Mad King Nandasena Executes Plan To Strip Political Opponents Of Civic Rights – Special PCoI Appointed

President Nandasena Gotabaya Rajapaksa made a giant leap towards dictatorship for life on Sunday, January 31, 2021 appointing a Special Presidential Commission of Inquiry (SPCoI) to determine whether politicians and public servants implicated by his Political Victimisation Commission should lose their civic rights.

A gazette extraordinary, dated January 29, 2021 established the Special PCoI which to take the Political Victimization Commission to the next level of persecution against Nandasena Rajapaksa’s political opponents. The Special Presidential Commission of Inquiry will be chaired by Supreme Court Justice Dhammika Samarakoon and will also comprise SC Justice Kumuduni Wickremasinghe and Court of Appeal Judge Ratnapriya Gurusinghe.

Colombo Telegraph learns that President Nandasena Rajapaksa has decided to utilize a Special Commission of Inquiry to take action against those the PCoI on Political Victimization has recommended for punishment is a result of the Attorney General repeatedly clashing with the Abeyratne Commission on overstepping its mandate by going into cases currently on trial in the High Court.

On being ordered to cease currently ongoing trials, AG Dappula De Livera refused to do the Commission’s bidding and publicly rebuked the Abeyratne Commission’s request. The Abeyratne Commission attempted to get the AG to suspend trials into the abduction of journalist Prageeth Eknaligoda, Ali Roshan the elephant trafficker and the Navy abductions case.

In terms of Article 81 of the Constitution once a Special Presidential Commission of Inquiry recommends individuals should be subjected to “civic disability” (loss of civic rights), Parliament must pass a resolution by a two third majority to strip that individual of civic rights for a maximum period of seven years and expel such a person from Parliament. The resolution must be introduced to Parliament by the Prime Minister.

Not since JR Jayewardene and his 5/6ths majority in Parliament has any executive President attempted such a blatantly despotic maneuver to decimate the opposition.

Tellingly, Sajith Premadasa the Opposition Leader whose surreptitious dealings with the Nandasena Regime has recently been in the spotlight is not listed for persecution through the Special PCoI.

Remarkably the main opposition SJB whose senior members are facing prosecution and jail time based on the recommendations of the Upali Abeyratne PCoI on Political Victimization and now a loss of civic rights, is yet to take a strong and credible stand on the political witch-hunt. However the JVP and pro-democracy organisation Lawyers for Democracy are expected to challenge the findings of the Abeyratne PCoI on Political Victimization in court.

The PCoI on Political Victimisation singled out key opposition MPs for prosecution, writing an entire chapter on the Anti Corruption Secretariat that functioned by order of the Cabinet of Ministers during the Yahapalanaya Government.

The loss of civic rights would render all these politicians, which together form the core of the current opposition to Rajapaksa rule, would not be eligible to vote, and therefore also ineligible to contest for and hold public office. In the immediate term except in the cases of Mangala Samaraweera and Malik Samarawickrema, the loss of their civic rights would expel the MPs from the current Parliament. Samaraweera and Samarawickrema did not contest the 2020 parliamentary polls and are not current members of Parliament.

Government sources told Colombo Telegraph that the intention is to pursue politicians through the Special PCoI but others singled out for prosecution by the Political Victimisation Commission would have the threat of prosecution hanging over their heads instead. In the list of those recommended for punishment by the Political Victimisation are current Rajapaksa stalwarts including retired members of the police and armed forces. At least two former Foreign Secretaries, several diplomats and at least two lawyers attached to the Attorney General’s Department have also been recommended for prosecution by the Abeyratne commission which handed over its report to President Nandasena Rajapaksa in December 2020.

The first blame should go to the previous Ranil_Mithiri regime because the people gave a mandate after long sacrifice to take legal action against the crimes committed by Rajapakse family who robbed the nation in the name of Lord Buddha. Today not only the officials, even the people are afraid to talk about their crimes. However, it is time for Sinhala people to realise that Rajapakse family dictatorship will sell this land to China and and make all Srilankans as slaves to china and runaway from the country very soon.

That was sadly not the case, since Sirisena was cheaped to Rajapakshe criminals from the begining on. THis was unfortunately covered from the people, since Ranil W is a decent politician. Day before yestreday i heard him saying ” Japan and India were contacted by his govt in order to search for funds for new investments” And Japan had offered loans on 0.1% interest for a period of 40 years with first 12 years being kept as grace. Can you imagine ? However, power greedy bitch s sons painted the picture in favour of their power gains, not having thought for the future of the nation. They are worst than mafia men. I know sinhala people would attack me, on and on, thinking that i am not sinhalaya, but ridiculous truth is Rajaakshes fish on muddy waters for their political survivals.
        The story regarding BOND SCAM was the same, that was not originated by Ranil or Maithrie… however, the architect of the BOND scam came into being through Mafia boss Mahinda Rajakshe govt.         You have the right to disagree and I do agree about it . I didn’t
        want to enter into the ” Chicken or the Egg ” dilemma ! But
        my observation goes further deep . This lot that is in power
        already had the ability to create anarchy in the country had
        any of them got caged ! The rogues in the name of Patriots
        displayed clear signs in many ways . Shops were set ablaze ,
        Mosques were targeted , and their backers were mobilised .
        There were clear signs destruction was waiting to happen .
        This is my personal calculation taking into account what was
        unfolding at the time ! We can even go to the extent of
        guessing that Sirisena and Ranil jointly played the exit game
        in order to prevent the hell getting loose ! After all , all of them
        are cards of one pack ! So , my write up was limited only to the

      This is better then the FP/TULF getting their opponents killed after being voted out…very “intelligent voters” decision override/reset button pressed meant certain death then in the 70’s by the children of the voters sold to foreign lands….hand grenades/bullets/stones/fire bombs/harassment/intimidations/death threats/name calling….this was in peace time in Jaffna…..override law enforcement/elected Mayor and conduct Tamil Research Conferences visited by Indians in open violations to National law…then shoot and kill the police and then blame them for all what happened………..

    No surprise to many. This outrage was predicted a long time ago. Everyone, except his loyal supporters, knew that this was the end game. Many experts, and even the media, here and abroad, saw the signs and called it out. The Rajapaksa’s are basically traitors to our country and our Constitution. They have removed Judges, professionals, Career diplomats, arrested activists, political rivals, or those who in their sick minds, THINK are a threat to their grand plans, and replaced them with yes men an women. Then they bring into their corrupt administration, war criminals, felons, murderers, and the scum of Sri Lanka, some pardoned, some released from prison, and make sure they have in place a regime full of greedy and dishonest tough guys, who will steal, cheat, and kill for the Rajapaksa’s without hesitation. This has been so gradually done, that they hope Sri Lankans will be too busy focusing on Muslim burials, and minorities being discriminated, and will not notice the autocratic regime consolidating themselves.

    As for the Rajapaksa supporters, hope they are all very happy and satisfied, how things have turned out, including the racist policies, discriminations, arrests and silencing of political rivals. They are going to have a jolly good time seeing their idols, the Rajapaksa’s ruling this country forever. Perhaps they can rename this country Rajapaksaland, that would be fitting.

      we have thousands of examples to place before the very same nation. They would pay close attention even if their lovely ones would have been hurt. Like for example, I happened to pass the video how a visting srilanken woman being faced in a hotel room, not being offered the minimum facilities even if collosal sums were charged. There, they just ignore it. How can this be if there are some sort of legal systsems are in place in the country. Why should it fall that deep within shorter period of time ?

      There is a sizable gap between truths and what are being telecasted by biased TV channels within the country ( Ada Derana TV and Hiru TV).

    It is my suspicon that Sajith lost the presidential election by design. The plan was hatched to lose the presidency then walk out of the UNP and destroy it as well. It is also my suspicon that some of the UNP seniors who remain with the party know this and are too scared to reveal it or take a stand. This is why Ranil remains UNP leader. It is out of fear. Those that left the UNP also know the truth but chose to leave in the hope that new master (Sajith) offers better protection from scoundrel family than the old master (RW).     I hope this “Development” that followed after the UNHRC Report would also be “VIEWED” in all seriousness along with what has happened in Myanmar (Burma). In Myanmar, the “Army” take over is now being interpreted in some quarters as being in keeping with the “Constitution” of the country. (1) A Presidential Commission was appointed to examine “Political Victimization” from Jan.2015 to Aug. 2019. Now those “recommendations” have to be looked into by another “Commission”, mainly to “Recommend” ways and means of implementation of the other Commission. All those “STEPS” are as per the “Constitution”. So on the surface, isn’t there a “Similarity” between Myanmar and Sri Lanka? Yes. All actions are in keeping with the “Constitution”. Yet, then, “WHY” the world over voice against Myanmar is pouring in? It is not a matter of “Constitution”, but because of the “WAY” such “Constitutions” are “USED” and “ABUSED” to undermine Democracy and Human Rights.     Constitution says there are three centers of power – Parliament, President and Judiciary, but Nandasena has added another the fourth one Presidential Commission.

    Nandasena will appoint one commission on top of another commission so that the legal decisions that cannot be legally obtained from the courts can be obtained from these commissions.

    Is it RULE OF LAW OR ROLE OF LAW?

      MyView: Yes. He was punished by the Judicial Service Commission for finding him “GUILTY” on the inquiry into a complaint. The punishment was “Compulsory Retirement” from Legal Services. So he remains a “Disgraced District Judge”. How “FUNNY” such a “Disgraced Judge” to be appointed as the Chairman of a Commission and holding “Kekille Court” to decide on cases that are pending in our Judicial system. Isn’t the very person who appointed him to a Commission and its President more a “LUNATIC” than this “Clown”?

    I am sick of political witch-hunt in Sri Lanka which takes place every time a new government is formed.
    I think the “mixed list” is to hoodwink people that the Presidential Witch-hunt Commission of Inquiry is impartial.
    I don’t understand the stupidity-sorry-justification of the Political Victimization Commission to recommend “victimization” as a punishment to political opponents and state officials.
    Including this Political Victimization Commission, all Presidential Commissions are POLITICAL BODIES chosen and financed by the President. That means, there is every chance that their recommendations will be discriminatory.
    I think, the two SC judges appointed to take action based on recommendations by the Victimization Commission are judges recently promoted by the President, who are indubitably obliged to please him.
    I wonder whether extra-judicial activities, recommendations and actions by Presidential Commissions are in par with our Constitution as they can directly impact the impartiality of the Judiciary and thereby violate the rights of individuals “listed for punishment”.

    All our politicians have been rogues (except the JVP guys possibly, too extremist in the past to get any traction). They raise the ethnographies-religious smokescreen to hide their crimes. We have a collection of sundry crooks and criminals displacing another lot of rogues. This has been the history of our politics. There seems to be no way out of this cycle. Unless the good Sinhala Buddhist people can wake up from there stupor, we will go the same old way. The Sangha has an interest in keeping the people in their stupor as they need their Benz cars. So we muddle on. The wise among us migrate (not to China). Even the Rajapakses don’t send their kids to China. We are on a slide that will not be reversed.

    This is the new form White-van Administration. The vans no longer dispatched from Rapist Army camps or the drivers are no longer the paramilitaries and militarizes. The new form of the coolies is Law College certified & admitted into Board with experience in Courts. Yes the Vans are abandoned. The operations are carried out from the Benches of the sanctimonious Court podiums. This is why Ranjan, who is a critic of the double justice, Sinhala Jury Only courts, was the first Ram to sacrifice. But the white-Courts are worse than the White Vans. How can the lowest civilized clan, the Sinhala Buddhist Intellectuals, in the corner from South Asia can imitate the Western civilized people using Court system and Democracy? This very bad injustice Britain did for Tamils, that putting the Tamils and Rowdy Wijeya’s decedents, Sinhala Buddhists on the same yoke.

    Cicero, Every cycle has a breakthrough point. If you can find it you can start a fresh and different cycle. It is found usually in health or education. We now have a pandemic and vaccines. Out of this will come a change. In the time of Mrs. B, the focus was on education. We stood in queues to get a few yards of white cloth for school uniforms. Then a crazy NCGE to replace O levels became break through back to A Level. The more weird the off path, the faster will be the come back of justice and righteousness, indicating there is a higher power ruling the world. I am not talking about conspiracies, deep state or another unifying world order. This is a real life experience that all will go through someday when it may be too late for karmic change. Let us be mindful of the eternal now in which we live.

      I do hope that you are right David. Hindus and Buddhists believe in karma.Christians talk about the mills of God grinding exceedingly small. But, we do not see anything happening to the bad guys in Sri Lankan politics. They kill, maim and slaughter. They steal and plunder from the state coffers. Yet, nothing happens to them. The Hand of God remains stayed. The arc of justice has not turned. So it is very frustrating, David. Are the Rajapakse kattadiyas so strong?

        Cicero, It is not that kattandiyas are strong but that when they reach their lowest depths, karmic justice is inevitable. Law of sowing and reaping is working. Though it looks as if they are successful, they are suffering guilt as they know they will be judged if they don’t grab power somehow and control the judgments. They want to destroy all opposition by removing civic rights, but the numbers targeted are too many, there will be many court cases for trying to dispute supreme court verdicts as contempt of court, even the highest taken to courts, and impeachment is a solution. The need is to find solutions to issues, but the struggle here is to eliminate political opposition. Power hunger is focused without justice.

    The need of the hour is the strategy change in Tamil Parties’ approach to Geneva. All these time they opposed the International Inquiry. Now, other than TGTE, all Tamil parties submitted a unified request for investigation. Disappointingly, TGTE still sent a separate letter to OHCHR, insisting its meaningless Referendum. The chaos in that is, the British unit of TGTE contributed to the 250 organizations’ unified letter. But, Mother Organization of TGTE went with its unique statement. Earlier too, when Mother Organization sent a letter to Ex State Sec. Mike Pompeo on his visit to Lankawe, one of its member Nimal Vinayagamurthi attacked Pompeo here in CT. This referendum is nothing but the old TC leader GG’s 50:50. It is an attempt to force IC to ignore Tamils’ plight & creating an edge to Aanduwa.

    The unified statement by Tamil Parties will, this time, enable the UNHRC to understand what the Tamils want, that is nothing anything a short cut, but a long, stable freedom and peace. Tamils are asking what they lost when Portuguese killed their king Chankilian. Now some Sinhala realists are starting to understand that they too did not get back what they lost on the death of Dom Juan or Wickramarajasingan, their sovereignty as they are the Buddhist Sinhala Society. Tamils should unify these realists, (not the chameleons like Thero de Silva) and take them to UNHRC to witness to the IC what went wrong when in 1948, the earlier British government gave freedom to Lankawe. This will help the UNHRC to be object oriented when it take up Lankawe’s matter this time. So, while the end of their action giving freedom to Tamils, the Buddhist Sinhalese also will get a government that truly care of Sinhalese, instead using their human nature to fill up the rulers’ bank tills in foreign countries.

    Champa says he is disgusted over political witch hunt , I say relaxl is not so bad as you think , its political bollywood , in bollywood girl chase boy , boy chase girl and lot of dreams playing socks.
    In Political bollywood its a different twist , the government chases opposition and opposition crys foul,
    and dreams fo not play sock on them, but people go into hallucination , holding to ransom those who voted is the common song .
    The political culture must change and needs to come from the minorities by kicking some of their yakos( devils) on their backs & groom young and extremely progressive minded and none among , especially those heavily doped on extreme religous opium& no experts among those who cut concrete with Swords , omg did I offend a people who strongly believes he is thier one and only one, ever best? Thousand apolagies .no ofence meant .
    And darling my love Sri Lanka, so it goes , like the river flows surely to the sea , somethings are meant to be.
    This Political culture is meant to be ,until & unless the entire people agree to change it.

    Wonder how many are aware , it was
    Minister Wimal Weerawanse who pushed the law to prevent foreigners from buying properties in Sri Lanka with the same privelege of citizens.

    He also pushed the law to implement the sale of Apts to foreigners only above the 5th floor or from the 5th floor.

    He also brought in a very good proposal to charge a levy on luxary homes per sqft , if implimented it would have discouraged lot of people who are struggling today to up keep large houses with space they may have even never used .

    I am not sure if the law of foreigners buying properties in Sri Lanks was implimented during.his term with
    Madam Chandrika under JVP,
    but the luxaury tax never was implimented.

    Howwever I never agreed on his and JVP members proposal to charge a fees on water wells.

    The only way to save our funds , and most importantly our natural resources is to find ways to reduce extraction and over use of it ,when it can be reduced.

    No one thinks of keeping anything for the future generation , even at the cost of destroying the entire enviorment, only things that matter is everyone wants more than they need and every miner wants to make maximum money .

    We have PCOI and now SPCOIs. Ay recommendation cum decision of an SPCOI to strip a person of his civic rights needs a parliamentary approval with a 2/3 majority. Now any keen observer would know that the 20th amendment was passed because some opposition members, a few in numbers, decided to vote with the government. Are people that sure that the performance could be repeated without limits? A million Dollar question. It has to be read in the context of infighting that takes place even within the government, best described as “freedom of speech”.
