“I Know He Is Innocent. If He Has Done Wrong, He Has To Face Jail” – CJ Speaks About Her Husband

“Chief Justice Bandaranayake seemed unruffled over the charges against her in the impeachment resolution. ‘I know he is innocent. If he has done wrong, he has to face jail. That is all there is to it,’ she told a confidante this week. She was referring to her husband, Pradeepa Kariyawasam, former Chairman of the National Savings Bank. He has been indicted before the Colombo Magistrate for ‘causing a loss of Rs 391,137,554.33 to the state’ and for alleged corruption. The pending case and Bandaranayake’s continuance in the office of the Chief Justice, one of the allegations in the resolution argues, would result in the ‘administration of justice’ being hindered.” the Sunday Times Political Editor reports.

The newspaper said; “Arriving some 15 minutes late for Monday’s Supreme Court sittings, the usually punctual Chief Justice Shirani Bandaranayake declared from the bench ‘as you understand, I had to collect so many documents’. She did not elaborate. Nor did lawyers present to represent clients in cases listed for that day raise any query.”

According to the newspaper, there was little doubt it was a reference to the impeachment resolution 117 government parliamentarians handed over to Speaker Chamal Rajapaksa, the previous Thursday (November 1). It lists 14 charges which are given in the box story on this page. Further confirmation came when Kanakanayakam Kanag-Ishvaran, President’s Counsel, marked his presence for a company of the Ceylinco Group in a case that was listed before her.

“‘I am not going to hear this case,’ she said. Here again, though she did not explain, the first of 14 allegations against her related to a purported transaction involving that group. However, she will tomorrow hear a fundamental rights violation petition linked to Golden Key Finance Company (a member of the financially crippled Ceylinco Group). This is one among three cases, allegation number one claims, which were removed from another bench of the Supreme Court and taken up for hearing by Chief Justice Bandaranayake.” the newspaper reported.

He got orders from the top to buy shares of TFC 150,000 from Reyno Silva ABC chairman and brother of Duminda Silva aka Kudu Duminda whoose medical Bills in Singapore hospital were mounting and these donkey Reyno didnt have the money . CJ husband faith fully carried out the order of the Governor of CBSL and landed in a soup.

    If CJ is taking the GK case tomorrow she should remember 70% of the depositors are people who have deposited moneys below 03 million and constitutes more than 7000 depositors of the total 9,400 and give them immediate relief !!!

    I doubt he is such a fool to approve such a transaction without the instructions / backing of the powers that be. Considering all the scams at the SEC and presidiental intervention to remove people all this rubbish is from the same source. Even the failure of the Ceylinco Group is still a big mystery. A lot of facts are being hidden from the public.
    In any case to charge CJ in case yet to be heard is pure speculation.

Remember how he acquired shell gas… Does anybody know the real reason to acquire it and how much they were paid( in foreign currency)…Why Central bank didn’t come to bail out Golden Key, while pumping Billions to Loss making Sri Lankan Airline, Mihin, Petroleum co-op,Electricity Board etc.etc. I sincerely pray that MR will not ruin the only profit making tourist industry which up to now was handled superbly by private sector. There are many questions than answers. Anybody’s guess.

      For once, I agree with Leela. To begin with, there was a conflict of interest between the CJ holding her current position and her husband holding his. If the CJ was as honest and godlike as she claims, then she would have convinced her husband not to take that post, in the first place. Now, of course, it comes to light that the husband is involved in various financial improprieties; hard to believe that the CJ, with her 20 bank accounts, was fully unaware. The more likely scenario is that the husband felt confident he could get away with his crimes, given CJ’s status and the patronage she enjoyed under Rajapakse.

      Leela, CJ is a professional and a human being. The human being in her makes her say that her husband is innocent. This could well mean that she being privy to actual facts (e.g. perhaps some things that were done on instructions from above) she declared him innocent (or innocent victim.) She also stated that that if he had done wrong he will face a jail term. That is part of her professional self. So Leela don’t throw your sense of justice to the winds and jump to unwarranted conclusions. We still follow the maxim that a person is innocent till proven guilty- that is upto now!

    Another paper reported as Kanag-Ishvaran PC is said to have replied to CJ for her remark written above; “Your Ladyship (CJ), we have just heard that a person (Obama) holding high office has won a new tenure. Let us hope it would be the same with you”.

    Surely, this PC couldn’t have been confused; for as we understand, CJ is not seeking a new term but fighting to survive remainder of her tenure.

    Neither the Chief Justice nor her husband is innocent. It is said that the Chief Justice has more than 20 bank accounts, all in Sri Lanka. Now, why would anyone need 20 banks in a country so small, especially given the preponderance of ATM’s? The only logical explanation is that she was hiding illicitly obtained money in these accounts. In other words, the likelihood that she was cutting deals and taking bribes is rather high. Now, I am not a fan of the Rajapakse regime, but to shed crocidile tears for a seasoned criminal is an exercise in futility.

      I couldn’t agree with you more: Judges are not only expected to act impartial but must be seen to bystanders as if he/she is acting impartial. Surely, that is not the case with this CJ. Pointing out even awful felony by politicians and their stooges is no reason to absolve misdemeanors of judges. Judges should stand far far above politicians.

      Right or wrong, more than a third of MPs have listed clear charges against the CJ and the speaker has accepted it and is in the process of appointing a select committee to inquire into it and judge it. Hence, CJ is now clearly an accused according to law.

      Usual procedure in all court cases is for an accused to appear before an appropriate court when summoned and prove his/her innocence there. No one dare write letters to press to show his/her innocence. But CJ is answering part of her charge sheet through letters send out to press, journals and etc by her attorneys. Surely, there cannot be one law for Simple Silva and another law for CJ.

      The fact that CJ’s attorneys have referred only to few selected charges and answered them vaguely adds to more suspicion as Lester says here have to be discussed separately. For one thing, it is obvious that CJ is trying to turn both local and international pundits to be the jury and influence the final verdict by the select committee. It will not happen for, lawyers or not, select committee is a bunch of Mervyns.

      It looks as if CJ think getting emotional type letters written by her son and her witty attorneys would make her popular. Sure, CJ would indeed be popular among anti Rajapakse clique just like SF was during the presidential election. CJ should know that those in such cliques are in the minority in this country for MR is a master tactician who keeps public at his side. If CJ thinks she can do a Pakistan here and rid of Rajapakse like the CJ there rid of Musharraf, she is sadly mistaken.

The ruling clan can do no wrong. Dr.Mervin can do no wrong. Anyone for the impeachment can do no wrong. CJ is wrong to point out the obvious false allegations levelled at her.           First get it right; I have never defended or supported any Mervins or their goons.

          I have supported MR last time because I thought SF and his JVP,UNP,TNA unholy band had their own aims and that would have made Sri Lanka another Libya. On the other hand, MR I thought would have consolidated peace we won with lot of sacrifices and after three decades. You can read elsewhere in this blog why I will not support RanilW if he contests next time.

Pray tell if it is good for some, why is it bad for me? Or, are you thinking that this forum is only for guys who adore your type of values and principles? Go, tell that to the moderator.

          For one thing, my gender has nothing to do with my writing. What I write here is related to subject matter or current political and economic point of view of the majority in Sri Lanka.           I dont mind whatever sexual orientation the leadiing politicians bear for them – this is common to yours too – no matter you re leela or leelawardhana.. but what matters is the substance of your comments often passed to these threads. Most of them MOST OF THE TIME just make every reader upset only. Besides, most of the time, they re one sided. Like you accuse of RW not focusing the refernces very often. I am not a supporter to any party. Nor am I am UNPer, but the manner current politicans handle matters pertaining to judiciary and the other alarming issues are far from understanding. FUTA has issued that the demands promised by Basil are not honoured. You dont need to spend hours – listen to radio senders and the voices of the average – whether they are happy with the manner the GOSL is handling matters today. The days ahead will be dark for the rulers. You can fool people once but not forever. Even if some feel that masses are ignorants in the country- I hope majority will join hands with the opposition to topple this megalomanics.

        Excellent point, Leela. The CJ is trying to draw out the issue, hoping the international community will exert pressure on Rajapakse so that he drops the case. But, it will not happen. The final decision lies with the Parliament, not the Courts, and Rajapakse can easily muster the necessary majority to suit his agenda. I doubt Rajapakse cares much for world opinion, or should I say Western opinion, so there is nothing the CJ can do. Neither does she have the support of the Opposition, since not only was she handpicked by Rajapakse (over more qualified candidates) but has been rubber-stamping his proposals up to this point. In a few months, the CJ will have disappeared with the wind.

      Anyone who has gone that far with education -w ould not make mistakes easily because they can forsee the depth the problems easily. Even if her Husband may be wrong, I cant accept CJ herself has gone wrong as pointed out by submitted charges.

      Whatever is being discussed against CJ, truth will reveal soon, then many will realize where they are standing.

      This is further clear to many – when focusing on any issues that are being on MR, BR or others today- lack of their education is becoming clear – alone the pictures that showed Presidents behaviour towards former CJ -vice versa are good examples people to realize… how ones with wisdom and others without react to the issues.

      In this regard – also following the speech that RW held in the parliament, it should be commendable.

    My only concern is why Basil or Namal Rajapakse did not sign the motion nor in the PSC. Did they duped other 117 to sign and got away thinking both might have to declare il….. assets if required by law. Good job anyway.

      Don’t concern yourself too long. There were many people, mainly Ministers and higher-ups who did not sign.

      1 Those who signed, signed a bland sheet as the motion had not been given to them.
      2 Ministers and people a little more experienced do not like signing blanks in case it is their death warrant

      3 Those who sign the doc, cannot be members of the PSC who will determine if she is impeached and put it to the floor for a simple majority vote.

      4 All those who signed may go down in history as sycophants for signing something because they were told to, and the slightly more scheming and slimy would not like to be known as yes men or slaves!

      Just a thought!

    People should look into CJ’s husbands first job and why he was fired from that ? Guy was a crook and have no idea why CJ married this guy.

    For CJ to comment about husbands guilt or not while it is sub judice is a matter of great concern and in this instance she has crossed the line.

    Many of the comments are amusing. It is the same level of MUPPETS who have been nominated to judge this issue.If Lake House and the State media were used to publish all allegations which were supposed to be judged by a bunch of MUPPETS what is wrong for her lawyers to reveal the true position where her bank accounts were concerned.
    That is not all where is the secreacy clause of the banks. Is this NDB a public bank or that bootlicker Cabraals bank.The SC must probe this gross abuse as no constituents transactions other than the privileged are safe from coming to the public domain without a court order.When Anuruddha Ratwatte’s 45 million came to the public dmain it was after a court order to search the vaults of HNB.
    This whole thing stinks to high heaven as the speed with which action took place with DIVI NESENA bill as some reader. This came to the Parliament after a propoer study of the Constituition by a panel of judges.If the muppets succeed its best to scrap the judiciary and have Dr Vermin and his goons to decide on issues affecting citizen Perera.
    The President should rise to the level of a statesman and not proceed as the Maha Nayakes and civil society has voiced if he is to die a happy man.As the Buddha said for a deed to be wholesome the thought should be good.The whole country other than assess and muppets who got washed in to the legislature thanks to the President are not in favour of this despicable witch hunt.As someone had said why did Namal not sign this,is it because she obliged him to pose for a picture as no CJ ever did. These are the mistakes she made trusting opportunists. When Mark Fernando took his oaths before the revered H.N.G.Fernando having sat for the exams with others in the open,he left the court and business was as usual and hardly anyone knew that it was the CJ’s Son.
