No Credible Hybrid Mechanism In The Draft Resolution: Tamil Parties And CSOs

A joint statement signed by all other three constituent parties of TNA except ITAK, Civil Society Organisations and Trade Unions on proposed US Resolution on Sri Lanka has been sent to all 47 member states to the UNHRC today.

Full text;

Zeid Ra’ad Al Hussein - The UN High Commissioner for Human Rights

Zeid Ra’ad Al Hussein – The UN High Commissioner for Human Rights

29 September 2015

We release this statement in response to the draft resolution titled ‘Promoting Reconciliation, Accountability and Human Rights in Sri Lanka’ tabled under Item 2 and scheduled for debate and adoption on the 30th of September 2015.

  1. We reiterate the firm conviction of the victims of the ethnic conflict in Sri Lanka, a majority of whom are Tamils, that accountability and justice can only be truly delivered through an international criminal justice process.
  2. We however in deference to the Report of the Office of the UN High Commissioner for Human Rights’ Inquiry on Sri Lanka (the OISL report) were willing to consider the possibility of achieving justice and accountability through a credible hybrid mechanism in the event of the mechanism being led and managed by its international component under the aegis of the UN.
  3. We regret that Operative Paragraphs 4 and 6 of the draft resolution do not adequately provide for the setting up of such a credible hybrid mechanism. The paragraphs when read together only seek to provide the appearance of credibility to a domestic process through the appointment of ‘commonwealth and other foreign judges, defence lawyers, and authorized prosecutors and investigators’. The Sri Lankan Government appointing foreign judges to its own judicial mechanism will not address the structural factors that inhibit the domestic structures in Sri Lanka, reasons for which are detailed in the OISL report. A mechanism, which is by and large managed and controlled by the Sri Lankan state, will not in our opinion be deemed credible by the victims in Sri Lanka.
  4. We also deeply regret that references to demilitarization of the North-East and an increased role for the OHCHR which were included in the initial draft of the resolution have been removed from the current draft tabled before the UNHRC. The current draft resolution in Operative Paragraph 3 provides for a ‘national’ victims consultation process thereby in effect excluding numerous Tamil victims who live outside of Sri Lanka in fear of persecution. The testimonies of these victims from the diaspora were key to the OISL inquiry. We note with deep regret that in the interest of arriving at a consensus resolution with Sri Lanka that many key components of the initial draft have been omitted.
  5. We urge you to reconsider the current draft of the resolution and to redraft it so that it truly serves the purpose of providing the basis for delivering accountability and justice in Sri Lanka.

“We urge you to reconsider the current draft of the resolution and to redraft it so that it truly serves the purpose of providing the basis for delivering accountability and justice in Sri Lanka.”

    Whom?

Today is final day for any last minute suggestions.

Which nation is willing to pay the price diplomatically for this action??

Let the underdogs remember all wells are governed similarly on this planet.

Run across any hall of honour, with statues of the great men of history lining the corridor, and you will perceive that the rationality of conduct is probably the last thing to be recalled from their lives.

Julius Caesar, who fell in love with Cleopatra- noble Julius Caesar who was so completely irrational that he almost forgot (as Mark Anthony did entirely forget) an empire for a woman.

The Moses who in a fit of rage shattered the sacred stone tablets which had taken him forty days on Mount Sinai to inscribe in company with God, and in that he was no more rational than the Israelites who forsook God and took to worshiping the Golden Calf in his absence.

That King David who was alternatively cruel and generous…….

King Solomon the very image of wisdom who could not do a thing about his son….

Confucius who told a visitor he was not at home and then as the visitor was just outside the door, sang upstairs in order to let him know that he was at home…

Jesus with his tears at Gethsemane and his doubts of the cross….Shakespeare, who bequeathed his `second-best bed` to his wife….

Milton who could not get along with his 17 year old wife and therefore wrote a treatise on divorce and attacked then burst forth into a defense of the liberty of speech in Areopagitica…

Goethe who went through the church wedding ceremony with his wife, their 19 year old son standing by their side…

J Swift and Stella….Ibsen and Emilie Bardach (he kept rational- good for him)
I can go on and on in seeing the bust of folk at Harvard, Oxford and Cambridge, Leuven Universities.

Is it not plain that `passion` rather than reason rules the world at large??

So the Indian tweak to draft resolution is holding strong
Even Alibaba China is investing the billions into mobile India..

To drive into conveyancing and draftsmanship of clipped Draft Resolution
The Tamils need a diplomat of standing and they have killed their own in the class crusade started by SJV. The ones left despise you, obviously..

make best of what you wished for as T.Nadu is introverts limit.

Sampanthar accepted the Final Draft in contrary of all his talk in the recent days.

Only people can save Tamils here is Ranil and New King. If they keep up their smart only something will be done in some days. At least, for the time being Ranil’s objective is that. He wants to name somebody as LTTE and hang them. That is what he did in Vidya case. In countries where law and order works, if the plaintiffs lawyers come and tells the court that all the evidences were erased so the case has to canceled, they might have lost license to practice unless the the office who destroyed the evidence going to the cells.

Mangala/Ranil duo have done the trick, after pressure from their party extremists, and probably from the military.
All depends on USA – how it views this watered down resolution.
The UN High Commissioner will see that all his efforts and that of his predecessor will be in vain, if this is adopted.

      justice,

that is your stupid point of view. There is no Sinhalese higher than Brahman Tamil of USA- if you are on google its Brahmin Tamil and its the same with many.
They failed because of the class struggle which the sinhala baldies promoted.

Yes the american immigrants understand you because you are the pirate from Portuguese era. same-same.

But the land is owned by Hindia in Nehru words and they are coming for it the English way- last man out in to Diego Garcia state.

Professor Thissa Vitharana’s statement in the “Island ” yesterday is an eye opener for the Srilankans, Sinhala Buddhists inhabitants in particular who are going behind this US, UNP, Diaspora agenda to demilitarize the North East, and give the TNA their long standing dream of Eelaam.

And pave the way for a US Naval base in Trincomalee.

After that current Srilanka which we know of will be history.

“And pave the way for a US Naval base in Trincomalee.”

Has Hindia granted permission to US?

Please revisit early 1980s. Remember Hindia chopped Yankee Dick’s clanging b**ls in front of his wife and sons. My Elders tell me that Hindia got Sri Lanka to sign a document, of course under duress. What does the document (Hindia Lanka Agreement) say about the limits of foreign involvement in this island?

  • 4
    3

If the demilitarisation clause has been removed in the final draft as per what is alleged in para numbered 4 above, the resolution will not be worth the paper on which it is written! There is an overwhelming and intimidating presence of the military in the North and under such circumstances, the proposed witness protection law will only be a joke!
The President rushed to Trinco to release occupied lands in Sampur, perhaps to buy over Sampanthan. Hardly any extra land has been released from the so called High Security Zone in Valigamam North to the people and Mavai Senathirajah M. P does not seem to be bothered. Perhaps, he is eyeing to become the next CM of the NPC after ousting CVW.
All Tamils, especially those in diaspora should realise that neither the US nor India nor any other country in the world has any special love for the Sri Lankan Tamils. They are only concerned about inter State relationships. They will make use of OUR problems only to serve THEIR interests and keep Sri Lanka on leash.

“”All Tamils, especially those in diaspora should realise that neither the US nor India nor any other country in the world has any special love for the Sri Lankan Tamils.””

      The dog collar is true.

Your GTF Diaspora is not a diplomat but a politician from low beginnings and it would do all it can to join the present government as its not built for any better.

Today the influential Tamils in the government are war criminals, arselickers and thieves with a faceless dictator

Until the beginning of SJV crusade (say 1970) there were JT diplomats of Colombo who could swing the shape shape shape donkey psyche of sinhala from Hindian or the west.

Where have all the flowers gone??
This is a wisdom man has not yet learned

Glad that you came down to reality on how the US and other western countries work. I have been saying this for years. Also, get real no country wants and will not want any one to tell them where their military should be kept. The best option for tamils is to have a cordial friendship with the government and get a negotiated settlement for what ever they want. Being hostile to the government is not going to get good results. Also, get rid of the diaspora getting involved in tamil affairs in Sri Lanka.

It is good that you guys are rich with “multistory luxury apartments”! Please use some of your wealth to build few places for your millions of shanty dwellers to defecate. Also those few rich should employ some of those millions as maids. For some reason even our Estate Tamils don’t want to go to India.

Here is something you would be happy to read about the country you claim yours:

“Toilet facilities are not available for all the households.
Those who don’t have toilets use nearby jungles and paddy
fields. Sometimes we have to face snake bites and wild

Toilets or telephones? That’s the wrong question!

Sri Lanka has its share of this problem. For example, 1,300 out of the country’s 9,500 public schools don’t have toilets. That means nearly a million school kids have nowhere to…go.

” They will make use of OUR problems only to serve THEIR interests and keep Sri Lanka on leash.”

Hindia has been seriously working on project Sri Lanka for quite a while. Hindians believe Sri Lanka is the Sinhala/state of Hindia. Full stop. Whether Kachtive remains with Sri Lanka or part of Hindia is irrelevant as long as Sri Lanka remains a small state of Hindia.

Sri Lankies believe this island is a sovereign country, a taste for luxury acquired during the colonial period. However Lankies are ignorant of the fact that the world is changing. Changing rapidly than one could imagine.

Lankies refused to adapt and change, a necessary condition for the survival of the people. Come to think of it somehow social evolution has left this island untouched.

You know stone age civilisation couldn’t survive not because of lack of stones but because of discovery of new raw materials and technology.

From Gunadasa Amarasekara, to ………. Dayan, Wimal, ……… will not survive not because of lack of oxygen or food but because they refuse to adapt and change, use their brain creatively. They are determined to drag this island to the bottom.

Their perception of this island being surrounded by enemies is good for merchants of death, who supply unwanted expensive military hardware and very bad for the country.

I am sure the Sri Lankan Tamils do not want to be a part of India as much as the Sinhalese. The reactions of the Northern fishers alone should be sufficient proof for this. If Sri Lanka is to remain an independent sovereign country it is inevitable that the major ethnic community, the Sinhalese build a strong bond of friendship with the Tamils and give the Tamils a sense of belonging to the country. But unfortunately, the likes of Gunadasa Anarasekera, Dayan and Wimal will continue to obstruct such a bond developing and thereby endanger the sovereignty of the country!

“LTTE coolies don’t seem to know whether they’re coming or going :D”

When they came, they came with a big bang. Then the Hindians had to draw a line on the Elephant Pass sand. Even Hindians were willing to provide ships to evacuate the brave soldiers of the Aryan Sinhala/Buddhists.

When the LTTE came, within hours the Mullaitive garrison evaporated into thin air, may be 1200 gallant soldiers didn’t know whether they were coming or going, but their coffins arrived within days. The parents found the coffins were being filled with rocks.

It is still a mystery as to how dead bodies were transmuted into solid rocks, perhaps into philosopher’s stones.

No it is not because unlike our identities, Siva Sankaran Sarma is a real name and is possibly the real identity and name of the person who was originally posting on the Sri Lankan forum. For this person to steal this name and identity and then use this to post mischievous anti Tamil propaganda, without the knowledge of the original Siva Sankaran, who fought so hard for the rights of the Sri Lankan Tamils is not correct. It was Siva Sankaran who originally opened our eyes to the real history of the island and the history of the Tamils. It is for this reason many Sinhalese and Muslims hated him and used to go out of their way to insult and attack him. I am sure this fake Siva Sankaran Sarma was also one of the posters in the now defunct Sri Lankan forum.
A few people posting in this forum also use their real name and identities. How will they feel if someone from this forum starts using their name and identity, to post all sorts of views opinions and racist crap that they do not agree, at various forums. This person is doing the same. It is not only here but I have seen this person using Siva Sankaran’s name to post various anti Tamil crap at many forums Eg the Guardian ETC. Morally very repugnant. Why does this person have to do this?

Give me a source of the real history of the Sinhalese other than the Modavamsa myth that is now being touted as history. We all know the real history of more than 50% of the present day Sinhalese. Purely descended from largely indentured Indian Tamils who were imported into the island by the Portuguese and Dutch colonials. There is enough and more evidence of this

I wonder what is the “give” and what is the “take”? Just by “asking your pound of flesh” as you have crudely put it, shall not mean the abandonment of reconciliation. Unless you consider the victims as not SL citizens, the state should have been proactive in seeking the justice for the affected victims. Such gaping wounds, if allowed to fester, will evade the peace that has eluded SL for a long time.

We are talking about possible war crimes. Let the wheels of justice roll and the perpetrators be hounded “for their pound of flesh” as this will go to show that future such misadventures would have to face the full force of the law.

Investigation of “possible war crimes”.Why an international
mechanism ?.First give a chance to the local investigation. There are people who don’t trust the international mechanisms. See the biased Darusman report

I had some respect for Sengodan, but now he is writing like a layman. He says” All Tamils, especially those in Diaspora should realise that neither the US nor India nor any other country in the world has any special love for the Sri Lankan Tamils. They are only concerned about inter State relationships. They will make use of OUR problems only to serve THEIR interests and keep Sri Lanka on leash. Sengodan. M” Of course every country has its own geo-political interests. What the TNA is doing is align/converge our interests with the geo-political interests. There are 47 countries in the UNHRC, so US has to listen to at least half of them. That is how a strong resolution gets diluted with the passage of time. The US resolution deals with a number of issues that are vital for the Thamils. Perhaps Sengodan will like to go back to the dark era of Rajapaksa who claimed there are no minorities in Sri Lanka. Politics is the art of the possible …. attainable ….. the art of choosing the next best. Thamils should not be seen to look at the teeth of a gift horse! Lastly, it is uncharitable and preposterous to suggest that Sampanthan has been bought over by the government. Sampanthan has been representing Trincomalee from 1977 (except from 1983 – 2000) and his record of service to the Thamil people is impeccable.

The petitioners have given on the surface an impressive list of parties and other civil organizations. The first signatory the EPLRF. Its leader Suresh Premachandran was soundly defeated placed a distant 7th out of 10 candidates contesting on the TNA platform. The difference between him and the 6th place candidate was 13,109! The fourth signatory TNPF lost deposit in 4 districts and saved deposit in the Jaffna electoral district by 6 votes. In fact the TNPF came 6th, losing to UPFA and the UNP an utter shame. In March 2014 the TNPF burnt the draft US resolution in the streets of Geneva claiming the resolution is useless, there is nothing in it for the Thamils. So it will be crystal clear the people rejected and defeated rabble rousers and fringe extremists among the Thamils. This speaks volumes in respect of these 2 parties. As for the other signatories they are mostly letter pad organizations. For example, The Thamil Civil Society Forum is a one man show. His name is Kumaravadivel Guruparan, lecturer Jaffna University and currently in UK!

Be that as it may be. Their main grievance appears to be the omission or any reference references to demilitarization of the North-East and an increased role for the OHCHR which were included in the initial draft of the resolution have been removed from the current draft tabled before the UNHRC. There is some merit in this observation, but it is more than compensated by operative para 8 which reads as follows:

    8. Encourages the Government of Sri Lanka to introduce effective SECURITY sector reforms as part of its transitional justice process that will help enhance the reputation and professionalism of the military and include ensuring that no scope exists for retention in or recruitment into the security forces of anyone credibly implicated through a fair administrative process in serious crimes involving human rights violations or abuses or violations of international humanitarian law including members of the security and intelligence units; and increasing training and incentives focused on the promotion and protection of human rights of all Sri Lankans.”

The signatories to the petition are also lamenting on the fact that “accountability and justice can only be truly delivered through an international criminal justice process.” That is fine, but an international investigation is only possible if the Security Council adopts a resolution to that effect. But that is not a viable proposition with both China and Russia wielding veto power. These countries are vehemently opposed to US draft resolution. So settling to the next best hybrid (this word is not in the resolution but in effect that is the fact. If anyone is in doubt, please ask Dayan Jayatilleka, political advisor to ex-president Mahinda Rajapaksa.)
