If as Harold Wilson said, a week is a long time in politics, it is an even longer time in diplomacy.

The upcoming week is the most significant in Sri Lanka’s contemporary history since the victories of May 2009, almost five years ago. Already the security blanket in the North indicates that a polarising resolution in Geneva will strengthen ‘the dark side of the force’. It is also likely to push most of the citizenry over to the dark side. However, Sri Lanka still has a week to dodge the cyanide-tipped arrow that is a UN mandate for an OHCHR led international inquiry.

The Northern Provincial Council has unanimously resolved to participate in discussions with President Rajapaksa, provided these discussions are without preconditions. OK, I know that sounds as if unconditionality is a precondition, i.e. that the condition for discussions is that they be unconditional. But that’s the only way to do it because there shouldn’t be, and shouldn’t have been, any conditions on talking with a formation, be it parliamentary or provincial, which has a democratic mandate. It was absurd for conditions to have been stipulated while discussions had commenced in 2011 without such conditions.

The offer to enter talks with the President is a last chance for the government to position Sri Lanka better in Geneva so as to open up space for a modification of the resolution, or if that fails, to narrow the margin of defeat. Though the intention of the NPC resolution may have been something else altogether, a speedy response on the part of the Government can turn this into a lifeline.

Even if the talks do not commence or cannot be announced before the vote next week, it is vital that they take place and make headway. The resolution or at least the management of Sri Lanka’s Northern Question was always at the heart of resolving the protracted crisis of the Sri Lankan state and society. It is unavoidable if Sri Lanka’s post-war impasse is to be overcome. More pressingly, resolving the Northern Question is at the very core of resolving Sri Lanka’s problems with the world.

If the Sri Lankan government fails to seize this opportunity and talk to the TNA and the NPC, it will soon be overtaken by a dynamic of political escalation located in a Tamil Nadu which is more influential than it is after the election. Colombo must realize that it is better to talk to Mr Sampanthan and Mr Wigneswaran than it is to deal with Jayalalithaa and Mr Modi. It is far better to settle with the TNA than be caught on two fronts, post Geneva: the UNHRC resolution/OHCHR investigation and a referendum-pushing Jayalalithaa.

After a heavy defeat for the GoSL in Geneva, the commencement of an OHCHR probe and the advent of a coalition government in which Tamil Nadu is a key player, Tamil politics and collective political behaviour in Sri Lanka will operate in a different register. Things may spiral way out of control. The only brake may be a process of serious political dialogue between the President and the elected Tamil leadership.

A problem immediately confronts us, namely the trust deficit. Neither side trusts the other and understandably so. A further and related question that cannot be avoided is why the earlier talks broke down and what can be done to prevent a repetition.

Given that I was part of the loop, though only a peripheral one, my sense is that the talks between the TNA and GoSL broke down for four interconnected reasons: behaviour on either side which went against the expectations of the negotiating partner and was promptly seized upon by the hawks on both sides; a lack of realism which prevented both sides from grasping the actual balance of forces on and outside the island; the conscious projects of disruption and escalation by the hawks on both sides; pressure from below or on the flanks from the more intransigent elements in civil society or in the Diaspora.

How then is one to push for the unconditional recommencement of a process of political dialogue and protect the process if it did commence?

The only way that I can see that happening is with external facilitation. More concretely, the only way I see talks re-starting seriously and being kept on track is if a new quartet of concerned external players were constituted as a collective facilitator. The parties I would suggest for this collective effort are South Africa, India, Japan and Australia.

If the Sri Lankan leadership invites these states to undertake the task of facilitation and agrees to a compressed time frame, we may be able to present in Geneva a joint commitment which permits the dilution and deferral of an intrusive, polarising external inquiry.

Of course, given the fate of the written undertakings of May 21 and May 23 2009 made by the Sri Lankan leadership, not to mention that of the Sri Lankan Ambassador/Permanent Representative who took these reformist commitments at face value and was sacked a mere six weeks after Sri Lanka’s resounding success in Geneva, I wouldn’t blame any state, however friendly and well-intentioned, of being exceedingly wary of buying-in. Given the ‘zero casualty-zero credibility’ reputation the Sri Lankan government has accumulated (what with ‘Gopi’ making it to the United Nations Human Rights Council!), I certainly wouldn’t blame the UN HRC for hesitation to believe it.

The only way to proceed then may be for the implementation of the commitment to be strictly time-bound, giving GoSL, say, six months, to comply i.e. until the September 2014 session of the UNHRC.

    Truth always triumphs however lies try to obstruct them harder.

      I happened to listen to DJ´s sinhala regular discussion to a local TV channel lately.

      There he said – the victory that govt named as it was can still be named as “not victory”. Meaning it looks that things turn its way worst for the MR administration.

      I think – in today´s context If MR administration was genuine, they could all have held several dozens of discussions with the elected NP candidate -Wignasvaran. As we all know in the past, it was very hard any govt or opposition politician to even make a platform for discussions. Recalling the earlier term of CBK, how many times Kadirgamar made genuine efforts to bring them (LTTE political wing) to discussion tables.

      Instead of showing wholeheartedness, MR is trying to benefit of his term. We the many that feel very against to BBS, felt it was a great effort by CBK to stand against BBS violence. But president now goes on saying that CBK and the other opposition folks are trying to win the people´s vote in a varied manner. Latter is like saying further yes to BBS or other segments that get mobilised to destroy the country.

You yourself repeat saying that current administration has failed to place the right person in right position, in the same time to avoid criticising MR is becoming a great puzzle to us readership. Not just trying to beating around the bush, but try to risk it. Either you have also fears to get whitevanned, or killed, or you are not serious about the alarming issues of the country. Basta.

            But I wonder why the man feels that his is in need. Even today he has come with an another piece. If his men in power failed to do the job, DJ himself could have approached srilanken lawyers on world stage to convince the stupid president. We call him stupid because we are all certain that MR is just a IRC, criminal minded a rascal only. But DJ to be away from criticising him is a big puzzle to me.
            He acccused RW of doing weak politics in the same time adding words on Premadasa junior´s success in Hambantota. Who on the earth will feel fine if Premadasa junior would fit better to run the country. Is it not like worst than the current situation ?
            All in all, we the ones being out of the country see coming colours is not at all good for the future of lanka.

            He is mostly focusing on the world theories when comparing them with lanken issues. CT articles must not be like lectures in political science; so long the contents are clearly formulated. And I really dont think many among us CT readership are familar with those world figures or the like such literiture (latin literiture). And the second point, I find his articles as you also say, often, passing know-all charactor and are not consistent either. And they are often biased too. Anti Ranil, but pro Premadasa junior. Anti CBK, but pro MR, even if MR´s administration has become to the level,that hardly anyone with sanity would agree with them, he stays silent saying nothing about impunity governing issues. Thilanga Sumathipala to set free an accused drug man was reported in the media yesterday, but how could this be ever possible, if MR regime works in accordance with stage rhetorics. I hated Premadasa in late 80ties, now I equally hate MR and their men today

            Clearly seen that DJ´s reactions lost his crediblity of the articles back and forth. NOt many would even take his serious to this day.

            Anyway,I myself find TG´s articles have a greater impact because her examples are mostly taken from the lanken societal incidents. Shamini´s are of my favourite because her writing style has been very simple.

            Today´s chaos are only because of lack of rule of law not having enough law provision within the prevailing consituational changes. Many incl us see it but DJ to ignore it – ? ?????
            If 17Amd was a part of the consitution, not this much of crimes would have been occured. Perhahps, we could save the life of that Mel Gunasekara, or the others that for no reasons left us all immatually.
            So, not criticising the key points, but just trying to make every effort still having second thoughts to join the MR administration is a joke I feel.

            I now believe, if 17Amd was there, not even UN would have followed srilanka in terms of HR violations in the post war times.

      TNA and the NPC or Mr Sampanthan and Mr Wigneswaran should NEVER get caught to such dead ropes. The Tamils have already talked with the Sinhalese politicians/leaders and the governments for the last 66 years and only got cheated with false promises. The Tamils should NEVER EVER trust the Sinhala leaders and SL governments. Any talks between the Tamils and the SL government should be with a foreign mediator like US or future Indian government.

      TNA (Mr Sampanthan) and NPC (Mr Wigneswaran) should never involve in any direct talks with the SL government. All agreements should be endorsed by the foreign mediator.

    It is actually Lost Week, Lost Chance for Dayan & his Sinhala regime.

    Nothing goes right for the regime & even the planned orchestrated arrest of Jeyakumari explodes in Geneva.

    With the Sinhala regime forcing the Cabinet Secretary of Northern province to slap cases against Northern CM which is unprecedented in a democratic setup, all his blabber of unconditional talks is just to buy time till next UNHRC Session.

    DJ’s desperate attempt to save the genocidal Sri Lankan govt shows his racist side to protect the murderous regime and continue their agenda and to hoodwink the International Community and destroy the Tamils in Sri Lanka.     I am not sure why you are asking for TNA to meet president. Is it to receive false promises? He is the father of all lies, who will promise something and will change it as he never discussed it. What happened to Tissa Vitharans report? What happened to the promise he gave to Ban Ki Moon? What happened to the promise he gave to Indian government? Have you ever heard of the word 13+? You are advising Tamils to be cheated again and again? You are advising this corrupt government to buy time until the great king MARA pass on the baton to his prince Namal.

    DJ, who is going to answer to 1000s of mothers like Jeyakumari?. Clearly her son, like many thousands of youngsters who were forcibly recruited by LTTE, was taken in to the clutches of Gota? Where is he? Where are they? You can simply say forget the past, because it hasn’t happened to you. Your sister or mother wasn’t raped? As you might have seen a recent youtube video on “training” of the recruits: it is beyond believe how a nation with 1000s of years culture treat women like these? Can you see the professionalism of those untrained trainers doing to these Sinhala army recruits? If they can do this to their own recruits who speaks their own language what would happened to innocent tamil women?

    DJ, don’t you think the time is right to realise this government is heading towards anarchy like the ones as we have seen in the recent times in the likes of Sadaam/Gadaffi/Kim?       He wants TNA to come for discussions, but why not the govt men cant make efforts in that regard. They are the ones that promised to bring peace. Promised not only to the nation, tamils folks but all interntional folks. promised to even big brother of the region – india who was one of the close allies to have stood by MR regime in last phase fights against LTTE terror in the first quarter of 2009.
      As few commentators clearly pointed out, it was not easy for any govts or anyone to get them to discussion tables. But today, the chance is open, but the government in power seems to be silly, unethical, unclever, incapable, half hearted, lethargic, – genuinely saying – NOT competent enough to hold regular talks. In order to start broad based discussions on long await peace issue, they have to have started it. Wignaswaran will surely agree with any genuine ones joining them in this regard. Why the buggers in lanken regime stay further mum, until when they are going to do so, are not clear to anyone. They are playing selfish politics to keep the power within their families. THat is it.
      People are betrayed. They have been looted by every means to this day. They have been made life long debtors. Highways are the advertisments for them to show off, by selling the souls of poor people to china. Chinese banks that have been black listed by WB have been dealted with MR today. There is no basis of their handling.

CT is a reliable source for IC to collect further info about the ground reality of the issues. So why not you directly become a hard critic of them ? MR has become a laughing stock to us all, but not to you yet why ?

    You seem to be still be a praiser of Mahinda Rajapakshe, why is that you dont get direct access to share him what you consider is to do next ?

    Dayan,

    You have accepted the need for external facilitation and the need to negotiate with the TNA. You may have to accept far more drastic external intrusion in the coming week and express your thoughts on how this should be facilitated.

    I think, the resolution will involve much more than external facilitation -very likely an independent external inquiry. The government will be wise to facilitate this without melodramatics, while commencing a serious dialogue with the TNA quickly, and genuinely implementing the LLRC recommendations.

    Ms. Balachandran has to be also released or charged under the normal rules of the land. ‘ Gopi’ , who many yet think is a fictional character,if real, has to be sought and arrested with less fear mongering and more scientific approaches. Rounding up youth, encircling villages and communities,and arbitrarily arresting persons, reminiscent of the recent past, is definitely not the way to go.

    Further, on what basis have you named the external facilitators? Why Austraiia? Why not the EU and the USA?

      Easy answer Dr N. Dayan names Australia because Australia (and for that matter Japan and South Africa are seen as being sympathetic towards the Sri Lankan government). India is a dark horse and probably thrown in by Dayan as a red herring.

If at all, the resolve of the international community has grown stronger and the recalcitrant attitude of this psychotic regime would not scare a bit that it needs to learn some lessons, some very hard lessons.

      Instead of charging or releasing Mdm Balachandran, the regime still treats Tamils as outcasts and has been trying all its tricks to subdue the Tamils and their aspirations. This dastardly regime has to pay for the crimes it committed. There cannot be two ways about it.

    The proud Sinhala ruling elite who took independence in 1948 to mean Sinhala hegemony over the island give it up as it snatched victory from the tiger’s mouth?

    How can we swallow the pride and negotiate with para demala?

      The National Security Forces which defeated the Tamil terrorists to liberate near 300,000 hostages from them (alleged kith and kin) do NOT need to be investigated by an ‘international body’. Some of us seem unable to let go of the Tiger’s tail. The sun goat had the chance to save his skin in February 2009, but was persuaded to continue on the lethal path by Vaiko and others who believed in devine providence, and we know the result.     This government loses at international fora simply because it considers this country belongs only to the Sinhalese and the minorities should live under them .
    It will never change its stand unless it is forced by powerful forces locally or internationally.

    Talks between the government and the TNA broke down because the government was never ever ready to devolve power to the North. It just wants to buy time until the next parliamentary and presidential elections.
    This is the truth. So let us ponder and prepare a road plan to defeat the chauvinistic forces.

      I agree with you mostly. But internal road plan will never work as the Sinhala Buddhists are incapable of resolving the ethnic disharmony. This is because they have been systemically programmed to feel insecure. As you said that they feel that the entire SL is theirs by right; the entire state machinery is geared to carry this policy through so devolution is seen as contrary to their rightful right!

      Only way is to force a solution with an international mechanism but it has it downsides but overall the benefits will outweigh the downsides.

    Dayan’s advice the government is how craftily they can escape from International investigation.There is no advice or concern about the moral obligations of the government to its citizens especially a wounded minority. He is only worried that the government is going to lose its chess game in the geopolitics.
    If his wife and children are treated like how army treats the Tamil women and children of the North, he would not be singing this tune. Instead he would hope the International bodies will take the rogue government to task for violation for democracy,torture and rape of innocent civilians,subjugation of free press and inumerous vioalations of human rights.
    Dayan,the only way to escape investigations is to restore good governance. How come you cannot get this into your “intellectual” brain?

    The Tamils do not expect much to happen in Geneva. They are placing greater faith in the Modi Govt which will come to
    power in a few weeks time.
    Why is the TNA having talks with Sinhala Govt representative in the Human Rights Council in Geneva at this time?
    For God sake wait for the Modi Govt comes to power in India.
    I hope the TNA. politicians have listened to the recent speech given by Mr Jaswant Singha who was a Foreign Minister

    President Percy Mahinda Rajapakse has already Lost the UNHRC resolution and has screwed our country both Locally and Internationally.

    We know that intellectuals and journalists like you Dr.Dayan, Tisaranee and many others including opposition UNP gave enough warnings to Percy MR for over Four years about what is going to come.

    But the moron along with the Sinhala Buddhist Racists who became too Proud after the war, were celebrating war victory, having parties all over, lighting fire crackers and eating Kiribath and did not listen to Intellectuals to find a lasting solution to the Tamil issue.

    We saw how President Kicked you, Tamara Kunanayakam and many other intellectuals who helped win 2009 UNHRC, and replaced Foreign Ministry with mere uneducated, unqualified,party goons and Yes Sir Goats.

    Also many times when President travelled to England he saw the Tiger raments protesting for their rights and who were pressing for a lasting solution.

    But the President did not listen or act on their demands, but merely putting up Posters, cut outs, roads and bridges while looking for prestige, playing a One Man show band.

    Is Saturday’s Election ,Ms Pillai and her US, Cameron, Harper and Disapora Alliance Vs Rajapaksa and his great majority of the inhabitant population?.

    Watching the final days of the campaign , it appears to be the case, particularly in the WP.

    How sad is that the oldest Party in Srilanka has to go behind Ms Pillai and her handlers to win an elections..

    Pandering to the West is fair enough if the UNP wins elections on real issues like the Development, Infrastructure, Employment, Security of the Nation,and other Rice and Curry issues.

    But allowing the LTTE supporters who have now become rich and powerful in the West to change regime because, the current Got wouldn’t allow the LTTE proxy Pollies to implement the Tiger agenda, is rather pathetic.

    Shouldn’t Dr Dayan become the mentor for the UNP and steer them in the right direction, with this strategic brilliance in his political tool box, which he often offers us free of charge.

    SL has not ratified ICC so UNHRC cannot drag SL to war crimes tribunals without security council approval. SC will not approve without China.

    Looks like you don’t appreciate what Dr.Dayan did at UNHRC in 2009.
    He saved Sri Lanka from UNHRC allegations.

    But Your crook comedy master Percy Mahinda Rajapakse (PMR) kicked all the qualified intellectuals, professionals and scholars from Foreign Ministry, foreign missions, all Govt. institutions and corporations and inserted his unqualified, uneducated Family and party goons.

    As a result all the Institutions including Foreign ministry started FAILING VERY BADLY.

    SRI LANKA HAS ALREADY LOST 2014 UNHRC AND WILL HAVE TO FACE WAR CRIME CHARGES.

    Had PMR (Pissu Moda Raja) implemented LLRC as Dr.Dayan advised him in 2009 and implemented 13th amendment as he (PMR) promissed to Ban ki moon when he visited Sri Lanka in 2009, we would have not have to face this UNHRC resolution.

    But the adament and swolen head PMR did not listen to anybody, and as a result Sri Lanka is facing numerous problems, losses and humiliation in front of the world.

    It’s time to kick out the crazy PMR and take our country back from thieves, thugs, drug mafias and morons.

    Dayan’s latest attempt to save the Rajapaksa regime from UN sanctioned international scrutiny. A desperate attempt, I would say, to save the regime from possible regime change plan of some outside powers. Dayan’s fear is the fall of the Sinhala supremacist regime embodied by Rajapaksa. Dayan needs to realise that Sri Lanka is doomed under Rajapaksa and ditch him as soon as possible before he loses the little credibility and respect he has left among the true patriots of Sri Lanka.

    See right from yesterday on, MR himself is on the mode of abusing general public telling that ” I would never second to anyone but to our own folks”; this is busness as usual. This man is deliberately making own folks fools.
    Colombo university senior students proved today that nothing has been done in terms of hostel facilities though each of the new comers are asked to pay an entry fee of 3000 rps. What have these buggers done during the last few years ?
    Only road constructions ?
    If they made the nation debtors for those so called projects, why could not they continue maintenance of university hostels and the like as had also been in the past ?

    DJ in trying to dodge a bullet, – his metaphor for the UNHRC Resolution in Geneva -, argues for a serious political dialogue. Hidden in his argument is that SL was never serious in its dialogue with Tamils.

    This calls for an external Arbitration, not just Facilitation.

    All this could have been avoided if the Rajapakse family gave unto Wigneswaren’s NPC what is morally and legally due – to allow the Council to function duly and effectively. The 6 months involved would have provided a fairly good example for the Rajapakses to tell the UN and the world they are, at last, trying to be honest. In the absence the Rajapakses, once more, are paying for their pettiness and poor diplomacy.

    Trying to get consensus from the Kandy Mahanayakes at the 12th hour is poor thinking. This is something that should have been done earlier. The 30 minutes costly advertisement in the NBC and ABC Channels in the U.S. today is a foolish idea. The American public hardly come in to the scene in formulation of US policy on Sri Lanka. They have little time or interest for a distant land of whom they know very little. This poor idea is a racket by some to make a fast buck. It will be interesting if the Govt tell the people (thru Parliament or the media) how much was the cost.

    US Policy is shaped by a team of experts including Blake (now in Djakartha), Samantha Power, Nisha Desai Biswal and others – many of whom the Rajapakses have unwisely alienated.

    Dayan’s suggestion of Australia as one of the countries to work out a formula is in suspect faith. Australia has sacrificed its neutrality in favour of the little business they get from Sri Lanka. If at all a 4th country is necessary, it should ideally be Germany or Switzerland.

It is also likely to push most of the citizenry over to the dark side” We had an inkling of this warning when Lalith Weeratunga was despatched to the USA a few weeks ago and he threatened “there will be chaos in the country” if things go against the Rajapakses in Geneva. The Rajapakses will only be adding to their troubles if they allow attacks on Tamil civilians in the South and elsewhere.
