Jayampathy Wants Second Term For Maithripala

“Complete abolition of the Executive Presidency will happen in 2025, but not by promises, it has to be written in the constitution,” says Dr. Jayampathy Wickramaratne MP, Chairman of the Committee providing Technical support to the Constitution making and a member of the steering committee.

He made above remarks on Sunday with a group of Tamil diaspora. The meeting was organised by the Non Resident Tamils of Sri Lanka (NRTSL).

“We are for Maithri to be given a second term, but elected through Parliament. We can’t go back to a directly elected Presidency,” Dr. Wickramaratne said.

“We all agreed present powers will continued till 2020. Because he is the man who gave leadership. But, I would even go further and say if we are to give him a second term under the new constitution, we can even think of the phasing-out. Complete abolition of the Executive Presidency will happen in 2025, but not by promises, it has to be written in the constitution,” he further said.

      I must admit I assumed that you were also a part of this but altered my opinion after seeing pre-planned half empty House at the 70th Celebrations.

      Mr. President, this is a trap. Don’t fall into it. This Parliament will never elect you for a second term. I can place the highest bid. The outcome can easily be presaged. When you fall short on votes, Ranil’s name will be proposed and then he will be elected. After that he will govern the country another decade placing people in untold misery and slavery.

      Therefore, Mr. President, please keep in mind, this Draft Constitutional Bill is not about federal, it is about you. Ranil,/JVP/TNA/JO are hell bent on unseating you. MR will readily agree to federal/13A or whatever, if he gets the PM post.

      Jayampathy says, “they can’t go back to a directly elected Presidency.” Who the hell is he to decide that?

      Mr. President, I wish to place my strongest opposition to the proposal to elect the President through Parliament. People have no authority to decide who the PM is. Therefore, voters should have the democratic right to elect a President of their choice through election.

      I don’t know whether you will contest again/not. But please don’t let the country be taken over by corrupt, selfish, power hungry politicians AGAIN. Stay strong until you hold the Presidential election. That is the best service you can do to the country.

      Please block the Draft Constitutional Bill prepared by NGOO from being taken for Debate in the Parliament disregarding people’s opposition, and for God’s sake, Mr. President, please read the damn Paper.

        there is no need of a executive prime minister elected by the parliament. Instead, remove the PM post elected by the PArliament. IF they argue, executive PM is better than Executive PResident. The otherway, that is executive president elected directly by the people against the parliament is also good, PResident should get more powers and introduce enough legilation to prosecute the president if he becomes one like the last time. He should be under the country’s laws.

    Why ? What is the rational for this..
    Today M&S is doing the job with support of all ..
    Now abolish executive presidency now..all will be in chaotic situation .
    MR and co is waiting to grab power by any means ..
    So; it would not be advisable to mess this cohesive cooperation between UN and SLFP as it stands today.
    Any mess up could lead to chaos.
    It is not issue of M&s or Ranil matters but what matters is the country and it’s future .
    Peaceful politics is good for all .
    For economy to grow you need good politics..
    You can not give the country into hands of thieves once again. .
    You all know how many millions are wasted during 10 of M&R ..
    It would be economically suicidal to change powers so quickly .
    What I want to see is this coloation should go till 2025 until some smooth transfer of power take place between UN and SLFP.

    Before writing a comment about Jayampathy Wickremaratne’s statement, I have something else to say which is also related to Federal Constitution. —

    I vehemently condemn Joint Opposition’s attack on the Most Venerable Chief Prelate Thero of Malwatte Chapter regarding Thero’s opinion on the Draft Constitutional Bill.

    JO is a part and parcel of the treacherous Constitutional Reforms. Dinesh and Prasanna are members of the Constitutional Assembly, therefore, they are also responsible for the proposals of the Draft Constitutional Bill.

    JO has no right to accuse the Chief Prelate Thero of Malwatte Chapter of supporting Ranil, when they themselves support Ranil in every way to divide the country by way of Constitutional Changes.

    Chief Prelate Thero of Malwatte Chapter cares about the country more than JO as Thero doesn’t take part in formulating a new Constitution to divide the country.

    Dinesh, Mahinda and JO are very much involved in the Federal Constitution as they have representatives in the Constitutional Assembly. Their greed for power have made them blind.

    Uvindu knows more than anybody else about the integrity and credibility of this man.

    The people of Sri Lanka never gave mandate to these people to do away with the Constitution. It is true that there are important areas that need to be addressed, like the removal of immunity granted to Executive President and empowering the Judiciary to quash any bill or act inconsistent with the Constitution. And also to remove parliamentry grip over the Judiciary but I’m sure these criminal elements occupying office in the legislature and executive will never do it.

    What the people of Sri Lanka wants today is not breaking this small country into pieces but the freedom from unequal treatment, live with dignity unharmed, respect with no discrimination in any manner.

    The Nation is crying a true philosophical ruler with zero tolerance of any form of wrongdoing, to be a symbol for the whole Nation and just for one community.

        Did you really listen to what Dr. Jayampathy Wickramaratne had to say about the history of constitution making, and the actors who played a destructive role in the process?

        The country adapted a system of representative democracy. Hence it should remain representative of all people. The only way it could represent all people is through maximum devolution through Federal System, not by the president nor by 225 crooks in the parliament.

        You never theoretically argued against Federalism. Your only argument is that the Tamil Diaspora bent on dividing the country. You too suffer from Dayan’s paranoia.

        As I have mentioned several times Hindians take the final decision on the nature of this island, not the stupid Sinhala speaking majority nor the stupid Tamil speaking minority. Probably you are concerned about Arab speaking people of this island too.

          A federal system would only dilute any executive power that is transferred through a mandate of all the people in this Island.

          It is an entirely a different matter why Tamils would not want to vote for a Sinhalese presidential candidate without some promise from Tamil supremacists to get what they want later.

          In an abstract sense, an executive presidency is the only way to solidify the “PEOPLE’S” mandate if you are worried about the Hindian power.

          If you have a problem regarding Hindian influence over Tamil culture, fight that with Hindians.
          Sinhalese feel pity about the Tamils in India who are suffering from the inferiority complex because of the skin color discrimination by Hindians.

      I agree with most of what you have said. I am just wondering what you meant by “not breaking this small country into pieces .” How much break up has occurred already after 13A? How big a country has to be to devolve power. Also cite us some examples where limited devolution has led to break up of country. I can cite a few where people demanded this, were not granted some sort of devolution, and that finally led to division of countries. I can also cite research evidence for how devolution of power from center to peripheries led to better economic and social development.

      By making changes to the constitution with the view to democratizing the entire state and its institutions, make it accountable for its actions or lack of it, how would it possible to break this small country into pieces?

    Good, let us include the abolition of executive functions from the constitution in writing, but don’t include any of the present MP’s or president as they all stink of corruption. Let a neutral, honest person be elected by the people to steer the country as provided by the new constitution.

      Do you think if you would be introduced to WALIKADA prison, you could easily change the system long functioning there.

      So is the situation with the current leaders. They have though promised, they are caught by so many illfated systems whose change would be no easy.
      Be it within legal system, or police, there have been made changes, but much more to be done.
      It is like a patient whose cancer situation is far close to Metastasis, and the various professionals make every efforts to take him back.

    Nagananda, what happened to you suddenly ? Are you out of your mind ( because of srilankan judiciary ) to expect a true philosophical ruler in Srilanka? Did we have atleast a reasonable fair minded ruler before and after independence ? No. A very loud No. All are crooks and cheats, willing to do anything to win a seat in the Parliament and remain in power. Since 1920 s how many times Sinhalese politicians have cheated Tamils by breaking their promises. Please do count. Do you still want the Tamils to trust the Sinhalese politicians. No reasonable minded Tamil will believe that their problems could be solved by a new constitution or any amendments you wish to bring. Only TNA politicians believe it because they too are equally crooks and cheats.

    Last several months poor Tamils are engaged in protests in the streets of Vanni but no Tamil politicians or the government care them? Please go to Vanni Trincomalee and Batticaloa and see the sufferings of ordinary Tamils, war victims, and bring them to the notice of ordinary Sinhalese. Similarly go to interior south, meet the ordinary poor Sinhalese and show their plight to the Tamils. Please do this without delay so that both communities will be free from the clutches of politicians and start creating a new different Srilanka. Who knows one day you could become their beloved leader, guide and teacher.

    People get the constitutions they deserve, in most countries. In Sri Lanka, corrupt politicians who want to rule so as to enrich themselves further, mostly always win elections – they have the money for it and the thugs – most of them in pure Arya-Sinhala clothes and some even in religious garb, on their side.
    Now the political situation is in the grip of the idling armed forces who ‘have the cake and eat it’ too, gobbling up the largest chunk of the budget – no one dares object.

    Minorities are under undeclared army rule and dare not protest the land grabs, the thrust of Buddhicisation of areas and loss of livelihoods etc., to say the least, & are in the grip of injustice.

    It matters little as to who will be head of state, as nothing will change for the better, worst being the economy.
    O Level failures are the majority in the legislature, and this percentage will increase.

    We will be another “Zimbabwe” soon.

    I politically disagreed with more extensive power of system of Presidency-rule of Democracy.
    But it was no wonder began with 1978 Republic Constitution installed by politics of UNP-JRJ the extent to which the system of democracy favors those at top of governances?
    That make puzzle of democracy by UNP leadership from 1978?
    Regardless the 1978 constitution an open path for wider range of power to elected their President by directed system of votes. Such democratic seems to be reflect consent and views of majority People of Island? The perceive policies of democracy that advance interest of citizens of Island. Last 34 months UNP leadership has shown tries to disenfranchise the poor section of voters. That created inequality of democracy become negative move by UNP!
    Meanwhile the Democracy of Sri lanka that we all at least that as most of us conceive of it was based on the principle of right votes for citizens ; from the President top to down to Rules Council members are elected by voters is structure of democratic foundation has some positive aspects of governances.
    That is not bad.
    The issues of mismanagement of democracy by UNP leadership . We cannot denied our political-Party system is being warped by influences’ of big money back by foreign big power which funding undermined Sovereignty of People in 2015 January 8th!
    We too want certain reform of Republic Constitution but not destroy Unitary character of Sri Lankan state..

    So RW will become the Executive PM…

    Under the proposed constitution the members will be appointed by vote to an electorate and the party that secures the Electorates with the highest number of votes will have highest number of members appointed on proportional representation system…under the circumstances the members will be increased to 240…

    Even under the present constitution with the Executive Presidency intact the powers can still be devolved to PC and thereby reducing the number of costly Ministers & Cabinet in the Central Govt to 20 max…PM do not want it because it obstructs his agenda….

    The objective of a new constitution should be for effectiveness both in Administration & Finances….besides it should define the quality of the Candidates….the Present Constitution meets all that…

    Dr.Jayampathy wishes a second term for him also as an MP , his long term ambition fulfilled by H.E. Maithri in 2015. Jayampathy contested Senkadagala in 1977 under LSSP and lost. He never lost his ambition , for 40 long years continued to build his way , acquired knowledge and has reached the Parliament and the inner circle in 2015. His policies changed over this period and not his ambition to sit in the Parliament. I admire his qualities, a boy who travelled some days in the same bus to school in 1960’s in suburbs of Kandy.

    Like in all well-run organizations, a would-be Member of Parliament should be a Graduate or alumnus of a recognized University or professional body (Doctor, Attorney, Accountant, etc.) OR, have at least a General Certificate of Education with Advanced Level passes in three (3} subjects PLUS a minimum of ten (10) year’s of well-proved, managerial experience in a reputed Public or Private Sector organization.

    Please incorporate this as an appropriately worded Clause in the New Constitution, or be resigned to to the fact that we will continue to be ‘Ruled’ by our inferiors, as counseled by Plato!
