Full Statement: UNP’s Stance On Sri Lanka Investigation; Govt. Must Cooperate With UNHRC

The Rajapaksa regime is once again playing politics with the national question and toying with the grave threat that it is posing in the international arena. After the recent announcement by the United Nations High Commissioner for Human Rights of the establishment of her team to investigate the atrocities committed by both parties to the Sri Lankan conflict, the government, in a blatant attempt to politicize the issue, has placed before parliament the question of whether the Government should allow the team to visit Sri Lanka or not.

Ranil Sajith KaruThe burning question before us today is not the issuance of visas to a few foreigners. Whether they visit Sri Lanka or not, is not going to have any effect on whether the investigation would be held or not; this investigation will go ahead. What we should do and what the United National Party (UNP) has been stressing for many years is the necessity to prevent such international scrutiny into our affairs. It is beyond dispute that we are in this precarious plight today because of the egregious errors committed by and the lackadaisical inaction displayed by the ruling family cabal.

The international community, after offering the Sri Lankan government numerous opportunities to carry out a credible internal investigation into the alleged human rights violations, especially in relation to the final phase of the war, has determined that the Rajapaksa regime is neither willing nor capable of such action. It needs to be recalled that it was President Rajapaksa who himself pledged to the UN Secretary General Ban Ki-moon in May 2009 that he would undertake an internal investigation to look into the alleged incidents in the last phase of the war. President Rajapaksa also promised that he would implement the 13th Amendment to the full. This pledge has been repeated for the consumption of the international community. After being duped for years, the international wheels of justice have now begun to turn.

The fundamental tenet of international jurisdiction is that the local justice system has failed to deliver a credible remedy to victims. What the Rajapaksa regime has done since the day it assumed power is the systematic destruction of the judicial system in the country. By illegally impeaching the Chief Justice, Dr. Shirani Bandaranayake, the first female Chief Justice in our two hundred year old Supreme Court, and the subsequent appointment of a puppet Chief Justice along with a long line of stooges and political friends to the highest court in the land, the Rajapaksa administration has demonstrated to the people and to the international community that Sri Lanka no longer has a functioning, independent judiciary.

Furthermore, the draconian and dictatorial policies of family rule have also shown that Sri Lanka is no longer a country where the rule of law and good governance-principles are upheld, prerequisites to accountability, in any country. Repealing the 17th Amendment to the constitution and hounding the media and other dissenting voices and forces, increasing acts of violence against religious and ethnic minorities which are clearly orchestrated by groups with aiding and abetting of the ruling regime, further cast doubts on the Government’s genuine commitment to reconciliation. Continuing abductions, torture, intimidation of the media, militarization of every aspect of social and economic spaces, blatant corruption, nepotism and the glaring impunity with which the ruling elite flout the norms and laws of human rights have all contributed to bring Sri Lanka to the brink of an abyss and the international community now has taken notice of that dangerous spectacle.

The UNP has repeatedly asked the ruling regime to address these international challenges head-on. Rather than hiding behind a nationalist, jingoist propaganda veil, the Government should realize that there is a serious issue of human rights in this country. When the Rajapaksa Administration unleashed the Army on innocent people at Weliweriya, whose only crime was to demand safe drinking water and massacred innocent school children, the truth dawned on many in the South as to what this regime had done to our own people in the North. Even at the cost of political expediency the UNP has always stood for the rights of all our citizens and we have continuously offered the Government our support to re-establish the rule of law in this country.

It’s never too late. International challenges can still be effectively faced and resolved. What is required from the regime is the political will. The resolution passed in March this year at the Human Rights Council allows for a window of opportunity for the Sri Lankan government to carry out a credible internal investigation. This would prove that we are capable of handling our own issues. In the meantime, by blanket refusal to engage with the team of investigators appointed by the UN Human Rights Commissioner, Sri Lanka is admitting guilt and depriving itself of an opportunity to make its case. This would not only be an injustice to the valiant soldiers who sacrificed so much for this country but a betrayal of all our people who will have to suffer the consequences of international action.

The UNP calls on the government to cooperate with the UNHRC. The mandate of the team also involves investigating the atrocities carried out by the LTTE. The Government should at least present to the investigators the crimes committed by the Tigers. And it is rather ironic that some members of the LTTE who committed inhuman crimes such as the murder of 42 Buddhist Monks in Aranthalawa are now Cabinet Ministers in this very Government whose catchphrase is patriotism and love for the motherland. In their own midst is the main weapons procurer of the LTTE, the infamous KP, the self-proclaimed leader of the group after the demise of Prabhakaran; one time deputy leader Hon. Vinayagamoorthu Muralidaran alias Karuna Amman (the man responsible for the killing of 42 Buddhist Monks) who sits in Parliament as a member of the government and is also the Vice President of the SLFP. These individuals have been responsible for heinous crimes including the attempted assassination of the then President, Chandrika Kumaratunga and the massacre of hundreds of policemen in the eastern province who had surrendered to the LTTE. Accountability can start now and here. Yet with all real Tigers in the ranks of the cushy Government benches, the Government persists in labelling all other progressive forces in the country as terrorists and traitors.

The UNP stands prepared to support the Government to restore the systems and institutions of democratic governance, provided it will pledge to restore the 17th Amendment and prioritize a return to civilized values and the rule of law. The UNP believes in a Sri Lanka that is unified, democratic and truly free. We have no interest in seeing our nation being relegated to a ‘pariah’ status in the international arena. We were once a respected country among the community of civilized nations. The Rajapaksa regime might want to drag this country to the pits, by force of their own short-sighted racist policies and incompetency in handling foreign affairs. The UNP is not willing to stand idly by and allow all the people of this land to pay for the sins of the ruling clan.

UNP has conveniently forgotten that chief cop of the superpower Obama had promised to close that inhumane Guantanamo Bay US torture camp before and after coming to power. After six years, Obama is there, and Guantanamo Bay prison is also there.

    Now, without going merry-go-rounds on past events, UNP must tell us how they expect to solve the so called national question. Otherwise UNP can linger on in the opposition.

      1. The lies and imaginations of Para-Monk Mahanama claiming that the Para-Sinhala were the first to be in the Land of Native Veddah, and that Para-Tamils and other paras came later.

      2. However, the facts are that the Native Veddah Aethho were in the Land of native Veddah for well over 30,000 years before the Paras from South India and India arrived by Illegal boats, Hora Oru and Kall-thonis.

      3. This fact, can be proved by analyzing the DNA of Para-Sinhala, Para-Tamils, and other Paras and comparing them to the Natives of South India and India.

      4. This fact needs to be publicized widely, the lies and imaginations of Para-Monk Mahanama Exposed, and clearly stated in a Preamble with the Indians.

      5. Once you get these facts out of the way, can make request if India will take back all the paras who came from India based on the DNA analysis. Naturally they would decline. Who would like to take a bunch of racists, murderers, war criminals and rapids claiming to be Buddhist and Hindus?

      6. It like being an alcoholic. It is hard to cure an alcoholic without getting the alcoholic to accept that the alcoholic is an alcoholic. The paras, especially para-Sinhala and Para-Tamils are like alcoholics. It is hard to cure an alcoholic without getting the alcoholic to accept that the alcoholic is an alcoholic. However, the data clearly shows that the para-Sinhala and para-Tamils are clearly Paras, in the Land of Native Veddah Aethho.

      7. All you have to do is to see what lies are being taught Sinhala School children, in School as well as Sunday School, Dahaam Pasela, based on the lies and imaginations of monk Mahanama in Mahawansa. The Para-Sinhala children when they grow up, they believe the lies.

      9. Even in America, still 1 in 4, 25% believe the Sun goes around the Earth. What percentage of paras in Lanka, the Land of Native Veddah, believe that beyond believing in the lies and imaginations written in Mahawansa?

      The paras in the Land of Native Veddah do not wan’t want to be relegated to a ‘pariah’ status in the international arena.

      The best the paras can do is get back to South India and India.

      Then the international community will stop calling Lanka, the Land of Native Veddah Aethho, a “pariah’ state, courtesy of Para-Sinhala and para-Tamils, in addition being called a Para state.

      Then, it will be called the true Land of Native Veddah or Egalitarian Veddah State.

    Why all this roundabout? The UN can with an International Armed Force invade Sri Lanka, replace the Criminal Regime, maintain a supervisory presence until all government machineries are installed and functioning, and leave. Seventy percent of the population (except 30 percent comprising the Moda Sinhala Buddhist and Jarapaksa Family and their supporters) will give their unstinting support.

Even if UNP pork their hands, the idios in the family ruling party will blame UNP for nothing (like Ali-Koti) when go for elections. Let the ruling family to get it settled.
    Peris has already informed them that SL Govt will not allow anybody to come here for investigations, and what else, and why do they want the permission from the Parliament NOW? All to bluff its people.

    Karuna was Ranil’s Golaiya. Current Karuna, the accused womanizer, child kidnapper, white van criminal is not LTTE Karuna; he doesn’t consider him as LTTEer anymore; rather he is a Ranil’s production. Now, Ranil is putting the credit of creating of “Karuna the Criminal” on The King. Ranil has been claiming that he established connection with Karuna and pulled him out of LTTE, helped him to from TMVP. Can Ranil give one single reason why he did had not the police arrested Karuna at that time? Is Ranil saying Karuna killed the 46 monks after joining the SLFP?

    Shiranee came through the backdoor, illegally; Got fired though the front door, illegally. Why Ranil is not taking about how she came in? During the PSC procedures, only TNA’s Sampanthar and Sumanthiran opposed her firing. Royal government was trying to arrest Sampanthar for that. Sumnathiran demanded Hakeem to resign. But, UNP argued that the Parliament had all power to fire the CJ – Western entities should not meddle with the Lankan parliament. Now, what is this new twist of Ranil? She supported 18A. How a CJ can do that? Did she ever go to a low school? Does Ranil remember that? She went against the Royal Government, only, when the rulers asked from her Royalty on her husband’s business (Rather their share of the bank robbery). She was not doing that to substantiate 17A. Did she? So why is he talking about her dismissal now. Let me ask the question again-What is this the new twist of Ranil?
    After the loss of Fonseka, the common candidate, Ranil was given to understand by the Royal Government that he never can become EP, but the Royal Government still would like to accommodate him under a new scheme called “national government”, a fraudulent action (Based onHakeem Doctrine – i.e. the best action for a politician is, stand on opposition on the election and join the government after that), if the opposition party agrees to merges into SLFP as a whole. To join the Royal Gang and become at least as a PM, the Gang Initiation Challenge given to Ranil was knocking off the Experts Panel Report at UN. So on July 05, 2011 Ranil was received by the Sri Lankan embassy in New York and taken by the embassy vehicle for the sparring with Ban-ki-moon. There Ranil argued with Moon that the production of the Expert Panel Report was illegal and infringement of Lanka’s sovereignty, so that it should be thrown away. But Moon replied to “Be assured that the report is not going to be lost in UN anywhere”. Drastically failed on his gang initiation challenge, Ranil was not taken into National (Royal) Government. Black’s strategies did not include Ranil, after seeing his in effective religious beliefs in winning elections in Lanka, though, it included Wimal through JVP. Now, Obama’s government has put almost all Blake’s strategies back to normal USA’s style (democratic based, private capital style). So Ranil was invited to Howard and given a lesson that he should not oppose the legal international bodies like UN, UN Expert panel etc. (Ranil, eventually, even may have to sign the ICC against his wish). This is why now Ranil has changed his tone on the crime investigation. America knows to bypass if Ranil refused to sign ICC and come back to him. But Ranil still has to realize that ICC has to prosecute King, if Ranil has to ever become EP (but, it is not guaranteed). America would not mind to go on that path. How about Ranil? Will Ranil, if the 12 person, OHCHR commission find that there are evident to refer Lanka’s case to UN-SC under this inquiry, and through that to ICC(that is a very high chance possibility), accept in Parliament, that it was his fault delaying the justice for the Lankan by refusing to sign the ICC accord and allow that legal, international body to take its action on the death of the 147,000 people, in time?

Most CT writers and commentators here are making their small contribution by attacking the Sinhala Buddhists and Buddhism with lies. Thank you.

        That may be because they think they can cut a diamond with a diamond only(Honest UNP-SLFP way). So, CT commentators are countering it with something similar to saying their fore fathers are moneys. It does not appear to be too bad technique for me.

        You are pretending like you are honest; can you publicly write here that it was a lie that Mahanama’s claims of Sinhala Buddhist are descendants of lion? If not can can you produce some prove of that?

        You can remember Ranil feeding Karuna and getting to his side, but cannot remember how many notes you counted and paid to VP to defeat Ranil. Do you? That may not sound like true democratic election, but it sound like, for me, it is an honest Sinhalese Buddhist gentleman(Modaya)’s action- who does not lie.

    When Gen.Sarath Fonseka, the Army commander who was in charge of Army during LTTE war says that he is prepared to testify in front of UNHRC and will defend our soldiers from war crime charges, then why Rajapakse Government still refuse UN investigators to enter Sri Lanka.
    It is only Gen.SF who could answer on war crime charges and he is willing to corporate with UNHRC. If so why MR is scared of UNHRC.

    We are sick of reading these “Statements” by this UNP and its leader.

    I saw in Colombo Telegraph today that the Leader of UNP making a statement in Bandarawela, that he would “topple” this Government through the Uva Provincial Council elections.

    Does he know what a Provincial Council election is and what bearing a win in an election of that nature could “topple” a Government.? He must be thinking that we too are “stupid” as the leadership of this Opposition party. We are very unfortunate to have an “Opposition” to this Government like the UNP with a leadership of this caliber.
