The federal judicial authority considers that “the existing suspicions against him are enough to justify the opening of a criminal investigation” in the event that Mr Dias comes back to Switzerland. Responding to the criminal complaint filed by Swiss association against impunity (TRIAL) and the Society for threatened peoples (SPM) the Swiss Federal Attorney General said. However the Federal Attorney General decided not to open an investigation, on the ground that Mr. Dias was no longer present on Swiss territory.
During the last phase of the internal conflict in Sri Lanka, Deputy Ambassador for Sri Lanka in Germany, Switzerland and the Vatican Mej. Gen. Jagath Dias was the major general of the 57th Division of the Sri Lankan Army, which is accused of intensive shelling of civilians, hospitals and religious sites. In August 2011, TRIAL and the SPM filed a criminal complaint with the Federal Attorney General against Jagath Dias for war crimes.
According to Philip Grant, the director of TRIAL, “Sri Lanka still denies the extent of the crimes committed. As long as no impartial investigation is carried out in Sri Lanka, the authors of these crimes may be punished abroad”. Angela Mattli, head of campaigns at the SPM, says that “after this judicial decision, the time has now come for the politics to send a clear message to the sri-lankan government: impunity for war crimes is not an option any more”.

YOu think the readers here only listen/watch/read Rupavahini/ITN and FakeHouse papaers? Switzerland and Germany warned Jagath Dias about this case you refering about. There are a few nut cases who buy regime books but not all. Regime is going thru a serious headache these days. They have screwed everything up themselves. You cannot fool the people anymore. From the begining the regime underestimated the strength of the people/opposition and international community. They have boasting about the war victory and did everything they want without considering the facts or consequences. They have over estimated the ‘rajapakse family’ Painted a massive giant pictures of them but to see they are carttons nothing nothing else. This is country is heading towards wrong direction under this regime supported by JHU/Weerawanse etc. They are busy making soem ‘prabakarans’ in the south.

Major General Jagath Dias was recalled after expiry of his term of office as the Deputy Ambasador to the Germany. besides there has been no court case or emminent case coming up against Jagath Dias in Germany or whereever. You cann not compare these two incidents. I may not be an expert in international law as you guys are, how ever as far as I know a person with diplomatic immunity can not be tried in domestic courts in any country, unless the goverment of the foreign state expressely wave the privilege.That is the fundamental principle.
