‘Justice Sripavan The Next CJ’ Govt Says

Following the retirement of the 43rd Chief Justice Shirani Bandaranayake today, the most senior Supreme Court Judge K. Sripavan is due to be appointed as her successor.

This was announced at the cabinet press briefing held in Colombo just a few minutes ago by Minister Rajitha Senaratne.
Justice K. Sripavan - Maithripala

It was before justice Sripavan that President Sirisena was sworn-in despite the availability of de-facto CJ Mohan Pieris.

Meanwhile a ceremonial farewell was held for CJ Shirani B today where she had said it is a momentous day as justice has been upheld and prevailed while also congratulating Justice Sripavan on his lawful appointment.

After extending the deadline for de facto CJ Mohan Pieris to resign from his position on several occasions, the new government yesterday announced that the process adopted in the impeachment of Shirani B and the appointment of Pieris to fill the position was void and was not legal.

Aiyoo Mohan Peiris. You were given enough and more time to resign in a respectable way. Now you seem a piece of s**t. Wait for your MR govt come. He may come to power after he face jail term for corruption and may be war crimes. long wait….

Of course for corruption. We Sri lankans will never allow him to be charged for War Crimes.

Goviya “Of course for corruption. We Sri lankans will never allow him to be charged for War Crimes.”

The War crime was committed by the last regime against a minority, unarmed Tamil civilians, young, old, poor, children, girls, boys, infants, pregnant mothers, invalids etc
Corruption is also a crime committed by the last regime, against all citizens of the country, Tamils, Muslims, Sinhalese, Hindus, Buddhist, and Christians etc. Corruption may not have visibly impacted everyone but the country’s wealth at large was stolen by the last regime thus economically depriving all the citizens including the future unborn generation.

The new govt has sought the assistance of international organisation such as the IMF the word bank and foreign countries such as India, USA, UK, Switzerland to help trace the billions of dollars, belonging to the citizens of Sri Lankan, stashed away in the private bank accounts of the members of the dynasty of the previous regimes and to bring them back to Sri Lanka. The corruptors will also need to account for their crime.
The UN is seeking the assistance of the new govt to bring the perpetrators of the war crimes also to account for their crimes.
Hope the past regime pay for both of the crimes.

for tax heavens to disclose unmarked accounts they have to be proved as terrorist- so a catch 22 you have to play close to your heart. The sihala wont let go as war criminal because they common folk suffered too and obeyed orders through fear from both sides.
Look at the number of war criminals former presidents living in the US UK France. Musharraf the coup master had exile at the cost of london tax payer for 2 years. Its always give and take because no one is right or wrong in politics. Hindian help will be the final say because they are big now; but how you negotiate with them to stay attached/detached or its messy over again.

The war crimes are hiding behind civilians.

I celebrate the appointment of Justice Sripavan.

The fact, he is a Tamil Sri Lankan from Jaffna is a bonus.

      Cheers!

PS: De Facto CJ’s dismissal seemed messy. I think it will set a bad precedent for future monkeys in positions of power in SL to follow. Unfortunate.

The feeling that none of tamils are appointed to higher offices can be changed with the time giving them more confidence that we are all the same – though our labels are sinhala, tamil, muslim, burgher or others. What matters is we are all srilankens.

          Ben Hurling,
“PS: De Facto CJ’s dismissal seemed messy. I think it will set a bad precedent for future monkeys in positions of power in SL to follow. Unfortunate. “

Remember how Bush was elected as president first time after the Florida fiasco. That was precedent and the 2nd term was always assured.
Now understand politics/diplomacy from the brainy one.- obama,
You may shout till you have no voice and 300k protestors at the UK stop the Iraq war to no avail similar to LTTE blocking London traffic for 2 hrs.

Mr. Obama’s speech came at the end of his three-day visit to India, after which he left for Saudi Arabia on a condolence visit following the death of King Abdullah last week.

Addressing criticism over the visit to the Kingdom, for which he had to cut short a planned tour of the Taj Mahal, Mr. Obama told CNN: “Sometimes, we have to balance our need to speak [to the Saudis] about human rights issues with immediate concerns that we have in terms of countering terrorism or dealing with regional stability.”

Siripavan is taking the second risk if he becomes CJ. The brilliant malay lady has retired without asking for any post.
Will he end up like TN Amma now that JT’s are all harping?? The Hoodoo Voodoo KoooDoo.

        Ben Hurling

Good to hear from you intermittently.

Aren’t you worried about the racists who would make use of this appointment as their campaign slogan?

Mahinda Pala, Sonali Waduge, Dayan the war monger, Weerawansa, Ganapathi Pillai, …………… have been waiting for an opportunity.

Please read comments from Sirisena Yatawara January 29, 2015 at 7:14 pm.

The country will only truly prosper when we NO longer CARE what race/religion/sex/sexual-orientation/height/weight the person is.

Why is the appointment of a Tamil “news”?

It should not be, we just want someone who upholds the law regardless of where he came from….idealistic I know…but we can all hope can’t we ?

          :-)

NO, I am not going to hold my breath that this country I was born in will achieve the above any time soon…

Does meritocracy mean anything in this island?

“Why is the appointment of a Tamil “news”? “

It shouldn’t be however it is a great gift to the racists who believe they own this land hence exercise monopoly on every state institution. The racists have already started glamouring for his blood. See below.

“I am not going to hold my breath that this country I was born in will achieve the above any time soon…”

            I agree.

When there is a glimmer of hope the dark forces are already out there and make it their business to destroy it.

May all these steps be exemplary to the nation. If Dr SB was appointed to move on, people would have raised the question – this is seen more exercising revenge against former authoritarian Prez MR. Now the common wealth will have more respect on the way this justice issue has been handled by the new administraton/srilanken judiciary.

    • 4
      6

Now the question the nation should raise

      a) what is more civilized and legal bound
      MOHAN PERIS#S dissmisal or

      b) Dr SB ‘s dissmisal two years ago, with the direct mediation and use of powers of Executive prez -MR ?

      • 9
        2

Mohan Pieris was not dismissed as his appointment was not legal in the first place. He was always considered a puppet of the Rajapakse regime installed to carry out their bidding, while Dr.SB on the other hand challenged that stand and continued to consider herself the official CJ.

        • 5
          4

This means those who got appointed by former Prez going against the legality – should be able to null and void with the approval the executive of the state. This should be valid not only to CJ s de facto function .. but also any other positions of unreasonable appointment.

I am afraid whether the BALU SENAS will now make hue and cry that a Tamil has been appointed as Chief Justice and Ealam will be given on a platter.

Do not be Surprised, if that happens.

That is why we are what we are and U.S.A is what they are. Barack HUSSAIN Obama can be the President of the most powerful country on earth and we need to be a Sinhalese to be the President of our country. No qualms though.

Hope it stays at least there and not to other positions. “MY3ta JAYAVEWA”.

though you imply on Hussain, Obama is not a Muslim. He is a christian who goes to church every Sunday.

Only a christian can be elected as the president in US, not even an atheist born in catholic family can be elected.

SL has had AGs and CJs who were Tamil.
Former AG Shiva Pasupathi was given deshamanya by racist sinhalas and later he became an LTTE supporter once he went to Aus.

Sinhalese had tolerated non sinhala leaders long before Colombus left English shores.

In fact right around the time We Thamizh started the suicide bombing ‘liberation struggle’, Siva Pasupathi was the AG, Suppiah Sharvananda was the CJ, and Rudra Rajasingham was the IGP. Such was the extent of the ‘genoccciitte’ carried out by the Sinhaloid overlords :D

Sach is right. Maj Gen Anton Muttucumaru was commander of the army. He was later ambassador to Pakistan, Egypt and Austrlia. Rear Admiral Rajan Kadiragamar (brother of Lalshman)was commander of the navy. Rudra Rajasingham, WB Rajaguru and TE Anandarajah were all IGPs.

RCA Johnpulle was ambassador to the USSR, C Mahendran to the UN, N Balasubramaniam and W Rasaputram to France and the USA,Yogendra Duraiswamy was ambassador to China, Tamara Kunanayakam to Cuba, AT Moorthy to the UK, A Mahadeva & C Coomaraswamy to India, H Thambiah to Canada…….

Did the U.S., orchestrate government backed riots 3 times? Did the U.S., government make journos disappear? Did the civilians simply vanish in the U.S., murdered by the US gov’t? I cannot believe you could be this dumb!!!! Siva P was JR’s close confidante. Sinahlese have tolerated non-Sinhala leaders? When did we ever have non-Sinhala leaders in SL, except for Sir John A. Kotalawela (spelling?) He was the only leader who kept buggers like you in your holes. You racist rabid dogs were chained up until SWRD came to power and cut them all lose. Yes US doesn’t only make Journos disappear they go after them and target them OPENLY Remember Assange…..

Yes SL has given opportunities to people from minority to rise above you ungrateful dog!

I was talking about sinhalese having non sinhala origin kings during kandyan period…that is why i said even before Columbus left english shores…

Tamils also contributed to the state coffers, or do you think only Sinhalese paid tax.

Sri Lankan Army looted untold millions of $ from Tamils.

Sinhala mobs looted untold number of Tamil stores and people in Colombo and elsewhere.

US does not kill people just because they are Muslim.

US does not target journalists in the manner and scope as MaRa regime did. The US still has a relatively free press where one can write anything they want against the government and President. Assange is an exception.

            • 2
              4

Where did I say only sinhalese pay? But it is not rocket science to understand who had been the major contributor.

I am not saying everyone in SLA were angels, but we spent for the upkeep of the people.

US does kill Muslims simply because of their religion. They track down and monitor them to see if they are tolerable. If one is not going to fit in he will be turned into a radical and taken care of.

US does target and do far heinous things if the journos harm the security and territorial integrity.

May be so because, all politicians in power heading departments etc have always had a Tamil seated on his brains signing the illegal deals- that is exactly what these village tam`ills in government service have done so far.Secret secret under the palm tree.
So don’t be surprised as to why both should be investigated. It is great to hear that Honourable Gentleman is going to be our Chief justice.
I am personally proud to say his impeccable character and commendable service guided him to highest office in our legal establishment.

Hope this Honourable gentleman will preserve and protect the true legal system.

In Fact some previous predecessors have politically favoured to protect Mahinda Rajapaksa.

Foremost classic example is Helping Hambanthota Tsunami Fund.

That is the initiation of horrendous erosion of our democratic legal system in our history.
That politically favoured judgement lead Mahinda Rajapaksa to cultivate and develop his illegal and immoral accumulation of incomparable acquisitions and Mahinda rajapaksa became a 8th Billionaire in Asia.

Hope this honourable Gentleman will not misguide our President and Prime Minister.

I would like to join with others to convey my best wishes to our New Chief Justice, Senior Justice Sripavan.

May you live long. May you have a healthy, trouble free and peaceful Life.

I am happy to convey my felicitations to Justice Sripavan from this public forum. In appointment and promotion, due recognition does not come easily to one who upholds principles and is self effacing. The appointment has come at the finest hour for the government, when the educated world is checking for the litmus tests of fairness.

On ethics and morals, Thirukkural serves as the sheet anchor to humanity.

“Holding the scales evenly and upholding justice unswervingly, is an embellishment in one’s character”.

May society wish Justice Sripavan a distinguished tenure.

After seeing the sagas and politics of Buffoon Silva, SB and Mokan Peiris SriPavan will be the most obeying, dedicated servant of the Sinhala Intellectuals. Sure he will behave more obedient than a house pet, the dog towards to its masters. Sure there is no way he can forget that all off when in the mornings the day dawns and the court rises up to the service of SriPavan. Minimum, if not he work with Chandrikathasan to cover up Mullivaikkal, the souls of the dead bodies wandering in the lagoon will rise up thier hands and prey SriPavan

Unlike Aththanagala Princess’s house pet Kathirgamar’s end, hoping and wishing for an honorable discharge at the end of the service rather than facing a painful fate to end of the carrier and the life simultaneously.

Once up on a time, there was a Tiger with in the hyaenas of Huldrop. That Julius Caesar was murdered by Sinhala Intellectuals.

When one realize this, the 65% of the government service job holders gave it up and shrank to 1 or 2% rather than doing cooly work to Sinhala Intellectual masters from thier Honorable positions, the loss Tamils make it feel proud.

If justice Sri K. Sripavan is the next in line CJ then he should be given the job. All we want is a person who loves his country, and therefore honours the constitution and the laws of the land.

He may be Sinhala, Tamil, Muslim, Christian or whatever as long as the above is fulfilled that should be the final say.

We have had enough people from the different ethnic religious groups who have put themselves, their kin and their religion before honouring the constitution and the law, I say enough of on saying one ethnic group is better than the other nonsense. Didn’t all our forefathers fight for freedom together as one ?

If the law and the constitution are insufficient then it is the job of the people to pressure the legislature to make those changes, so lets do that.

Our expectation of the judiciary should b the proper and just implementation of the constitution and the laws and advice to the legislature on how to enhance it for the betterment of the nation and it’s people.

We lost our national dignity and identity of all Sri Lankan.
Removed CJ of Mr Mohan Peiris by MS regime is next step move for negative directions of Judiciary dominating out of hand of Majority of democracy.
Independence of rule of law that control by anti-Sri lankn ARATIONAL.

Sri lank will become second lost nation after 2015 January 8th Presidential election.

First step was that appointment of CB governor which become Singapore’s national by arbitrary decision.

We as nation want to address reconcile by politically, which there is some thing wrong in some where? WHO ARE REALLY CONTROAL SRI LANKA AFTER 67 YEARS?

Siripavan is the best choice for the job of CJ – no doubt. He has been endorsed by the law fraternity as well.

However I question the legality of President Sirisena being sworn in by Siripavan. Expect some issues to arise from this most unusual occurence. Siripavan at the time of the swearing in was not the CJ.

    hmmm food for thought.

“Siripavan at the time of the swearing in was not the CJ.”

So was mohan peiris,as the government says he was appointed illegally due to procedural flaw, and therefore appointment is void.

So who is the CJ that he has to sworn before?Obviously the former CJ shiranee. So if the constitution states that president has to be sworn in by the CJ(which i doubt, show me the clause)then the appointement of maithri as the president is void too due to procedural flaw.If mahinda becomes PM then he can get rid of maithri, get rid of sripavan this time with correct prcedures, appoint mohan peiris as the CJ and gotabhaya can take oaths as the president. All this would not happen if maithri did the reinstatement of shiranee immediately after the election and on the one day she came to office took the oaths before her.

However mahinda becoming the Pm is remote because he is a Libra and saturn changed house to mars on the 2nd nov last year.very bad for him for the next 2 and half years until it changes house again.Incredible that his astroleger did not know this and told him he will win.

The law is clear that the Oaths be taken in front of a Senior judge of the Supreme Court, not necessarily the CJ. So there was no issue with legality.

Sripavan apparently is the most senior of the SC justices, and I think you are reading too much into it.

    • 1

All you need is a Supreme Court judge to do the honours. No need of CJ.

BBS Rep: Please note that President Sirisena was sworn in by senior
most supreme court judge, which is perfectly normal and legal as per the laws of the country. It is not an unusual occurrence as you have stated.

Judge Sripavan. being the next most senior judge got this position and
it is a good sign for the minorities that the govt.looks into merits
and seniority rather than a pull a candidate has. How long will this
policy remain in effect is the question.

There is no country in world that all powerful President in Globe except Sri lanka?

Even most powerful nation like- Big power of USA, which, President of US no such power appoint all positions and post of State, Parliamentary and Judiciary, rather than MS Regime in Sri lanka?

That is how new democracy work in tiny an Island of Sri lanka.
MS regime, that back by UNP-Ranil W..,CBK,JHU, TNA,MC and JVP has demonstrated inability to democracies governances of ‘GOOD’ the areas hold ,but doing so largely by authoritarian RULE rather than democratic means and its values.

How is that MS regime mode of operandi works at Sri lanka?
That very lesson to be learn form ongoing ‘Rule of Law and ‘good governances’ that created lawless nation like Egypt, Indonesia( that after Surharatho in 1965 by coup) Tunisia, Iraq and Libya which after Arab spring.

1 MS has appointment of Primer Minister Ranil W.. of UNP minority Party in the Parliament. Minority elected to become PM is
anti-constitunital and denied majority norms of democracy.

2 MS sworn as President in before NOT that Chief Justice, but some of his own selects person, that is constituently illegal.

3 MS become President of Ex-Ruling party President of SLFP by using his power of Executive Presidency.

4 MS appointment Leader of Oppositions of SLFP by using his executive power of State. There no democratic world that any country in world that ruling party of govt. that President chair an Opposition forces and party.

5 By forces without going through the Parliamentary process, MS regime has remove Chief Justice Mr Mohan Peiris by using executive power of President of Republic. The action of President of MS is unconstitutional by the law of Land and violated the independence of Judiciary by authoritarian rule of bad governances.

6 An appoint Central Bank Governor of Singapore national by MS regime is against accepting practices of Financial norms and regulation of values of Sri lanka.
CB is governor must be Sri lankan national, that we have many skill and professional working Central Bank.

Of cause we need more transplanting and an open system of governances rather than past MR ruling alliances. But MS regime working towards various administrative bodies prevent democratic accountability; MS rule working towards AUTHORITARIAN RULE.

A reversion to the practice of appointing the most senior supreme court judge is most welcome. It will minimize ethnicity as an issue in these appointments.

Minister Rajitha Senaratne has stated that the accusations made by the previous government against former CJ Shiranee Bandaranayake are somewhat true. He must be feeling guilty for bullying her during the parliamentary select committee inquiry by insulting her and abusing her in raw filth preventing her from participating further in the inquiry. [Edited out]
We want this government to continue without any obatacles. We do not wish MR to come back. The above article contains good suggestions for the government.
