Need For Retraction & Apology By President

Just as pathetic as the recent repugnant public criticism of the Bribery Commission, CID and FCID by the President, is the stupidity of some Ministers who have been trying to vainly put a good face on a bad speech, as if the people of this country are fools who can’t understand spoken Sinhala and will believe anything they are told. Where millions have heard and watched the widely circulated video recordings of the President’s speech for themselves, the people are not deceived. People know exactly what he said and meant notwithstanding the distortions of politicians who would pull wool over their eyes. Indeed if nothing else the resignation of the Director General of the Bribery Commission is final proof that the President’s remarks were deeply offensive to such agencies.

There is of course nothing new in the tendency of Ministers to embellish the truth for the sake of damage control and tell us that everything is hunky-dory. One example from history is that of a current Minister who speaking at a public function two days ago is reported to have said that “the President had not found fault with the Commissions . . . had not included any remarks intended to weaken the functions of the independent commissions . . . but had only emphasised the importance of protecting the dignity of war heroes who saved the country from the clutches of terrorism”. So I suppose we are being asked to believe that the President was only being kind to the Commissions ! Interestingly in clause 397 (P.83 ) of the Human Rights Council OHCHR Report on Sri Lanka as an example of the previous regime repeatedly denying any responsibility for enforced disappearances, the report specifically mentions the name of this Minister who when he was a Minister in that regime had in 2007 (quote) “ claimed that the reports about people who disappeared were the result of the “propaganda strategy” by “a ruthless terrorist organization” which tried to ‘paint a bleak picture internationally to bring pressure on the government so that our resolve will be weakened’”. So much for his credibility today.Maithripala

The reality is that the President’s ill conceived criticisms were a sad betrayal of the many good people who trusted him to uphold the rule of law and relentlessly bring criminals to justice without fear or favour whoever they might be. On the contrary the threatening tone, strong language, and content of his emotional speech reflected an abuse of power in seeking to demean, demoralise and put political pressure on these valued independent agencies investigating corruption and crime. Indeed his outburst was reminiscent of the arrogant contempt for independent bodies we had come to expect from the previous Rajapaksa regime in which ( lest we forget ) this President sat as a Minister for about 9 long years during its worst excesses.

Far from criticising the brave hard working officers of the Bribery Commission, CID and FCID the President should be praising encouraging and honouring them for persevering with a complex – even dangerous – job under difficult conditions. His attempt to seemingly put the brakes on the work of these institutions and slow them down runs contrary to public impatience that investigations should be pursued even more rigorously with more wrongdoers being brought to justice more speedily. Perhaps his remarks were provoked by anxious fears that going after senior figures in the military establishment might be politically unpopular making life harder for him. But that is his problem to solve. Such considerations must never detract from the imperative to bring wrongdoers to justice without fear or favour.

The President seems ultra sensitive to the feelings of high ranking security forces personnel being investigated as if gratitude to them for winning the war should make us tread more lightly in dealing with their offenses. But he has forgotten the cardinal principle that all men and women are equal under the law irrespective of rank, position, titles, status, medals, honours and past record of service to the nation however distinguished. Indeed it is possible to argue that misdemeanors by the security forces at any time should be investigated more urgently and punished more severely because of the exceptionally high standard of discipline and morality expected of those whose statutory duty it is to protect innocent people and defend the nation. In this connection the President’s proud boast about disarming the UNHRC, neutralizing its concerns about war crimes and circumventing the need for foreign adjudicators in any investigation – sounded puerile and unprincipled. It is as if his patriotic duty was cleverly outwitting the UNHRC – not uncovering the truth whatever that may be and dispensing justice.

Sadly the President’s criticisms of the Bribery Commission, CID, and FCID at the “Sathviru Sanhinda” function on October 12th were a monumental blunder. His credibility is in shatters opening doubts about his commitment to the purity of public life. He has deeply hurt, confused, and upset his own supporters. He has undermined the independence of respectable investigative agencies and demoralised good officers who are fighting valiantly to bring those guilty of crime corruption and cover up to justice. Sadly he may have compromised the good name and respect he has personally built up as President both locally and abroad. Finally he has energized the demonic enemies of the government who are gloating over the chaos and confusion created by his comments, and are in a position to taunt those who yearn for truth, justice and good governance.

In this situation whether the President’s ill conceived intervention was provoked by naivety, fear, ignorance, political cunning, or something else need not concern us. Whatever that may be it is hoped that President Sirisena would have the humility and good sense to do that which may help redeem the unfortunate situation created by his deplorable criticisms namely :

(a) Openly retract his criticisms of the Bribery Commission, CID and FCID

(b) Issue an unqualified apology to these agencies and to the nation

(c) Persuade the Bribery Commissioner to withdraw her resignation and continue the good work

(d) Reaffirm his unequivocal commitment to strictly upholding the rule of law and speedily bringing those guilty of crime and corruption to justice whoever they might be.

          I am not sure whether your comment is a compliment or a criticism . If ‘management’ is “scheming”, be it of a situation or persons, then Ranil is a good schemer.

          You will note he said the least, throughout the showdown with the President.

            Mrs. Dilrukshi Wickramasinghe was only playing a drama, nobody was Prosecuted because Ranil was playing a game. Now that she is gone, the President can appoint a right person. Mrs. Anoma Fonseka is the best person for this post. As the wife a former Army chief, she will do a very good job in prosecuting the criminals.

          Rule of law ceased to exist long time ago as far as Tamils are concerned:

          In 1956 Tamils from their homes were chased out and Sinhalese from the South settled in Padavia, Aaparai and elsewhere.

          In 1958 riots houses belonging to Tamils in Ratmalana were occupied by Sinhalese rioters and never given back to the lawful Tamil owners.

          The collective Sinhala political hierarchy both UNP and SLFP and the people know all these lapses of the rule of law.

          We can’t pretend things are changed all of a sudden, the same story continues not just for Tamils but for all.

            It is now almost definite that Gotabaya Rajapakshe is the next candidate from the Joint Opposition (SLFP) for the Presidency. Since there are tens of thousands of Sinhala-Buddhists out there to vote for him, he will win with a Landside. However, among the Rajapakshes, Gotabaya is very well known for his Anti-minority stance (he is Anti-Tamil and Anti-Muslim). Sri Lankan minorities get ready for another Anti-Minority Rajapakshe government very soon with Gotabaya as the President and Mahinda as the Prime Minister. The Minorities (Tamils & Muslims) will be Kaput very soon.

              First of all, Gotabaya Rajapakshe has to give up his US citizenship to contest elections in Sri Lanka. Secondly, if the executive Presidency is abolished in the new constitution, My3 will be the last executive President in Sri Lanka. Thirdly, even if he contest, he will not get a single vote from the Muslims and Tamils. The Muslims consider him as Anti-Muslim (the man who created grease devils and the BBS to attack the Muslims). The Tamils consider him as Anti-Tamil war criminal. With only Sinhala-Buddhist votes that are divided between UNP and SLFP, if the UNP fields the right candidate, there is very little chance for Gota to win. And even if he wins, not only the minorities, even the majority Sinhala-Buddhists who oppose him will be Kaput. We have seen how he killed the journalists, how he killed people in Gampaha who protested for drinking water, how he killed the Welikada prisoners who protested, he will be another Pol Pot in Sri Lanka and all the thieves, drug dealers and criminals will gather around him, more than the minorities, the majority will be Kaput. Even God/Buddha cannot help Sri Lanka.

      English Translation Summary: President expresses his opposition to Keeping Intelligence Unit Criminals in Remand for the killings and murders carried out on behalf of the Rajapaksas. This has resulted in disruption of the CID and Bribery Commissions.

      Question: Was the President fooled by false reports by Army Intelligence? Gonata Andanava, Dressed to be a fool?

      Controversial statement and False Reports by Army Intelligence from the vines.

      “Mahinda inquired from Alok Prasad (of India) where he could arrange for the assistance of the Indian Army in order to protect his government if by chance an Army Conspiracy took place. At that juncture Alok Prasad spoke to India and got down ships of the Indian Navy to Colombo.” this was after the war was over.

      Civil Society Activist Professor Sarath Wijesuriya said that Maithri made the controversial statement about Gotabaya and the Navy Commanders recently based on false reports handed to him by Intelligence sectors that there was a wave of anti-government sentiments within the Army. During the past when Intelligence sources handed over their reports against Fonseka to mislead Mahinda, he did not shout it out in public. He requested the assistance of India and later removed Fonseka from the post of Army Commander. If Maithri made that statement based on those reports, it is a very dangerous situation. The reason is a tremor was experienced within the government and the image of the President was also damaged. If Intelligence divisions are attempting to take over the administration of the country by handing over Intelligence reports to the President, the room for Sri Lanka too, to become a victim of the tragedy that has taken place today in Pakistan where Army Intelligence sources control the Presidents of Pakistan, is very real.

      In his controversial statement Maithri said that if there are no accusations against the Army Intelligence Division Officers who have been taken into custody regarding the murders of Journalists Lasantha and Prageeth, they should be released. One day after he made this statement, a Sergeant Major committed suicide accepting the blame that he committed the murder of Lasantha and requesting that the Intelligence Division Officer who is in custody right now in connection with the murder be released. While Maithri requested that he be released if there are no accusations based on Intelligence Division Reports, a Seargeant Major has committed suicide requesting that he be released.

      This is a very dangerous situation. While a retired Sergeant Major says that he killed Lasantha, and information has been revealed that he was deployed in Army service even after his retirement, there is suspicion regarding an invisible hand that is in operation within the Army. If Maithri does not clear out the pawns of Gotabaya and cleanse the Army and take control into his hands, huge destruction is at hand. If Maithri becomes a prisoner of these invisible hands, it would not be possible to prevent Sri Lanka becoming another Pakistan.

      Here, it is valuable for Maithri to identify the war heroes and the Rajapaksas or the Army personnel who carried out the contracts of the Rajapaksas. If he cannot identify them, it would be degradation of war heroes who served the country and not of those who worked on behalf of the Rajapaksas during the war.

    How about the accusations that his relatives were monoplizing the paddy buying in their area, building tourist hotels at the water line of the biggest reservoir, dugging sand from th river and causing soil erosion, and I think, illegal cutting of trees…

They are the worst enemies of the general public. They will say that a Disney land will be created for you and me to live if they come to power.     If the security personnel used the war situation ans hiding behind it if they stole public wealth, they should be prosecuted.

    I think both Ranil Wickramsinghe and President talked about corruption and not politically influecing FCID, PRECIFAC etc., But, when they came to action they both took politically influencing decisions on those organizations.

    Ranil Wickramsinghe wanted FCID to investigate those whistel blowers in the Central bank. Maithriapala Sirisena wanted this Lady to step down. FCID investigations were also look partial, as it was investigating only the Rajapakses and those close to rajapakses.

    Ranil Wickramsinghe should not be trusted at all. HE had been always like that. Country is better off without Ranil. Maithripala Sirisena is also making statements but his work contradicts what he talks.

    If President does not regain his posture and acts correctly in terms of the Mandate given by the people, he will become HERO to ZERO and will signal a sad ending to his long political career at the end of his present term. If the Unity Government collapses due to this crisis, the primary blame will be on the President who will become the laughing stock of the Leaders of foreign nations who have been praising him for setting up a consensual rule. The President should review the role of his close advisors who would have given this wrong advice to him and plunging his image to a low level! Wijewickrama

    The Prez has said that his speech has been taken ‘out of context’. No way. A string of long sentences with threatening words and index finger makes him clear and loud. That’s exactly what long sentences, threatening words wagging fingers all combine for. How much longer does he think he should speak on one topic for people not to misunderstand him?

    Prez will not apologize. But he will pay heavily for his unwarranted outburst.

    President Sirisena’s decision looks completely political and it is nothing about war heroes. He is upset senior SLFP politicians are asked to come to FCID. Particularly, AHM Fousie has been caught for illegal usage of vehicles. President’s argument is if he goes to jail, every one in the cabinet goes to jail.

    The Commissioner is guilty and therefore tendered her resignation – examples
    quoted in the web are: 1) Spending the allocation of funds in 8 months.
    2) Not filing any Case upto then and two after it was pointed out. 3) Not
    consulting the AGs Dept. 4) Double Standard – Namal appearing twice and not
    thereafter when summoned taken to Courts, but Rajith not even once in 10 summons? -no action.

    I don’t think that MS will retract his statement or tender an apology. He will get his acolytes to make out to the public how innocuous his statement is.
    People should no longer depend on either the SLFP led by MS or the UNP led by RW to deliver good governance. Time has come for the civil society organizations to found a new political force under a new leadership.

    Thank you very much for giving voice to what so many of us feel.

    As you say, finding explanations for the damage caused by Maithri “need not concern us”. Yet that is exactly what I’ve been doing for almost a month.

    First there was his speech to teachers, where I felt that he was making some sort of point. Then there were the accounts of his son vandalising a night club; on that I found it impossible to excuse him, except for hoping that he would have it properly investigated.

    I know that last paragraph of mine sounds somewhat pompous, but I’m past caring what it sounds like. That speech of his was a betrayal of all that we had together fought for. I am neither an important person nor a particularly insightful man, but I think that I must have the same rights as any other citizen, and a responsibility to assert those rights for all citizens.

    We wanted the President whom WE elected to give us that much dignity. Since he obviously won’t, we have to support other forces that will help assert our rights.

    Having stated that, I don’t see much point in involving myself with any more rogues. Maithri isn’t the worst of them, but unless he apologises for what he has foolishly said, and gets back on the road that we wanted him to travel on, there can be no tolerating him any more.

    President has lost his mind. A news item in lankanewsweb.net reads that the President has said, because Fowzi has been in politics and SLFP for 50 years his small violation of the law should be forgiven and not taken to courts. Imagine a leader of a country saying this! Next he may say since Gotha was the defense secretary he should not be taken to courts (although he said this in his speech and now says he did not, its in voice cut for all to hear). How can a Yahapalana President who was elected to bring law and order and who promised us justice and who said he will not interfere with the Police and Justice is now making open statements in public. Can we ever trust him. What has Gota got against him which is scaring the President. He has become a Maithripla Rajapakse as some one wrote in one column.

      I also agree with you Soma, I believe the real issue is all who backed the new government including JVP and Media are biased only watching, blaming and criticizing President and his allies/acts.

      Ranil, Ravi and UNP team has already done many blunders,severe frauds, CB bond scams etc.They are fully controlling the bribery commission, FCID and CID and they are not independent at all. No one speaks. If the media and civil societies are unbiased and criticizes all in same manner these situations never arises.

      Any body can notice that Ranil is scheming to be president ( which he cannot via votes ) tarnishing President and his allies.

    There would never be independence in FCID when it’s investigations are directed by a political committee headed by the PM.

    There would never be independence in CID when the IGP who heads the department openly boasts about bending the law.

    Lastly, this President and the PM have broken the law multiple times and should be ready to go to jail under a future administration because the institutions mentioned above will never investigate the illegal and corrupt acts of the yamapalana leadership.
