Foreign Ministry Fumbles Playing Cheap Media Games With Damning And Confidential UN Report

In an unprecedented move, the Ministry of Foreign Affairs has openly leaked a version of a scathing report by the UN High Commissioner for Human Rights sent confidentially to the Government of Sri Lanka for comments ahead of its release just before the 46th Session of the Human Rights Council Session in Geneva, Switzerland.

Michelle Bachelet, the HCHR transferred her ‘draft’ report on the human rights situation in Sri Lanka to the government on 12 January 2021 for comments on any errors in fact or law.

The High Commissioner is mandated by a Human Rights Council Resolution in 2017 to report on the progress made by Sri Lanka on post war reconciliation efforts. Customarily, the High Commissioner schedules the release of country reports just ahead of the UNHRC Session. It is usual diplomatic practice and courtesy to send such draft reports to the country concerned to provide an opportunity for the concerned state to address and point out errors in facts or law. Never before has the confidential copy released to the Government of Sri Lanka been leaked to the media by a ruling administration. It was unheard of even during the tenure of President Mahinda Rajapaksa who had his own battles with the UNHRC and the High Commissioners for Human Rights, diplomatic sources who were part of the process during that time told Colombo Telegraph. The move could seriously jeopardise an already highly tenuous relationship between the Sri Lankan Government and the United Nations, the diplomats warned.

The contents and recommendations of the confidential version of the report appeared in a Sunday newspaper printed in Colombo on the 24th of January. Foreign Ministry sources confirmed that the Secretary to the Ministry Admiral Jayanath Colambage had decided to use the advance copy of the High Commissioner’s report to score points in the local press before Sri Lanka faces its challenges in Geneva in February-March. Colambage, a former commander of the Sri Lanka Navy has no previous experience with diplomacy and international relations but was appointed to lead the Ministry of Foreign Affairs after parliamentary elections in August 2020. “The objective is to try and minimize the political fallout of the damning report when its officially published later this month,” Ministry sources said. The decision to leak the report has dismayed professionals in the Ministry who realize the implications of the move.

The previous Yahapalana government cooperated with the UN human rights system and prevented an international investigation into the Sri Lankan military. By cooperating and co-sponsoring a resolution at the UNHRC in 2015 the then government was able to reverse the international processes that were already under way. In 2014 the Human Rights Council had for the first time mandated the High Commissioner to carry out an investigation into human rights and humanitarian law violations in Sri Lanka. The resulting report which was presented in October 2015 recommended stringent action against perpetrators.

But when the Sri Lankan Government decided to cooperate with the UN and set some processes in motion to bring perpetrators to justice and closure to the victims through a complicated transitional justice mechanism that adhered to international standards, the UN agreed to allow Sri Lanka to lead this process. The actions of the Gotabaya Rajapaksa Government which has pulled out of its justice and reconciliation commitments in the HRC 30/1 resolution, coupled with the regime’s gross disregard for human rights and deliberate abolition of democratic and human rights processes and instruments in the state sector has virtually turned the clock back to 2014 in Geneva, diplomats and rights advocates explained.

“President Gotabaya Rajapaksas decision to withdraw from the co-sponsorship of HRC 30/1 was nothing but a political gimmick – but he was playing with fire because there is a way the international system works and how it kicks into gear when states get reckless about its commitments and couple that with more human rights violations and crackdowns on freedom” the international diplomats said.

“In fact Gota’s decision to withdraw from co-sponsorship made zero impact on the High Commissioner’s report due in February 2021 and when the resolution on Sri Lanka happens at this session, on the contents of that resolution” they added.

According to the leaked information by the Foreign Ministry, High Commissioner Bachelet’s report on Sri Lanka is scathing. It highlights the serious deterioration of the human rights situation in Sri Lanka since Nandasena Gotabaya Rajapaksa assumed office in November 2019.

The High Commissioner for Human Rights warns the international community of an impending human rights disaster in Sri Lanka unless corrective measures are taken. Intimidation, arbitrary arrests, discrimination against minorities, the erosion of independence of the judiciary and the independent commissions through the 20th amendment are some of the points made in the report. More significantly the High Commissioner notes that there is simply no political will in the current administration to address the serious allegations of human rights and violations of humanitarian law during the ethnic conflict.

Therefore Bachelet is now formally recommending international action. For the first time in Sri Lanka’s history of engagement with the UN Human Rights Council and the Office of the High Commissioner for Human Rights, High Commissioner Blanchet is recommending Sri Lanka’s referral to the International Criminal Court in The Hague, the permanent tribunal tasked with dealing with grave international crimes such as war crimes and crimes against humanity.

The report also calls on countries to take targeted actions against individuals involved in serious human rights violations. These targeted sanctions can be in the form of travel bans, as already imposed on General Shavindra Silva or asset freezes.

In response to the incoming international storm, which could spell doom for members of the administration who have been identified as war criminals and human rights violators, Secretary Colambage has assembled his own “Core Group” of local experts.

Initially Colambage decided that Sri Lanka would not respond to High Commissioner Blanchet’s report, not realising its damning nature and the gravity of her recommendations. It was Foreign Minister Dinesh Gunewardane who intervened to instruct MFA officials to draft a reply. Despite Colambage’s attempts to put a positive spin on the issues facing Sri Lanka in Geneva next month through friendly journalists, it is reliably learnt that there was hardly any preparation for any response.

Foreign Ministry officials scrambled to draft a response together with Minister Dinesh Gunawardena’s ‘core group’ consisting of Mohan Pieris, disgraced former Chief Justice and current Permanent Representative to the UN in New York, the daughter of a former Chief Justice and personal lawyer to President Nadasena Rajapaksa who currently works at the Attorney Generals Department and Chamindry Saparamadu a lawyer known to Foreign Minister Dinesh Gunawardena. Colambage has sidelined several senior officials with intimate knowledge and experience on the workings of the Human Rights Council in Geneva, Colombo Telegraph learns. A former deputy Permanent Representaitve to UN in Geneva with vast experience in handling the Human Rights Council was recently forced into early retirement after Colambage refused to grant her no pay leave.

Instead of experienced hands the ‘core group’ dealing with this vital issue are augmented by a few mid level officials from the Ministry of Defence, Kotelawala Defence University, the Attorney General’s Department and the Foreign Ministry. It is expected that the response will highlight many of the atrocities of the LTTE instead of answering the allegations against the Sri Lankan officials. Particular concern will be shown to cases which have a direct involvement with President Nandasena Rajapaksa such as the Lasantha Wickremetunge murder case and the abduction and murder of 11 Tamil men by the Sri Lanka Navy. The alarming militarisation of all spheres of administration is another element to be addressed in the response.

Colombo Telegraph has also confirmed that a key ‘advisor’ in this process is a former secretary to the Foreign Ministry who was also a Governor of a Province under the Yahapalana government and currently a member of the progressive group of academics and public servants the Friday Forum.

A very senior official with knowledge of Human Rights Council workings told the Colombo Telegraph that Admiral Colombage through his amateur approach to the UNHRC is going to jeopardise Sri Lanka, its military and political leaders. “Through such juvenile gimmicks like leaking a sensitive and confidential report just to get ahead in the media narrative, Colombage has destroyed any good will of the office of the High Commissioner. This time the Kegalle Vidayalaya alumni has bitten off more than he can chew,” said the disgruntled senior diplomat. (By Janakie Mediwake)

        The principle should be is either you do a perfect job or do not even attempt it if you cannot do it right. If UN cannot cut the mustard it should admit it and get out of the way instead of making a bad situation worse. When they post individuals costing UN an arm and a leg, it becomes a double whammy for the unassuming man in the street for naively believing that they are there to protect his rights to discover it is only a mirage. It is a very time consuming and a costly exercise especially for a poor man to seek justice from so called courts of law. When the guardians of the law treat him like a floating carcass down the river by the vultures the cruelty and wickedness thus inflicted is stratospheric.

      The Government should insist to conduct an investigation to war crimes and human rights violations committed by LTTE Tamil terrorists over a period of three decades. There are solid evidences to prove these crimes e.g. recruiting child soldiers and shooting civilians by LTTE who tried to escape from the human shield formed by terrorists. LTTE cadres who committed war crimes and human rights violations are hiding in foreign countries under new identities. They too should be brought to justice.

      UN may be able to secure justice to one side by punishing those accused by the Tamil side. She calls them ‘credibly’ accused. She wants to punish them BEFORE any investigation.
      Do you honestly believe they will investigate Tamil crimes in equal vigour and deliver justice to the Sinhala side? That is not easy because Sinhala side is confined within the island while the arms suppliers to the Tamil side is outside the country and the failure in being fair to both sides will ignite further hatred.

      I wouldn’t put too much stock on letters like this. There will be a lot of behind the scenes maneuvering by China and India, and in the end, hope will be dashed again. We have to wait and see if there is any bite with the bark in the end.

I brought to her attention the criminal abuse of power by Mr. Mohan Peiris as the Chief Justice upon his acceptance as Srilankan Ambassador of UN compromising the credibility and the integrity of fellow members which must be fiercely guarded. He urged the President Elect to let him retain his defacto position as the Chief Justice assuring the former that he is fully capable to turn justice on its head if that is required of him to keep the President happy.

    The ethnic and power sharing or devolution of power is a national problem from the beginning of Sinhala rule or end of British rule. Still this problem continues and the islands peace, economy and rule law continue to deteriorate and its now become a playground for national political and religious opportunistic leadership and international powers. The continuation of this is a need for these players and they will not allow the island to prosper with peace and growth. Since 2005, who are the real beneficiaries of this problem are politicians and Monks and international powers but the real losers are the people and religion and country.
    Rajapakse family pretend that they are cheating international players. International players pretend they are cheating Rajapakse family. In real both are playing game with lives of Srilankans.
    It is a well known fact a thousands of Tamil civilians, LTTE fighters, Sinhala military fighters have lost their lives in this war under the direction and order of Military commanders, defence secretary, and former President. Further a thousands of people and fighters became disabled and lost their breadwinners. At the end M.Rajapakse and Sarath Fonseka fought for power and promised to bring peace but nothing changed. Recently, Gotabaya Rajapakse publicly accepted that he who ordered to kill civilians during this war.

    Doesn’t matter what this report contains for or against anyone in SL if any idiot for one iota of a second thinks this was done in the interest of SL and her subjects should go get themselves some serious mental health help.

    Now we have a new type of “beggars in SL” facilitated by UN under various NGO grants/development work grants for various activities in SL…..and there are very many local and foreign Mafias making money out of this for some time…this is going to be the hardest one to tap into and control for any states let alone by SL?

      Just because someone object to the UN report/purpose does not mean their allegiance to any party politics or to anyone in particular individual (those who have mastered this way of playing the game are the ones who have landed us all in a S*** to date)…..one has a right to evaluate the UN involvement and its effect in his/her land without being accused of party politics but bigger picture for the Nation to focus on issues that really matters following the a critical path to liberation of all in our Nation.

      If this report does not include anything from 1970 the FP crimes in Jaffna then we will be rewriting history regard to law and oder and all the norms known to humanity. Some of it already done.

    Sri Lanka is known for, and has a long history of, blaming all others for the accusations of human rights abuses leveled against us by world agencies and human rights organizations. The Rajapaksa’s have accused Western nations and these World Organizations of “interference’ trying to bring down the Rajapaksa’s, or picking on poor little Sri Lanka.
    Rajapakse supporters always justify the refusal to cooperate with the investigations, as all the agencies, and organizations, out to get them. They will find some minute connection between UN officials leading the investigations, to some Tamil organization, or Western government, to magnify just how biased these UN officials are, and demonize that particular official here in Sri Lanka, poisoning naive minds, and justifying their open defiance and refusal to cooperate. They will point to other nations and ask why they have not been investigated. They will do and say anything to protect themselves from investigations, and requests of accountability, for human rights violations, and war crimes, which they insist never happened. So why are they not opening that door and inviting all investigations, that will surely exonerate them?

    Don’t we need to show good faith, when we reach out for that badly needed aid from the very same nations that we accuse of interfering and plotting to bring us down?

    I feel sorry for the “Low Levels” that our Minister of Foreign Affairs, Mr. Dinesh Gunawardena has fallen to. Once a respected “SON” of “Boralugoda Singhaya”, who could very rightly speak of an “Illustrious Career” in Parliament has by his own “Karma” has been reduced to a position of a “Coolie” of the “Rajapakse Clan”. Who does he “Agree” on the appointment of a “Commission” to look into the “Findings” of two other Commissions and Mechanisms that had already submitted reports on the question before the UNHRC? Doesn’t he realize the “Absedity” of such a move being made just at the time that the “Report” of the UNHRC Commission is “Confidentially” handed into the Government for “Observations”? To my understanding, this Minister is at the “Beck and Call” of his Secretary the Rt. Major General who has been planted by the President.

    Wasn’t there a write up in CT about diplomats of other nations bowing down to GR with his ‘musclemen’ after the Swiss embassy fiasco & the UN Resident Coordinator congratulating disgraced CJ, Mohan Peris, as well as, the British High Commissioner ‘cosying up’ with her cricketing buddy, our own High Commissioner to UK, indicating everything is hunky dory in SL? I suppose in SL, personal friendships can go a long way but will it be the same when it comes to professionalism in an international arena? Shavendra Silva was promoted as the UN Representative by MR, despite his abuse of human rights allegations, & now, another publicly disgraced bum sucker is appointed to the same job, effectively showing 2 fingers to the UN once again but we are a nation of proud citizens, so who cares about sanctions, foreign aid or direct investment when we have the Chinese to give us loans at commercial rates?

    Foreign countries are aware of Gota’s appointment. Canada is delaying in accepting the appointment of a Sri Lankan Ambassador, former Air Chief Marshal Suzanne. Sri Lankan Ministry of Foreign Affairs has ignored Canada’s support for the resolution against Sri Lanka and Canada’s call for security reforms in Sri Lanka. Let us wait & watch the development hereafter.

    Why should the report which is based on losers’ lies be a secret? Yahapalana regime cosponsored resolutions against Sri Lanka with UN secretly, knowing very well that Sri Lankans are against it. A treason!

    UN is bluffing. Now it has been 11 years and they can do nothing against Sri Lanka.

    Colonialist Britain, colonialist Netherlands and LTTE terrorist organisation’s creator India are strictly responsible for Sri Lanka’s endless Muslim and Tamil problems.

    UNISEF is guilty of not stopping LTTE terrorist organisation recruiting child soldiers.

    The actions of the present government is based on short term political gains rather than what’s overall good for the country. Since January 2020 to January 2021 the Rupee has depreciated almost 20% +-. The Government kitty is empty, Govt bonds down graded, Govt banks down graded, the big brother China only promises loans but the money is not coming through, with the cancellation of the rapid train Japan has withdrawn from giving funds to SL, UNHCR is getting ready with a noose, all these changes have happened since January 2020. What does this show, it clearly shows that the present Govt has FAILED.

    Its not only the foreign ministry that has failed, its the entire government. I still do not believe that Gotabaya has given up his US Citizenship. If he has given up he can always get it back as his wife and son are US Citizens. Basil has not given up his US Citizenship, the constitution was changed to help him to get into the Parliament through a “Pinata Seat”. Over all Nandasena/Gotabaya or Basil will not stay one night in Sri Lanka if the Government falls. Unfortunately 99.9% of Sri Lankans who voted for the present Govt do not have the similar opportunity.

    The Foreign Service chappies are whispering that if that debonair lad Ravinatha Ariyasinhe was Foreign Secretary, this would never had happened. RA is far more sophisticated than that blunt navy chappie blessed with the brains of a gnat, name of Jayanath Colombage. The same circles are regaling themselves with the news that Ravinatha is rolling on the floor laughing….. some much deserved respite after the terrible episode with that comely lass Saroja!

    Mahinda Rajapaksa claimed his soldiers were fighting the war against the LTTE with a gun in one hand and the Charter of Human Rights on the other hand. This is a tall claim since evidence in the form of video clips and photographs showing the bullet-driven bodies of those who surrendered to the army carrying white flags on May 18, 2009.
    They were advised by Mahinda Rajapaksa and Basil Rajapaksa to hold their white flags high so that the soldiers can see them at a distance.
    Another batch of LTTE cadres who surrendered to the army on the same day were transported away in CTB buses for a “short inquiry.” There are hundreds of eyewitnesses, including the spouses, fathers and mothers, who saw them bused away.

    A photograph appeared in the media showing Balakumar and his son seated in a bench which appeared like an army camp. A soldier is seen walking behind them.

    None of them, more than 100, ever saw them alive after that day. So, the BIG question is what happened to them? Did they all vanish into thin air? Did they commit mass suicide?
    Mahinda Rajapaksa and his coterie continue to deny any knowledge of their whereabouts. Rumour has it that some of them were placed inside cement grinders and crushed!
