MS To Avoid De Facto CJ And Swear In Today Before A Senior SC Judge

Victor of the Presidential poll, Maithripala Sirisena is due to swear-in this evening before senior Supreme Court Judge J. Sripavan and not de-facto CJ Mohan Pieris.

Article 32 (1) of the Constitution states that President elect should be sworn in before the CJ or a Supreme Court judge.

The swearing-in ceremony is planned to be held at the Independence Square.

    That is a big call, but not surprising. It is a clear signal for him to pull the pin, voluntarily, paving a way forward for the President to nominate back the Honorable Madam as promised to the voters.

        May be true, but he was in a panel headed by a parachuted de facto CJ, if I remember correct was he not in another panel headed by the late Justice Sriskandaraja which quashed the decision of the Parliamentary Slect Committee on appeal?

        The remarkable point here is Justice Sripavan is from the minority community and this gesture of of the President elect speaks a lot for the future.

          I am surprised that anyone talking about the ethnicity of Judge Siripavan. He has a good track record in his career. No controversies. He even gave judgements that may not please the hardliners of his own ethnicity, so to say. If MS chooses him to take oaths, I think the choice is good because Judge Siripavan has done his job well and fit enough to administer the oath of office of the President of Sri Lanka.

          WE WANT JUDGES WHO CAN JUDGE BEYOND THEIR POSSIBLE PERSONAL AFFILIATIONS.

What he did for a dictator who left his team with no other option is precisely why he left and became the common candidate. It is time for Mohan Peiris to submit his resignation and go gracefully like his boss. The writing is on the wall take the hint and depart.

    This is the honourable thing to do… the shameful Cheap Justice who was blessed to have attended two of Lanka’s greatest schools was ultimately the victim of his own arrogance, conceit and woeful lack of ethics. A better man would have refused to accept the positions, offered to him by Lanka’s master crook, the Medamulana Village Idiot.

    IT IS A SHAMEFUL BLOT ON LANKA’S JUDICIAL HISTORY TO HAVE THIS IMPOSTER LORD IT OVER LANKA’S HIGHEST COURT.

    He should be removed from the position by the same parliamentary select committee that removed his predecessor, forthwith.

      2nd tier Lawyer Mohan Peiris will be remembered from now on in the judicial-political history of the country in the same disgraceful and dubious manner in which the Norwegian traitor Vidkun Quisling is seen by his country, the world and history. Mohan Peiris is a good example we have in the country, even among those called highly educated persons, a few prepared to sell their soul for a pot of porridge – regardless. At times like this, one must recall and respect those senior lawyers who were approached by the Rajapakses but had the honour and conviction to refuse the high office.

      As to Shirani B as CJ again, this will be a poor choice. She too humiliated the high office to which she was thrust by political interests. She did not hesitate to connive and play ball to further her personal greed and that of her nondescript spouse. The judicial stables must be washed and cleaned once and for all.

    Until new CJ is appointed – Swear In Today Before A Senior SC Judge is a great sign for reverse of rule of law and order. I have no doubt MS-Ranil-CBK coalition priorize the law and order above everything. THis was the reason why at least some fractions of the nation voted for the newly built coalition. We the srilankens should be given equal rights in all areas. Thanks for Tamil and muslim communties – we got rid of the MAKARA -dragon of the nation this way. ::

    It will not be surprising if Sarath N Silva is brought back into the political fold – as Minister of Justice, even with all his short-comings, to lead the Country in as a shrine of Democracy. Any support?

      I go with you… He realized his mistake and apologized conditionally, IF KP Pillayan and Karuna COULD be given a pardon why not a Learned Judge ? He is of better use to society than all those three put together… SO I would pardon Sarath…

      Punchinilame – The ideal person for this position is TNA Stalwart
      Mr. Sumanthiran, a person who speaks all three languages fluently
      and argues cases in Sinhala in Sri Lankan courts. He is a leading
      lawyer and popularly known in the judiciary circles and a Royalist.
      He was removed from a panel of lawyers , if you remember, from a case lodged by Sunday leader, where GOTA faced difficulties in answering him and the case was settled out side court as he was on the verge of winning the case for Sunday Leader. This can be possible only if TNA agrees to take positions in the new cabinet.
      I hope the President will not give into pressure from CBK and appoint
      Mrs. Sriyani Bandaranayake, her relative or Mr.Sarath N Silva as both have sided the Govts in power and faulted in their judgements and the people are aware of it and their credibility at stake but of cause,
      her dues should be settled by the govt. and pension and any other rights she lost should be restored to her

    Is it the right thing? Is it not better to,
    take a the oaths in front of the formerly appointed chief justice, Later if he is bad, Follow the due procedure? Impeach him? Bring laws to investigate? Send him home!

    This is an election win, Not a revolution?

    Mohan Peiris was an advisor to MR and also chairman of Seylan Bank when he was appointed CJ. Where in the world can one expect justice from this fellow. He is a stooge of MR. Pres- Elect Sirisena has taken the right decision to be sworn before another Supreme Court Judge. De facto Mohan P should then resign and the new President should appoint an acting CJ until the next move is done legally.

    The CJ should immediately quit and do some justice to the judiciary and the religion he belongs to. His most important verdicts affecting the public should be re called and reviewed and justice done.

        Paul- Agree with you on your suggestion that Justice Sri Pavan
        should be appointed as C.J., if he is qualified for the position and this gesture should please the Tamils who took a grave risk by voting for the opposition Candidate H.E. Sirisena, If Mr.MR
        won, it would have been hell for them for another six years. MR
        himself stated after the election results announced that Tamils
        voted him out, calling them as his enemies, which means that he wants to continue with his political career,spreading racism and create disharmony between the majority and the minorities and we will be back to square one if he or member of his family comes
        back to power, again.

        The govt should see that they do not appoint another political
        stooge of theirs as judiciary should be allowed to function on its own without any interference from the govt. as practised in
        India and many other countries like USA, Canada and the EU. The
        two names floating around are not acceptable to the people tho’
        they have high connections. There should be transparency and the govt should move forward.
