I write this brief missive on 12th August. If I am published tomorrow 13th August and wake up, it happens to be my 84th birth anniversary. As my shadow length opens across the evening of my life, it is time I added my non-lawyer’s two cents to the debate.
Justice has remained the most elusive goal of humankind. ‘Justice’ has been continuously redefined across human history—from cosmic harmony as explained by Plato in ancient times, to obligation-based ethics of Immanuel Kant in the late-modern era, and finally to the contemporary frameworks of liberal democracy and capitalism.
Today, our island nation seeks this elusive ideal while tightly bound to global economic structures and the stringent realities of the IMF, from which we cannot seemingly extricate ourselves.
It is within this gridlock that we must analyze the home front battle over judicial reform. The National People’s Power (NPP) framework—exemplified by its proposed 22nd Amendment—aims to address systemic backlogs and ensure citizens receive speedier, accessible, and fair justice.
Conversely, the institutional inertia of the Bar Association of Sri Lanka (BASL) seems intent on preserving a presently entrenched culture of physical diaries, systemic delays, and endless postponements. It is as if they treat the gridlock of human lives as a mere sample page from the slim diaries they produce for lawyers—ironically sold at Rs. 800 apiece.
I fully understand the Chagrin clouding the cherubic countenance of the BASL president.
I have no desire to tread Lawyers’ territory or on the complexities of deciding the retirement age in our Judicial System.
My concerns are simple. People desire Justice. Not long hours in consultations in chambers of eminent counsel where young lawyers refer to their master counsel as ‘Sir”. It is the Master Sir edifice that the NPP desires to demolish.
I have in my day seen these trapeze artists perform in their elegant Book Lined Chambers.

To understand the world is never a matter of simply recording our immediate perceptions. Understanding inescapably involves reasoning. We must ‘read’ what we feel and seem to see and ask what those perceptions indicate and how we may take them into account without being overwhelmed by them. One issue relates to the reliability of our feelings and impressions. A sense of injustice could serve as a signal that moves us, but a signal does demand critical examination, and there has to be some scrutiny of the soundness of a conclusion based mainly on signals…We also have to ask what kinds of reasoning should count in the assessment of ethical and political concepts such as justice and injustice.”
Reader should forgive me for these lengthy extracts. I am running out of time. I see no logic in reinventing the wheel.
This clash is perfectly explained by modern political philosophy. John Rawls saw ‘Justice as Fairness,’ arguing that a just society must architect its institutions to protect the basic liberties of all citizens, particularly prioritizing the least advantaged.
However, Economist Philosopher Amartya Sen took this further by drawing from classical Indian philosophy to distinguish between Niti and Nyaya.
Niti represents organizational propriety, behavioral correctness, and formal institutional rules. Nyaya, on the other hand, is concerned with the actual lives that people can lead and the elimination of manifest injustices in the real world.
The tragedy of the Sri Lankan legal fraternity is that it has become utterly obsessed with Niti—protecting an archaic, procedural bureaucracy of delays and physical ledger entries—while remaining completely blind to Nyaya, which is the substantive realization of justice for the ordinary citizen. While the state navigates macro-capitalism and IMF mandates at the top, the citizen at the bottom is denied fundamental fairness by an institutional gatekeeper that measures human suffering by the price of a lawyer’s diary.
True judicial reform must break this cycle, moving us past the empty rituals of Niti and finally delivering the livable reality of Nyaya to our people.”

Justice Ranil style, Justice JRJ style, Justice SWRD side, Justice Rajapaksa style, Justice AKD side. You cannot compare one or other. They all are one sided. That is about Buddhist Sinhala style. AKD style may different to Ranil style both depend on unitary system. All style talked about devolution of power or sharing the power. If it is only for Buddhist Sinhala style at the moment of Bankruptcy, AKD looks better until what is AKD is open enough to what is AKD’s motive? It can go either way but AKD depends on votes of Sinhala Buddhists.

Sarath, simple arithmetic: Sri Lanka has an outstanding 1.1 million cases in the Courts.
Giving two more years to a bunch of Judges will not impact the backlog in any way.
I have seen references to a UN Report on Judicial Systems in Sri Lanka.
It requires a complete overhaul of the judiciary with an ADR focus.
Two years in office, JVP/NPP and its Justice Minister have done nothing in this respect.
By the way, the JVP Brain is dreaming of the Govt’s perpetuity over two decades.

Not only Judicial systems in the island of Sri Lanka, this island requires complete overhaul of the whole system that should decide this island not only belongs to one community, one race, one language or one religion. I am not to blame on one particular government whether it is UNP/SJB or SLFP/SLPP or JVP/NPP governments. All should recognise that there is something wrong in the system they had in the past or at present now. The current system allow all the governments to encourage that the power of ruler can influence on the judiciary, parliament, president, security etc. The word “I” is very dangerous; I am the leader knows every thing and I am only the right is very ignorance. The word ” special” will always work against justice and equality. For example, executive power, special status to Buddhism, special status to parliamentarians in the parliament are some examples which allowed to violate the principles of equality.

Being elected democratically gives a government the authority to govern, but it does not remove its responsibility to listen, explain, consult, and remain accountable. Constitutional reform in particular should not become a matter of parliamentary arithmetic alone. Before fundamental changes are presented for approval, the public, constitutional experts, the legal profession, and institutions such as the Bar Association should have a meaningful opportunity to examine and debate their consequences.

The continuing revelations surrounding the alleged loss of US$2.5 million raise further serious questions about transparency and accountability, and the public is still waiting for clear answers and proper investigations. Similarly, the petroleum minister’s alleged connection to coal-purchase anomalies must be fully clarified and brought before the nation through a transparent investigation. These matters cannot simply be ignored or allowed to disappear from public attention. At the same time, the situation is creating new divisions between senior Buddhist monks and the wider public. The correspondence issued by the monks regarding the proposed amendment was reportedly said not to have been received by the President. Yet, if it had in fact been received and was not accepted for reasons that appear difficult to justify, releasing information to the media that was not accurate raises an even more serious concern. Such conduct can create the impression of impulsiveness and immaturity in the highest office of the country. The President’s credibility is like a glass wall: once cracks begin to appear, restoring public trust becomes increasingly difficult. People are becoming increasingly frustrated and furious, and the government must understand that competence, transparency, truthfulness, and accountability are not optional qualities in national leadership—they are fundamental responsibilities owed to the people.

I have listened the translation of the speech of the President AKD, the speech is great. There is no doubt that AKD is completely different President compared to past presidents or past prime ministers, particularly about the corruption of the past governments, past ministers., past civil servants. His focus in finding the culprits behind the Easter Bombing is great. It is a well known fact that past governments and officials misused the power and misuse of resources for their benefits.
So far his focus is cleaning of the south or the rulers of the country to make the political culture of the country. But you should know that there is Tamil speaking people are the victims of the past governments. I am not talking about past political parties or current political parties. The victims of the past governments affected directly the people of the country for speaking another language and following another religion. I do not want to tell what happened in the past. President AKD has said that his life is under threat. The obvious question is: who exactly is after AKD? Presidents say many things, but the following day they sometimes behave as though they never said them. Before the election, we heard many exaggerations that went beyond even the claims of the well-known king of exaggeration, Chethiya, the “liar of the nation.” Yet there is a section of the public—much like the followers of our own “King of Unawatuna,” Kadamandiya, or the like—who will believe almost anything, because they have convinced themselves that their intelligent and brave leader, AKD, can do no wrong. But for how long?

I predicted what would happen to Gotabaya long before his campaign even began. I also predicted that AKD would eventually be rejected by his own supporters sooner rather than later. Now, almost 24 months have passed. Despite the so-called high promises, the government has had a two-thirds mandate in Parliament, an enormous mandate outside Parliament, and control of regional bodies. Yet what has actually been delivered? AKD came to heal the economic wounds left by the Rajapaksas, but the growth rate has now fallen to levels inferior to those that existed when he took over.

National reserves have not increased by even US$0.5 billion, despite Ranil Wickremesinghe and his team rebuilding reserves from around US$20 million to approximately US$6.2 billion by the time AKD assumed the presidency.
The uncomfortable reality is that AKD lacks the leadership skills required to take Sri Lanka to the next level, and his inability to communicate in English places another limitation on building the close international relationships that leaders such as RW and JRJ were able to develop. Meanwhile, cyber propagandists and those who blindly believe leaders of the Kadamandiya variety refuse to look at the ground realities. Their thinking is too often driven by untruths, hatred, envy, and hostility towards the middle and upper classes and towards “elite” or accomplished people in leadership, rather than by facts. Sri Lanka will not attract the investment it desperately needs as long as this mindset is tolerated and ground realities are ignored.

Above all, look at the people being placed in key positions. Sunil Handunnetti, who has little or no English-language capability, has been sent to promote investment in English-speaking countries such as Australia. What does that say about the government’s ability to put the right people in the right positions?

Abrahamic Religions (JUdaism, Christianity, Islam, Marxism) taught that justice was differen for the chosen few (those who had God’s grace, those who were members of the Communist Party), and for the vast majority (who end up in hell, or the bourgoisie who remain under the thumb of the CP). It was such doctrines that mattered. A small number of people read Plato or Kant or Grotius, but the actaul LAW as executed was fashoned either as Dharma and Danda, or in terms of the prejudices positioned in society by Abrahamic Religious leaders and the rulers who ruled by Divine Right. The Magna Cater replaced the divine right by the Rights of the Elites. If you analyze it closely, even Donald Trump, strongly supported by the Evengelicals the Christian Right, and the Tech Titans clearly believes that he rules by Divine Right. The Tech Titans think that they are Gods. Mr. Sarath de Awis and others of his ilk need to wake up.

Ask your Kadamandiya to protect AKD if you can. He has been looking for any excuses since he can’t face the music like a defeated dog. “If it is the case, that I have to go, I can do so” is the statement made by the man who said that no one else could accomplish anything better than NPP. Whatever comes out of the ill mouth of an inexperienced leader is inconsistent. This is largely due to his constrained upbringing, which prevented him from growing into a true leader. It is now evident that he and his group are a major failure that the country failed to adequately analyse. There isn’t a single capable minister in his government to be commended.

In The Republic, Plato defines justice, not as a legal contract, but as social and individual harmony. To Plato, a society is just when it is divided into clear UNEQUAL classes (Philosopher Kings, Warriors, Producers) and everyone performs their duty respecting the pecking order. This is similar to the Indian system where Philosophers=Brahamins, Warriors=Kshatriya, Producers=Mercantile class. The Chandalans of the Greeks were the slaves. As far as I can see, this is nearly identical to the Svadharma (individual duty based on one’s position in life) in Indian thought. Both ancient Indins and ancient Greeks maintain that social stability requires people to fulfill specialized, non-egalitarian roles based on their attributes. This was fully endorsed by Abrahamic religions and Hindu religion, although Buddhists and Jains broke from it. Ponnambalam Ramanathan took a petition to England in the 1930s asking the English to modify Donoughmore and enshirne the caste system in the Ceylon Constitution. “All are equal came” with the Enligtenment, JJ Rouseau, Voltaire, et al., and furiously opposed by the Church.
