
A joint statement signed by all other three constituent parties of TNA except ITAK, Civil Society Organisations and Trade Unions on proposed US Resolution on Sri Lanka has been sent to all 47 member states to the UNHRC today.

We release this statement in response to the draft resolution titled ‘Promoting Reconciliation, Accountability and Human Rights in Sri Lanka’ tabled under Item 2 and scheduled for debate and adoption on the 30th of September 2015.
- We reiterate the firm conviction of the victims of the ethnic conflict in Sri Lanka, a majority of whom are Tamils, that accountability and justice can only be truly delivered through an international criminal justice process.
- We however in deference to the Report of the Office of the UN High Commissioner for Human Rights’ Inquiry on Sri Lanka (the OISL report) were willing to consider the possibility of achieving justice and accountability through a credible hybrid mechanism in the event of the mechanism being led and managed by its international component under the aegis of the UN.
- We regret that Operative Paragraphs 4 and 6 of the draft resolution do not adequately provide for the setting up of such a credible hybrid mechanism. The paragraphs when read together only seek to provide the appearance of credibility to a domestic process through the appointment of ‘commonwealth and other foreign judges, defence lawyers, and authorized prosecutors and investigators’. The Sri Lankan Government appointing foreign judges to its own judicial mechanism will not address the structural factors that inhibit the domestic structures in Sri Lanka, reasons for which are detailed in the OISL report. A mechanism, which is by and large managed and controlled by the Sri Lankan state, will not in our opinion be deemed credible by the victims in Sri Lanka.
- We also deeply regret that references to demilitarization of the North-East and an increased role for the OHCHR which were included in the initial draft of the resolution have been removed from the current draft tabled before the UNHRC. The current draft resolution in Operative Paragraph 3 provides for a ‘national’ victims consultation process thereby in effect excluding numerous Tamil victims who live outside of Sri Lanka in fear of persecution. The testimonies of these victims from the diaspora were key to the OISL inquiry. We note with deep regret that in the interest of arriving at a consensus resolution with Sri Lanka that many key components of the initial draft have been omitted.
- We urge you to reconsider the current draft of the resolution and to redraft it so that it truly serves the purpose of providing the basis for delivering accountability and justice in Sri Lanka.

If the demilitarisation clause has been removed in the final draft as per what is alleged in para numbered 4 above, the resolution will not be worth the paper on which it is written! There is an overwhelming and intimidating presence of the military in the North and under such circumstances, the proposed witness protection law will only be a joke!

M” Of course every country has its own geo-political interests. What the TNA is doing is align/converge our interests with the geo-political interests. There are 47 countries in the UNHRC, so US has to listen to at least half of them. That is how a strong resolution gets diluted with the passage of time. The US resolution deals with a number of issues that are vital for the Thamils. Perhaps Sengodan will like to go back to the dark era of Rajapaksa who claimed there are no minorities in Sri Lanka. Politics is the art of the possible …. attainable ….. the art of choosing the next best. Thamils should not be seen to look at the teeth of a gift horse! Lastly, it is uncharitable and preposterous to suggest that Sampanthan has been bought over by the government. Sampanthan has been representing Trincomalee from 1977 (except from 1983 – 2000) and his record of service to the Thamil people is impeccable.

The petitioners have given on the surface an impressive list of parties and other civil organizations. The first signatory the EPLRF. Its leader Suresh Premachandran was soundly defeated placed a distant 7th out of 10 candidates contesting on the TNA platform. The difference between him and the 6th place candidate was 13,109! The fourth signatory TNPF lost deposit in 4 districts and saved deposit in the Jaffna electoral district by 6 votes. In fact the TNPF came 6th, losing to UPFA and the UNP an utter shame. In March 2014 the TNPF burnt the draft US resolution in the streets of Geneva claiming the resolution is useless, there is nothing in it for the Thamils. So it will be crystal clear the people rejected and defeated rabble rousers and fringe extremists among the Thamils. This speaks volumes in respect of these 2 parties. As for the other signatories they are mostly letter pad organizations. For example, The Thamil Civil Society Forum is a one man show. His name is Kumaravadivel Guruparan, lecturer Jaffna University and currently in UK!
Be that as it may be. Their main grievance appears to be the omission or any reference references to demilitarization of the North-East and an increased role for the OHCHR which were included in the initial draft of the resolution have been removed from the current draft tabled before the UNHRC. There is some merit in this observation, but it is more than compensated by operative para 8 which reads as follows:
8. Encourages the Government of Sri Lanka to introduce effective SECURITY sector reforms as part of its transitional justice process that will help enhance the reputation and professionalism of the military and include ensuring that no scope exists for retention in or recruitment into the security forces of anyone credibly implicated through a fair administrative process in serious crimes involving human rights violations or abuses or violations of international humanitarian law including members of the security and intelligence units; and increasing training and incentives focused on the promotion and protection of human rights of all Sri Lankans.”
The signatories to the petition are also lamenting on the fact that “accountability and justice can only be truly delivered through an international criminal justice process.” That is fine, but an international investigation is only possible if the Security Council adopts a resolution to that effect. But that is not a viable proposition with both China and Russia wielding veto power. These countries are vehemently opposed to US draft resolution. So settling to the next best hybrid (this word is not in the resolution but in effect that is the fact. If anyone is in doubt, please ask Dayan Jayatilleka, political advisor to ex-president Mahinda Rajapaksa.)
