Need To Show Results To Ensure Closure

There are two aspects to the process unfolding in the UN Human Rights Council in Geneva at the present time. The first is the outcome of the report of the UN High Commissioner for Human Rights, Michelle Bachelet which was released on January 27. The second will be resolution of the UN Human Rights Council itself which is in the process of being finalized, and of which a draft is available. It is this latter document that will be debated in the final days of the 46th session of the UNHRC later this month. This will be the document that sets out the expectation of the UNHRC in terms of implementation by Sri Lanka.

So far it has been the report of the UN High Commissioner that has taken the centre stage of public attention in the country and being subjected to severe criticism by the government. Foreign Minister Dinesh Gunawardena has appealed to the member states of the UNHRC to reject the report and impending resolution as a “pure political move” against the country and asking that the issue be brought to a closure. The report arranges and sets out facts from a perspective that indicates that Sri Lanka is heading in the direction of contracting space for political freedom, weakening of checks and balances in governance and increased conflict between ethnic and religious communities. The picture painted is a bleak one, and includes incidents such as the detention of lawyer Hejaaz Hizbullah for nine months without formal charge.

However, even more serious than the opinion expressed about the negative direction that the country is taking are the recommendations given in the UN High Commissioner’s report. They are potentially calamitous ranging from freezing of assets, travel bans and targeted sanctions against public officials suspected of human rights violations and referral of such cases to international tribunals including the International Criminal Court and an invitation to individual countries to take action under the principle of universal jurisdiction.

Draft Resolution 

The government has strongly refuted the UN report as being biased and over critical of the state of governance in the country. Foreign Minister Dinesh Gunawaredena said “Sri Lanka rejects the High Commissioner’s Report which has unjustifiably broadened its scope and mandate further, incorporating many issues of governance and matters that are essentially domestic for any self-respecting, sovereign country.” Over 20 countries have spoken against this report including China and Russia that possess veto powers in the UN Security Council which is the UN body authorized to permit international punitive actions. The problem is that the report opens the door to punitive actions by individual countries over which the countries that have pledged support to Sri Lanka will be unable to veto.

Another problem from the government’s perspective is that the UNHRC resolution had drawn inspiration from the report of the UN High Commissioner and has both observations and recommendations that are drawn from it. For instance, the draft resolution accepts the anticipated trajectory of Sri Lanka’s future political direction as presented by the UN High Commissioner’s report. There is a negative anticipation in this regard “over emerging trends over the past year, which represent clear early warning signs of a deteriorating human rights situation in Sri Lanka, including the accelerating militarization of civilian government functions, erosion of the independence of the judiciary and key institutions responsible for the promotion and protection of human rights, ongoing impunity and political obstruction of accountability for crimes and human rights violations in “emblematic cases”, policies that adversely affect the right to freedom of religion or belief, surveillance and intimidation of civil society and shrinking democratic space, arbitrary detentions, allegations of torture,” among others.

However, on the positive side the recommendations for action that are likely to be made in the UNHRC resolution on Sri Lanka are achievable ones on which action has already been taken in several instances. These are recommendations that the government can take on board and implement because they are meant to ensure a system of governance that is more just, law abiding and democratic for its multi ethnic, multi religious, multicultural and plural polity as described by Foreign Minister Dinesh Gunawardena at the UNHRC session in Geneva in February 2020.

The government is in a position to comply with most of the recommendations that are in the draft resolution. These are as follows:

a. Support the work of the Office on Missing Persons and the Office for Reparations and allow them to proceed with interim relief measures for affected vulnerable families and resolve the many cases of enforced disappearances so that families of the disappeared can know their fate and whereabouts;

b. Set up a comprehensive accountability process for all violations and abuses of human rights committed in Sri Lanka, including those by the Liberation Tigers of Tamil Eelam, as highlighted in the OISL report of September 2015

c. Deal with the prevailing marginalisation and discrimination suffered by the Muslim community, and that the Government of Sri Lanka’s decision to mandate cremations for all those deceased from COVID-19 has prevented Muslims and members of other religions from practicing their own burial religious rites;

d. Ensure the prompt, thorough and impartial investigation and, if warranted, prosecution of all allegations of gross human rights violations and serious violations of international humanitarian law including for longstanding emblematic cases; and ensure reversal of non judicial closure of cases involving rights violation or major crimes;

e. Ensure the effective and independent functioning of the National Human Rights Commission, the Office on Missing Persons, and the Office for Reparations;

f. Ensure a safe and enabling environment in which civil society can operate free from hindrance, insecurity, and reprisals;

g. Review the Prevention of Terrorism Act and ensure that any legislation to combat terrorism complies with its international human rights and humanitarian law obligations;

h. Foster religious freedom and pluralism by promoting the ability of all religious communities to manifest their religion, and to contribute openly and on an equal footing to society;

i. Continue to cooperate with special procedures mandate holders, including responding formally to outstanding requests and obtain advice and technical assistance on implementing the above-mentioned steps.

Action Taken 

It is to be noted that the government has already taken preliminary action with regard to several of the recommendations including those dealing with the Office on Missing Persons and Office for Reparations. It has also acted fully with regard to another one of the recommendations in the draft resolution. This is with regard to the issue of enforced cremation of Covid victims. Even though ten months late, the government’s decision to permit the burial of Covid victims in the face of strong internal opposition needs to be commended. It is likely to have a positive bearing on the discussions in the forthcoming discussions in the UNHRC, where the issue of enforced Covid cremation was a matter of censure. This decision will also contribute to make Muslims citizens of Sri Lanka feel that the government has finally responded to their deeply felt sentiments. Likewise, the government needs to be responsive to the Tamil citizens of Sri Lanka, their political aspirations and in particular whose grievances that continue to remain unaddressed eleven years after the end of the war.

It appears that the government is prepared to take action with regard to yet another one of the recommendations in the draft resolution. President Gotabaya Rajapaksa has expressed his desire to meet with the families of missing persons. This is a highly visible group of people who have been protesting for years that they want more information about their family members who went missing during the war and its immediate aftermath. Their unresolved grievances have been internationalized due to the inability and unwillingness of successive governments to offer a solution to this issue. Foreign Secretary Admiral Prof Jayanath Colombage has been quoted as saying that the president “wants to listen to them identify their actual grievances, rather than what politicians might say and give them a solution. It will happen very soon.”

The indications are that the resolution on Sri Lanka and its post-war reconciliation process will be presented by a group of likeminded countries with majority support in the UNHRC. The government is in a position to agree to most of these recommendations that advance the rights and privileges of Sri Lankan citizens, strengthen principles of good governance and are in keeping with the parameters of Sri Lankan sovereignty. The Lessons Learnt and Reconciliation Commission that the government appointed in 2010 in the face of a previous UNHRC resolution came up with a factual record and analysis that won both national and international recognition and some of its recommendations were adopted by the government. But more remains to be done. Instead of trying to mobilize countries in the UNHRC who themselves have questionable human rights track records to reject the resolution, the acceptance of those sections of the resolution that advance the quality of life of the Sri Lankan people and their human rights could take the country in a direction in which there will be no need for future resolutions by the UNHRC.

You don’t find a government ministers burning a library in these countries. you don’t find the American military protecting Christian thugs burning their own civilians. USA is a union of 50 states. Even now, stoning to death is practiced in some Middle Eastern countries. The Saudis recently hacked a journalist to pieces inside their embassy but economically powerful countries can get away with it. However, as Ajith says, it is about our country & equal rights & rule of law for all its citizens. At least, thanks to UNHCR, atrocities can be exposed, otherwise, there is no hope for real heroes like Shani, Hijaz or fearless journalists who expose wrong doings. Atrocities will continue if we don’t acknowledge our own dark past & happy to be in denial.

    In a tribal society, members of each tribe tend to be fiercely loyal to the hierarchy of the tribe, including its leader. They are sometimes willing to forego basic needs in order that sentiments supportive of and partial to, the adopted policy or attitude prevail. However, in more civilised, secular societies that have mature and discerning people, loyalty is not paramount, but justice and fairness are. They also tend to be far more ethical in their conduct, courteous and considerate of others in their daily habits and behaviours, giving way to others and foregoing the “me first” attitude that dogs immature societies. Humility is practiced, more than any hint of arrogance or superiority. Honesty is of high value and given top status, while liars are eternally condemned. Does Sri Lanka qualify in any of these aspects?

Standardization was introduced to reduce the number of Vellala Tamils from Yapanaya and Sinhalayo from Colombo who enjoyed best education facilities going to universities and increase the number of Sinhalayo and Tamils in other areas with less education facilities to enter universities. As a result more Tamils from the East and Central part of the country got the opportunity to go to universities. But unfortunately Vellala Tamils projected this to the International Community as discrimination.

            (The Standardization we faced limited Tamil medium students. The rich boys and girl took two or three tuition and paid to ministers went through. We were left behind. Any way thanks for your attempt to please us, who lost.)

        Tamils brought to Sinhale by colonial rulers sought asylum in this country when they were abandoned by colonial rulers without returning to their ancestral homeland because they were willing to live under Sinhala rule. If majority Tamil population like it why you are bothered about that. Tamils from the North, East and Central part come to Colombo and live without problem. To them there is no ‘Tamil Problem’, ‘National Problem’, ‘Minority Problem’, ‘Ethnic Problem’. These imaginary problems exist in the minds of racist separatist Malabar Vellala Tamil politicians who want to use them for their political survival. None of these guys will be willing to move to a mono-Tamil enclave in the North where they will get only 15.4% of land.

        China woke up to it a little too late, but was firm on terrorism (a menace between 2009 and 2014) which is now subdued. Social violence in Xinjiang was not anti-Uighur but by Uighur terrorists against the Han and other non-Muslims. (Some Uighurs were counterattacked by Hans amid terrorist violence in 2009 though).

          Muslims need to.stop playing this victim card and bravely stand up and condemn any atrocities in the Name of Islam , God , The Prophet and the Scripture and endorse a ban on any Islamic creed that endorses , seclusion, violence , encourages non patriotism and deny the right to speak out , question , to be able to conclude with independent reasoning and not be subjugated by indoctrinated dogmas.

          That is the day the Islamphobia will end and Muslims will be able to regain their dignity lost in the golden age.

    1] Law and order in the country should not happen according to the will of the Rulers.
    2] Security Forces in the North and East should be based in equal proportion around the Island. Private Lands should be handed over immediately. It is a FACT that there is no possibility of further civil war erupting in the North and East of the country for many more years.
    3] Provincial councils should have the power to do their policing and tackle the Land issues. There should not be a Governor for these Councils. Enough money should be allocated for development purposes.
    4] All prisoners AND others who were accused of war time activities should be produced in front of the Courts ASAP.
    5] Politicians and religious people should be prohibited from promoting Racial/Religious hatred.

      UNHCR is a humanitarian organization looks after refuges and in the Case of Sri Lanka UNHCR was looking after even the internally displaced people in the Northern and Eastern provinces in addition to refuges during the conflict.

      Refuges are defined as people displaced and go out of the country into another country whereas Internally displaced people are people displaced ,but remains within the country itself..

    The main issue this Govt has is that in order to come to power they whipped up the “Racist Feeling among communities”, not only that, even after coming to power the President mentioning not once but in several occasions that he was elected by the Sinhalese. This has added fuel to “Racist Feelings”.

    For such a Government to appoint either an Independent Truth and Reconciliation Commission or take actions against those soldiers who killed innocent surrendered/captured soldiers and children (enough military personnel videos we have seen) is a difficult task.

    At the end of the day for one family to be in power and their band wagon of all the crooks, rapists, drug dealers and criminal MPs to escape the grip of the law they ignore the actions that has to be taken for the benefit of the country and its people.

    Unless and until we have a Government that has the guts to put the communal issues to rest Sri Lanka will be at war with the rest of the world.

    I for one who had been always advocating a federal system , will never support 13+ , we will end up like Southern Sudan or East Timor.
    The Tamil people need to accept this reality , they will end up killing each other.
    With our local governments with limited powers we can not be of service, hence with autonomous regions.
    The best and most practical alternative is , to have a mix of Northern Ireland with administrative provinces , with a premier in each province but answerable to parliament , like northern Island , same thing should be done with all provinces , including North and East, police , land powers ,and judicioury should be considered to be under parliament and the central government.
    I also strongmy believe except the MCs, UCs and re-introduction of Vcs; the rest must be just converted to full scale E-goverence.
    People should be able to get their D/L , NIC , passport and birth certificates by a click on their computers and making payments online; by registering a special citizen’s pass with a special pincode, to be used to get into each institution.it will save time, the suffering of travel from far away and of cause money .
    With so much access of Internet we hardly exploite it for anything beneficial.

    My belief of a successful goveernment is one that has no alliance , but a political party with representatives from all communities with a strict constitution drawn within the party , or within a new constitution of the parliament,that clearly makes a person who crosses over to lose his or her MP status, by having a government representating members of all Communities as per their percentage of population, which will ensure no one intimidates the government or leaders.

    What use is it even to have all the powers in the land ,if you have to give into everyone’s demands .

    The Muslims and Tamils were both taken for a ride by Yahapalana ( not just UNP but also their partners) .
    While Muslims were instilled with fear of The President Gotabaya,
    The Yahapalana played the tofee child teasing using the 13+ .
    While some others expected The President to make irrational actions against certain members based purely on prejudice.
    The biggest losers are The Muslim Community for not voting for Mr.Gotabaya Rajapakshe , while he sincerely invited and openly stated he is for a new political culture.
    I sincerely pray for his good health and long life and also pray sincerely God keeps him well and strong and he will
    Run for his 2nd term too.
    It is absurd to only keep harping on The Rajapakshes , all past politicians have skeletons inside their closets .

    There are two way questions arise in the eve of Tamils & Muslims agitating the UNHRC for justice for them against the Appe Aanduwas’ tyranny. 1). What did UNHRC do about the Sinhalese problems they facing from the mass murdering governments & 2)what kind of action Sinhalese took at UNHRC to bring back a legitimate government in Lankawe.
    There are no clear cut answers to these questions. But it is not coming out of the thin air, but there are some, at slow motions sometimes and dormant state sometimes. Death of Vaalaiththodam Sr. in 1989 ended Sinhalese call to “go for UNHRC (the Commission)”. The crime committed by Vaalaiththodam Sr. was a Human Right violation case. But as he was missing and as pursuing those cases anymore would hurt Chandrika’s Army which was engaged in War for Peace, she abandoned those cases. Ranil, just like he escaped in the 4/21 PCoI, he escaped from Batalanda Commissions’ recommendation too. Unlike Ranil, Chandrika is not Impunity Queen, but she was the real guru to Ranil become the King of impunity. And she might have been inspired by Ranil’s resistance to sign Rome accord. Then, after the war was lost by Tamils in 2009, Old King renamed UNHRC, for the Use of Sinhala Buddhists as “United Nations Tamil Terrorist’s Inhuman Commission”.

    When Tamils approached UNHRC, to use that for his 2010 election victory, Old King campaigned that Tamil Terrorist were trying seat him on the UN Electric Chair. From that day onward, UN & UNHRC are the most dangerous terrorists in world, even worse than LTTE, in poisoned minds of Sinhala Buddhists. This scared even the moderate Buddhists Sinhalese from associating them with UNHRC. Though a socialist, Dr. Wickramabahu supported UNHRC resolving Tamils issues, including self-determination. Nimalka Fernando took a different angle. She insisted the Rapist armies’ murders and rape accusations are true even on the Sinhalese sides and to prove it, she took Raped or toured Sinhala Women with her to UNHRC. For that Nimalka was about to pay the ultimate price. The Modaya match maker Mervyn De Silva warned her not to come otherwise she would be killed. So she avoided Lankawe for some time until she felt safe to return. Nimalka is the only one that I know of that honestly letting know UNHRC that Sinhalese are too suffering by the Royals and their rapist Army. Mangala worked with UNHRC on Resolution 30/1. Because he badly lied about the progress of the implementation, often, now it is rejected by Royals. After the Royal Hitler’s ascends to throne, the moderate Buddhists Sinhalese have lost hope of Sinhala Majority fixing the problems themselves in elections.

    For these Sinhalese, unlike Tamils or Muslims, Human Rights is not the only problem thier governments created for them. Country’s unredeemable debt-ness, slavery to China, depleted local labour force by refugee and indentured, the competition created by their own governments among Superpowers in their soil, the inability of their governments bring back the justice, Law and order as all past and present politicians are heavily trenched into high crimes, from Suthu Nelum through Chitanta, Yahapalanaya and the Royal governments were/are not able to investigate any serious criminal cases, other than school children’s coconut thefts etc etc.. When the British tourist Sheik Kurham was murdered, British Crown Prince had to come to make the case to move. As our PhD has pointed out somewhere, even Buddhist Sinhalese’s emblematic cases are not investigated by any government. Further, as the above mentioned Sinhalese problems are hooked into one another by the Aappa Diplomacy Tricky government, no future governments they send to clear them can solve them. Intelligent Sinhalese are observing that at the mouth of the tunnel not the light, but the gate is closed and locked by the incumbent Royal government. Their enthusiasm on a CC in 2015 has completely evaporated.

    Like in the saying of “Muttukku Muttaha” (Perl to Perl) Sinhalese are not able to see any difference between two Sinhala Politicians. Other than this propagandist PhD, there is an opinion in some Sinhalese, that they should be open to employ any decent method to clear these criminals and bring a new Constitution, a new government- not the regime change. They are open to UNHRC, if a train is leaving from Ford Station. That is where that there is vacancy is existing for a simple and honest Sinhala statesman leader, who is reachable by all kind of Sinhalese, not for the Biryani-Arrack seeking Sinhala Buddhists, to grant a trip for learned Sinhalese gentlemen to Geneva.

    There will only be closure when justice is done and the greater Tamil nation comprising of the indigenous Eelam Tamils, the Indian origin estate Tamils and the Tamil Muslims are treated with dignity and have the same rights as the Sinhalese and federalism granted to the Eelam Tamil lands of the north and east with police and land powers, so that they have control or their land and law and order and not outsiders or the armed forces and other government departments who are now using this to steal land, ethnically cleanse Tamils, destroy Hindu temples and settle Sinhalese from the south

      By getting land and police powers to NE Tamils are losing more than gaining. Because the package comes with land and police powers to Sinhala majority provinces too where +50% Tamils live. Minorities in federal provinces will be rendered second class citizen level. With land powers come entitlement for the natural resources within. Control of resources like water by Southern federal units could leave NE seriously disadvantaged. Same with other natural resources in respect of their revenue potential. What I fear most is tit for tat measures in North versus South. Ex. religious sites , land grabs , cross border incursions. cross border crimes etc.. Problems are innumerable.

In addition they want these people’s governments to follow their guide lines, but rather not to form Escobar Cartels with the name of magic shows called “elections”. Regarding the supports to UN conventions, like our Diyawanna Lake Palace 8th graders, there are many willing to accept the 19As and that same many ready to vote for the 20As, too. But it is unlikely UN downgrading itself for 20A. If everything keeps moving in positive side, UNHRC getting again upgraded as UNHRC+ is the possibility (At least that is what President Biden wants). If the Royals are not willing to deal with the current UNHRC they would be reserving their to deal with the UNHRC+.

    Why do you think so many Sinhala Buddhists voted for this Government? Tamil separatism as displayed by the diaspora at every opportunity, Muslim expansion and terror, Christian proselytization with church planting, faith healing, music shows and unethical conversions.

    The Sinhala Buddhists don’t mind the country being in a mess. Nothing is worse than these three threats to their way of life. They have survived foreign invasion and occupation do you imagine that a weak economy is going to worry them?
