The daughter of Sunday Leader murdered Editor Lasantha Wickrematunge, Ahimsa filed action against Nandasena Gotabaya Rajapaksa in the courts of Los Angeles, California requesting a Jury trial and compensation. Gotabaya who was the Secretary of the Defence Ministry was widely known to be single minded and ruthless. His ruthlessness pervaded all he perceived and was not restricted to the LTTE.
Unlike strictures that bound other Secretaries of Ministries Gotabaya was not bound to follow any such rules. He was often seen making political speeches on behalf of his brothers and extended family. Any other government servant would have been issued a show cause and summarily dismissed. No, not Gotabaya. Apart from the whispered stories of white van abductions alluded to Gotabaya many were the published news of threats to journalists such as Poddala Jayantha and Fredrica Jansz. Yet this man wishes to be President of this country.
“There is no progress without discipline”, says Gotabaya throwing his hat into the ring to run for President. What about discipline for him? White vans, abductions, murder??? Is he a psychopath? Discipline? Certain signs of a budding dictator.
Gotabaya Rajapaksa was seen singing and partying with his ex Army buddies at the residence of his buddy Malraj de Silva ex Army surveyor whose wife runs montessori schools in Los Angeles. Never did he envisage that action would be filed against him as he had hired a legal firm headed by an Indian to cover his back.
Summons were served on Gotabaya on Sunday evening when he was shopping at a Trader’s Joe store. A tap on his back, “Mr Nandasena Gotabaya, summons for you” whilst photo evidence was also obtained shocked the once all powerful man. Let us watch how this action unfolds. Whilst Gotabaya answers whether he gave orders, executed the dastardly deed or supervised. That is the killing of the Internationally celebrated journalist Lasantha Wickrematunge recipient of the World Journalism Hero award and the UN award for Integrity. Lasantha was vilified by the Rajapaksas. But perhaps like all cowards he gave the nod to his trusted ex Army Intelligence Chief who passed down this to the next line and finally to foot soldiers who simply kill people not
known to them for the perks that come with it. Maybe overseas appointments to Embassies et al.
Let us hope that justice for Lasantha and the others will be met by a foreign country as Sri Lanka flounders on.

Gamaya you are absolutely correct, by paying fifty dollars anyone can file a civil case in a US court, if the complaint is correctly presented the clerk will sign and then the plaitiff pays someone to serve it, unlike in a criminal case there need not be evidence or any hope of winning the case, this is used as a annoyance or harrasement.

If the summons asks the defendant to answer certain questions or attend to court on certain days and if he doesn’t, Plaintiff is going to tell the judge the fact. Plaintiff is not going to tell judge because defendant claiming that he didn’t receive the summons the plaintiff wants to withdraw the case. If judge see the defendant is on denial game, he will order for arrest and bring him to court. When police take him to court, defendant will be talking about a bail, not of that plaintiff does not have a case because he is not served a with summons by Royal delivery.
If judge see plaintiff is in fault he will ask the plaintiff to correct the deficiencies. In this defendant will be picking the summons from the court. Practically there is no chance at all defendant is escaping the case, once it is filed and proper documents support that case. If attempt to hide, that is a “life time on the run!”

Mailing prove is accepted in many countries as delivery proof. So, mailing date, in those places, is the delivery date too for legal purpose. This is because mail is government service in many countries. This doesn’t go well with private deliveries. Lawyers use private couriers to confirm delivery. So if the client is not found couriers hang it on the door knob of the last known address. Though that is enough, to protect them, they photograph it too. Normally last known address is valid enough. But under normal circumstances, the client needs not to occupy any home as a legal requirement. A police officer may stop any vehicle and issue summons, like issuing a traffic violation. It is impossible for the client to sue the officer for stopping to issue summon. A summon can be issued in any manner, but not with illegal techniques. If Old Brother Prince’s aim is to run away from US court system with lame duck excuses, he will be stop at airport and picked up. If he is success in hiding, INTERPOL may do the look out.
The Modayas, by mistake thought it was a private detective’s delivery so they can deny the receipt of it. But, the plaintiff party has made them look goofed by releasing the photo. Entire world knows the dodgy behavior of Lankawe Royals. They would be prepared with their own precautions too. But, even if the photo was not there, denying the receipt or denying the existence of the court case will not work. Not receiving summon issued by court is no defense.

The server then files an affidavit with the courts that he/she had served the summons. This is the judicial system. With all due respect for the late Mr. Lasantha Wickramtunga, I really have not read anything outstanding written by him. Why he was awarded the “World Journalism Hero award and the UN award for Integrity” is beyond me. IMHO Lasantha became a symbol of whatever he is today, because he was murdered, not because of any special journalistic abilities or accomplishments. If Gotabaya or the Rajapakshas are the actually the killers, it seems that he was killed because of personal feuds, than his writings. In the atmosphere which prevailed in those days, it was not easy to be good humoured but he agitated when it was not necessary. Although we can all get angry, we must know to control our anger. Only weak people act up unnecessarily. Lasantha never got to fully expose what he was working on, because his approach was wrong and too confrontational. We must all be smart and think what we are up against before going to attack a whole system of criminal gangs and a violent establishment. He should have at least gone into hiding and finished what he was working on… Sadly things are the same or even worse now. This is a also a piece of advice to all the ideologically motivated activists – there’s no need to lose your lives by leveling unwanted attacks on the establishment. Think before you write and go into safety before attacking any politician and the rogue businessmen and lawyers etc. Lets hope Lasantha’s killers whoever they are, are found and punished.

Nothing is going to happened to Goata in the USA. He is their agent and proxy for the greater clandestine project USA (Unilaterally Sponsored Asshole). There were scores of kidnapping, abductions and murders during the reign of Mahinda Rajapaksa and his siblings Gotabaya Rajapaksa and Basil Rajapaksa. The murder of journalists is a serious matter. Yet more than 25 journalists (most of them Tamils barring two Sinhalese and one Muslim) were murdered and made to disappear after the arrest.
Nimalarajan Mylvaganam was a BBC correspondent from Jaffna. Mr Nimalarajan was very critical of widespread vote rigging by the EPDP during the general elections of 2000 in Jaffna. He was killed by an armed gang on 19 October 2001 at his home situated within the security zone. An army sentry point was just stationed just about 200 meters away.
The special investigation team of the CID searched the Jaffna EPDP office on 9 August 2002 on the order of the Jaffna Magistrate and seized a 9 mm pistol, allegedly used for killing the journalist.
However, the letter of authority produced by the EPDP officials in court on an earlier date permitting them to keep the weapon was for a 7.62 mm calibre weapon and not for the 9 mm pistol.
The first suspect was Kandasamy Jegatheeswaran alias Jegan, a member of the EPDP. In fact, while absconding in the Kayts area, the murder suspect is alleged to have sexually assaulted a girl student on her way home from Karampon Little Flower Girl School. But the name of the person suspected in committing the sexual crime was given to Police as one Kiruba and also a member of the EPDP, police said. 1/2

On March 31, 2004, it came to light in the Jaffna Magistrate court that the first suspect, in the murder case of Journalist Mylvaganam Nimalarajan is also the person who had sexually assaulted a schoolgirl on March 26 in Karampon south village while absconding.
The Kayts Police on an open warrant issued by the Jaffna Magistrate Mr.R.T.Viknarajah last week in the Nimalarajan murder case arrested Mr Jegatheeswaran.
However, the Police were unable to find a suspect with the name Kiruba. Later, they arrested Jegatheeswaran on an open warrant in the Nimalarajan murder case. On the orders of the Kayts Magistrate, the suspect was produced in Jaffna magistrate’s court in connection with the Nimalarajan murder case. Then it came to light that Jega and Kiruba is the same person and was involved in the murder of Nimalarajan as well as in sexually assaulting a schoolgirl on March 26, police said.
The case dragged on for over four years and then fizzled out. The suspects fled the country with the government’s connivance.
The EPDP also killed Ramesh alias Atputhan, editor ThinaMurasu in Colombo. Douglas Devananda did not attend his funeral and did not hold commemoration meetings for his colleague and fellow M.P. 2/2
