‘Justice Sripavan The Next CJ’ Govt Says

Following the retirement of the 43rd Chief Justice Shirani Bandaranayake today, the most senior Supreme Court Judge K. Sripavan is due to be appointed as her successor.

This was announced at the cabinet press briefing held in Colombo just a few minutes ago by Minister Rajitha Senaratne.

It was before justice Sripavan that President Sirisena was sworn-in despite the availability of de-facto CJ Mohan Pieris.

Meanwhile a ceremonial farewell was held for CJ Shirani B today where she had said it is a momentous day as justice has been upheld and prevailed while also congratulating Justice Sripavan on his lawful appointment.

After extending the deadline for de facto CJ Mohan Pieris to resign from his position on several occasions, the new government yesterday announced that the process adopted in the impeachment of Shirani B and the appointment of Pieris to fill the position was void and was not legal.

        The War crime was committed by the last regime against a minority, unarmed Tamil civilians, young, old, poor, children, girls, boys, infants, pregnant mothers, invalids etc
        Corruption is also a crime committed by the last regime, against all citizens of the country, Tamils, Muslims, Sinhalese, Hindus, Buddhist, and Christians etc. Corruption may not have visibly impacted everyone but the country’s wealth at large was stolen by the last regime thus economically depriving all the citizens including the future unborn generation.

        The new govt has sought the assistance of international organisation such as the IMF the word bank and foreign countries such as India, USA, UK, Switzerland to help trace the billions of dollars, belonging to the citizens of Sri Lankan, stashed away in the private bank accounts of the members of the dynasty of the previous regimes and to bring them back to Sri Lanka. The corruptors will also need to account for their crime.
        The UN is seeking the assistance of the new govt to bring the perpetrators of the war crimes also to account for their crimes.
        Hope the past regime pay for both of the crimes.

          for tax heavens to disclose unmarked accounts they have to be proved as terrorist- so a catch 22 you have to play close to your heart. The sihala wont let go as war criminal because they common folk suffered too and obeyed orders through fear from both sides.
          Look at the number of war criminals former presidents living in the US UK France. Musharraf the coup master had exile at the cost of london tax payer for 2 years.         The feeling that none of tamils are appointed to higher offices can be changed with the time giving them more confidence that we are all the same – though our labels are sinhala, tamil, muslim, burgher or others. What matters is we are all srilankens.

    May all these steps be exemplary to the nation. If Dr SB was appointed to move on, people would have raised the question – this is seen more exercising revenge against former authoritarian Prez MR. Now the common wealth will have more respect on the way this justice issue has been handled by the new administraton/srilanken judiciary.

        Mohan Pieris was not dismissed as his appointment was not legal in the first place. He was always considered a puppet of the Rajapakse regime installed to carry out their bidding, while Dr.SB on the other hand challenged that stand and continued to consider herself the official CJ.

    Do you know that Mohan Peiri’s father who was a railway station guard and is now about 90 years old has been employed as a consultant by the Railways Department. This is the same thing that MR did to Shirani Bandaranake’s husband. Control the judge by giving various jobs to family members. Members of parliament and JVP over to you for investigation.

    It is great to hear that Honourable Gentleman is going to be our Chief justice.
    I am personally proud to say his impeccable character and commendable service guided him to highest office in our legal establishment.

    Hope this Honourable gentleman will preserve and protect the true legal system.

    In Fact some previous predecessors have politically favoured to protect Mahinda Rajapaksa.

    Foremost classic example is Helping Hambanthota Tsunami Fund.

    That is the initiation of horrendous erosion of our democratic legal system in our history.

In appointment and promotion, due recognition does not come easily to one who upholds principles and is self effacing. The appointment has come at the finest hour for the government,when the educated world is checking for the litmus tests of fairness.

      On ethics and morals, Thirukkural serves as the sheet anchor to humanity.

      “Holding the scales evenly and upholding justice unswervingly, is an embellishment in one’s character”.

      May society wish Justice Sripavan a distinguished tenure.

    If justice Sri K. Sripavan is the next in line CJ then he should be given the job. All we want is a person who loves his country,and therefore honours the constitution and the laws of the land.

    He may be Sinhala, Tamil, Muslim, Christian or whatever as long as the above is fulfilled that should be the final say.

    We have had enough people from the different ethnic religious groups who have put themselves, their kin and their religion before honouring the constitution and the law, I say enough of on saying one ethnic group is better than the other nonsense. Didn’t all our forefathers fight for freedom together as one ?

    If the law and the constitution are insufficient then it is the job of the people to pressure the legislature to make those changes, so lets do that.

    Our expectation of the judiciary should b the proper and just implementation of the constitution and the laws and advice to the legislature on how to enhance it for the betterment of the nation and it’s people.

    Siripavan is the best choice for the job of CJ – no doubt. He has been endorsed by the law fraternity as well.

      So was mohan peiris,as the government says he was appointed illegally due to procedural flaw,and therefore appointment is void.

      So who is the CJ that he has to sworn before?Obviously the former CJ shiranee.So if the constitution states that president has to be sworn in by the CJ(which i doubt,show me the clause)then the appointement of maithri as the president is void too due to procedural flaw.If mahinda becomes PM then he can get rid of maithri,get rid of sripavan this time with correct prcedures,appoint mohan peiris as the CJ and gotabhaya can take oaths as the president.All this would not happen if maithri did the reinstatement of shiranee immediately after the election and on the one day she came to office took the oaths before her.

      However mahinda becoming the Pm is remote because he is a Libra and saturn changed house to mars on the 2nd nov last year.very bad for him for the next 2 and half years until it changes house again.Incredible that his astroleger did not know this and told him he will win.

      The law is clear that the Oaths be taken in front of a Senior judge of the Supreme Court, not necessarily the CJ. So there was no issue with legality.

      Sripavan apparently is the most senior of the SC justices, and I think you are reading too much into it.

      All you need is a Supreme Court judge to do the honours. No need of CJ.

    most supreme court judge, which is perfectly normal and legal as per the laws of the country. It is not an unusual occurrence as you have stated.

    Judge Sripavan. being the next most senior judge got this position and
    it is a good sign for the minorities that the govt.looks into merits
    and seniority rather than a pull a candidate has. How long will this
    policy remain in effect is the question.

    There is no country in world that all powerful President in Globe except Sri lanka?

    Even most powerful nation like- Big power of USA, which, President of US no such power appoint all positions and post of State, Parliamentary and Judiciary, rather than MS Regime in Sri lanka?

    That is how new democracy work in tiny an Island of Sri lanka.
    MS regime, that back by UNP-Ranil W..,CBK,JHU, TNA,MC and JVP has demonstrated inability to democracies governances of ‘GOOD’ the areas hold ,but doing so largely by authoritarian RULE rather than democratic means and its values.

    How is that MS regime mode of operandi works at Sri lanka?
    That very lesson to be learn form ongoing ‘Rule of Law and ‘good governances’ that created lawless nation like Egypt, Indonesia( that after Surharatho in 1965 by coup) Tunisia, Iraq and Libya which after Arab spring.

    1 MS has appointment of Primer Minister Ranil W.. of UNP minority Party in the Parliament. Minority elected to become PM is
    anti-constitunital and denied majority norms of democracy.

    2 MS sworn as President in before NOT that Chief Justice, but some of his own selects person, that is constituently illegal.

    3 MS become President of Ex-Ruling party President of SLFP by using his power of Executive Presidency.

    4 MS appointment Leader of Oppositions of SLFP by using his executive power of State. There no democratic world that any country in world that ruling party of govt. that President chair an Opposition forces and party.

    5 By forces without going through the Parliamentary process, MS regime has remove Chief Justice Mr Mohan Peiris by using executive power of President of Republic. The action of President of MS is unconstitutional by the law of Land and violated the independence of Judiciary by authoritarian rule of bad governances.

    6 An appoint Central Bank Governor of Singapore national by MS regime is against accepting practices of Financial norms and regulation of values of Sri lanka.
    CB is governor must be Sri lankan national, that we have many skill and professional working Central Bank.

    Of cause we need more transplanting and an open system of governances rather than past MR ruling alliances. But MS regime working towards various administrative bodies prevent democratic accountability; MS rule working towards AUTHORITARIAN RULE.

    A reversion to the practice of appointing the most senior supreme court judge is most welcome. It will minimize ethnicity as an issue in these appointments.

    Minister Rajitha Senaratne has stated that the accusations made by the previous government against former CJ Shiranee Bandaranayake are somewhat true. He must be feeling guilty for bullying her during the parliamentary select committee inquiry by insulting her and abusing her in raw filth preventing her from participating further in the inquiry. [Edited out]
    We want this government to continue without any obatacles. We do not wish MR to come back. The above article contains good suggestions for the government.
