Government PSC Members Insulted CJ And She Walked Out

Citing a lack of faith in the process and reiterating that a fair trial was not possible under these conditions, Chief Justice Shirani Bandaranayake and her six member legal team walked out of sittings of the legislative committee set up to probe the impeachment motion against her today.

Consistently, the Committee probing the impeachment has refused to grant the Chief Justice and her lawyers time to file responses or laid out the procedure being followed during the trial by parliament.

Bandaranayake appeared before the Committee at 2:30 p.m. local time today and heated proceedings continued till nearly 6 p.m. before the Chief Justice informed her legal team that there was no point in continuing to engage in a process in which she had absolutely no faith she would receive a fair hearing.

The 11 member committee in which the Government is represented by seven MPs, continuously refused requests by the Chief Justice’s lawyers. During the previous sitting, lawyers for the Chief Justice had objected to the presence of Government Ministers Wimal Weerawansa and Rajitha Dissanayake on the committee since Bandaranayake had given rulings from the bench against both ministers and it constituted a conflict of interest. However at the beginning of proceedings Committee Chairman Anura Priyadarshana Yapa rejected this objection saying both Ministers could continue to sit on the committee. This ruling raised a ruckus with members of the opposition represented in the PSC objecting to the fact that the issue had not been deliberated on at all during Wednesday’s sittings of the committee, at which the Chief Justice was not present.  Ministers Dilan Perera and Wimal Weerawansa repeatedly heckled and disturbed submissions by Romesh De Silva PC, the head of Bandaranayake’s legal team. Both Government MPs also repeatedly insulted the Chief Justice, calling her ‘baby’ and ‘nona’ and generally demeaning her.

Informed sources told Colombo Telegraph that Bandaranayake’s lawyers had requested a list of documents and a list of witnesses from the PSC to support the impeachment charges against her but the Committee had no major witness list to present. A big sheaf of documents were however handed over to the Chief Justice’s legal team although enough time was not permitted to peruse the documents which some lawyers said amounted to hundreds of pages. They said the PSC had also refused to allow Bandaranayake’s lawyers a chance to cross examine the witnesses cited in the documents. Instead the Committee Chairman requested the Chief Justice and her lawyers to appear before the PSC again at 1:30 p.m. tomorrow and respond to Charges 1 and 2 of the impeachment motion pertaining to alleged financial misconduct.
Senior lawyers said that refusal to allocate a defendant sufficient time to prepare a defence was a grotesque violation of the laws of natural justice.

The PSC will reconvene again at 1:30 p.m. tomorrow. If the Chief Justice does not appear before the committee, a decision on that issue will be made about what action to take, according to Deputy Speaker Chandimal Weerakoddy. Meanwhile, UNP representative on the PSC John Amaratunge told the media that the lack of procedure was hampering the process but said the UNP was not going to quit the committee since they should be there to fight till the end. However, there is no decision on whether to quit the Committee by DNA MP Vijitha Herath or TNA representative, R. Sampanthan. The opposition will make a decision on the matter tomorrow Colombo Telegraph learns.
There is speculation that the process to find the Chief Justice guilty of the first three charges is already in place. President Mahinda Rajapaksa last night called PSC Chairman Yapa and informed him that the judgment was ready and asked him to lead proceedings from today onwards. Yapa was informed that the verdict would hold the Chief Justice guilty on the first three charges on the impeachment motion which contains 14 charges against Bandaranayake. The PSC report – filed by the majority membership in the Committee, with or without the sanction of the opposition members is reportedly being readied for submission to the Speaker on Saturday (8).

    CJ must face the Criminial offance of Corrupation charges before the Parliment of PSC.No orginization or individual has special rights to overstep the Parliment and constitution.Such violation of Sovergenity of Parliment and denied republic constitutions by the CJ must be investigated.We should endeavor to fairness and justice in case agianst corrupation of CJ.
    We think on people’s point of view CJ has avoding PSC session of probe of invegestaion by Parliment,is serious challange in Rule of Law.
    This not way to approch of democratic patten of Fair play of Justice by CJ.She set wrong example to Rule of law,as enforcemnt Judge.Such behiviour is not fit her position as CJ have been not perfect ,there are still visiable phenomona of LAWLESSNESS AND LAX OF ENFORCEMENT NOT PUNISHING-LAW BREAKERS IN TIME OF JUDICIAL SYSTEM in Sri Lanka.

    Walking out is not an effective way of facing corruption charges. This is the stand of a guilty person. If she was innocent she should stick to her guns and face the proceedings. What has she to hide if she can counter the charges against her and her husband. She could afford to walk out because of her position. Imagine an ordinary innocent victim with no power or clout taking this stand. He will be first charged for contempt of court. Even the law favours the mighty and the powerful (sic.)

      She is walking out because she is not being given a fair chance to answer the charges. 100 pages give today to be answered by 1.30 pm tomorrow. No wittnesses ca be cross examined etc. What kind of court or tribunal is this. Also the uncouth words ‘Baba”Nona’etc. uttered by the likes of Modawanse and the Dentist who have no right to sit since they are interested parties.

        Dear Safa,

        This is thae typical way of doing such a thing in each and every country in the world. She has to prepare for that with out agitating people. She must concentrate on this matter. She has a team with 5 lawers and she waist lots of time by showing her butt to democratic people in Sri Lanka. Finally , no any country including USA, Canada, UK, France or tamilnadu give extra preperation time to answer question when the inquiry begun. That is the nature of the inquary (Reason is when you get extra time you try to bribe people).

        Why should one learn the language of UK, USA,and Canada? We have a language and it’s good enough for us. We learn other languages to be able to communicate with others. One doesn’t need to be perfect in English to write a few lines of his opinion.

    but as it looks as the writer of this article speculates:

    If CJ is the saint she is pretended to be :

    1) Why didn’t she resign when her husband was appointed for two powerful political appointments? Conflict of interest…she is a doctor in law..She cannot understand that….Now she is trying to be a ‘Baby’ what else????

    3) If she couldn’t resign she should have stopped her husband taking up those appointments.

      You seem to be seeing just one side for your advantage. According to you – it seems very acceptable to look down upon CJ to the manner those idiots – uneducated buggers but got elected to the parliament by any means have been, easily. Not even few weeks ago, Rosi senanajake too was condemned by one of their henchman- no any one from the top leadership even considered that it should NOT be.     CJ and her legal team should follow the common sense approach. The guilty verdict has already been made by the newly appointed MR’s PCs who were given the copy of the charge sheet at the party given by the President at the Temple Trees and calling their observations soon after their appointment as the PCs.

    Without playing into the hands of these rouges the CJ should refuse to take part in this ‘Kangaroo Court proceedings’ until a complete authoritative interpretation to the particular standing order is given by the Supreme Court. In fact this was the decision of the PSC that appointed to inquire into allegations made against then CJ Samarakoon. They (which include Dinesh Goonawardana MP and Sarath Muttettuwegama MP) conveyed their decision to the then Chief Govt Whip, which has never been attended to since then.

    In the given circumstances the team that represents the CJ should follow common sense approach. The message written on the wall is abundantly clear; what the govt want is a Supreme Court consisting of judges obedient to the President and not a independent Court that protect the democratic rights of the people whenever threatened by the Executive and the Legislature. This sinister move by the joint efforts by the Executive and Legislature is clearly unacceptable as it violates the Independence of the judiciary, a fundamental need of any civilized democracy.

    According to the press “Legal Action initiated against 42 Politicians in Sri Lanka for involvement in various crimes…..Furthermore According to
    Police Headquarters the crimes committed by these politicians range from killings to rape,assaults,harassment land acquisition,treasure hunting,unruly behavior ,soliciting bribes,ransom,extortion and obstructing police from discharging their duty.These are reported crimes

    What does she and her lawers talking about insulting. Go to any court and see how those layers and other court staff insult innocent villagers. That is insult and once they were insult those innocent people gave up theis case because of diginity. You dont see such a thing in Colombo but go to rural areas. Insultin of people is very popular among the lawers and that is the way they win the case and grab big chank of money from innocent people. Probebly now CJ and hes lawers understand how much bad thing they have done to innocent people by insulting them. Finally I would like to say, once we analyse all the statement she gave to reporters indicated that she is lack of professionalism and behave like a uneducated person. I think foregin money must be behind every thing. They want to drag this thing until the end of next march (Until next UN assembly). That is why she ask more time.

Not only in rural courts but even in city courts, not only villagers but even educated citizens are insulted by lawyers in front of the judge.They stoop so low as to even make fun of such irrelevant matters as their innocent victims sexual orientation, civil status,inability to bear children etc and the Hon (sic) judge smugly watches the scene as the court drama unfolds before him enjoying every moment without interruption. Eventually,the hapless victims lose their dignity and self-respect at the hands of these black-suited Hulfstdorph vultures, and give up. The winner is the client of the most foul-mouthed and vulgar of the lawyers battling the case.

    There were 14 serious charges against the CJ. Through a different pretext though, Elmor Perera has been advising her not to attend the PSC from the very beginning. So, this walkout is of no surprise. Indeed it could have been the plan from the outset. By making the judges (PSC) who constitutionally judge all impeachments the defendants PSC members and the speaker, she has designed a new route to judge her case in increments by fellow judges whom she appoints.

    The first charge is; apartments the CJ bought for her sister domicile in Australia with her power of attorney is in the list of properties of a subsidiary company of the company that filed a fundamental rights case, where the CJ had taken over from another judge using her authority to judge and that is not right.

    The second charge is the way she earned the money to pay for the above property is not disclosed.
    Now the accused CJ has walked out with a ridiculous excuse; ‘a lack of faith in the process and reiterating that a fair trial was not possible under these conditions.’

    Since she knew the case in and out why she wants six weeks to prepare for the case is rather puzzling.

        Asking for more time to prove her innocence in my opinion is rather mindboggling for she should have known all facts related said two charges off by heart. And she should have had bank statement, remittance details and etc in hand. So, why she wants six weeks to prepare for the case is no doubt a delaying tactic. Perhaps she too wanted to get ready for this case like all knowing and infamous politicians.

        Anyway, now the accused CJ has walked out with a ridiculous excuse; ‘a lack of faith in the process and reiterating that a fair trial was not possible under these conditions.’ the entire parliament should finish this drama off once and for all in one voice as soon as possible.

        In my opinion, the CJ has chosen this confrontational route hoping financial and political gains like SF had. Financial gains could be; but definitely not political gains for Eelam aspirators, NGO cahoots, pseudo democrats, green brigades and red blooded revolutionaries cannot stick together for long. She better remember the pit falls as well.

    First I thank CT for bringing these news to us all readers.

    Both Gon 9th grade rowdy kelawaddas Wimal Gonwansa and Dilan who were languishing in streets looking for work before were turned into politics for their own survival.
    They have no right to insult the chief Justice who should file a case against them for SEXUAL HARASSMENT AND FOR INSULTING HER IN PUBLIC.

    Who is this pi.p Wimal who think he is to call an educated, cultured and respectable CJ to call her ‘Baby’ and ‘Nona’.
    He can find a ‘baby’ at night after 9 pm in Kelaniya or Thotalanga Junction….or call his friend Mervin to find one.

    CJ should immediately file a case against both on Sexual Harassment charges both Local and International courts, with the help of Supreme courts.

    Second what CT must do is to collaborate with Supreme Court to work with International Judiciary, Commonwealth Jurists, Asian Human Rights Association, US and UK courts to file a case against Govt. of Sri Lanka for not giving her rights to proceed with this Impeachment case along with the sexual harassment she had to face during the last PSA hearing.

    They could implement a Travel Ban to all Govt. members if the Govt. did not give a satisfactory reason for abandoning the trial.

    Third what CT must do is to collaborate with Supreme Court to work with International Judiciary, Commonwealth Jurists, Asian Human Rights Association and with Interpol to get all the information relating to local and foreign investments, both financial, real estate and others …like land, farms , shares, bonds ets that are owned by all the ruling family, parliament members and their family members and friends, in and out of Sri Lanka.

    This is a MUST and URGENT which CT along with Sri Lanka Bar Association, Supreme Court and the CJ that could initiate this with the help of International Courts, Interpol, and the Sri Lankan Diaspora.

    Fourth CT should work with SC and other law enforcement departments to give additional protection to CJ, her family and her Lawyers. THIS IS A MUST.

    I hope CT and the Judiciary will help Sri Lankan citizens by protecting CJ and to trace these Black money which actually belong to them and could bring justice to all of them.

    No one is above the law. Or… are we supposed be a tiny bit lenient towards VVIPs? Everyone needs to co-operate and find out the truth… running away means… something is fishy and loopholes are sought.

    She needs to come out of this drama gracefully and if not found guilty should go for the highest office in the country as she is a great fit for that as well. It is stupid to use this issue to create unrest, possible violence and divisions and expect a good result. She needs to come out not only winning… but winning the hearts and minds of the people as well. Similarly… if she done broken law, pay the price.

    She has nothing to fear, because the truth cannot be hushed up.

    I won’t be surprised to see even this issue will cause the Tamil Terrorist Diaspora to lick the a&&es of the foreign vultures at an alarming vigor, and beg them to punish, warn, insult, demean and harass our elected leaders and Sri Lankans.

    If anyone is undervaluing or demeaning our leaders they are doing that to us, the people who voted for the leaders.
