Faizer Sends Father Faiz To Meet CJ And Offer Support

Faizer Mustapha, Deputy Minister, who is in the forefront of the impeachment process has got his father, Faiz Mustapha, senior President’s Counsel to meet the Chief Justice Shirani Bandaranayake and offer her “all support” Hultsdorf sources told Colombo Telegraph.

According to our sources, Faiz Mustapha has met the Chief Justice at 11.00 am on Thursday, 22 November in her chambers and offered to support any application that is filed against the impeachment. It may be recalled that when Chief Justice Sarath Silva was impeached, Faiz Mustapha appeared for 3 lawyers of the People’s Alliance and obtained a stay order against Speaker Anura Bandaranaike.  Hultsdorf sources said that Deputy MInsiter Faizer Mustapha is worried about the information that has leaked that he and Deputy Speaker Chandima Weerakkody are the main people doing the dirty work related to the impeachment. They are supported by Kalinga Indratissa and Priyantha Jayawardena, who along with Faizer Mustapha were appointed President’s Counsel recently.

Faiszer Mustapha first entered Parliament through the Ceylon Workers Congress led by Arumugam Thondaman but crossed over to the UNP later. At the 2005 Presidential elections, Faizer Mustapha supported Ranil Wickramasinghe but crossed over to the UPFA “strengthen the hands of the President.” He is widely expected to return to the UNP if it is clear that the Mahinda Rajapaksa regime is in danger falling. Lawyers say that Faizer Mustapha is a good political weather-cock and that the fact that he sent his father Faiz Mustapha to meet the Chief Justice shows where the wind is blowing.

The Colombo Telegraph has been unable to reach Faiz Mustapha or Faizer Mustapha for comment.

    Mudiyansalage – Other readers, who I expect on personal knowledge, also have commented here on Faizer’s knowledge of the law. So how can he “settle” a knotty legal issue for Arumugam T. I doubt the man was a VP in the CWC. He had to be inducted into the ExCo to be given a ticket, though. By the way, in addition to SB, Aru also enjoyed the friendship of Mangala S at that time. The latter knew many successful
    PC’s personally during that time he enjoyed much influence with CBK.

      Congress chief and Arumugam Thondaman, recently set up a Muslim unit with the party’s Vice President Faizer Mustapha, as its leader. Mustapha, a lawyer by profession successfully contested the Kandy district on the UNP ticket at the last parliamentary elections in April.

    What a shame on these prominent lawyers turned politicians, they have forgotten that they are going to leave this world one day and the torture of the grave “Azaabil Qabr” for the wrong doings in this world. May Allah protect this Muslim Umma from these traitors

    Dear all,
    I have gone thru your comments . I wish to make one or two points.
    1) Faiz is a gentleman like his father. He is a man of integrity. He was a Director of an Insurance Co run by some Muslims. He was unable to stomach the rather dubious financial transactions recorded in the books and , like a gentleman, he resigned from the Board.
    2) Faizer is a different story altogether.I believe he is a fool and at Royal he was treated as a fool. If he is a PC perhaps the entire bar should be awarded PC status.
    3) I agree that many political stooges and side kicks have been elevated to PC status. Can you compare these guys with people like Colvin,Thiagalingam, Nadsean, HV Perera , Ashy Mansoor, Suntheralingam, Nagalingam, etc,? Its chalk and Cheese !!

    2) Faizer is a different story altogether.I believe he is a very ordinary lawyer At Royal he was mediocre . If he is a PC perhaps the entire bar should be awarded PC status.

    APPOINTMENT OF PRESIDENTS COUNSEL is unconstitutional for the following reasons. THERE ARE 14000 odd lawyers as against a few hundred thousand other distinguished professionals. Over the last 10 years I have highlighted this anomaly in the press. BUT NOT A SINGLE DISSENTING OPINION WAS FORTHCOMING!!!

    President appoints them under CHAPTER VII 33.(cc)

    This is in conflict with CHAPTER III 12.(2)
    and
    CHAPTER VI 27.(6)

    All the above clauses are quoted below:
    CHAPTER III – FUNDAMENTAL RIGHTS

    Right to equality.
    12. (1) All persons are equal before the law and are entitled to the equal protection of the law.
    (2) No citizen shall be discriminated against on the grounds of race, religion, language, caste, sex, political opinion, place of birth or any such grounds:
    CHAPTER VI – DIRECTIVE PRINCIPLES OF STATE POLICY AND FUNDAMENTAL DUTIES
    Directive Principles of State Policy.

    27.
    (6) The State shall ensure equality of opportunity to citizens, so that no citizen shall suffer any disability on the ground of race, religion, language, caste, sex, political opinion or occupation.

    1978 CONSTITUTION did away with this unfair practise. But somehow lawyers manoeuvred to bring the 8th AMENDMENT to restore this practise thereby causing a disability and discrimination to other OCCUPATION.

    Adding to Mr JK Wijedasa’s comments, it is clear the “selection” of President’s Counsel is utterly replusive since the mid-1970s when politics entered the fray. It is time the more responsible organised sections of the legal fraternity get together and put a stop to this annual output mostly of misfits. This will go a long way in regaining public confidence and, more so, bringing back dignity to an important and otherwise respected profession of the law and order machinery.

    I would have suggested BASL. But of late the spectre of majoritarianism – the main cause of ruin and decline of our once-high standards- has put paid to quality and has succeeded in replacing mediocrity in its place. It is a matter of regret Hultsdorp portals that vibrated to the jurisprudence brilliance of the universally acknowledged legal giants like QCs HV Perera, EFN Gratien, GG Ponnambalam, C.Thiagalingam, S. Nadesan, the Wickramanayake Brothers, S. Navaratnarajah, A. W. Ameer et al has given way to pygmies unable to write 3 lines in good English and reduced to breaking coconuts to relying on occultism and the trickery of kattadiyas. We do still have able Barristers like N.Choksy, Romesh de Silva, Faiz Mustapha, K. Kanag-Iswaran, Shibly Aziz and others in practise today – all of whom appear to prefer to concentrate on their lucrative pracises rather than get involved in the tug-of-war of Buddhist Sinhala political in-fighting for positions at the Bar)

    Elsewhere Prof Parakrama wrote when he went through the list of many names who had signed a recent public petition going as Professors working in various Universities, most of them were found to be bogus. The Doctorates and Professorships are, he maintains, from nondescript educational institutions. I hope the medical doctors who work in our hospitals have a better story to tell although some from suspect Russian universities also float around.

    Mudiyansilage – In as much as the Leader was wrong on Faizer joining SLMC are the others you mentioned. You cannot start a Muslim Unit in the CWC with just one man, can you?

    I am at a loss to understand why there has been NO COMMENT by LAWYERS about the UNCONSTITUTIONALITY OF APPOINTMENT PROCESS OF PRESIDENTS COUNSEL…I believe that I am ABSOLUTELY RIGHT….I dare the lawyers to defend this unfair privelige/practice.
