From early September last year, I have been saying that the Rajapakse regime entered a period of acute decline and qualitatively sharper crisis, starting final quarter-2012. Events have borne this out more vividly than anticipated, and the slide appears more precipitate than expected due to a confluence of accidental occurrences. But I repeat, ‘appears’; this is not accidental; it is in the nature of things. When foundations rot, at a certain point collapse sets in; then a system that would otherwise have ridden through difficulties is faced with calamity. An inconspicuous and somewhat boring Chief Justice has shaken the regime to its foundations by being a little stubborn!

What is surprising on the other side is the handling of the impeachment issue by the UNP which has, in any case, been behaving oddly for some time. Its contortions betray inconsistency and confusion. The last thing I wish to do is upset the applecart of opposition unity when all who oppose Rajapakse’s onslaught on democracy must stand together. But when concerns arise about the rectitude, reliability and transparency of one of the major partners in the united opposition, it is necessary to take the bull by the horns, demand straight answers and hold the UNP accountable. That’s the way to strengthen unity. The Asian Human Rights Commission has raised a red alert of a possible palace-led coup in the coming weeks therefore it is doubly important to clarify these concerns.

Is the UNP really opposed to the impeachment witch-hunt orchestrated by the Rajapakses, or is it up to some devious game? Why is Ranil behaving in a manner that leaves an unsavoury taste in the mouth that engenders justifiable suspicion that he is collaborating with the witch-hunt? Public disillusionment is widespread after revelation that super-luxury accommodation was paid for by the SL Embassy, for him and his wife on holiday last week in Venice. At this time, when impeachment fires were blazing out of control, there is palpable fear in society at large that Ranil is in Rajapakse’s pocket. Bahu shouts at Tissa Attanayake that the UNP is a traitor, but there is nothing he can do to deter his erstwhile big-brother ally from subverting their Joint Opposition.

Let me clarify what I am not saying. I am NOT saying that those who suggested, some weeks ago, that CJ-Bandaranaike (CJ-B) should step down, because her husband was embroiled in financial controversy, are now contradicting themselves by opposing the impeachment. I did not call on her to step down because I did not discuss the issue, but had I taken it up at the time, it is possible that I too may have said she should resign. Impeachment, however, is a new topic that cuts across this previous concern; it is far more important, and makes that matter irrelevant. I go so far as to say that if CJ-B were to step down now, it would be a stab in the back of the public which has rallied to shield democratic norms. None who said, at that time, that CJ-B should resign, should repeat the call, at this time, when defeating the witch-hunt is synonymous with defending democracy. Fighting on, not stepping down, is the task now. I see no contradiction in UNPers who were uncomfortable with CJ-B’s incumbency at that time, standing against impeachment at this time. If you donned a fur coat in winter you must discard it for a cotton dress when summer arrives.

Ranil’s vacillating ways

However, there are other matters where the stance taken by Ranil and the UNP is indefensible. I will deal with three; the refusal of the UNP to be forceful about the threat to democracy and its reluctance to take the lead in mobilising opposition, despite being the largest component; second, Ranil trashing the Supreme Court’s determination that it is unconstitutional to use Standing Order 78(A) – SO78A – in impeachment proceedings against a judge; and thirdly barring the two UNP Select Committee members from participating in the Appeal Court hearings of January 3 and 7. Ranil has, in effect, assisted Rajapakse to prosecute his dangerous agenda.

Imagine if a government played fast and lose with democratic and constitutional propriety, or subverted judicial independence, when giants like NM, Colvin and Pieter were in the House! The blast inside the Chamber and the mobilisation outside would have put an end to the nonsense. All criticise the Old Left for its expectation that socialism could be ushered in by coalition with Mrs Bandaranaike, but nobody has accused them of a lickspittle mentality and submissive toadyism to the prime minister. Ranil may not be a lickspittle stooge to the extent of today’s Dead Left trio, but he lacks fire and guts. Is that a personality trait or is he seeking opportunist accommodation in exchange for received and/or anticipated benefits? I suspect it is a blend of both. How the Dead Left leaders vote on impeachment depends on the leeway their boss permits them without getting fired from their jobs as low level jokers in Cabinet.

Just before Christmas the Court of Appeal (CA) took up the constitutionality of the Parliamentary Select Committee (PSC) and warned the Speaker to be restrained till its determinations were finalised so as to avoid a “chaotic situation”. Unsurprisingly, Mahinda Rahapakse’s brother, the Speaker, rejected the request outright; but surprisingly Ranil too told the CA to keep its nose out of PSC business. Then when the Supreme Court made a ruling, read out by the CA on 3 January, that SO78A had been employed in a manner inconsistent with the Constitution and that the PSC’s findings are null and void, he suddenly changed track and called upon Parliament to abide by the ruling. So Mr Ranil what became of your much publicised demand that the Court keeps its nose out of this business? The UNP first played along with Rajapakse but when the tide turned it decided to ride the public mood for political mileage.

The barring of the two UNP members of the PSC from joining the JVP’s Vijitha Herath and TNA’s Sambanthan and making an appearance before the CA on 3 January is an act of treachery – Sampanthan is abroad and put in an appearance via his lawyers. The regime’s case that there is conflict between Parliament and the Judiciary is blown sky high when the representatives of the parliamentary opposition refuse to boycott the CA. Then it becomes clear that the conflict is only between the government parliamentary group and the Judiciary. So why did the UNP undercut the opposition united front and attempt to give credence to the picture that parliament as a whole is at loggerheads with the Judiciary? Search me; I have no answer except speculate that the hotel in Venice must have been classy, or that Ranil and the UNP are up to dirty tricks to wreck the anti-Rajapakse opposition. Harsh judgement? Well it’s a crucial point in history, and the UNP’s game is alarming.

Saving the system

The impeachment saga is the only game in town, and frankly, of the significant parties, the JVP is the only forceful opposition player – the issue in centred in Sinhala-land hence the TNA, despite a correct stand, is an outsider of limited effectiveness. It is the JVP that is making all the running at this time and I predict that it will make gains at the cost of the regime and the UNP. Mark my words, in a year the JVP will be stronger. Now, I don’t want to hear infantile gibberish that I have become a JVP fellow traveller; I am making a prediction about potential benefits based on observed current activity.

The Peratugami (or Frontline Socialists), the JVP breakaway group, is at sixes and sevens and unable to cope with fast developing situations. It is at sea, unable to work out how to intervene; a difficulty the JVP, with its much longer political experience, is not facing. To the Peratugami, this chap Lenin, his strategic approach to basic objectives, and his finesse in tactical issues, is a closed book. There is some usefulness, nevertheless, in simpleton fundamentalists. Let me explain.

Rajan Philips said last week (“Year of Judgement”, Colombo Telegraph, 6 January),

 “(T)he UNP opposition has boxed itself into ineffectuality by being dishonestly evasive. With Machiavellian intent the UNP leader wanted the CJ removed and the government fatally discredited. It has backfired on the UNP; it has lost its identity in the impeachment drama; it has talked from both sides of its mouth and lost its credibility.”

But even Rajan does not ask and explain why! Why does the UNP not take a bold confrontational approach, grab opportunity by the fetlock and mount an open challenge? This is a good opportunity for a challenger, as the JVP has realised.

The aforementioned fundamentalists have an answer; “the UNP, the bourgeois leadership of the UNP, will not go so far as to rock the system; it will not unleash events that will threaten the very foundations of the bourgeois state system”, they have told me. Ranil’s UNP does not want an apocalyptic standoff between two arms of the state, Judiciary and Executive (the Legislature is a mere proxy for the latter) which may lead to fundamental challenges to the nature of the state. I think they have a point, but being fundamentalists they do not simultaneously appreciate the significance of conjectural issues, nor do they have tactical deftness. The simple fact that Ranil’s wits are firmly parked in his nether regions is part of the UNP’s identity and credibility crisis that the JVP is ably exploiting.

    Ranil being as unpopular as he is, has no choice but to depend on the President to remain as the UNP leader. As for the Government, Ranil is their dream opposition leader.
    It is only a continuation of the original deal – made following the last Parliamentary election – to appoint Ranil as the Opposition leader in order to prevent Sarath Fonseka getting this position.

      Spot on Kumar, your analysis of Ranil needs to be translated into Sinhala for the Sinhalaya modayas to read.
      But I have a slightly different reading of Ranil’s performance – it stems from the absurd claim that Ranil makes: that the parliament is supreme, even though it is not so in law or in fact, in form or in substance! For, how can a parliament full of uneducated morons, thugs, criminals and knaves be supreme?! Ranil gets his kicks, his dick up if you will, from being the big boss in the parliament and acting like he is a great intellect and authority on the constitution among the morons in the Diya-wenna parliament – the source of his legitimacy given his unpopularity in the UNP. Hence, his desire to present parliament as “supreme” and of course MONEYPOLITICS – the Audi and Merc that his read lipped, white clad, post-feminist wife is chauffered in and the five star luxury in Venice that stem from his position in the Diya-wenna parliament is the reason for the claim that the Parliament is supreme – so Ranil can be supreme!
      At this point, I’d go with Vijitha Hearath and the JVP now. The sad thing is that the other folks in the UNP are as bad as Ranil – Karu, Sajith, Dayasiri etc. Opportunists without brains or guts..!

    Dear Professor Kumar David ,

    Don’t be mislead of the Hilton hotel accommodation story ,actual story is a much sophisticated one , in fact it’s a combine effort professor , from the very inception of the impeachment saga RW was right behind MR until the final result , please go through each and every disgraceful action of RW and see whether you can find answers.

    1) Why did Rw’s stooge Dr Jayalath J committed himself to participate in a potential PSC well before the formation of PSC?
    2) What was the real reason for careful selection of RW & MR buddy, long John A for the PSC ?
    3) Why did RW give the consent for the PSC without any pre conditions what so ever ? Didn’t this despicable action put DNA & TNA in an awkward position?
    4) Why did RW declare Anura B ‘s verdict as the final and parliament is supreme ? is it ?
    5) when there were continuous denials of UNP requests , why did UNP members put up such a humiliating experience ? ( had UNP walked out earlier , CJ’s life could have been much easier )
    6) Why did RW order UNP members to refrain from appearing before the appeal court?
    7) Why did RW choose to participate in that illegal PSC debate in parliament? Didn’t RW want to give the much needed legitimacy for this perfect blunder?

    The Writer and Comments are all true to Colombian form. They are just unable to think out side the box and know the facts, and boring repeat of dinner table gossip.

    Just before I go into the main issues, I would like to remind the readers that the writer is also making the same mistake of believing the newspapers who are anti RW in believing that the Govt. of Sri Lanka (via the Italian Embassy instead of making the bookings alone) paid RW’s hotel bills in Italy on a private holiday (by the way Hiltons as reported in the press are third class hotels in Italy or the West and hardly likely be ones that RW would stay at).

    That is absolute tripe spewed by the pro govt press to discredit the Opposition leader. Is any Sri Lankan out of their minds to believe this kind of story? ( I am shocked that a writer of stature would stoop to this, just to underscore the point he makes in the article!)

    If in fact the writer is true, prove it and then there is no point RW being the Leader of the Opposition, he may in fact be the leader of the Country in all but fact – all benefits and no responsibility!

    I will go as far as calling the writer an MR stooge, if I did not know his past, for saying this!

    Anyway to get back to the main theme, whether we like it or not, RW being a pragmatist realizes this issue alone is not sufficient to take the upper hand the timing is not now with the in built majority. RW has said then, and continues to believe that a regime such as this acting in the way it does, and RW a voracious reader of history realizes it cannot last.

    Digging the knife in now when the chips are down, will only flare the Dragon (MR) into a Syrian like murderous spree, which he wishes to avoid. (Similar to the RW approach to defeating the Tigers which would have happened without any blood being shed – see how effortlessly he managed to split Karuna from Praba!)

    It is not within the bloody past of Sri Lanka and the bloody future that MR wishes for us by his actions, that RW wishes to act. When MR falls on his own sword, why assist him look for the sword that is with him anyway.

    There are some clear distinctions on what the Legislature and Judiciary are superior on, and it is that which needs to be preserved. His prevention of the PSC members from appearing before the CA is simply exercising a right, that a parliamentary committee cannot be questioned on an internal matter. SC ruling on the unconstitutionality of the proceedings is clearly a completely different ruling which it has a right to opine on as part of the job of the SC. The whole thing is very clear and NOT confusing.

    As far as attending the debate, not speaking in it, that is quite within his rights as an MP for a regular debate in Parliament despite the outcome being illegal in Law. After all a club can rule they can kill one of its members, but you cannot enforce it because you fall foul of the Law of the Land!

    This is all part of the plan. It is simple, one discredits everything passed in parliament, including the 18th Amendment etc. and hey presto when these issues are further taken up by the Courts, most of MR’s acts will be illegal. He may even be impeached and parliament may enforce it when its members finally decide the game is up against their leader. It is all conjecture I am sure, but RW is trying to achieve it through Legal means, whilst the population wants it under pressure and violent means.

    Take your pick. Are you advocating violence or peaceful means to the same end?

      I reckon you are right on the money here Patta Pal,funny how Prof David couldn’t read between the lines,even though he tries to show us he understands whats going on behind closed doors.One might say he is another vessel in MR propaganda machine or he’s just exhausted emotionally and out of ideas as to where to direct his anger(desperate attempt at playing the blame game).

      Also to add another point to your comment i feel that RW is orchestrating this to hurry the inevitable fall of the dictatorship

    Reasons why Ranil hang onto MARA:

    1) Getting Rupees 86 million annual pay (special allocation by MR) as opposition Leader.

    2)All other perks….such as Free rent,all Utilities, telephone, travel expenses, foreign trips including medical checkups etc…etc…all on house.

    3)Special protection supplied by MR to make sure RW stay as opposition leader. (Last November UNP Ballots for leader nomination final count….4500 against 500 in favour of RW………a mystery)

    4)Free Black coffee without sugar when visiting Araliya gaha mandiriya to consult MR on party matters.

    5)Far more better than the second available profession……. which is a clown for children’s birthday parties.

    6)Never dream to be a winning opposition leader but a 85 million loosing opposition leader. …….loosing 14 years and 20 elections.

    7)Extra protection given to safeguard life time Parliament Club Membership.

    8)Free on board all social, recreational and bublic activities including foreign treavel,conferences, meetings and plessure travel.

    9) All other perks ……….with abundance of benefits.

    10) Only the one who ate the cake…..know the taste……..

      You obviously believe what you read. Stick to the facts, you will be surprised how little RW gets and how much he manages to do with the little he gets. In comparison to the Rs10B MR wastes just on his office.

      Do some research you will definitely change your whole position. RW never speaks about the lies so you never hear his point of view it is just his character not to bother about the likes of you and what you say.

      The problem is that he does not want others to defend him either, as it is no point in talking to people who have some part of their brain missing! Until the majority of Sri Lankans can fix their deficiency he will stay in opposition.

    Ranil has ruined the UNP and has helped MR to destroy democracy and ruin the country. I can’t understand why the UNP seniors continue to accept his leadership. Why can’t the UNP dissidents like Karu, Dayasiri and others quit the UNP to form a new political party? Most UNP dissidents have been short-sighted. They should have known that if they were to succeed in ousting Ranil, they should have first chased out Tissa Attanayake. There is nothing sacrosanct in the name,`UNP’. The UNP stalwarts should lose no time in either kicking out Ranil or quitting the UNP to form another political party. It is quite obvious there is no future for the UNP under Ranil’s leadership. I feel sorry for young upcoming UNP politicians like Ruwan, Harshana, Buddhika, Dayasiri, Shiral and Maitri. They have to decide whether they should commit political suicide by remaining in the UNP or quit the UNP and form the vanguard of a new political a party. Time has come for all patriotic leaders (not of the Modawansa type) rise to the occasion to save this country from the looming dictatorship.

      NO politician with any ambition will commit Hara Kiri by leaving the UNP. they know better than you! Ask any one of them if you do not agree with me.

      Have patience, the UNP will form the next Govt. with or without Ranil.

    Ranil is the ironic strength of Mahinda similar to his manipulated two third majority in parliament.At present Ranil is the Mahinda’s international trouble shooter. His recent paid vacation to Vatican is best example.Mahinda has done yeoman service to Ranil by incarceration Sarath Fonseka to oblivion and supporting Ranil to become the leader of the opposition for next six years.Mahinda also supported Ranil’s effort to silence Karu Jayasooriya, Dayasiri Jayasekara as the may be posed to disturb his apple cart if they hold the reins of the UNP.Ranil cannot silence Sajith be cause Mahinda want to keep Sajith in abeyance until the opportune time to get rid of Ranil one fine day.Further Mahinda has purportedly connived with John Amarathunga to engage in government business deals.Further his son in law has been appointed as the Chairman of a leading commercial bank owned by the government. By doing that Mahinda has established a two way communication channel with Ranil to get advance information of UNP strategies with Ranil blessings. So it is Ranil + Mahinda government is in force now.Ranil’s action on impeachment was well rehearsed and agreed upon with Mahinda.
    One fine day Mahinda will do the same thing what he did for Shirani. On that day Ranil will be a loner.

    There is no point in blaming RW.There is no second line leadership in the UNP.Instead of blaming RW, the people who love the party should form a different group like Lalith Athulathmudali and Gamini Dissanayaya who took on the Premadasa madness.These UNPers has no back bone.Only a few had some guts to come for the meeting called by the Bikku peramuna. The UNP now is what you will see when you look at the pictures of MR and the UNP boys having fun.A picture is worth thousand words.

      The voters essentially see the opposition as a single party or coalition. A credible coalition without RW is what we so desperately need

    Dr. David should know that Ranil has to behave like Dr. Jekyll and Mr. Hyde. Why?

    Ranil has hopes that one fine day he would be the executive (executioneering) president of this country. So he needs the present mechanism to have a pliant judiciary. On the other hand he must embarrass the government in whatever way to have a better chance of getting into the big chair.

    Dr. David, to people like you and me this type of behavior is unacceptable. But this is what is expected of a present day politician of Sri Lanka.

    Ranil (since CBK’s time) gave his backers the idea that he has some grand plan/devious method to come to power and they beleived it,most of his backers learnt the hard way that there never was any plan by him,he either missed or misread one political oppurtunity after another.
    Even now its the same story with the biggest pussycat Lanka ever produced.
    If he was in the private sector he would have been sacked years ago for non performance.

    Ranil is the only gentleman and the decent guy in the opposition. Look at the rest if the part leaders and they look more like Kala Veddahs than men with any substance.     Thanks to god you are going to open your eyes. At least now you realize the hidden content of Liam Fox agreement and the “Awabhodatha Givisuma” which allowed them to exchange Parliament Members to protect existing ruling party. This helps them to create the majority without getting or leftist’s help. The idea was created by British and approved by Runil.
    Immediately after the election British PM called MR and explained this. As he agreed with the plan they allowed him to destroy LTTE. His son got prestigious Navy training in UK as a “santhosham”. Ranil know that he will get the power one day. because according to the agreement MR will never allow any other 3rd party to get the power. But the same time he knows ones Ranil come to the power he will never give it back to any other person. So MR and family has no option other than making enough money for generations. Have you ever heard MR say any wrong about Ranil? Actualy MR loves this country. But before he comes Ranil came to the agreement with western powers and India. This agreement gave navel defence tights around Sri Lanka and Maldives to India. That is why they are coming hear for a Operational Visits. All these things are inked and sealed by this man. Not poor MR. Can you remember once Thamil Selvem told his leader not agreed to give up the war to full fill powerful nations agenda. That is the start of their fall. If they agreed to get some kind of autonomy rather separate country, they are still alive. Thanks to the Norwegian spy service who keep in touch with LTTE movements, LTTE couldn’t hide any thing from the final war. JR came to the power (first time in 1977) with out any “hora chanda” system. (He use this after his got 2/3 majority through a fair election) But India destroyed his government. Ranil’s plan destroyed LTTE. (Unfortunately MR and his government got an opportunity to play the show.) So I personnel think Mr. Wikramasinghe has to get a chance to control the country with the help of his western friends. according to the history, when UNP come to the power westerners help to develop the country. As long as MR is handling the country Sri Lanka in the same position for ever. Now The education, legal system, health system, road network, public admin system, and political system itself has destroyed. To develop these things we have to get a support and advise from the countries those who develop these technology. Remember King Sri Vikrama Rajasingha does not gave those systems to us. I think this is the best time to join both parties and abolish Executive presidency. Then MR can be a life time president and Ranil can become a lifetime executive prime minister. By doing this we can get western help and expertise for our life time. Comply with “Givisuma” will allow MR to control the country as long as people not oppose, but it will not develop the country. To stop asking “English Teacher Training from India” (as MR once ask) we have to ask the training from Native English speakers.Join together come to the correct development path, then use the executive powers to retain the power for lifetime to develop the country.
