one such thing that prevents human rights. The issue here is that most Sri Lankans just do not understand what it means “human rights” and believe it is something that you can appeal to when you are a member in the JO and almost caught by the anti-corruption committee to prevent yourself from being jailed. And if that doesn’t work, you suddenly go ill and have to be treated in the prison hospital. When bailed out, you suddenly have to be treated in Singapore – even when you are the minister of Health (that is a bit awkward don’t you think)

      Good keep the so called greatest religion from almighty god to your self and your family and to not try to come here and anywhere else and impose is it on others. Religion is something personal between you and your creator as to the path you take to the so called salvation. Not to impose it on others or humiliate and degrade women and people who do not share your so called greatest religion. Then it becomes tyranny.
      God is loving and forgiving and does not want people to whipped chopped stoned and killed for minor transgressions or women to be covered from head to foot suffocating and treated like chattels. If this is the so called greatest religion. There is nothing great about it and I do not want to have anything to do with it. In Tamil we commonly say Anbe Sivam meaning God is love. This is not love but something evil and revengeful. I do not think any loving god will ever want that Sharia ever to be imposed on any human or animal. There is nothing humane or merciful about it. It was written by humans during the middle ages for conditions and situations that affected the harsh deserts of Arabia. Not the modern days.
      Remember the verse in the bible as well is in the Quaran when people were stoning a woman accused of adultery to death, Lord Jesus Christ stopped the mob and stated only people who themselves are without any sin can caste a stone on this poor unfortunate woman and every one hung their heads and left in shame. All of us have sinned and none of us have any right to condemn another human or animal to any sort of brutal punishment. If these sorts of punishments are advocated in the name of a religion then there is nothing great about it

    Brother Latheef Farook’s main bone of contention is the reported insistence on the part of the EU that Sri Lanka should reform the existing Muslim Marriage and Divorce Laws (MMDL) as a pre-condition to the granting of GSP+ facilities. His expressed fear is that this may result in the opening of a new front in the War against Terrorism being conducted by the Western Countries.

    Instead of focusing on the pro’s and con’s of this important issue, the commentators have mistakenly chosen to direct their ire at the MMDL per se, which is rather unfortunate, because we have thereby lost the opportunity to debate the main issue raised by Brother Farook. Is the availability of GSP+ so critical to it’s future economic prospects that Sri Lanka is willing to sacrifice the legal rights of a minority group of it’s own citizens ? How far backwards is Sri Lanka prepared to bend over to adhere to the demands of foreign nations ?

    In my humble opinion, the mistake on the part of Brother Farook was his reference to ‘Shariah Laws’, which served to divert attention from his main grouse.

    Muslims believe ‘Shariah’ to be the divine laws revealed in the Quran and Sunnah (the words and deeds of the Holy Prophet (SAL)) and are therefore immutable.
    Fiqh on the other hand refers to the interpretation of Shariah by qualified Islamic Jurists and implemented by the rulings of such jurists (Fatwas). Fiqh deals with the observance of rituals, morals and social legislation in Islam and by definition is not immutable.

    The MMDL is based on Fiqh Laws. Any ‘amendments’ to the MMDL in it’s present form will therefore not require the breaching of Shariah Laws. It will only require the re-interpretation of Shariah Laws (amended fiqh laws) so that they are compatible with the changed socio-religious environment that encompasses the Sri Lankan Muslim Community in this day and age. It would be extremely difficult for a Muslim Community in one country to live their lives according to Fiqh Laws interpreted to meet the socio-religious needs of a Muslim Community in another country and at a different period of time.

    The reason why the task before the Muslim Community has become so onerous and almost impossible is because of the stubborn resistance and fear on the part of ‘qualified Islamic Jurists’ (aka Ulemas) in Sri Lanka to use the technique of Ijtihad (Independent Reasoning) in the re-interpretation of Shariah to formulate amended Fiqh Laws.

    The Islamic Shariah is the prescription for social justice, economic prosperity and a life of contentment. It touches the very foundation of Humanity’s ‘fitrah’ (The Natural / innate Disposition)

    The Islamic Shariah is to protect the five important indispensables in Islam (religion, life, intellect, offspring and property), Islamic law has provided a worldly punishment in addition to that in the hereafter. Islam has, in fact, adopted two courses for the preservation of these five indispensables. The first is through cultivating religious consciousness in the human soul and the awakening of human awareness through moral education. the second is by inflicting deterrent punishment, which is the basis of the Islamic criminal system. therefore “hudud,” retaliation (qisaas) and discretionary (tazir) punishments have been prescribed according to the type of the crime committed.

    Islamic law is very different from English common law or the European civil law traditions. Muslims are bound to the teachings of the prophet Muhammed (pbuh) whose translation of Allah’s will is found in the Noble Quran. Muslims are held accountable to the Shariah law, but non-Muslims are not bound by the same standard. Muslims and non-Muslims are both required to live by laws enacted by the various forms of government such as tax laws, traffic laws, white collar crimes of business, and theft. these and many other crimes similar to common law crimes are tried in the modern courts. The modern courts can also hear civil law, family law and all other cases. Islamic law does have separate courts for Muslims for “religious crimes” and contemporary non-religious courts for other criminal and civil matters.

    MMDA is nowhere telling it is a Sharia law. EU is not asking to remove Sharia law. This La Theef is crook, he is eying if the Lankawe Muslims women are going to be freed by the new Committee. That is unlikely based on the Lanakwe’s history. The sinister La theef is very reluctant to accept the Women status of in Sri lanka. He just dreaming import joly life the middle countries who are importing Lankawe women to slavery.

    Blaming it on EU’s call for human rights is 100% dupe. Even American Ambassador in Jaffna about a month ago said the women status has to improved.     Religion is for a particular group who wants to practice, it cannot be enforced on anybody even if their parent had and has been following a religion. If foolishly Latheef is trying to block the freedom of women to practice any religion, he is starting to implement USSR system in Lankawe too. So it abide to that group and Law is to be applicable to all. Law is for the country. A country is place for anybody associated with it, is to live in. MMDA is not a law act. It is only an opportunistic pact between Sinhala Leaders and Muslim leaders to curb Tamils. MMDA was introduced to split Tamil and Muslims and it is a very successful act in that. At the same time, it reduced the women to rice cooker status. I do not think any more the Sinhalese Mass will take it. So the Sinhala Politicians will have to answer to them.
