The daughter of Sunday Leader murdered Editor Lasantha Wickrematunge, Ahimsa filed action against Nandasena Gotabaya Rajapaksa in the courts of Los Angeles, California requesting a Jury trial and compensation. Gotabaya who was the Secretary of the Defence Ministry was widely known to be single minded and ruthless. His ruthlessness pervaded all he perceived and was not restricted to the LTTE.
Unlike strictures that bound other Secretaries of Ministries Gotabaya was not bound to follow any such rules. He was often seen making political speeches on behalf of his brothers and extended family. Any other government servant would have been issued a show cause and summarily dismissed. No, not Gotabaya. Apart from the whispered stories of white van abductions alluded to Gotabaya many were the published news of threats to journalists such as Poddala Jayantha and Fredrica Jansz. Yet this man wishes to be President of this country.
“There is no progress without discipline”, says Gotabaya throwing his hat into the ring to run for President. What about discipline for him? White vans, abductions, murder??? Is he a psychopath? Discipline? Certain signs of a budding dictator.
Gotabaya Rajapaksa was seen singing and partying with his ex Army buddies at the residence of his buddy Malraj de Silva ex Army surveyor whose wife runs montessori schools in Los Angeles. Never did he envisage that action would be filed against him as he had hired a legal firm headed by an Indian to cover his back.
Summons were served on Gotabaya on Sunday evening when he was shopping at a Trader’s Joe store. A tap on his back, “Mr Nandasena Gotabaya, summons for you” whilst photo evidence was also obtained shocked the once all powerful man. Let us watch how this action unfolds. Whilst Gotabaya answers whether he gave orders, executed the dastardly deed or supervised. That is the killing of the Internationally celebrated journalist Lasantha Wickrematunge recipient of the World Journalism Hero award and the UN award for Integrity. Lasantha was vilified by the Rajapaksas. But perhaps like all cowards he gave the nod to his trusted ex Army Intelligence Chief who passed down this to the next line and finally to foot soldiers who simply kill people not
known to them for the perks that come with it. Maybe overseas appointments to Embassies et al.
Let us hope that justice for Lasantha and the others will be met by a foreign country as Sri Lanka flounders on.

Let us not run out and break open the Champagne to celebrate the downfall of Gothabaya Rajapakse.- Not Yet!
This is a civil law suit – not a criminal charge. That is why there was no arrest, no perp walk, not even an indictment.
Both Roy Samathanam and Ahimsa Wickrematunge are alleging that Gothabaya’s actions caused them harm (torture for Samathanam, and death for Wickrematunge) seeking damages for harm done to them by Gothabaya’s actions.
Both Samathanam and Ahimsa need to prove their claim based on a preponderance of evidence and not ‘beyond a reasonable doubt’, a standard that a criminal indictment would require.
In other words – on a scale when all the facts are considered, plaintiffs need only to prove that it is more likely that Gothabaya caused the alleged harm to the plaintiffs in the case than otherwise.
It is a slow, painfully long process and very costly for both plaintiffs and the respondent.
O.J Simpson who was acquitted in the criminal case of murder of his wife was found guilty in a civil case brought against him by wife Nicole Simpson’s family and lost all his assets to settle the damage claim.
Gothabaya and military officers who committed any crimes when engaged in the final stages of the war need to worry more about ‘Universal Jurisdiction” – a new legal doctrine that is now being applied by many countries to bring errand political and military leaders to justice.
These wrongdoers run the risk of being arrested and detained when they leave the shores of Sri Lanka.
But the amazing irony surrounding the Gothabaya charge is this:
Plaintiff in one case is: Samathanam.
Plaintiff in the second case is: Ahimsa.
Samathanam = Peace.
Ahimsa = respect for all living things and avoidance of violence toward others.

This summons could mean two things to Srilankan political scenarios . Promoting
Gota or kicking him out of the race ! This move coming close to president election
heat could affect major parties in an unpredictable way and the US knows this .
One Sinhalese and one Tamil have marched forward to confront Gota but on a
foreign soil and on cases that happened on another territory ! We hear and see these
days how suspected drug dealers who are in remands of Dubai are being deported
to Srilanka and of them , some are freed and others are remanded . They were taken
in not for crimes committed back in Srilanka but in Dubai . The hearing in Gota case
will somehow require help from Srilankan authorities and that’s where Ranil Govt
faces the dilemma ! So , it’s going to be a cloudy scene I suppose .

This is great news. I hope Gota will have to pay big money when he found guilty like OJS. I hope many others will file civil cases against GR for killing their loved ones. Katunayaka victims, walikada prison victims, etc. US authorities will track GR’s hidden money he stole from Sri Lanka.

The costs of Litigation, for both Ahimsa and Roy Samathanam would run into Millions of US Dollars.
Even the Respondent Gota will have to pocket out quite a tidy sum to defend the suit.He may not have a problem on this score. The MIG deal [which Lasantha exposed] kickbacks are in his kitty!
Most probably, Ahimsa and Samathanam have financial and Legal backing. The timing of the whole operation could not have been a knee jerk reaction. Considerable planning was put in place. They must have known Gota would sooner or later turn up in the USA before his Presidential bid!
Anyway, this may be the last chance to reign in Gota.
Best of luck to Ahimsa and Samathanam. Whats in a name?

My friend brother was in USA, for Srilanka army training in Period, he( Tamil) and his friend ( Sinhala) , both was had removing. Gold(18,c) from Shoes, ( no American army officers don’t know this matter, ) but later Army intelligent officers found the removed gold ( shoe gold), because Americans not like Srilankan, then two persons deported to Srilanka, This matter ( those day Government) knew, today news Verra Gota.
