Jaffna Judge Says President Must Ensure Judicial Independence If Trials Are To Be Free And Fair

The rape and murder trial of Sivaloganathan Vidya took a new turn today when a judge hearing the case at the Jaffna High Court came under gun fire by an unidentified man this evening. Soon after the shooting, the judge, Manakkawasagar Illancheliyan who was unharmed called on President Maithripala Sirisena, Defence Minister and Justice Minister to ensure that the independence of the country’s judiciary is safeguarded, if trials are to be free and fair.

Speaking to the media soon after the incident, Illancheliyan, who is a member of the trial-at-bar that is hearing the rape and murder case of Vidya said, “I request the President, Defence Minister, Justice Minister, the Chief Justice and the Secretary of the Judiciary Service Commission to take this incident very seriously and take steps to safeguard the independence of the judiciary and protect the judges which will ensure a free and fair trial”.

Illancheliyan explained that it was obvious that he was the target in the shooting, although he was unhurt, when the unidentified gunman opened fire towards him and his police bodyguards. One police officer sustained injuries and was admitted to hospital. The incident occurred today evening around 5.30 pm near the Nallur Kovil in Jaffna, which was a regular route taken by the judge.

Illancheliyan also said that, “this is a real threat to the judges and the judiciary. I am handling one of the most dangerous cases in Jaffna and this matter should be taken in utmost seriousness by the Government of Sri Lanka.”

Incidentally the shooting also comes just days after the Criminal Investigations Department arrested Senior DIG Lalith Jayasinghe for allegedly helping a key suspect, Mahalingam Sivakumaran alias Sashikumar escape. He was however later arrested in Colombo.

Sivaloganathan Vidya was 18 years old at the time she was abducted, raped and murdered by a gang in May 2015. The rape and murder trial of Vidya began on June 28, 2017 before a three member bench at the Jaffna High Court. The three member bench comprised of Balendran Shashimahendran, Annalingam Premshankar and Manakkawasagar Illancheliyan. A total of nine suspects who were arrested in connection to the case have been served indictments on 41 criminal charges including abduction, gang rape and murder. (By Munza Mushtaq)

      Our country is still not safe!! a large criminal network is still active and is desperately trying to protect itself.

      This is part of the Mahinda Rajapaksa criminal network and is going to take our country down a road that leads to international intervention. At that point we as a nation will lose whatever say we have when it comes to our self determination as a nation. We have to expose this criminal network and punish them before they destroy our beautiful nation.

      Our government has to stop trying to protect them if we are to get out of the mess we have created for ourselves.

      Speed up all the investigations and punish the criminals send them to Hague if we must.

      We need to get INTERPOL involved before it is too late.

      Gunman was shot to death. Gunman was the SI, the Bodyguard. The arrested ones are gal_men, or Toddy Men, who were, as per police, drank with the the assassin. I thought Yahapalanaya police had to pay for only to one, the shooter, but it seems they have paid for another two, to drink toddy with the man they arranged.

      You know, this why they call LTTE. “Matakkaal iruddaanaalum Manthi koppilakka paayaathu”. (Even if it’s pitch black dark, the monkey doesn’t miss the branches on its leaps) This guy was rehabilitated and had lost his practice. He had been drinking with another two until he and his clique was noted and reported to police. SI was riding the Motor bike. This stopped the bike; robbed the pistol and shoot many times, in this full dope. and killed one experienced SI. Think about how he would been if he was under LTTE.

      I don’t know anything of it. But that is what the police is telling.

      What kind of shameless stories are these? 1:5 army in the North. What the those idiots are are doing? If a Tamil student is riding a bike, the sentry police is sharp-shooting without missing the target, if it is a man arranged by them, they don’t even see which way the culprits are taking off!     The judge Ilancheliyan is highly respected for his dedication to his profession, independence of the judiciary and the effect of his judgements on the social justice. His proactive action has stopped many violent gang operating in Jaffna. He also has appealed to diaspora do-gooders not to help youngsters commit motor bike related offences and accidents.

    Heavy presence of security forces and police over a long time in the peninsula has in the increase of violent crimes to an intolerable level. This may be due to the step motherly treatment of civilians or a carefully planned operation by the head of the Defence Ministry under the previous regime. Either way the government must be held responsible for the high level of crimes. The government must act fast to instil discipline in the law enforcement and judiciary.

    The assailant got so close to the security detail that he was able to take the gun of the policeman and shoot! What a grave situation. What is the point of such security detail? Worst still this attempt had taken place in a province with the highest ratio of security personnel to public, 1:10! Is this guy Swiss Kumar so powerful to have his own Junta? Or is it an inside Job?

    As per the story goes, there are two most possibilities to find armed goons in Jaffna city.
    1. There must be an organized gang of armed thugs operating in Jaffna Peninsula under the patronage of politicians -some time ago the fingers were pointed towards former minister Mr.Douglas Devananada who operated his own gangsters to commit all kind of atrocities with the blessings of Former President, Mahinda Rajapakse.Later on both fell apart.Once you patronized thugs it is difficult to liberate from your shady past.
    2.Since a DIG was involved in helping the prime accused to escape from custody ( an assumption) .Probably a handiwork of Police men to divert the attention of the judgement. On the whole government should realize to suppress the “Gooda Raj” at regional and national levels .Otherwise many undesirable out comes will dominate the democracy.

    One individual , like judge Illanchelian cannot put things right in the North. There should be a joint effort. But when there are culprits in the top , both politicians and the rich, it is rather a Herculean task to bring in reforms in the society. There is no point in blaming the army or the police.it is the politicians who have to be churned out . A complete political system has to be changed. To have judicial freedom, politicians should not intervene in cases .

    Gentlemen,
    President, Defence Minister, Justice Minister, the Chief Justice and the Secretary of the Judiciary Service Commission must demonstrate to the world if not to the Sri Lankan people, that they have courage and execute their duties and do what is right and safeguard the judiciary by protecting the judges to ensure a free and fair trial in one of the most dangerous cases that includes two senior police officers.
    This at a time when there was lot of infighting among the legislators of all shades for petty political reasons accusing the government of inaction to control crime and corruption on one hand and on the other hand accusing that the security forces including the police are being victimised accusing them of crimes committed in particular during the later stages of the war and beyond during negative years.
    These accusations are coming from aspirants from south and north regions of the country, who were dethroned by the people in 2015 and are now putting the country up for more foreign intervention and themselves betraying the very communities they claim to represent and continuing to destroy their lives and weaken the communities to the present day.
    People have the moral responsibility to think twice about others in positions of responsibility be it the religious leaders or the trade unions or any professionals, who for reasons known only to them are encouraging the activities of these dethroned aspirants. For checking and controlling the activities of these frogs in the well minded politicos, will go a long way to help President, Defence Minister, Justice Minister, the Chief Justice and the Secretary of the Judiciary Service Commission to safeguard the judiciary.
    If such activities are not curbed, it will only take the country back to violence activities and result in inviting foreign intervention. Trust our leaders at the top will react positively and act fast.

    pre emptive strikes are needed in the north ,without waiting for them to strike first.Send pest controller gota with full powers to clean up the north of all pests.Give him one year only so that he does not become a liability instead of an asset.He cleaned up the muslim underworld in colombo with dead bodies strewn all over the streets.Also start implementing the death sentence fast and git rid of the backlog in our cells because they are not sleeping inside but with mobiles conducting their normal businesses.How can you stop underworld kingpins trying to kill judges in jaffna when even the judge in colombo was killed by pottu naufer and he is still in jail conducting his usual operations.pests and vermin must be first eradicated from society completely,not just locked up.

Buddhism was brought to Srilanka by a violent criminal Vijaya and that is the cuture followed through in Sri Lanka. For your part, violence is limited 30 years but for ordinary Tamil, Sinhalese & Muslims citizen violence has a history of over six decades (60 years) and I don’t know who should take the responsibility. This is a threat to a judge. Who is responsible for the safety of judges in Srilanka?     The policeman (over 50 yrs) died last night (22nd). He had been the judge’s Chief Security Officer for 15 years. The younger policeman behind the judge who took the shot meant for the judge is OK.

    The CSO had been ahead on his motorbike and was trying to clear the way.

    The assailant was involved in the ongoing Vidya rape and murder and was out on bail. He (yet to be confirmed) was a waiter at the Lingan Ice Cream Bar, had seen the judge and used the opportunity.

    The DIG arrested for assisting Swiss Kumar escape had been an M.Sc. (Human Rights) student of Colombo Law academic Thamilmaaran. Thamilmaaran, to jog your memory, took Swiss Kumar from Kayts in the Colombo University car to Jaffna and released! In that car were Thamilmaran’s family members and a Jaffna Policeman involved in many corrupt deals.

    Judge Ilancheliyan issued a statement and granted news interviews (unusual for judges) without knowing that Colombo had already issued a statement and the two were contradictory. This is said to be creating waves.

        Normally I am not with Judge Ilancheliyan for his “Hang them high” Style. It is punishes the lower level and let the while color and planning levels to escape. Further IC may not be willing to accept it for long term strategy, as Jaffna justice system is still LTTE style. But this tough minded judge is broken a lot in this case. He choked on the first interview. After that he was too emotional in the hospital and Funeral house.

        Apparently a lot is going behind the scene of this case. UNP’s Sinhala only speaking lawyers tried to appear for Vidya family and opponents. Appe Aanduwa forced out the famous Tamil lawyer, who was appearing virtually free, from the case.

        Judge Ilancheliyan is enjoying popularity next to CV, in the North. This made New King to meet Judge Ilancheliyan in one of his Northern visits. That is only a bad omen; that is not good at all for Judge Ilancheliyan.

        There are many jobs pending in Colombo not finished.
        1. Secret solution is only stalled, not stopped. That has to be stopped without damaging Politicians or Ayatollahs’ names. So wiped out LTTE is the last report.
        2. UNHRC Resolution is delayed. Not deleted. That has to be repealed blaming Tamils for not existing violence.
        3. Army’s staying in the North has to be justified to IC.
        4. Importantly, SLFP has to go out of Yahapalanaya and join the Joint Comedy Club and Old King. Only giving a surprising jerk in North can make the normal Sinhala minds to approve the reunification of SLFP and allow it to come back to power. One can not damage the South for these purposes.

    How can I put this in my words? He was serving a patron with ice cream; Saw the parade moving on the street through the window of the Ice Cream parlor. Jumped over to the road stopped and the motor bike; grabbed the gun; shot the officer.
    Who put this murderer at Lingan and from when he was working there?

    Further it is said this guy is a former LTTEyer too. Now the police have a witness to say that this was not at Judge Illancheliyan; but a rehabilitated LTTEyer had grudges on that security officer. (An LTTEyer was hired, it seems, because they were known not to miss the target- Otherwise an ordinary paramilitary would have been enough)

    The explanation seems that past LTTEyer wanted to take up on an enemy at a time the murderer knows well that his enemy will be well armed and with colleagues, instead a time at market or somewhere else. Now, how the LTTEyer got into antagonism with a security officer instead of the other officers who arrested him and kept in jail in many other occasions? It could be because the dead officer might have been stealing the girlfriend of the former LTTEyer. We yet have to see the Appe Aanduwa’s part III of “Lies Agreed upon” to get the answers for that.

    This is much more thrilling Hollywood movie than the old one in which the police informant Gopi jumped over Jeyakumari ‘s house compound, and was hiding in Nedunkerny and at the same time a Tamil army officer who worked Gopi was accidentally shot by an unknown person. The G. L. Peries fame suicide jacket drama even cannot come near to this murder attempt of Judge Illancheliyan .

    Spin doctors of the Appe Aanduwa just write for money doesn’t care of the masters.

    None can live in North until 1:5 ratio manipulating security workers occupying the North.

    It seems “Another Tamil from the North” is supporting the theory of assassin targeted the bodyguard. The theory is proposing good place to drink milk is under the Palmyra tree: “The assassin intercepted the Judge Illenchelion’s convoy to shoot the bodyguard”.

    It seems Appe Aanduwa got its defense clue from Judge Illenchelian. He, in his interview, incidentally it was the first one published by any media before anything else on this, said that his bodyguards were virtually unknown people, so he treats it as the attempt was on him. Appe Aanduwa wants to prove that judge is lying and they were and there are reasons to target them. Shooting somebody for unknown, or yet to be concocted explanation, while he was on the duty of protecting a famous judge is only Modaya minded plan, not rehabilitated LTTEyer’s plan.

    There is another mix up in this story.

    An eye witness appeared on Tamil News is claiming that the assassin targeted another man and he had ran away. There is no reason cited by for the proposed victim not coming forward to file a case against his potential killer. They say they have arrested the assassin. But so far no word from the arrested which of the stories he would prefer most to select and continue to repeat up to the court.

    Ranil and New King have been trumpeting that they individually have to be credited for having the notorious war criminals get out of UN hook. Saving a Sinhala SDIG is very important part of their election promise. Dilrushi, the director of Bribery Commission was fired only because she was involved in investigating the patriotic war hero army for bribes.

    Another Interesting is that none of the Colombo embassies are ready to comment on this. They have been visiting Mosques to protest Gnanam, a private monk, where all SLFP-UNP governments’ shad disassociated from him. They seem to preferring Appe Aanduwa put this blame on a former LTTEyer.

    What has to done here is some learned Sinhalese has to come out and say to Appe Anduwa, “Hey , Guys this not Sumanthiran talking, this is we few Sinhalese; Murdered here is not Parah Demelo girl Vidya, it is one of our Police man Hemaratne. Come out and investigate, instead of blaming LTTE”.

    That may work, if Ranil and New King wants to come back.

    Here is a hint as to why the “mega cases” are in limbo. Judges will face threats for the rest of their lives. The easy way out is to grant bails and lift travel restrictions.
    The person who can do something here is the Justice Minister. Do you still stand by your comments (foul-mouthing?) of the United Nations Special Rapporteur Mr. Ben Emmerson?

    Here is a Tamil man (I presume the arrest is correct) wanted to shoot a Tamil judge. A Sinhala man, Sarath Hemachandra, gave his life and saved the Judge.

    Here is a great political opportunity. Not the in the way Chitanta or Yahapalanaya governments would operate. Scrupulous political leaders might have issued a statement saying “this is the way we want the country to go. Criminal cannot divide us. We are united against criminals”.

    Unfortunately the police’s statement issued suggests that every indications of Appe Aanduwa’s nose were there in that murder. The family who lost the man cannot feel proud of his service. As per police, either he was killed as by stander, or he was killed for a private quarrel. The family only can feel “are we traitors to die by the gun of an unwanted Tamils?”

    Judge Ilancheliyan visited to the house. Judge Ilancheliyan is not an ordinary judge, but the most respected Judge of North. Many Northern Tamil judges want to go there too. By these actions, the family will feel honored or feel soothed if Ranil or New King had told the truth, that “if the body of the guard was not lying in that house, it would have been the Judge’s body will be lying there”.

    Ranil or New King is not able to use this marvelous opportunity of a dedicated man having sacrificed his life to perform his duty to the fullest of his satisfaction. Their job is not honoring this real hero, but the looters of 18 billion.

    That is why they are not able to come out and tell a message to country. These are the crooks Sampanthar is pointing at as going to bring out secret solution.

    Please take back your memories to 1983 and reflect on the picture of the Judge Illancheliyan bowing down to the mother of the gunned down Police Officer who was his bodyguard for the last fifteen years. In the video clip going round in social media, you could hear how this judge cries so loud and been conducted into a house in a very distressful state. What do we have to gather and learn from this scene? It is the Universal Truth of BONDAGE built into the Human Beings of this planet Earth. This scene also gives us the NEED to BIND us together and discard all types of SEPARATISM, IMPOSED on us by the vultures who want to prey on us to live in a heaven of their own creation. I am happy to see that we have come a long way from that 1983 Black July.

    This policeman is an absolute hero. He is not a hero because he is Sinhalese died protecting a Tamil. He is a hero, because he died as a valiant soldier who gave his life protecting his boss. But I feel so sad for his family. I hear that he was around 50 and wondering how many small children he left behind who depended on his income. I hope they catch these hoodlums who opened fire and killed this poor policeman. While these fat bastards sit in Colombo talking crap, this man laid his life to save another. I hope there will be enough financial help for his family. If anyone hears of it, please post the details.

      “I hope there will be enough financial help for his family”….there are so many Tamil diaspora charity organisations in the UK and all over the world raising money for various charity work in Sri Lanka. I urge them to dig deep in to their coffers and support the Police officers family

    A tough judge became so emotional and cried out loud and openly in public as he couldn’t tolerate the loss of the loyal officer and the great loss of his grieving family members.. Judge Ilancheliyan is a rare gem of a judge who gave justified and tough judgements over many difficult criminal cases without any bias, strictly following the rule of law, until the very end. He had no sympathy for law breakers and brought a great deal of law and order in the province. He is the most suitable person to hold the Chief Justice position or even the minister of justice seat ! But none of the racially biased governments are matured enough or ready to appoint the most suitable personnel to any responsible position in this politically prostituted nation. They always look into the race, religion and political connection before appointing anyone. That’s the big curse of the country we live in today. They will never change until the monopoly of the so called Sinhala Buddha sanga is kept out of the politricks of Lanka. Secularism is the only and the best solution , if Lanka is to survive ! Until then, we will suffer and continue to live in untold agony without any peace.

    Regarding compensation, your intentions are good but please do not get too emotional and over-react. A police officer was killed and certainly deserves our appreciation. However, remember that an officer who dies on duty gets a huge compensation package from the government.

    On the other hand, there are many others who have been killed, ordinary citizens, who get nothing. Let’s keep perspective on where the little money we have goes.

    We find it disturbing that in an event of this kind involving a leading judge in Jaffna, there is still no coherent version of what precisely happened, except that one officer lost his life in the course of duty. He deserves to be mourned for his onerous sacrifice. If the truth of the incident cannot be placed accurately before the public, the people will become cynical about all what the authorities say. I have heard it from persons who are normally credible that the incident began as a drunken quarrel between two parties that had nothing to do with Ilancheliyan, except that his route home was blocked by the fight.

    One of the judge’s escort went to check on the incident, and was reportedly grabbed by a drunken man involved in the quarrel. According to this account, the police officer’s gun had been grabbed and he was shot in the back while trying to retreat to safety. It does not in any way diminish the dead man. Distorted history does not serve the cause of any good and does little credit to leading personalities who have earned the public’s gratitude in the fight against crime.

    An Unwarranted Quarrel that Hurts Law Enforcement

    The public has enormous respect for Judge Ilancheliyan. However, some felt that his maverick approach, popular when the law is seen as ineffective, might result in friction. From 1998, when he handled the Chemmani human remains attributed to the Army, there is no doubt that he showed guts, and people began to expect too much from him, which makes a man vulnerable.

    The recent incident where his bodyguard was killed has led to an unhealthy dispute among law enforcement officials. The immediate the public impact of the news was that the Judge was the intended victim. Ilancheliyan told the Press at the bodyguard’s funeral that he saw the assailant grabbing the bodyguard, holding his pistol aloft, and then push him away (to apparently load the gun) and began shooting. Another officer in his security detail returned the fire, and, though hurt, prevented the assailant from aiming at the judge. Ilancheliyan’s surmise that he was the intended victim would stand if it were established that the assailant was part of a plan to that end. That is by no means clear. His subsequent surrender and confession seem to support the version I gave above, which is roughly the Police spokesman’s – that the initial rowdy fracas was unconnected.

    Ilancheliyan has argued in support of his claim that his security men were unknown and no one had a grudge against them. He should have avoided this speculation. The pathological investigation on where the security man was hit, the distance from which the weapon was fired, and what happened during the time the assailant was loading, should say a lot.

    A proper investigation will help everyone’s reputation. Hurtful speculation and surmises must stop.
