International Inquiry: Putting The Cartwright Before The Horse

By Dayan Jayatilleka –

Dr. Dayan Jayatilleka

Dr. Dayan Jayatilleka

In her farewell address to the UNHRC, Madam Navi Pillay drew attention to the need for healing the wounds of Sri Lanka’s civil war, which she rightly noted, had yet to be done. To this intent and purpose she commended cooperation by the Government of Sri Lanka with the comprehensive international inquiry that her office has undertaken. What is bitterly ironic is that the healing of wounds cannot take place by means of a lacerating external inquiry or even an overly extensive and premature internal one. The international inquiry will do just the opposite of assisting any process of healing. It will generate resentment and hatred among the overwhelming majority of the people of Sri Lanka.

The appointment of Dame Sylvia Cartwright, former attorney general of New Zealand as head of the international inquiry into Sri Lanka, is hardly likely to have a positive resonance on the island. Her most positive and notable achievement is the best evidence of what is wrong with the international inquiry into Sri Lanka. She was a member of the UN hearing into war crimes in Kampuchea.  That inquiry stands in complete contrast to the proposed inquiry into Sri Lanka.

The Kampuchea inquiry was into war crimes committed by the militarily defeated Khmer Rouge. It was instituted decades after the episodes being inquired into (during which I was an undergraduate who published a series in the Lanka Guardian analyzing and denouncing Pol Pot). It was a joint tribunal, established with the blessings of the Kampuchean government.

Obviously if the international inquiry into Sri Lanka were about the war crimes of the defeated Tamil Tigers, the Sri Lankan government would have welcomed and facilitated it. If the Sri Lanka inquiry such as it is presently crafted, were to take place a few decades down the road, perhaps a different Sri Lankan administration in a different Sri Lanka would cooperate with it having significantly modified its terms of reference. Decades down the road, there could even be a joint commission of inquiry.

Those are not the contours of the international inquiry into Sri Lanka which Dame Cartwright will head. Thus the dynamics and outcome will be different, as will the response of Sri Lankan public opinion and any elected administration (or political party which is strategically serious about being elected to office).

While the Sri Lankan government cannot be faulted for refusal to cooperate with the international inquiry, it can and must be condemned on several other counts.

Firstly, the dismantling of the successful defence of Sri Lanka in Geneva from precisely such a war crimes inquiry five years ago. (In that sense, the ‘regime change’ strategy of which the international inquiry is one axis of advance was possible because of the ‘regime change’ that the Sri Lankan ruling elite implemented in our defences in Geneva after and despite our UNHRC victory of May 2009.)

Secondly, the Government missed the chances provided by the defeat of the LTTE and later by its own commendable and historic move of holding the Northern Provincial election, to strike a deal with the moderate Tamil nationalists by implementing the 13th amendment.

Thirdly the Government has just dropped a vital catch by failing to pivot to Delhi under the Modi administration, which is turn requires the implementation of the 13th amendment and negotiating improvements on the basis of renegotiating the concurrent list.

These blunders stem from three flaws or blind spots: (i) A chronic inability to calculate the balance of forces, including, most obviously, the military balance of power: how else could anyone think to resist the West propelled war crimes inquiry without India’s active support and worse still, to fight the West and India at the same time? (ii) An inability to read a world map: how else to explain the confidence that China could be or would consent to be anything more than a limited counterweight for an island on India’s doorstep? With the best will in the world, how could China and Pakistan protect Sri Lanka and how could Sri Lanka protect itself? (iii) Amnesia: the lessons unlearnt from 1987.

Thus the Sri Lankan Government has as a foreign policy posture, the stance of an ostrich: head buried in the sand.

In domestic terms of course, the President has displayed his usual tactical skill. By tossing the ball of whether or not to cooperate with the international inquiry to Parliament, he is expecting the Opposition to hang itself electorally, which it is quite likely to.

The first effects of the international pressure are already visible. Any student of history would know that it was the encirclement and isolation of Russia, the impact or perception of siege upon and in a peasant/provincial society that resulted in the rise of Stalinism at the expense of other options. A repetition of sorts has taken place with the return of President Putin. The worst decades of the blockade of Cuba hardly led to the strengthening of moderates or moderation, but rather to a greater radicalism. In Sri Lanka this would not be sustainable, but a Sinhala-Buddhist strongman is already on the rise and will be strengthened by the external pressure. From being the ‘power behind the throne’ at present, he will be ‘the power beside the throne’ in the upcoming administration and finally ‘the power upon the throne’. That will be the final turn of the screw of Sinhala Buddhist domination. That period will be short, but going by the evidence so far, it will also be nasty and brutish while it lasts.

      Native,

It is because of hordes of unethical Sinhalese intellectuals like Dayan that the Sri Lankan state and its armed forces continue with their impunity.

None of these ‘intellectuals’ protested seriously against the Sri Lankan state killing tens of thousands of Sinhala youth merely for the suspicion of being JVP members, and killing of hundreds of thousands of innocent Tamils during the 30 year war.

Dayan doesn’t care whatever goes on in the name of government these days. All he cares is to save them from punishment.

DJ, who plays many roles under the Rajapakses, is always careful to insist the time he was heading our Geneva team was the best and everyone else wrong. To him the only wise 3 are he, Rajiva W and Tamara K. Why doesn’t he gather up his wisdom and advise the Royal Brothers to throw the question of whether to allow the UN team or not to the PSC. That way, like his conundrum with the TNA and the Tamil question, he can wisely say it is now the PSC’s baby. He can keep away the Saffron anger, the prejudice of the Sinhala extremists like Weerawansa, Ranawake and the lot. To complete the plot he might get that impish Nimal Siripala and the garrulous Keheliya, Goebellesian style, to make the untruth the truth. Medamulana village crafty wisdom, say what!

        I agree with you AVB

A husband brutally kills his wife and the husband is due to undergo murder trial. If this stupid Dayan is their neighbour, he would write to the crown prosecuting dept and complain that the above murder trial would split the family and there will not be any reconciliation.

Why didn’t you stupid Dayan use the same yardstick to prabaharan. You could have overlooked all his wrong doing and made peace with him. Why are Dayan writing like a complete nutter?

Sinhalese have a deceiving gene in them for centuries. This is how the SL politicians wasted 60 years only promising. Sri Lankan foreign policy was to deceive India and the IC. MR managed it well for the last five years. Mahinda wasted the last 5 years promising 13+ but delivering nothing. The funny thing is they will promise anyone including the world leaders and then they will blame the Buddhist monks, the Sinhala-Buddhist racists, the opposition, the Tamils and the list goes on. Now they are on borrowed time, can they still continue to deceive India and the IC?

You can fool someone sometime but not everyone every time!

MR should realize that Modi is not Manmohan, deliver what you promised 5 years ago or face the consequences.

        Dayan Says,
“From being the ‘power behind the throne’ at present, he will be ‘the power beside the throne’ in the upcoming administration and finally ‘the power upon the throne’. That will be the final turn of the screw of Sinhala Buddhist domination. That period will be short, but going by the evidence so far, it will also be nasty and brutish while it lasts.”

        This is absolutely hilarious!

Dayan is trying the Dr. Mervin Silva approach, like a village thug. This kind of empty threats are very common among the Sinhala Modayas after ’83. The Tamils are still looking forward to it.
The Tamils in SL have already faced the nasty and brutish Sinhala Buddhist domination for the last 60 odd years whether it was the power behind, beside or upon the throne. What more can happen when India and the IC are closely watching unlike in the past when it was either a domestic issue or a terrorist issue?

Wonder how this fellow got his doctorate, the attitude is very similar to an illiterate village thug.

No all sinhalese have the mentioned gene. But you are right some have that. They are the ones who support thugs.
You know birds of a feather flock together.
MR and DJ are not apart from their thoughts. There you need to care about how he has obtained his doctorate. Anyway regardless being Sinhalese, tamils or muslims who support MARA have same thuggish mentality. See how that bone licking AZWER reacts in the parliament to protect the UPFA. He has no that courage to shine a light at the time muslims were attacked by abusive GOTA backed BBS. At the time Rizana the poor girl got beheaded the bugger behaved as a dog that hide its tail.

Had UN or any other bodies were straightforward, wholehearted, they would not have gone this far. Today, the lack of UN or other bodies prompt actions as it should have been – caused taken all harm to people that I think could have protected their lives.

Sri Lankan regime treated the LLRC recommendations shabbily and now has to face the International Investigation.

Similarly if they fail to grant the 13th Powers in full to the Tamils, then even that option will be off the table. Either an Indian invasion of NE Sri Lanka or a referendum for Eelam will become inevitable.

I would have thought a man of your calibre would assert that international inquiries in uncovering warcrimes should be timely and targeted. This is so the culprits are held to account; the prime thrust of such a move to send a message that such atrocities will not go unnoticed. What is the point of having an inquiry 2 decades after the events? Why waste money and effort after 2 decades? The majority does not know what really went on; all they had been told as to how bad the LTTE was. An international inquiry with a clear remit should establish warcrimes and crimes against humanity committed by both sides. Such an inquiry should establish the Truth and nothing but the Truth. A meaningful reconciliation can only begin on this platform. You, the scholar of political science, cannot hide behind the Sinhala ethnicity and utter biased prates! It is about time you have a good look at yourself!

don’t you know DJ is MR’s unofficial mouth piece ( Modawansa is the official mouth piece), hence he has to perform his duties whichever way he can , pl note that DJ has been exposed and no body really takes him seriously , in other words he is in the same boat as his sole mate Dr Mervin silva !

        1

Yes, DJ is the unofficial mouth piece of MR – earlier in late 80ties DJ both ends were used for Premadasa regime by which over 50k lanken youth were taken. Now the man with hands on tactics collected are connected with MR. MR and RP (R Premadasa) are almost like identical twins by their performances. Recalling my thoughts then, I still remember the utterly foolish words that stupid premadasa added to BBC broadcast after Wijeweera was murdered ” They the rebells killed thousands of innocient youth, so we also killed them”. More or less it was blunt the way stupid Premadasa responded to BBC interviewer. This reechoed my ears even today. I lost my bathcas – that went to thousands – even today, while living on the west, I have no idea many of them at Pera University that were known me are in life or not. One saddest incident of a father whose son – my school mate (school bus mate) final year medical student (Kumara) had been abducted by the unidentified men – he never had the chance to return home. His father became life long sick turning his a mad character. That is one of the thosands incidents.

I think it is high time you to study the phrase “man of your calibre” going through all the recent DJ articles published on alone CT. One behind the other his sounded as if he is appointed to defend MR or his regime or both from being fallen that deep. Latter should have become clear to many that used the brain but some who think DJ is one who is said to be one of our senior diplomats who even defended the nation on International podium in 2009, will become in the days to come that this creature has been made cheap for some reasons- for some unexplainable reasons to hang on to MR.
What qualities MR has shown along since the war is no longer there is good enough DJ to draw in his horns atleast now. Anyway, wait as see how many more weeks months DJ would go on with his usual mission ?????

      Burning-Issue:

Well said. I think most of us are on this page. Let there be an internationally sanctioned independent investigation on both parties. At least after that everyone can move on. Of course, dragging this for another 30 years in the SL language is to consign it to the dustbin – completely forgotten. And yes, this should be a lesson that other regimes should get the message – that there will be a price for throwing caution to the wind. Everyone should read what Bianca Jagger has written about the atrocities committed by this regime. She writes thus:

“I have campaigned for human rights, social justice and environmental protection for over 30 years. I have met many victims of sexual violence, from Bosnia to Guatemala.I was very shaken by the brutal accounts of sexual violence in Sri Lanka. Rape is systematic and widespread against both men and women. Horrific crimes are being
committed with total impunity by police and armed forces” BIANCA JAGGER

Let Dayan and this regime be clear of this. Jayalalitha is not angry because she has an axe to grind against the regime. The atrocities, and particularly the sexual crimes and violence committed are so severe and serious that Dayan and the regime should drive bullets through their head, if at all they could even feel the remotest understanding of such grave and horrible deeds. The Tamils must now work towards naming and shaming the form and type of Buddhism that allowed this to happen. Sri Lanka is not a Buddhist country. It is a country that has the Buddha into a devil. Cart before the horse it seem. What a bullshit. Utter disgrace.

DJ again all over the place in his recommendations.

“requires the implementation of the 13th amendment and negotiating improvements on the basis of renegotiating the concurrent list” – in the past DJ had rejected anything beyond 13A – now all of a sudden it needs to be done. I suppose he didn’t expect world (indian) opinion to demand it eh?

The rest is the usual rejection of international intervention of any sort – but he still fails to explain a credible route for domestic reform .. perhaps a future paper? In any case the only party he commends the govt for allowing the vote on the NPC (if one needs to be commended for doing whats right .. but apparently so in sri lanka), ignoring the fact that there was huge international pressure to do so, including the rights to hold the commonwealth summit.

And the sting in the tail .. international intervention will aid a ‘brutish period of sinhala buddhist domination’ .. which would be unusual, because the rest of sri lankan history has been so very non-brutish .. yes that makes sense?? Just all over the place with a tinge of threatening malevolence.

DJ is to interested in the implementation of certain acts that are overdue and cooperation with Indian government with a view of canvassing support to avert UN sponsored investigation of alleged car crimes and violations of human rights committed by both parties. He also boasts unashamedly as repeated elsewhere his misdeeds of praising genocide of Tamils in the UN resolution dated May 2009.

Reconciliation will only stem when the parties committed atrocities are made to be aware of such horrors and repent over them. Supporters of the LTTE and the Sri Lankan government are in denial of the alleged crimes. Only an international and impartial investigation can bring the truth out. Then only they and the friends who support the present rulers will realise that protecting the wrong doers will only encourage them to continue on the dangerous path.

Don’t keep saying “Sri Lankan public opinion”, say Sinhalese public opinion!

Tamils don’t agree with your opinion, but they don’t count to you do they?

    • 8
      1

It is not Sinhala or Sinhala-Buddhist opinion. It is the opinion of a select few peddled as various forms of public opinion to suit their objectives and motives. The Sinhalese are maligned as much as the Tamils and Muslims are because of the ‘Public Opinion’Games such persons play. They create a myth of the so-called public opinion, whilst at times they assiduously cultivate it.

      • 1

The exchange between Thiru and Dr. RN, for the moment at least, is proof that, emotionally, both Sinhala and Tamil (NEP) peoples
now think of each other as different Nations within the island – as was the norm and reality before the arrival of the first colonialists in 1505. Govts from 1970 up to now had ample opportunities to close ranks between the 2 major communities and provide the necessary logistics for tangible reconciliation. But no. The Sinhala Govts, forming 75% of the electorate, were far more concerned with holding to their positions and power at the expense of the unity of a visibly and fastly dividing land. Both the SLFP and UNP Coalition Govts of the time were busy building nests for their children and relatives to enjoy the loot in huge Contracts and the like. The net result is now they do not have a stable country to benefit from their loot. The Chinese factor makes the scenario more complicated and exposes the country to conflict from outside powers to proportions hitherto unknown.

The Rajapakses are preoccupied with their fear of what Modi and JJ will do. The regime failed to utilise the grand opening provided by the change of guard in Delhi. Now relations between the two countries is complicated – as the State-inspired and provocative demos outside the Indian High Commission in Colombo last week suggests. Worse is the simultaneous threat to the regime from the possible actions of the UNHCR that can include travel bans, freezing of surreptitious foreign bank accounts and exposure of hidden overseas loot. That state of anxiety and desperation explains the irrational behaviour and action from the main players in the regime. Closing ranks within and promoting the more ambitious brother in the family are all aimed to make it an oligarchy with an obliging and servile armed services support to keep the project going at least for the next decade and a half. That form of bribery in the far too many appointments of armed forces officers to plum diplomatic and other positions in the square peg in round holes tradition is clear indication the regime fears a backlash and expects the rogue elements within the uniformed community to keep them afloat. The initial signs of collapse are the frequent strikes and demos of Sinhala University students. Even the dormant UNP under its pusillanimous and divided leadership re-discovers its backbone.

The people of Sri Lanka have no cause for joy in the present and immediate future. As Dickens was to note “it is the best of times” for a few favoured and “worst of times” for the vast majority. It did not last in France then, the Phillipines or even as recent as last month, in India.

      Thiru,

Please note that his is not the actual Sinhala public opinion, but a few left wing, facist, extremist Sinhala mind set.

If you read many comments here from Sinhala readers, many disagree with Dr.Dayan’s writings simply because his theories are age old, unrealistic and not practicle.

Please read more of Ms.Tisaranee Gunasekara’s articles which are more current, practicle, balanced and realistic.

There are only two types of Sinhalese. They are those who are down to earth, practicle, open minded and adjust to current day situations and those others who are closed, blind, rigid, arrogant and live in a vacuum.

Therefore all Sinhalese are not the same.

“The appointment of Dame Sylvia Cartwright, former attorney general of New Zealand as head of the international inquiry into Sri Lanka, is hardly likely to have a positive resonance……… That inquiry stands in complete contrast to the proposed inquiry into Sri Lanka.”
If you say Punk Mohan Pieris was selected for this job, then we know the obvious results, because other than being a punk to his master and washing laundry he has no other credibility. Sylvia is just clean opposite of that humbug and most important a woman with a clear conscience.
“Obviously if the international inquiry into Sri Lanka were about the war crimes of the defeated Tamil Tigers, the Sri Lankan government would have welcomed and facilitated it”
Now you are a typical Sinhalese punk who does not want to smell the shit of what his people did but the shit what the LTTE did. This inquiry is not only investigating war crimes by GOSL, but also the criminal acts of LTTE. Obviously as a Sinhalese you would be worried about the high extent of crimes that will become public that were committed by the Sinhalese and specifically by the Sinhalese government on their own minority Tamil citizens that could amount to genocide. The Sinhalese public opinion will always remain the same because of the obvious shame when everything becomes public. Don’t blame the poor diplomacy and foreign policy of Sri Lanka, because you were also part of that. A lawyer can manipulate evidence and protect the criminal acts of his client only up to a certain extent, only until the evidence becomes too obvious. In the case of Sri Lanka, the State Criminality and evidence is surmounting to the extent where the IC privately recognized officials of this regime as fellows without a morsel of respect, honor or conscience or simply said a pack of punks.

    Is Srilnka a Kapuchia?.

Has Modi signed off on Ms Pillai.s Hanging Judge and her Posse?

If they at least mange to get USD 30 Visas, who is going to provide Escorts and Bodyguards, when these are the people the Hanging Judge is coming to hunt and hurt for killing Ms Pillai’s pet Prabakaran.

According to out real Elite rag Daily News, 150 Fund Managers who look after Pommy Pensions attended the LSX and CSX joint seminar in London.

They are keen as mustard to get into the top Ten companies in Colombo.

Are they going to do their Pension members’ hard earned Dough when Ms Pillai sends the Blue Berets to fight our BBS , RBV and even patriotic Muslim brothers.

Dr Dayan never focus on mundane things like investment, standard of living, development and economic welfare of our inhabitants.

He perhaps thinks all inhabitants are on par with his Elite mates when it comes Economics?

    Oh just one more thing….

Norwegian Sol recently said that he is going to tell all in his soon to be released book on LTTE and the Srilnkan Govt.

Being the mentor and adviser to Prabakaran for decades, and even receiving the last known communication from Praba and his Police chief and been in touch with them right through the final battle, who would know better than Sol if the Srilanka forces did bad things.

Will the Hanging Judge take evidence from Sol first, which will negate her need to beg our bad Sinhala Buddhists for Visas and Protection.

Dayan, your snide remarks “Cartwright before horse”etc are just puerile for a man of your standing. I thought that G.L.Peiris, Ariyasinghe and Kehelmala were hollering that the government will not under any circumstances entertain any members of the UNHRC inquiry panel to enter Sri Lanka. How come they now want the Parliaments rubber stamp approval to hoodwink the world.Iam sorry that of late the political scenarios that you spin to get into the good books of the Maharaja is in vain, as most thinking people see that you are nothing but an unprincipled slipper sucker of MR and waiting for him to handover another diplomatic posting, or some such crumb.

It will take decades to change his glasses.

This man has become a joker not second to Mervin the doggy man who abused people on day light in order to paint a better image for Rajano.
Now though for some reasons, Mervin – toilett mouth has been made silent while Azwer has taken over the place. Over and over this could go until MR administration feels that they are the ones to govern this nation.

Sitting on the wrong side, DJ has been doing an exemplary task paving the way more people to easy become criminal friendly MR supporters. Entire srilanken history, we have not experienced this kind of tactics.

Having gone through almost all your article in last 15 months, I sense you always parrot few things repeatedly

    1) How your mission achieved its success in 2009 and how later MR played spoilsports in your absence
    2) Failure to implement 13A in time accelarated war crime enquiry ( Seriously you think IC is of such fools)
3)UN and world is revolving on India ( My foot! Though I am Indian, your conception is far fetched, India does not even control 1% of the economy of the world when its population is whopping 17% of the world population)
    4) Occasionaly you throw mud at TN,Tamil People, warn TNA and its collision course

Have some creative analytical skills to write something meaningful, else restric yourself to commentary section.

      Manisekaran ,

Go through DJ’s earlier articles , you will notice how naive/stupid this self proclaimed “Political scientist” is , he was the of the view that without India’s support UNHRC can’t/won’t achieve any thing meaningful against SL regime , DJ was proven wrong this time round at the UNHRC and after that debacle he tries to ignore his blunders like as if nothing has happened, there was an early release of the UNHRC resolution against The regime run up to the Mrach session , highly educated , well experienced political scientist DJ got all mixed up of the earlier version of the UNHRC written document and jumped the gun , saying there was no mention of International investigation , at both occasions i started laughing at this veteran diplomut/political scientist’s intercultural capacity , Mani take it from me , there are enough votes to pass any resolution against the regime in 2015 , there will be 14 new member countries joining in as replacements in November and majority of them not going to vote for the regime !this regime has put all the srilankan people in a very awkward/hapless situation where ordinary people going to suffer in the foreseeable future.

“The appointment of Dame Sylvia Cartwright…. She was a member of the UN hearing into war crimes in Kampuchea. That inquiry stands in complete contrast to the proposed inquiry into Sri Lanka”. This is precisely why she would be most useful at the inquiry. The fact that the Sri Lankan presidential system is a joke is revealed in the fact that Rajapaksa is confident that the parliament will endorse his wish in regard to cooperating with the inquiry having made a statement to this effect. DJ may have won his turn in Geneva and lost the War on protecting the Nation on an international inquiry.

In an era where the belief in the Occult is at it’s Zenith, The last paragraph is telling. We are heading towards a Kampuchia. This is our fate, we wanted it, we get it.

As in Kampuchia many will perish. We will then plead for someone to ” Please Help “. After the mayhem and then the help, the Tamil Nation will emerge. The Kandyan Nation, can live under the loving jackboot of the South.

The Nation will revert to it’s historical roots, For this we can only blame ourselves.

imagine the war was not brought to an end in 2009 and ltte’s criminal killing maschine is still busy with suicide bombings, destroying airports, trains, central banks and anyone they did not agree with. No we do not want that and we happy to pay any price to achieve it.

Not sure Dayan, if you remember that chappie who dug that deep hole in Geneva for the Ostrich to bury its head in. I guess that chappie did not expect the entire ostrich family to stick their heads in and expose that fat rear to the world as they have done now – representing the Sinhala Buddhist.

Thanks to your good efforts they are securely plugged in now. The vast majority now have to await the “nasty and brutish” period, till they learn what the Tamils learn t at terrific life loss – that it is not a good idea to stick ones back side at the world – because it exposes to the world a more realistic view of themselves -which they themselves may not be aware of.

Anyway, thanks to that chappie who dug that big hole in Geneva.

Just as much 30% of the Sri Lankan citizenry will celebrate and support a foreign invasion of Sri Lanka, 99% will enjoy and light fire crackers if one day they hear you have killed yourself.

What is perplexing is why is the President referring the matter of an investigation to the Parliament if he has already rejected the investigation? He knows what the Parliament will decide since has a two third majority. What he is trying to do is to put the opposition on a spot. The opposition should abstain otherwise they will be a party for non investigation.

The proposed inquiry too, will be about the ‘militarily deafeated’ LTTE, like in Kampuchea – and,how the victorious sri Lankan military machine won the war.
Who is the “Sinhala-Buddhist strongman” on the rise and about to end up as ‘power upon the throne’?

  • 9

The comment of DJ – “What is bitterly ironic is that the healing of wounds cannot take place by means of a lacerating external inquiry or even an overly extensive and premature internal one”, is shocking.

DJ, first of all why is there an external inquiry? The external inquiry is there because the regime has not given a viable solution to the minority issues in Sri Lanka and has not even implemented the LLRC recommendations. Even after five years the minority issues have not reduced, in fact it has gathered momentum. Now the present issues are not only Tamil – Sinhalese issue as the Government wants to portrait (or LTTE issue), its a Hindu, Muslim, Christian and Buddhist issue as well. Further minority issues within the same group such as the Uni student issues, Rathupaswala issue etc., are getting added on. Day by day rule of law in the country is fading away, example impeachment of the Chief Justice, killing of prisoners in police custody, road accidents of those who are opposing the regime, MPs attacking police and civilians etc.. so why should there be no external inquiry as the internal forces cannot do anything without getting killed or harmed.

Why is it overly extensive? You should not make comments without telling the reasons why you call it overly extensive. It is not. Do you mean investigating LTTE actions is overly extensive?

Premature, why premature? Five years have passed and still no solution has been provided by the Government. Even their own LLRC recommendations have not been implemented. You lied at the UN and what you told the whole world has not been implemented even today. When LTTE was destroyed all of us were happy and we thought the President will provide an equitable solution to all parties. It never happened. All that happened was the President and his brothers have become dictators. Even you got kicked out. Although you keep on telling us you were able to defend Sri Lanka with your opposition at UN, the fact of the matter is that you “LIED”.

Why do you call the inquiry an inquiry of Sri Lanka. It is not, the inquiry is to find the facts and bring those who have committed illegal activities during the war. Let it be LTTE or the armed forces, if they have committed a crime they have to pay for it. Today both the living LTTE leaders and those who committed crime during the war from the Armed forces and ministry of defence are on the same side. Even here it is only the Rajapakse brothers, KP, Pillayan, Karuna and the armed forces guys who are now diplomats who will get into trouble. Why do you twist this to be an inquiry against Sri Lanka or Sri Lankan civilians. The inquiry is against specific individuals who have committed human rights violations.

So DJ be honest to yourself first. At least now tell the truth.

      Park,

      I totally agree with you.

Dr.Dayan’s duplicity will allow MR to do more heinous crimes in Sri Lanka.

What is Dr.Dayan’s opinion on the Murder of Lasantha Wickrematunge whose perpetrators are still languishing freely and stay scot free.

What is Dr.Dayan’s opinion of Jailing Gen.SF simply because he crossed MR red line when he challenged Pres.Rajapakse in 2010 Presidential elections.

What is Dr.Dayan’s opinion on the impeachment on CJ Shirani Bandaranayake and the PSC kangaroo court process on false charges.

What is Dr.Dayans opinion on BBS Gnanasara acting like a thug with presidential immunity.

What made Fredrica Jansz and hundreds of other Journalists to flee Sri Lanka and now exciled abroad after breaking away from their families unable to visit them. For how long……

What is Dr.Dayan’s opinion of Thousands of Tamil refugees exciled in Abroad and feared and unable to visit their relatives in Sri Lanka fearing of false prosecution and imprisonment.

I could write over 100 pages, but Dr. Dayan please be honest and be realistic in your views when writing.

Yes we CT readers ate Milk rice and lit fire crackers celebrating war victory. We supported GOSL and the to the war wounded soldiers by donating our blood.

But soon we saw MR’s duplicity when he jailed our war hero Gen.Sarath Fonseka and impeached CJ Dr.Shirani Bandaranayake when we saw his true being. We are still waiting for justice for every citizen who were been prosecuted and punished for no apparent reason and that’s what UNHRC is doing now.

Infact you should praise UNHRC and should support and be thankful to them for their good and painstaking work.

With this type of mind set, will the UN ever recruit you one day if the need arise is the million dollar question.

We don’t care what happened in Iraq, Afganistan or Sudan. But we care only about Sri Lanka.Others are their business and they will be judge one day.

Please unmask yourself and look at the true picture.

Don’t allow Sri Lanka to fall further into another Pariah, racist, fanatic and a dictatorial banana republic thieves den.

DJ has conveniently forgotten/amnesic to the fact that , it was MR who went to UNHCR after JVP massacre asking for inquiry.

It was MR who went to around the world promising to India and UN Chief that he would go beyond 13A after the war is over.

Now the same MR with his Brother facing the music from the UNHCR,USA,UK,India etc for not keeping his words.

Cann’t expect the world to be silent when you dont’t deliver what you promise and carry out heinous crimes in the name of war against terrorism.

In fact this is what subsequent Sinhala majority governments did to agreements with Tamil leaders and India as well.

Be it BANDA-Chelva, Senanayake-Chelva, India- Lanka etc.

Only one thing is certain with these Sinhala nationalist governments/Leaders in what ever shade they are, they will break any agreements no matter who signs them.No matter what the cost is.

They are no different to Nazis(Hitler/Musiloni),Polpot, Radavan Karadich ,Sadam Hussein,Gadaffi,Osama Bin Laden Etc.

Now that they have shown there true face,

The world need to unite to isolate/eliminate these despicable Family breed.

I think you are confusing Niranjan with his brother Nirmalan who commented above. The former’s articles, while critical of Tamil nationalism, show more sensitivity to the loss of innocent Tamil lives in the war, and even made fun of DJ in some satirical pieces.

Nirmalan on the other hand has confessed in CT earlier that he was one of the very few SL Tamils who thought the murders of thousands of innocent Tamil civilians in the Vanni would be an acceptable price to pay for defeating the LTTE, and he supported the pro-SL military functions (fundraising drive?) in the UK.

In other words, he thought that some elected officials and their supporters could play “God” by choosing which other innocent citizens should live and who should die. But here he hopes and “prays” that there is no “dismemberment” of SL. Who would have thought that some medical doctors could be so utterly irrational and idiotic. Is it a surprise that such people find an idiot like DJ to be persuasive?

Surprise to hear Dr.Dayan still talking about Buddhist Sinhala hegemony to prevail, after the same racism that caused slaughter over 300,000 inhibitants and wounded over 100,000 during the 30 year nasty war.

First he says about “Amnesia: the lessons unlearnt from 1987″……. and then at the last sentence he says… “‘the power upon the throne’. That will be the final turn of the screw of Sinhala Buddhist domination. That period will be short, but going by the evidence so far, it will also be nasty and brutish while it lasts.

I wonder whom Dr.Dayan trying to fool saying Power upon the throne by Sinhala Buddhist domination. Is it similar to the Wimal’s Thummulla Lemon puff drama. Yes this could happen ony in a divided Sri Lanka after given powers to North, and not before it.

Dr.Dayan should be made to understand that Both Pres.Rajapakse and his Sinhala Buddhist racist thugs are already been checkmated by both India and the International community. Any small spark of a communal riot or uprising could lead to both Indian and International intervention on Sri Lanka. There won’t be anymore 1987 Indian “Parippu” dhal drop this time, but physical foreign troops in Sri Lanka soil like Crimea or Afganistan.

I wonder how Dr.Dayan is unaware of this when Pres.Rajapakse himself is aware of consequences of any mis calculations this time.
What can 25,000 yellow robe racist fanatic Buddhist monks along with another 200,000 thugs can do in front of 60 Million Tamil Nadus across Palk straight and another 200 Million supporters across the world to back them watcing every move.

Hope Dr.Dayan could remember what British PM David Cameron said during CHOGM and just after four months UNHRC passed resolution against Sri Lanka.
Who threw stones at Glass House and who got hurt. Who ate “Parippu”. Dr.Dayan has to be more realistic when writing his thesis.

Also Dr Dayan says about…. (during which I was an undergraduate who published a series in the Lanka Guardian analyzing and denouncing Pol Pot). Pol Pot is history now and the world has learnt much lessons through it. Now it is a new world order with geo politics leading the world and Internet is directing and sending Messages across the world in miliseconds and drones are leading the sky. Therefore there’s no parity between Pol Pot history and current day Sri Lankan issue.

President Rajapakses current crucial challanges are not the Tamil issue, but the economy and uprising from the majority Sinhala community. Constant riots, Trade unions, mothers, children’s issues, employment and cost of living issues have taken priority today.

Both India and the UNHRC and West will take care if anymore uprisings against Tamil and minority communities take place this time. There won’t be anymore 1983 like progroms in Sri Lanka due to watchful eyes of the International community.

Both our close allies, China and Pakistan are been closely monitored by the West. Burning Jayalalitha cardboard cutouts in front of Indian High Commission will not influence anybody, similar to Weerawanse’s Lemon puff eating fast unto death joke, but only true reconciliation, retribution and distribution of central powers to North will heal the wounds.Trust, patience and tolerance among all communities has to be built if Sri Lankan politicians intend to survive as a one nation.

Finally the Tamil issue could finally resolve with a Federal States like governing with more powers given to regions if GOSL hopes to survive as a one nation.

Hope Dr.Dayan will agree to my comment.

    Dayan,

Man you know I was wrong about Geneva process, originally I thought this is regime change but now I have figured it out.

so you know, this is just repeat of Gautamala. You already have the guy in very old age basically being taken down.

Essentially there is an effort by the USA rather then to try a coup which already failed, and then color revolution whatever in elections already failed, USA is trying to blackmail the President into towing their line. Basically Geneva has become into this in my opinion. So basically down the road in decades as you so rightly identify in Cambodia this guy will get problems if he does not abide.

So you know I already know President in Colombo how he will react to this. He will just get mad, already since time of France and UK coming to Colombo in 2009 he doesn’t like US led block. So whatevr. This is just blackmail. I think the alternative for him is to stay in power until he dies, which is seemingly in the cards.

The proposed inquiry will be into crimes committed by BOTH sides unlike in Kampuchea where only one side of the crimes were investigated. Isn’t that more fair? Of course the LTTE is dead except for its ex remnants such as K. P and Karuna who have to answer a lot of questions!

What an uplifting series of comments. So much can be learned from the article and the messages.

DJ, though intelligent and knowledgeable, has lost the value base – overtly ethnic/communalistic and protective of the power/elite who terribly erred. In some sense sad, but also hilarious, that once he lost his value base, his writings appear so shallow, and could be effectively and intelligently countered in numerous ways. The responses from the readers, from all the ethnic communities, are so powerful and convincing, that DJ truly appears as a third rate, simpleton analyst/writer.

During the peak of the LTTE period, the same phenomenon was seen with many Tamil intellectuals. Normally intelligent and rational people, when compelled to defend the un-defendable,came out silly, and several of them permanently damaged their reputation.

The time is right for DJ to embark on a critical and honest self analysis, and to ground him back in basic human values – decency, honesty and compassion – not just politics and power play. An inglorious conclusion for a man, who is intelligent and knowledgeable, and also had a colorful past, is sad and wasteful.

“UNP Colombo MP Wijedasa already said “Yes”..

It is soon after the LTTE proxy TNA Colombo MP Abraham said, “Ms Pillayi must come and get the Army War Criminals”.

Do the TNA and the UNP Christian Faction know what Ms Pillai’s intended targets are?

Has it got something to do with the Christian Faction Leader Ranil’s month long stint in Massachusetts, learning how to give good Governance to poor Sinhala rural Buddhists?.

And Madam Ambassador , Miss Sisson’s long sessions with Sambandan and Sumanthiran in Colombo?.
