Govt.’s Duty Is To Stand By Our War Heroes

Though the passage of the US sponsored resolution against Sri Lanka in the UNHRC without a vote last Thursday is being hailed as a diplomatic victory for Sri Lanka, I am unable to share that view. Operative paragraph 6 of the resolution affirms the importance of the participation of foreign judges, prosecutors, lawyers and investigators in the Sri Lankan judicial mechanism to be set up to investigate alleged human rights abuses during the war. Operative paragraph 8 encourages the Sri Lankan government to remove individuals in the armed forces suspected of human rights violations through an administrative vetting process even if there is insufficient evidence to charge them in a court of law. Operative paragraph 4 welcomes the government’s willingness to allow the various judicial and other mechanisms it intends to establish to deal with the past, to obtain financial assistance from overseas, which means that these supposedly Sri Lankan mechanisms will be paid for and maintained by foreign powers.

Those are just a few of the objectionable operative paragraphs in that resolution. After its passage, the Prime Minister said that Sri Lanka has now been ‘taken off the agenda in the UNHRC’.  Posters of the UPFA have appeared on the streets hailing the government for delivering the country from the ‘imperialist death trap’ in Geneva. Such statements sit oddly beside the operative paragraphs of the resolution mentioned above. The mismatch between the provisions of the resolution that was passed and the government’s present mixed signals and rhetoric may be due to a belated realisation that nothing has been gained by Sri Lanka joining the USA as a co-sponsor of this resolution except to commit the government to a course of action which runs contrary to the interests of this country and is therefore politically unfeasible.

I acknowledge that there are times when foreign powers try to foist their way of thinking upon other nations and the country at the receiving end has to find ways of dealing with the situation.  The first duty of the Sri Lankan government is to see to it that the interests of our war heroes are looked after.  Operative paragraphs 6 & 8 of the resolution run directly contrary to that sacred duty. I regret to note that there is an attempt to whitewash the unfavourable resolution in Geneva by claiming that this was the best that could be achieved and that things could have been far worse with the near certainty of economic sanctions if my government had been still in power. The withdrawal of the GSP+ trade concession in 2010 and the ban on Sri Lankan fish imports to the EU in January 2015 were mentioned as the forerunners of the sanctions that were to be imposed on Sri Lanka.

The public should be made aware that the ban on fish imports to the EU this year was due to issues relating to ‘illegal, unreported and unregulated’ fishing in the Indian Ocean in contravention of the rules of the Indian Ocean Tuna Commission and had nothing at all to do with politics or human rights.  As for GSP+, this is a special trade concession of doubtful utility which gives the EU a political handle over the recipient country. In 2010 when GSP+ came up for its quinquennial review and this was being used to impose the EU’s will on Sri Lanka, my government made a conscious decision not to reapply for GSP+. Even after this trade concession was withdrawn, my government ensured that apparel exports to the EU kept growing at more than 6% a year. It should be noted that no major exporting country in Asia has applied for GSP+ due to the political strings attached to it.

It was also said that I had antagonised the Western nations by being photographed with my arm around Muammar Gaddafi of Libya. It is actually Gaddafi who has his arm on my shoulder in that much publicised photograph. In the last months of the war in 2009 when Sri Lanka was fast losing foreign reserves due to the severe global economic recession that year and the IMF under pressure from the Western nations was delaying the standby facility that we were entitled to, Muammar Gaddafi agreed to lend 500 million USD to Sri Lanka in response to a single phone call from me. If not for that pledge, the economy would have collapsed before the war could be won.

It was also said that when foreign dignitaries came to Sri Lanka to persuade us to stop the war, I had deliberately insulted them by taking them to Embilipitiya and giving them manioc to eat, and that that resentment was motivating the Western countries to pass resolutions against us. I have no recollection what was on the menu when the British and French foreign ministers met me in the final days of the war demanding that I halt hostilities. But it is certainly true that I refused point blank to halt the war. It is because I did not buckle under foreign pressure that this country is free of terrorism today.  Governments are elected by the people of Sri Lanka to do what is best for the country and not to agree to everything said by foreign powers. That applies to the resolution that has just been passed in Geneva as well.

      They have one thing in common: they both gave false facts in their applications for the GSP+ grant received in 2005 and 2008. When it was found out in 2009, GSP+ was terminated in 2010. As soon asthe EU investigation report about the applications was published, Cardinalalcolm Ranjith along with a Hindu priest, Buddhist Bhikku and Islam priest were sent to Italy to get GSP+ but were toldthat the Human Righs criteria had to be met. But the former President refused to adopt ICCPR(that would have served justice to Tamils). So he was prepared to forego GSP+ by refusing to adopt principles that would haveserved Tamils justice. to

        P-6 About foreign judges, etc.

        Can we be proud of our judicial system ?, can we market it to others ? is it attractive ? NO, Not at all. Who is answerable for it ?

        For ex.
        (1)When Tangalle PS chairman -rapist & murderer was walking as freeman for years , he was brought to justice only after UK MP visited you as then president on eve of Commonwealth summit.

        (2) A container load of Heroine 260kgs ,was caught at Colombo, the biggest in South Asia, after a tipoff by US intelligence, But no body was prosecuted or sentenced

        (3) Pradeep Eknaligoda still remains disappeared , no body was prosecuted. we caught Prabhakarn, but couldn’t find Eknaligoda allegedly arrested by Army intelligence in Colombo.

        All those happened under your nose, so who is answerable for our sordid judicial affairs ? Other than you, your self ?.

        Further, still man with rape & assault charges ,surrendered before Mt. Lavinia courts ,is serving as a Supreme Court Justice.

        If we ourselves are disgusted with our Judicial system, any wonder outsiders are asking for foreign Judges, Investigators, Prosecutors ?

        P-8 About- Remove armed forces individuals

        If they are suspected of HR violations, (even though no sufficient evidence prove in courts ) .
        Okay, They don’t ask us to kill them, just to remove them from service.

        Can we expect any better lenient punishment ?

        We should know that cases dragging for decades & finally being dropped for lack of evidence, that is not acceptable to outside world.

        P-4 About ..To obtain financial assistance from overseas..

        This is to ensure that legal process won’t fall by way side if political monkeys stop allocating funds from govt. treasury.

        This is the testimony to confidence they have in our politicos.

        This could have really aggravated if you were in power, thank Triple Gems, it’s not the case now.

        Further we are in this untold economic hardship, than ever, one person (including fresh born baby) is indebted to foreign lenders over Rs.450,000 each, because of your extravaganza & waste of public funds over dozens of billions of US$ on White Elephant projects like Sea Port, Air Port, Coal Power plant , High ways with expenditure inflated 4 -5 times more than real cost & none gave any tangible Return On Investment so far.
        This made us more dependent on US/West economic power & You know the motive behind those waste running over billions of dollars & who benefited, better than anybody else.

          Was it only a pledge?

          If indeed the money had been transferred, could we have cite of statements of the bank account to which $500 millions was transferred as he alludes to. If it was deposited in Seychelles I am not interested.

          Over many years until the war ended, Hindia (MR’s big sister) had been lending huge amounts of dollars disguised under different schemes towards Sri Lanka’s war footing. MR has not mentioned Hindian side of financing the stupid war.

      Certainly, it is the country’s duty to stand by its heroes (armed forces or any other) but HR violators, criminals, rapists of public coffers must be exposed and severely dealt with.

      Percy the cardboard Sando, ….. I thought you once offered to sit in the electric chair to save all HR violators from being taken to the Haig; why the change of heart? Those UPFA colleagues who were also fighting to be the first to go to the electric chair have also deserted you. You truly are a lonely sorry arse.

    A) if you think that you are the only, there you are wrong – you need to make the mind up thinking collectivity won the war against LTTERs
    B) GOVT has already proved it by giving the due respect to Sarath Fonseka, as MR govt failed to do it.
    C) Security forces and their respect will be upgraded in the days to come since the current govt are not abusive as had been the case with MR s

It is now in the hands of the PRIVATELY-funded OHCHR, the office holder being the Jordanian Zeid. Jordan is a country which hosted the US bases training terrorists to be sent to Syria to liberate it from it’s citizens. DJ was the hero in 2009 June in Geneva as he was able to change the UNHRC resolution which was against Srilanka for ‘war crimes’ DJ claims that he single handily changed the resolution to praise the victory over terrorism, giving credit to this Hero. 6/12 later Geneva Hero lost his Job. However, can we forget the State terrorism since 1956 Which really gave rise to Liberation war by Tamil Youths which was castigated as Terrorism for Srilankan state’s convenience. Then 9/11 was exaggerated to bring about this war by M R. His ‘Chinthanaya’ shows his intended ‘Genocide on Tamils’. Terrorist war was a façade to his intended goal

      The big question is who is the war heroes, in your terms Mahinda,
      A) If it is Defense Personals, asking the Democratically elected Government to Stand by the Defense Personals is an absolute breach of protocol, it is always Defense Personals who should Stand By Democratically elected Government, otherwise it should be a Military Government or if the present regime also doing the same or publicly pronounce to Stand By the Defense Personals the system is wrong by all means.
      B) If You Mahinda, calling the Govt. to Stand By You as a War Hero, please go thru the following sequence of events and decide whether they would fail your request
      Failing to arrest Veluppilai Prabaharan and his accomplices when they were having dinner of hoppers at Amirthalingam’s house, immediately or later following gunning down Alfred Duraippah, at Ponnalai.
      2. Failing to apply a return ambush at Kadju Farm Murungan Mannar Road when Veluppilai Prabaharan and his accomplices ambushed a radio-car with few CID officers at the same farm, despite of its close proximity to Thalldi Army Camp, Mannar one of the biggest then existed.
      3. Bringing an abrupt halt to the Vadamarachchy Operation Liberation in May 1987, when General Denzil Kobbekaduwa and Brig. Wimalasundra’s battalion have managed to isolate the civilians from rest of the fighting groups including Veluppilai Prabaharan and LTTE, and thus for failing to arrest or shoot down the most wanted people of the law by then and failing to avoid catastrophe in succeeding years by that abrupt halt of Operation Liberation
      4. Failing to uphold the Sovereignty of Democratic Socialistic Republic of Sri Lanka, which is uttermost responsibility of a Responsible Government at the most required time, by halting the Operation Liberation at a crucial juncture at the behest of India another Sovereign Independent Nation (Could have finished the job swiftly said in above 3. and then sign the agreement)
      5. By the action said in above 4 the Responsible Government of Sri Lanka (here in after referred to as RGOSL) wasted an opportunity to tear the Indian Super Power attitude and its’ face mask for the betterment Regional Independent Nations’ Sovereignty; worst of all RGOSL allowed Veluppilai Prabaharan to be carried off to Delhi by an Indian Helicopter from the shores of Sri Lanka, then to return by same means instead of to Colombo on both occasions – with ulterior motives unveiled later as a war.
      6. By the actions above said 3 and 4 of RGOSL, the siege by the LTTE as well as by other groups over the entire population lived in the North and East of Sri Lanka and over the defense installations there in were allowed to recommence swiftly, though unfortunately for entire Sri Lanka population.
      7. By agreeing to sign and signing an accord at the behest of India, the treacherous act described in above 4, was repeated, and the entire population lived in the North and East was exposed to the atrocities of Indian Peace Keeping Force, and to the crony groups ENDLF, EPRLF, TELO, PLOT, and the worst to the war against LTTE, and the atrocities of LLTE as well. This is an absolute failure, and abandoning the responsibility of the RGOSL, and its constituent Defense Forces to protect and saving its own population from external forces and miseries. More than 20,000 people perished apart from permanently inflicted trauma and despair of war on the living people. Though RGOSL, failed to compensate or compassionate towards that IPKF war affected people, India did only compensate for lose life and property.
      8. In the Alambil Jungle, though IPKF have managed again to trap the, Veluppilai Prabaharan and LTTE far, far away from the civilians, again RGOSL, failed to give the necessary shooting orders in time to IPKF, Thus the RGOSL, failed, again to prevent the mayhem all that have been done by LTTE from there on and failed to protect the people, to which the accord was signed RGOSL, claimed.
      9. Though the prime aim should have been to eradicate the LTTE and its terrorist activities, Government of Sri Lanka, acted invariably constantly in series of contradicting manner, funding, providing arms and ammunition, at the same time the security forces had been engaged in war with the same group, keeping the state of commotion afloat, totally disrupted of day to day life people of unabated.
      10. as such in above 9. RGOSL, connived with LTTE, exposed very able, dedicated, members of defense forces who were very capable of segregating the civilians from terrorists and terrorism to be targets of LTTE and to be killed by same LTTE; to name a few, General Dezil Kobbekaduwa, Wimalratne, Clarence Wiyewardene and Brig. Wimalasundra. Similarly political rivalry also connived with LTTE to get rid of one or the other and not only succeeded in devil dared political maneuvering but also in propagating a maneuvered suspicion among gullible that the Tamil civilians, are against the State as well its leaders through LTTE. In one of those political killing, main informer to LTTE was a former cabinet of minister famous for highhandedness.
      11. As such, pursuing the above action said in 10 the both political parties using the name Government of Sri Lanka deliberately closed the pathways for natural integration between the two major ethnic communities.
      12. An action plan with a notion of Sinhala Buddhist Nation, was allowed to spread intentionally, hence the above said 10, and thus 11 took its own course to polarize the Sri Lankan society and pushing the Tamil civilians towards LTTE further and further.
      13. LTTE on its part, as grown in stature in indisputable terms locally and internationally, staked claim as sole representatives of Tamil people, and to be attractive to that impression conducted series attacks on border villages, monasteries and suicide bombarding in civilian predominant places, such as Railways, Bus-Stand etc. Even their own brethren were killed in spree.
      14. The grown stature of LTTE, as above inducted themselves to carry out suicide bombarding of economically important places of RGOSL, such as Central Bank, etc.
      15. RGOSL by its own actions tabulated all above, concocted state of concede to carry out ostentatious cosmopolitan decorated Peace Talks for deception, with off tracking LTTE, and then entered into a ceasefire agreement (CFA) thus pushing the ordinary Tamil civilians towards LTTE and made them to keep Himalayan Trust on LTTE for their unresolved issues
      16. Having constructed a full-fledged war, as an action plan, RGOSL using planes, artillery and mortar bombarded civilian targets on the pretext of LTTE targets, within its own territory.
      17. From above all, it is abundantly clear that GOSL wanted a situation mass of population going behind LTTE, and did achieve it, rather than attracting the people of the land towards its rulers RGOSL
      18. It is also abundantly clear that the above tabulated series of actions by the so called RGOSL were in line with, meticulously constructing a situation prolonging and culminating to be equivalent of 1971 and 1989, Machiavellians and Machiavellianism massacre, outside North and East of the country for the reasons described in above 12.
      ACTUALLY THE UNP HAD HELPED YOU TO BECOME A HERO FROM ZERO, How did they manipulate you Mahinda, to do what the thing they don’t want to do for themselves. Ask the National Security Council once you chaired.

    Loss has been tremendous, time has been too long. But the mission Don Stephen Senanayake started will be put to rest by international communities very soon.

The real war Hero General Sarath Fonseka, now the Field Marshall, who was the strategist and articulated as to how LTTE could be defeated militarily, and carried out the plan, had been falsely accused by you and you war criminal brother, and jailed for 2 1/2 years. All those who were associated with him were punished as well.

    Leader of the Democratic Party (DP) Field Marshal Sarath Fonseka says that former President Mahinda Rajapaksa is crying out against revenge from the defeated because he always extracted revenge from the victor.

    We know how Medamulana Mahinda Rajapaksa treated the real war heroes, and how they used the country’s resources to exploit to the advantage of the Rajapaksa Family.

    Mahinda Rajapaksa, if you are found guilty, please give reasons as to why you should not be hanged? after all you put the Real Hero in jail, and your brother wanted the real hero killed.

    I can’t really understand why anyone should worry about the outcome of a fair investigation and trial by an independent and impartial judicial mechanism whether local or foreign + commonwealth. These learned men ad women are quite capable of identifying war heroes from war criminals. Most of our soldiers would be identified as heroes but certainly there may be few criminals. Can you please put your hand on your heart and say that you are not trying to knowingly protect the war criminals? If that is the case then you should support an impartial investigation and trial wholeheartedly whether local, foreign or combination thereof. This will only make our nation stronger.

    He has misunderstood the resolution L29 adopted by the UNHRC. His lack of comprehension is acceptable.

    He ruined the judicial system and its institutions by appointing his stooges to such places to cover his and his stooges malarial acts in governance. In the Presidential election manifesto of the Common candidate it was categorical that Sri Lanka in emphasizing the need for an overhaul change to restore law and order and ensure justice to all and to rebuild the confidence lost of the people in the judicial system .

    He pretends to be guardian of the war- hoers(“ranaviruwas”). Who are these ranaviruwas ? Are they the entire army, navy and air force and the police past and the present ?Or were they who have fought against terrorism and those lost their lives, lambs in the war against terrorism ? Surely they do not and cannot be the militia that is responsible for war crimes such as rape, wanton killing ,robbery , torture etc during the war. Is Mahinda in defence of war criminals under the cover of “ranaviruwas” for which he is fully accountable as the Head of state. The short fall in L29 resolution is that it does not envisage to impose penal sactions for those responsible for war crimes.

    mahinda ,don’t you know the difference between war heroes and war crimes perpetrators.The latter could be only a few.Do you want the former to be tainted by the latter.I certainly would not if i was in the armed forces.When i in my uniform go to my village i want to be respected and admired,not to be looked at as a person who could have raped women,killed children and civilians in cold blood.Don’t speak for the forces as if you are a member of it.The former army commander Field marshall Fonseka is the best person to do that and he has said he welcomes a international investigation to clear the name of his troops.

    PS. so mahinda don’t try to protect your nutty brother who probably was suffering from PTSD when he left the army and went to the US.Our war hero is sarath fonseka and he will do the needful and whats right for our country.

      Mahinda Rajapakse did not handle it properly. There was no post war strategy except to use it for the next election win.

    Mahinda Rajapakse, you raised an important point. I can assure you Mahinda Rajapakse that President Maithripala Sirisena will always stand by the war heroes in the way you did, and punished even the Army Commander and sent him to jail when he was found guilty. So having a wrong doer punished is not in any way going against war heroes and you have clearly demonstrated by your own actions.

    President Maithripala Sirisena will also stand by the war heroes and if any found guilty of war crimes will not hesitate to punish them whoever they are and irrespective of the numbers. By doing so he has not done any harm to the war heroes in the same manner you too have stood by them even though you have got Sarath Fonseka the army commander punished.

    You can now rest in peace.

    Come on you fool Rajapakse, you were the President of a country and your duty is to stand by its people, and stand by the victims and not to take sides of the criminals in the military. Why are you dissociating from the people you were elected to serve as President. You were not elected as a military commander to stand by the corrupt military. When will sense prevail on you, you Jackass?

    Who are War Criminals?

    War Criminals are those who killed the five students who were non combatants, the seventeen Aid workers who were not armed fighters, and all those under capture of the Forces whose hands were tied at the backs and shot by the Forces subsequently. There is no case of denying this fact because thee is ample evidence. Hence the Forces personnel who are guilty of the above should be dealt severely. I can not understand why the rest of the Forces or the Public has to agitate for them not to be tried. When the Forces personnel who are guilty for the murders of Lasantha Wickrematunge, Prageeth Eknaligode, Raviraj Nadarajah and others once convicted is it that they should not be punished? Why? for doing the bidding for the Rajapaksa family? All these guilty should be put before a firing squad.

        Do not comment without knowing the facts. The five boys assembled at their normal rendezvous by the beach which was close to their homes. The Doctor’s son was on holiday. The Forces first after shooting them down tried to concoct a story that they threw a hand granade at them and went on to introduce one. When the autopsy revealed otherwise they started to spin various stories to cover up but have failed miserably. I believe the guy or guys who fired from the Forces from their jeep should be tried for cold blooded murder. Nothing short of it would do. Jimsoftiyo you should be hung from your toes for spreading false stories. Bloody SOB.

      War criminals are the ones that abused the power to kill the innocient masses – avalanche of people s dead bodies are believed to have been burrried during the war end without the knowledge of anyone – there details should be reachered… everyone has right to demand for that.. so inveistgaiton of unbiased kind is mandatory. Those who have guilty feelings in terms of having ordered wrongly may feel today, that any kind of such inveistgaiton could catch them.
      Rajapakshes should be brought before the coughts. Punishments should be given to anyone regardless of them being former leaders or not. Then only, the real reconciliation would start in the war torn country/nation. I am not proud to be a sinhalaya, but once upon I was proud to be srilanken… now having lived on the west for the last 25 years, I feel, Rajapakshes are the most abusive of all nature… to have abused the power arbitory. No forgivness should be allowed towards them.

It is he who should be held answerable, accountable and made to face the firing squad if at all it comes to that.     Mahinda the best honour can be done to war heroes is clearing their good names.I am sure there are thousands of soldiers fell fighting a legitimate war. Their names are tarnished by the accusations of war crimes.If any one thinks winning the war at any cost is justifiable I do not agree with that .Why did we have to wait this long.We could have destroyed and finished the war By carpet bombing N&E . It couldn’t be done due to civilians.Any war will bring civilian casualties .Thats is un avoidable .However if some one has taken undue advantage of the prevailing situation and had committed grave crimes that has to be revealed and those people should be prosecuted.They should not be allowed to hide behind the rhetoric of ” Ranawiruwa”. We have a law in this country and according to that investigate these accusations. That will give an opportunity to clear the good name of the armed forces .
    It will never be an impartial investigation unless foreign expertise is involved and there fore we as law abiding citizens have no problem with it.
    If you have not done crimes deliberately you don’t need to panik.Just present your case and justify your actions.
    The recent report highlights the crimes committed by LTTE as well and we can expect a fair transparent trial to address these accusations.
    Please don’t incite racial tensions for your personal gain and we have to resolve and put a full stop to these issues.We need to move forward as a country and please don’t pull it in the other direction.

    Yes, the country will stand behind the war heroes who fought the war without violating the military and civilian rules of war and humanitarian laws. Certainly, majority of the people of the country will not mistreat Filed Marshal the way he was treated in the past. Fonseka is willing to testify to clear the names of gentlemen soldiers, and wants to bring those violate the law to justice.

    Even more importantly, we hope that this government will also stand by the victims of war as well, I mean those suffer from alleged war crimes and crimes against Humanity.

    Just relax and work with the government to bring closure the issue. You had your chance, you failed.

    Why it is important to divert the attention;

    ” The police Financial Crimes Investigations Division (FCID) has last week raided a company operated by former First Son and United People’s Freedom Alliance (UPFA) parliamentarian Namal Rajapaksa as part of a probe being carried out under the Money Laundering Act.
    The FCID is carrying out a probe covering the operations of six companies operated by Rajapaksa – Hello Corp Pvt Ltd, Gowers Corporate Services Pvt Ltd, Gowers Solutions, Gowers Secretariat, Gowers Ceylon Holdings and NR Consultancy.
    The Sunday Leader learns that FCID officers had commenced a probe on Gowers Corporate Services Pvt Ltd on Friday and is to continue investigating the other companies as well.
    The FCID probe is expected to uncover the sources of funding for these companies and its earnings as well as how the monies were utilised.
    Gowers Corporate Services Pvt Ltd, which was floated with the sale of 100 Rs. 10 shares, had purchased Hello Corp Pvt Ltd for a sum of Rs. 100 million even before completing a year in operation, FCID sources said. Despite claims that the monies were raised through loans and by the sale of NR Consultancy to a Bangladeshi national for Rs. 50 million, the FCID is yet to find proper evidence that could prove this fact. In fact, Gowers Corporate Services Pvt Ltd has recorded an earning of Rs. 81 million in the 2013/2014 financial year. The Sunday Leader further learns that MP Namal Rajapaksa has already been questioned by the FCID over the investigation into the six companies. “
