National List fraud; Premadasa, Ranil And Sirisena Lied

The basis under which defeated candidates were appointed through the National List to parliament was fraudulent and deceiving of the voter, says Public Interest Litigator Nagananda Kodituwakku.

The provisions under which such candidates were appointed – the National List Provision ( Article 99A) introduced to the Constitution on 4th May 1988 by the then Prime Minister Ranasinghe Premadasa supported by the 14th Amendment, had two drafts circulated in parliament.

Maithri RanilOne was approved by the All Party Select Committee and the other bill approved by the Party secretaries .

The second contained a provision to the effect which permitted party secretaries to nominate defeated candidates through the national list, a provision not found in the bill approved by the APRC.

The then Prime Minister had in parliament presented the bill approved APRC and had informed the house that. “… Names of the Party nominees are known beforehand and that the voter are aware of the identity of the candidates of the different Parties who are to be elected as National Members…” alluding to the national lists presented to voters prior to an election.

Writing to Colombo Telegraph Kodituwakku says; “It is a mystery as to the insertion of a clause not in the original bill and got it ratified by the speaker who had no power to ratify a bill containing any provision that would takes away sovereign powers of the citizens (enshrined in Article 3 of the Constitution). The law on this point is absolutely clear. Sri Lanka is a representative democracy and in a situation of this nature there shall be a referendum held to obtain people’s mandate to that effect, the result of which should have been ratified by the President and not by the Speaker to make it law of the land.

“Both President Sirisena and Prime Minister Wickremesinghe who had pledged to draw the ‘ good governance’ boundary in their governance mechanisms came into severe criticism by the public for their disregard to the mandategiven to them.”

Several defeated candidates including S.B Dissanayake who publicly admitted that he had threatened elections officers with a “pistol held to their mouth” during the Wayamba elections and was accused of serious misdemonours were appointed cabinet Ministers of the present government having failed to be elected during the last Parliamentary election.

      Corrections.

      1. Buddha is not Lord, only a Great Teacher.

      2. Sinhala Buddhism, is Not Buddhism. So, they can lie.

      3. Only fools, Modayas, who believe in Sinhala Buddhists, are affected, along with everybody else.

      4. Sinhala and Sinhala Buddhists are Paradeshis, Paras, in the Land of Native Veddah Aethho. Therefore you may refer to them as Para-Sinhala and Para-Sinhala Buddhists.

      5. You can use the Para- for all other paras in the Land of Native Veddah Aethho.

    So, this provision allows for defeated candidates who are:

    1. Competent but not elected by the voters, whose average IQ is 79.

    2. Lost by a small margin.

    3. Those who are skilled in the arts, sciences etc, Eminent People. who may be good candidates to be turned into cronies ( Example Dr. G L Peris)

    4. Candidates whom the Party very well know will help the Party more than the People. By Helping the Party, it helps the people and the country logic.

    5. Those segments of the population who underrepresented such as women and minorities.

    6. Those candidates who were rejected by the People, but have threatened the Party leadership, and promised the Party leadership to support them if comes through the part membership, and to be given Minister Posts.(Example: Several defeated candidates including S.B Dissanayake who publicly admitted that he had threatened elections officers with a “pistol and was accused of serious misdemonours to be appointed cabinet Ministers.)

    So we have got the MaRa MaRa Chatu MaRa Disease Spreading to….

    Mr. PM you got what you wanted but the people have not got what they voted for. You have struck deals with MR and the people have been left high and dry. Talk only once you have produced some results in this regard. The rest is all theory.

    The then president JR Jeyawardane obtained un dated signed resignation letters from all the contestant of his party before the election. So he can sack those MP’s who use their discretion and vote against him and the party. He had the letters and he could date them say they have resigned. Should not be allowed into the Parliament. Actually it is a blackmail. the 1978 or constitution and the amendment and laws brought under that government are brought with the act of blackmailing. especially the PTA act. The constitution and laws brought with blackmailing are not valid. they should be made null and void , all the proceedings and procedure should be revisited So the PTA is not valid the conduct of the war was illegal.
    It pathetic none of srilankan and international lawyers took note of it.
    giving jumbo cabinet is another form of irregularity to deal with conscientious voting. There is pressure and free and fair decision.

    It is worthy of public interest to know how the courts determine this application.

    Nevertheless there should be a proper guide line how members in the national list are appointed. This should be laid down by a special act or amendment to the constitution.

    None of the earlier political leaders of Sri Lanka did an honest job to uplift the living standards of the ordinary people. The present two, Ranil and MY3 seem to be the worst pair when one looks at what they are up to. Appointing 100 odd ministers, giving amnesty to all rogues , murderers including the Rajapaksas, going against the mandate given to them. What is evident is that the Ordinary Sri Lankans are the most unfortunate people and the Sri Lankan politicians, their families and henchmen are the most fortunate people in the entire world. If one believes in rebirth, at this rate no ordinary Sri Lankan will want to be reborn in this country again. That is why Sobhitha Thera wanted people to apply for a visa even to Hell considering the undemocratic actions of the present politicians..

      where did you obtain your PhD ?

      How can you a PhDer jump and say this – with minister not even 50 for the current cabinet (for the national govt).

      Sobitha theros views are theoretical but how would you be able to handle the current day problems if MY3 and Ranil would not make every effort to work with the snakes and dogs like UPFA men and women easily.

        So, you double Phd woman agree that these UPFA people are nothing more than snakes and dogs. Please can you further clarify if the dogs are just stray dogs or ‘Pissu Ballo’?.
        In any case they should not be included in a democratically appointed government as they are extremely dangerous.

      Ven. sobitha Thero was deceived too.

      He thought Voting for MaRa, MaRa, was a “Papa Karmayak”. an action that will get you to Hell, that will get you to Apaya, Hell.

      Looks like MY3 and RW seen to hep everybody get to Apaya sooner, using 100 Odd ministers..

      MaRa can claim that he will you to Apaya, Hell, before My# and RW can.

      So, Ven. Sobita Thera wants people to get pout ASAP.

    You can’t be a politician if you are not a born liar. Lying is part and parcel of a politicians life and work. Sri Albanian politicians have made lying in to a form of art.

    The are lies and deceptions in everything they do and they cover these under the excuses such as national security, national sovereignty, national interest etc. There are no politicians that do not lie. Period. People reelect these liars knowing that they are liars. Please don’t complain if you are not prepared to challenge them in court.

    CT is very unkind to these two Gentleman..

    Look at them. Isn’t it a wonderful depiction of reconciliation , understanding and harmony between the Elite and the Dalits.

    Although our Dalit rep and his family are all Elite class ,

    Do they look like liers?.

    I mean they are the epitome of Yahapalanaya. Right..

    IF sirisena or ranil or other scumbag of a politician does any illegal thing, does not reduce the number of minsters ,encourage democracy, human rights after 5 years we will defeat them. But we wont allow any rajavassas to come back either.
