External Affairs Minister Ravi K’s “Internal Affair”

Any person holding a public office, if found to have abused it for improper purposes violating the law, particularly the bribery or corruption, the law demands such persons to be dismissed from the public office and people want such people be named and shame in public.

Before Ravi Karunanayake was appointed to the office of the Finance Minister, the PM, Ranil Wickremesinghe had the prior knowledge that Ravi K was an accused charged before the High Court (HC/4648/2009) of Colombo by Rajapaksa Administration in a serious foreign exchange fraud involving 3 million US Dollars. The man who sent that money, Raj Rajarathnam, is already serving 11-year jail term in the US.

The total breakdown of law in this country is such that regarding this factor Ravi K was made the Finance Minister by Yahapalana Administration, and he was subsequently discharged from the case, due to an error in the indictment as claimed by the defense lawyer which did not prejudice the rights of the accused Ravi K. However, in the judgment delivered on 18th May 2015 the legal right of the Attorney General has been expressly secured by the Court to charge Ravi K on an amended indictment. However, after he was discharged Ravi K went on the town, deceiving the people that he was exonerated from all charges, which is a diabolical lie.

Then it became the statutory duty of Attorney General, Yuwanjana Wijeyathilake to perform the office as required by law, which has not been done to date. Herein it is important to mention that another former Minister of the previous regime Basil Rajapaksa was charged with an amended indictment under similar circumstances.

The Attorney General Yuwanjana Wijeyathilake went on retirement without complying with the Court ruling. Therefore on 09th March 2017 he was charged with corruption and abuse of office to confer a favour to a senior Cabinet Member of a Yahapalana Administration and enabling it to rob the public finance as in the case of Bond Scam. And in the public interest now the incumbent Attorney General Jayantha Jayasuriya has also been served with a notice on 14th March 2017 to perform the public office he holds on trust, urging him to act as required by law against Ravi K. In these circumstances it is beyond belief as to how such a person has been given one of the most important Cabinet portfolios, the Foreign Minister.

This simply demonstrates the total breakdown of Rule of Law in this country, which is an insult to the intelligence of the people, inflicted by those who are appointed or elected to the public offices in the Legislature and in the Executive.

This piece of writing is an open appeal to all citizens with common sense (not to those who are blinded with green, blue or red glasses) to be proactive and to come forward, demanding the state (both the ruling party and the opposition) to respect and honour the Rule of Law. And this is what the battered people yearning for from the Judiciary that is required by law to protect, vindicate and enforce people’s sovereign rights against any person holding public office.

Lord Denning remonstrated that ‘Judges cannot afford to be timorous souls. They cannot remain impotent, incapable and sterile in the face of injustice’. And this why the Judiciary is pleaded by the people to become a symbol of hope for the electorate, enforcing people’s judicial power fearlessly against any person holding public office in the Legislature and the Executive, who abuses the office for improper purposes.

      President Maithripala Sirisena who has in the past ordered the Police to carry out impartial investigations on various crimes, in his capacity as the Head of State, has this time around passed the buck, evading responsibility and has instead blamed the police for allowing anti-Muslim.

        I dont think I can see the manner the current men in power have not done it yet as we expected them to. But in a country, like srilanka, with highest potential to clash between ethnicities easily, recalling the manner they kill in 83 riots and 89 insurgency, with people being like animals rather than educated people, nothing would be easy to get Rajaakshes punished easily. Majority would let their lovely ones to get raped, if it is the demand of Rajaakshe for one single reason, their mind sets have been manipulated by the biased media feed.

        and well realized where majority of them lie with their thoughts in terms of protecting buddhism, minority rights of srilanken society, which is they are more into tribes than to anyone else. Nor would they ever be ready to mind up that minorities should also have the rights to fight for their rights.

        For them, minorities are just foreigners joined to srilanka later. No matter even if their generations would hav ebeen living in the country like the very same manner Sinhalaese have been.
        Believe me, if Europeans would treat – migrated communities this way, how would you have been feeling ? I mean even after citizenship is offered ?

        Why is that it is no easy lanken average mind set to see it right yet – We are the majority, we are the ones to grab the bigger portion, we are the ones to respect buddhism (but which is not lord buddhas teachings, ananother philosophy going through Mahawansa). Is this not so uncivilized ?

        Even if people would still attack Germans in general as Racists, I would not do so today, since they the Germans (majority) tolerated Dr Merkel decision vicitimzed syrians to get in. Not a small sum, but upto 1 million (10 lacks), more than the population living in Colombo. Can you imagine ?
        If our people would have been a powerful nation, they would BEHAVE like australian or the like folks – not looking at the issue with more humanity.
        The manner, they even today, talk about Tamils are beyond all bearing. I hate to read even. Lately, I happened to argue with EDWIN RODRIGO, he added, various thoughts about tamils -as no other would do. May be CT have blocked him inbetween and that is why we dont read from him anymore. But how many of the kind of dimwits put the fire even today after 30 years of long war. ? can you imagine ? Forgive me, even if the topic is different, my flow did not allow me to stop.

    Until you had disclosed I thought this corrupt politician had been fully exonerated by the Courts! I think media too gave publicity to the judgement favouring Ravi K. Thank you for your good work.
    Let us raise this issue all the time until the Attorney General takes some tangible action.

    It was in the papers that PM Ranil had told Sajin Vas to first settle his court cases and seek nomination from his party. But he has given a promotion to Ravi K. How can you expect justice from a Prime Minister who went so many extra miles to protect a person like Arjun Mahendran!

    The PM is loyal to those who were always loyal to him. Ravi K was loyal to him when Punchi Premedasa launched his attacks. Rosie is shunted because of same. She sided with Punchi Premedasa. Thalatha K was also part of that crowd so she got a fairly useless ministry. RW is very vindictive and he hides it behind his autistic smile. Arjuna M is long time elite upper echelon Charlie Mahendran’s son. They were with RW and JR all the way. He is believed to have funneled some of these profits to the UNP for campaigns and other purposes. Eran W also used his NDB days to fund the UNP. Kolu M also does the same and also there are other “special personal relationship” issues with Kolu M and people like Sagala Ratnayake that CT will censor if we mention them explicitly.

    One said, “Conduct and behavior in public life are, like never before, under very close scrutiny”. It was essential that the three pillars of democracy — Legislature, Judiciary and Executive — “are strong in structure, pure in form and uncorrupted and unblemished in conduct”.
    The present President made it clear that “if we cannot make Sri Lanka corruption-free, then the vision of making the nation developed by 2020 would remain as a dream”.
    In this context, the members of the Judiciary “become inviolable role models, the perfect incorruptible ideals of a civilized society”. Every function and celebration they talk about these clad in white. Let us ask why the Prime Minister and President are so slow to act against ministers who abuse their authority. Let us push for a strong and empowered judiciary whose decisions cannot be influenced by perks.
    Expressing concern over the huge pendency of cases in courts, the President has to realize it is time that judiciary is really independent and efficient.

    Some time ago, there was a newspaper article which said that as soon as the 100 day govt came or yahapalana govt came, Ravi Karunanayake got that case passed through a judge who about to retire. So, some how Ravi Karunanayake was “acquitted” and soon after that Judge retired, I read.

    Even now we can here, politicians asking law enforcement to start prosecuting. So, it is obvious, LAw enforcement is nor proactive for enforcing the law.

    We have empowered the present govt. to cheat and rob the state. They believe that people can be deceived again and again. The people should be made aware of who the honest and intelligent politicians are and encourage them to be elected next time. The assurance should be that all corrupt should lose their civic status and the wealth so accumulated. They should be made to sweep the roads as social service for cheating and robbing the public.

    Being a witness first hand to the transfer of $ 3 mil where Nexia Corporate Co. were the Secretaries, was with approval of the then Governor of the Central Bank of which RK has a copy. This is why there was nothing illegal in the transfer of the funds, as it was declared according to financial regulations. It is for this reason that RK could not be held liable and punished. Imagine MR just letting RK go, if he had an ounce of evidence otherwise. As for the sender Raj Rajaratnam being lugged in jail long after has no bearing on this issue with RK.

      Thank you for throwing new light on the episode about the 3$ transaction between Raj Rajaratnam and RK, which helps explain what actually happened and how RK who was then in the Opposition at that period of time escaped prosecution by MR.
      That is how Lady luck works in unforeseen ways for some people..

    Most commenters here are venting their frustrations but what next? We must openly offer him moral support. Nagananda is a true true true Buddhist. He is interested in a just society which is what Buddha himself wants. We need a few more Naganandas.

      The educated crooks know how to manipulate & exploit the system while the dumb crooks still get away with it because the judiciary is corrupt. I don’t think the likes of Gota, Basil, the Rajapakse brats, Sajin Vass, etc, etc, will ever be brought to justice, let alone RK, Mahendran, Alyosius, etc.

    K.Pillai: You are absolutely correct and to the point. It is useless any further to waste time, money and energy to correct this present corrupted vagabonds who have captured power riding on the back of the innocent, ignorant voter who up to now concerned only of “Grabbing” something for daily existence. This must change. It is heartening to see people like Naganada doing something towards that. This is a HUGE task and it has to be done soon. How could we do that? That is the most crucial and the immediate task of a group organization that must be formed from the ROOT levels. The time has come once again to evolve a MOVEMENT like “Pancha Maha Balavegaya” of 1956. But, remember it has to be a NATIONAL MOVEMENT for a JUST SOCIETY (not that Dharmishta type) where a NATIONAL TEAM of Legislators have to be put into power at the next 2020 elections. Of course for that, there must be a Political Leadership that has to emerge from among honorable, educated and wise men and women of the entire country. That MOVEMENT has to stand only for NATIONAL EMPOWERMENT and not for any other “Sectarian” matters centered on ethnicity, religion, tribalism etc. The next two and a half years must be completely devoted in building that National Movement and stop trying to correct these vagabonds already in power. Mr. Nagananda: START that now and talk to like minded people and let a STRONG LEADER emerge to LEAD.

      Many in our island across the racial divide would support your position for a National Movement if it is formed for the purpose of establishment of a secular, liberal, democratic and just society in this island.
      For that to happen work has to begin with identifying the causes and reasons why the ‘Pancha Maha Balavegaya’ of 1956 which you refer to failed and the subsequent ‘Dharmista and the War for Peace’ movements also failed.

      That said, it must be remembered that every negotiation that takes place for the formation of such a movement would involve people who would want to reach a consensual agreement that would serve their substantive interests too.
      When will the process begin? There are people are ready to join the process.

    Today we Sri Lankans are in a woeful mire as the country is in the hands of bandits – who fatten themselves and their kin with the peoples` money and lead luxurious lives as we the common folk languish without the bare necesities of life. We are fortunate to have with us people like Nagananda if not for whom we would be in the dark about the serious misdemeanours of our rulers. On the other hand we are unfortunate that we do not have more such Naganandas in our country. It is time for all patriotic, rightminded citizens of this country to rise from their slumbers and join hands to oust these bandits out from their roosts. Otherwise the outlook for the common people of this country is bleak.

    Uthungan: Thank you. I had quite a lot of explanation to do (to my few associates) at the very mention of that “Pancha Maha Balavegaya”. Understandable., because I did not make myself clear on that borrowed slogan. My suggestion to form a “National Council” was based on to face the “National Crisis” on FIVE FRONTS viz. (1) Economy (2) Education (3) Health (4) Law and Order and (5) Justice. This country, has over the decades brought into ruins by all our politicians and that became very visible during the past ten to fifteen years. As at date, we are into a calamitous state where recovery is almost slipping away. That is the very reason I say, it is useless and futile to depend any more on this present aged (in every way) politicians and their leaders. Instead, immediately take steps to form a National Council to formulate policies and an action plan based on a common platform agreed upon pure “Commitments” and “National Consciousness” to handle the affairs of Governing in FIVE FRONTS, I have enumerated above.
