Nandasena Tightens Noose On Judiciary: Magistrates To Be Ordered To Ban All Public Protests At Ministry Seminar

The Nandasena Gotabaya Rajapaksa Government has summoned all magistrates serving in the Western Province to the Ministry of Justice in Colombo on Friday (13) where orders will be issued to lower court judges to ban public gatherings when police bring the matters to court.

Magistrates from all other provinces have been instructed to join the meeting virtually because inter-provincial travel is still restricted to essential services only as Covid-19 infections spike across the island. All magistrates in the Western Province will attend the “seminar” while magistrates in all other parts of the country will attend the “webinar”. Separate lists of participants have been drafted and circulated by the Judicial Service Commission (JSC).

Chief Justice Jayantha Jayasuriya and Supreme Court Justice Buwanekha Aluvihare will preside over the meeting. The Seminar, titled “Matters relating to judicial proceedings in the context of Covid-19 pandemic” will be held at 9.30AM on August 13, at the Sri Lanka Judges Institute inside the Ministry of Justice.

A letter to participant magistrates representing every district in the island from Judicial Service Commission (JSC) Secretary Sanjeewa Somaratne makes it clear that attendance will be mandatory and warning that failure to comply could result in dire consequences for the lower court judges.

“I have been further directed by the commission (JSC) to inform you that failure to participate at this seminar will be taken into consideration when recommendations are made for promotions, annual salary increments, foreign training and appointment to the High Court,” the JSC Secretary’s letter to participants threaten.

Letter to Seminar Participants from JSC Secretary Sanjeewa Somaratne

See Full Letter in PDF here

Colombo Telegraph learns that the JSC was badgered into summoning magistrates and threatening told hold back promotions and other perks if they failed to participate by none other than Justice Minister and President Gotabaya Rajapaksa’s personal lawyer, Mohammed Ali Sabry.

The implied threat in the letter from the JSC Secretary is also unprecedented affront to judicial independence, legal experts said, since the Commission is insisting that the magistrates attend a Government seminar, while making it clear that attendance could affect career prospects.

The Nandasena Regime’s move to strong-arm lower court judges comes amid a wave of protests against the President’s disastrous policies on agriculture and education. Magistrates have reacted lukewarmly at best to police requests to stop these demonstrations considering the coronavirus situation. In Weligama recently, a magistrate allowed a fuel price hike protest organized by former Urban Council Chairman Rehaan Jayawickrema to go ahead, despite police efforts to stop it.

All over the country, farmers are protesting the Government’s horrendously short-sighted ban on agrochemicals. Farmers have been forced to abandon thousands of acres of cultivated land, where yield is sure to be poor due to the fertilizer shortage. Farmers and agriculture experts are warning about food scarcity in the coming months because of the ban. The Nandasena Government is viciously cracking down on teachers and academics protesting the draconian KNDU bill which will set up a highly militarized university outside the jurisdiction of the University Grants Commission and will enroll civilian students as well as military personnel. Several union leaders have been arrested over the demonstrations, with some of them abducted at night allegedly by policemen in plainclothes.

Gas, milk powder and salt shortages are also increasing public frustration and fuelling discontent, with Government leaders now concerned that hunger riots could be in the offing. Daily death-tolls have crossed the 100-mark with medical experts and statisticians warning that Sri Lanka could be looking at 20,000 dead before the country sees the back of the pandemic.

Cash-strapped and facing public ire, the Government is determined to move mountains if necessary to end protests and demonstrations in Colombo and other parts of the country, sources told Colombo Telegraph. Manipulating the magistrates who will be faced with a spate of such requests from the police to ban protests in the near future will be key to ensuring that rising public discontent over the Government’s failures and mismanagement will not be captured on camera and broadcast around the country. Nandasena’s short time he acted as ” president of srilanka”, is more than enough to stand against him. His has so far been very unconstitutional, unethical and morally no right.
Alone leaving innocient masses be misled by the govt, not having proper mechanism on the containment of the COVID 19, caused people fall dead all these few weeks. There are reports that the dead in hundreds get accumulated in mortuaries without any identifications. All these are the consequences of his improper actions taken just going by hearsays of unskilled officers. Not every leaders got elected have good advisers, but the leader himself should see it right to rely on the good advisers. If the leader himself is a wrong person by every means, the greater impact the nation faces is inevitable. That is the reality in today s context in SL. It has become a pariah state as of today. It took only less than 2 years since bitch s sons are back.

      Captain Morgan,
There is at least one thing that Rajapakshes did not screw up; eliminating Tamil terrorists who bragged that they cannot be defeated militarily. If they did screw that up like Ranil and Chandrika, still Tamil terrorists may be massacring Sinhalayo.

          Humble,
You are wrong. Most of the Sinhala leaders mollycoddled Tamils. SWRD Bandaranayake and Dudley Senanayake wanted to have a pact with Chelvanayakam to hand over NE to Tamils, JRJ agreed to give Provincial Councils, Premadasa gave arms, ammunition and money to Prabhakaran, Chandrika and Ranil competed with each other to hand over NE to Prabhakaran perhaps eyeing for nomination to Nobel Peace Prize. Eventually, Ranil handed over NE on a platter to a terrorist. Only Mahinda Rajapakshe had the guts to face the deadliest terrorists in the world who bragged that they cannot be defeated militarily and eliminate them.

Eagle Thaatha the Rajaopussies and the Chingkalla army on the pretext of fighting with the LTTE only massacred and killed innocent Thamizh civilians, around 150000 in May 2009,deliberately done. However the so called Thamizh terrorists, like Karunai Amman, Pillayan, KP and uncle Douglans and the Ava kunchchis of Jaffna are all their friends and do their dirty work in the north and east.

… orders will be issued to lower court judges to ban public gatherings when police bring the matters to court.

Why not tell the police not to bring matters to the court? Let the police decide what to do.

Rule of law is a waste of time, money and energy. We know that 20A is the grave for rule of law.

Good, the 6.9 million largely racist bigots voted him in thinking he will only kill, starve the Thamizh and steal their lands and they will be rich and prosperous, at the expense of the Thamizh. Never thought this racist psychopath will turn on them too. This is what the Germans thought when they elected Hitler. Misery for everyone else but joy for them. How wrong it proved. You reap what you sow. At least the Germans learnt their lesson but the brainwashed Chingkallams will never. Will discard him and elect another anti Thamizh psychopath.

Did this guy ever live in the United States? I wonder! If he has lived in the USA he should know the difference between “Independent Judiciary” and “Enslaved Judiciary”. I think it’s time for the countries where the “Independent Judiciary” is there to impose a travel ban on all Magistrates of Sri Lanka including the Chief Justice, Attorney General, and the Minister of Justice.

      Buddhist 1,
Not in the US Terra Firma! Just off US Pacific coast, anchored in a little tramp vessel, during the time he was off work from 7-Eleven, where he earned his bread and butter!
Living with the sea animals and hence his penchant and affinity for Sharks and first ever President of Sri Lanka to boot!
He did not have real exposure to the US democracy or way of life. He was in seclusion and in his old and own world, imagining all the time how life goes on in a democracy to inflict on the Sri Lankans.
The opportunity arose for him to arrive and take over Sri Lanka when some highly educated and esteemed prelates – who of course had no in-depth knowledge of History or the personae called Adolf Hitler, who ruled Germany post WW 1, – made the raucous call post 2015 and pre 2019 to an individual to become president of SL and who had the ability to behave/become like a Hitler.
They in turn convinced 6.9 Million to make it a reality and we have now arrived at this significant NODE in our history, become like or reincarnation of pre WW 11, Germanic tyranny.
Abridged version of 2015–2021 history so people understand how we arrived at this point in history.

      Buddhist1,
Freezing travel to judiciary would be welcomed by the Nanadaseeni Regime.
Remember 1970-77, the same regime had EXIT visas issued the then New Secretariat Building (CID) for anyone going overseas – like a communist or Bolshevik state imitating Marshal Tito’s then Yugoslavian state.
What these people are not realising is this makes the claim by the EU, US, UK and others who passed 2015 HR resolution claiming that the SL Judiciary cannot be relied upon to deliver impartial judgements and dispensation of Jurisprudence and rule of law, but are sublime to pressure of the executive!
Who is this intelligent Maestro, who believes that SL Judiciary is independent, when at every turn it is the dictum of the executive. They think all others in this world as foolish and unintelligent/uneducated as they are inept at governing.
It will be amply proved that none in SL shits or farts w/o a Presidential Fiat! This includes the Chief Justice, Speaker and any and all the servile nincompoops.
So interesting times ahead at Geneva! Come September 2021, we can realise the outcome.
Not the fault 6.9 million voters exclusively.
Greater part due to 20th amendment by corruption of elected representatives post 2020 elections.

Yes the main criteria for the Chingkallams to vote for any leader is not their ability to rule or to develop the island but how much he or she can discriminate, kill and starve the Thamizh. This is the most important quality that their leaders should have. Nothing else matters. The vast majority of the Chingkallams are largely brainwashed by their Mahavamas myth and are as racist as their leaders

It is very “Surprising” and “Ambiguous” to note how the “Judicial Service Commission” has decided to hold a “SEMINAR” on the subject: “Matters relating to Judicial Proceedings in the context of Covid-19 pandemic”. “Surprising” Why? A “Seminar” is a meeting for exchanging and discussing information. The question is: What is the “Information” or the relevant “Subject” and “Where” it is “Stated” or “Detailed” out and distributed in “Document” for the participants to get prepared for the “Seminar” intended to “Exchange” opinions? Next: “Ambiguous”: Why the need to impose punitive action for failure to attend the “Seminar” as laid down in item “3” of the communication? That smells a rat.

If JSC wanted to, it could very well spell out the “LAW” pertaining to situation arising out of COVID-19 and issue “INSTRUCTIONS” to be followed and adheared to by the Courts. Why this “Hide and Seek” and “Hora Police” game? In my opinion, this move by the JSC is noting but “DESECREATION” of the entire Judiciary of the country. As things are moving, even our last HOPE of an “Independent Judiciary” has been shattered. Now Sri Lanka is undoubtatedly a “FAILED STATE”.

My Dear LLM: Thanks. I read through the article. I too agree that the “Teacher Community” at all levels is very vital to make a “CHANGE”. However, the present is very critical, in that, ALL turning towards that “Change” must be very carefully and responsibly be “Managed” and “Directed”, without leaving any void for “Rajapakse Bandits” to encroach and infiltrate into the mainstream movement. This “Attempt”, I saw in a TV program titled “Mawatha” by “News 1st” aired two weeks back, in that, the two teacher representatives from SLPP and SLFP tried without success to turn the public support sympathetic towards “Rajapakse Bandits”.

Please note, the show of “Protests” is mainly based on “FRUSTRATIONS” and NOT towards the path for a “CHANGE”. The fact of “Frustration” is “Temporary” (as happened in the last elections resulting in the fall of Yhapalanaya) whereas, the path to a “CHANGE” has to be carved out by those steering and seeking the “Change” on a well “Designed” plan for widespread recognition by the People. I haven’t seen that yet, but it could arise at any moment if the “Designers” are “Forward-Looking”. I have to be brief. Please read “Between the Lines” and understand me. Thank you.

LLM: I forgot one fact and that is “COMMUNISM” and “LEFT” mentioned in that linked article. No “Communist” or “Left” going to work here. What is needed is a “Consolidation” of “Progressive” elements from “SLFP”, “UNP”, “SJB” and even “SLPP” who are both “Frustrated”, “Let Down” and “Forward-looking” to one “Camp” with a short, medium and long term plan to develop the country towards a better living. Please add this to my reply comment. Thank you.

If I am the Chief Justice I would have resigned immediately when this meeting was called. Shameless Chief Justice has proved that he is a Cheap Justice. How can he allow such a thing? He is suppose to protect the constitution, but allowing this and not resigning from his position he has become the “slipper of the President”. What an idiot!

But everyone seems to forget when speaking of how our great heroes like MR and GR overcame the LTTE, they also led thousands of mostly young Sinhalese to their deaths while serving in the armed forces. Please let us not forget these people, mostly from poor, rural families who went to serve in the armed services because they could not find employment elsewhere. Without them, GR and Sarath Fonseka and the ‘Top Brass’ would have been useless. And, please, while GR is due some credit for the successful ‘war effort’ he is not due the kudos which a clever PR exercise has made us believe he is due. With a brother for President, he had a free hand and there were no questions asked or accountability sought of him.

Anything should be done without violating the constitution. It is the only protection we have.Free speech, the right to protest,if they are enshrined in the constitution then protest should be allowed.
