No Election Until Supreme Court Gives Green Light: Mahinda Deshapriya

Elections Commissions Chairman Mahinda Deshapriya is likely to wait for the Supreme Court’s opinion on the legality of the dissolution of Parliament before proceeding with preparations for a General Election, Colombo Telegraph learns.

Election Commissionors

Deshapriya told media that he would wait for the Supreme Court’s opinion on the legality of the dissolution of Parliament before proceeding with preparations for a General Election.

Deshapriya said the Elections Commission was not in a position to hold an election when Parliament is dissolved illegally. In such circumstances, Deshapriya said, he required the Supreme Court’s opinion on the legality of the dissolution before proceeding with the election.

Sirisena, when he signed the gazette announcing the premature dissolution of the legislature, grossly violated the provisions of the 19th Amendment to the constitution – which he architected in April 2015.

Strong arguments have been presented against the dissolution of Parliament saying the President has no constitutional power to do so, before four and a half years into a Parliamentary term, as stipulated by the 19th Amendment.

Update – Speaking to Colombo Telegraph, Elections Commissioner Mahinda Deshapriya said he never made such a comment to Lanka Enews nor was he contacted by the website, at any point, on the matter. However, his brother, journalist Sunanda Deshapriya tweeted the story reported by Lanka Enews expressing confidence that the Elections Commission Chairman would seek the opinion of the Supreme Court before proceeding with an election. Meanwhile, sources within the Elections Commission told Colombo Telegraph that the members of the Commission have arrived at a unanimous understanding that they would not hold an election in violation of the constitution.

Recent inspiring speech of Prime Minister Imran Khan in China must be televised day and night to tell these corrupt and craving politicians of Sri Lanka to be ashamed of themselves.

From the day one Ranil’s government was formed, Mahinda family accompanied by the fattened purses of their regime are all out to destroy it. The dissolution of the parliament is culmination of their relentless efforts.

Is Sri Lanka a cursed country?

It is now the turn for Deshapria (Patriot) and the Judiciary to prove Sri Lanka is not fully sunk to the rule of Kommision Kaakaas who amazed wealth in their war dealings to bribe their way through to throttle even what remains in the foundation of fair governance of Sri Lanka .

If MR to earn any respect from the voter then he must follow the rules of the country. Courts will refer to the Parliament and Parliament must be open for business.
Coming through the back door is unacceptable and he should not use the legal system to release the convicted criminals or people will unite and form a front to put out committed honest and honourable people on the 5th.
We don’t want a banana republic in our country,

        SL is a banana republic.
The present constitution is a “fake” document framed and amended with ulterior motives.
General Election is the most practical and fair way of solving the present impasse and gridlock; let the people decide i.e. democracy.

You are a comedian. You don’t know whom to support when. You, all these time supported Old Royal family giving a hand to Ranil to keep them out of all court cases. Ranil refused to take them to court even after he was sacked from his PM job. Now don’t white wash yourself too.

      Mr.Rajasinham

Lets be honest and unbiased. Only way to address grievances of all individuals. Are we not ashamed of rulers in a variety of shades. MR / MS / Chandrika et al . Does that spare the gang of rogues in Green colour. JR / Premadasa duo. This Green Man the rep of his uncle JR crept into politics from the back door and bragging as 4 times Premier, the curse of SL. He and his ring – I prefer to distance myself calling derogatory terms in butterfly stories which is an insult to those harmless creatures. They belong to a group, if called appropriately, the shit eating Hyenas.
The UNP sank to its present status under his rule. Now he is running behind the west to rescue him. By any chance if he won the day, that’s the beginning of the end.
6.2 m Sri Lankans gave them the opportunity to get rid of Rajapaksa rogues. MS the so called Grama Sevaka did what he knew best within his village level, leaving Ranil the smart GA in old terms, to punish rogues. He ran a dirty game of playing with thieves a double game. The result today is there for all to see.

What is happening in Sri Lanka is unprecedented.

There are a cocktail of issues to dissect with all stakeholders involved. I will give credit to Ranil’s premiership under a difficult partnership arrangement with ardent forces to bring about the much needed climate normalcy in the country.

With the cronies around him to make himself a crony, he was able to bring about some significant changes – fundamentally, the 19th amendment that provided independent commissions, controls on the power of the President etc., The present stalemate is the product of those required to account for their own deeds and the President lacks the sharp acumen to respond responsibly.

The alleged Mahendran’s misconduct must be brought to honest closure.

To cut my comments short, we cannot allow what is achieved with Ranils governance. To change this, is like taking a step back to peddle on the glorification’s of white vans, Grease Yakkas etc.

MS said soon after his election as president, that he will stand only for one term. He is now saying he will pack his bags if RW become the PM.

It is testing time for MS and he is at the crucial juncture to honour his outright claims.

        God save Sri Lanka!

      .
Were you guys not actively supporting MR and in fact work with MR to promote MR’s propaganda and programs to raise diaspora support to help MR establish the Army in the North for their land grabbing and business ventures as well under the cover of regional development?!
      .
It is indeed fine, and perhaps even creditable that you have now seen the “light” (albeit because MR cheated you guys), but I think the first step should be to show remorse for your own actions and not ignore or pretend otherwise!

          .
What ever happened to that International Tamil Diaspora Group about whom you wrote glowingly pretending to be a third-person not involved in the group and then was caught red-handed that you were indeed a critical component in that rogue-grouping undermine fundamental Tamil issues as you pursued poltical capital for your own purposes.
          ..
Every time you make an appearance Tamils shudder at the prospects of your familial boot licking and undermining the Tamils, both at home, and in the Diaspora.

                  Jayadevan,
                  .
Do you really consider the following an intelligible sentence? “Go and sell your coin story in millions of rupees dimension to the political market that is thriving to horse trade”.
                  .
It is typical Trump-speak – a diarrhea of irrelevance! No defence, therefore just distract! If not you would have addressed the accusation more forthrightly about your clandestine efforts to organize and promote a bogus group under the pretext of an international Tamil Diaspora, a group that had a shelf life of no more than a month or two as it was quickly recognized for what it was! Just a scheme to rob the Diaspora!
                  .
However, despite your silence on that, my intent was only to expose your duplicities, especially because new comers to the blog may not realize you past actions, especially the sucking-up to MR, Gota and Douglas because they offered you guys free trip (talk about “horse trading”!) and buttered you up to evangelize on their behalf among the Diaspora to extract Diaspora funds. But then, as was inevitable MR’s gang undermined you because you had no clout in the Diaspora to collect any funds. Now you are rabidly against MR, having bitten by him.
                  .
Anyhow, thanks for giving the opportunity to briefly expose your past, for a clearer view of your current and traditional intents – nothing but devilishly selfish to the core!

Very Important for all to note:

“President Sirisena has, by his unconstitutional actions, also now exposed individuals in all sectors, who acted honestly and in a forthright manner in furtherance of their duty towards good governance, to grave risk of retribution at the hands of a potentially repressive regime, which would derive its existence and de facto power by unconstitutional means.”

“The collaborative/collusive role and hand of Mr. Mahinda Rajapaksa in all these events, is beyond doubt.”

I would like to call upon all Srilankan citizens and those of all who are interested in the welfare of the Srilankan people:
Our political culture deteriorated day by day from the day of independence until now and now there is nothing more to worse than any more. Enough is enough and we need to change our political culture completely. I don’t think any one in the current politics are trust worthy. We need to get rid of all of them. We have to set out our standard and conditions that have to be followed by every public servants public institutions or organisations and no one should be above the law. Opportunism should be completely wiped out and bribing in any form should be stopped.
President’s call for immediate election should be stopped or boycotted. Any urgent decision to hold election means that the same old politicians and political parties to continue with their political culture. People need the time to find the new political institutions and make their choices. Election should be allowed to create the standarads and conditions for changes. We should stop the current political culture. We can change the culture.

Politicos need to be careful here: they can win the battle but lose their reputations which means at election times loss of votes.

Sri Lankans by habit are great theoreticians, i.e.” Pothe’ Guras”. They are not practical and like bookworms just stick to what the books say without any idea what it means in practice; they are blinkered and do not have a lateral view or the ability to think outside the box. That is why people like RW and his supporters are all just hanging on to rules in a book, which have been written by fallible men and women. They have lost sight of the fact that they must go back to the fundamentals, if lost in their own fallible rules. Democracy is not in a rule book; it is about the will of the people. For some days and weeks, supporters of RW have been screaming that there was no democracy in Sri Lanka. Even they have been egging on Trump and EU to echo their voices. But now when Sirisena has called their bluff by giving an opportunity to the electorate to vote the “Pothe’ Guras” scream that it is not in the book. What a fallacy; throw the damn book away in the garbage. Now given the chance to convince and win votes, just go and do it. If not it just proves that those who were weilding the rule book were doing so because they have no popular mandate, and were trying to manipulate the book in order to cling to power. Sirisena, good for you, thank you fo rcalling their bluff.

Those who drafted the 19th amendment are super geniuses. First it was the PM’s dismissal and now it is dissolution of parliament. They did an excellently superficial job leaving room for ambiguity, was it deliberate?

      0

C.Perera, I blame RW for this mess with the constitution. He was in the opposition over a long period. He should have worked out a suitable draft which could have been the subject of a discussion. They came to power in 2015, without a clue of what they had to do to get the constitution amended. Neither of the competing parties has an iota of vision to solve this country’s problems. The solution has to be at least 90$ local-based ,I prefer 100% local-based.

We do need a fresh lot in the parliament. These guys ,be they of the UNP, SLFP or the left have reached their dotage.

Damn you name sake. It shows what the motives and agendas of this selfish corrupt former PM was, to usurp power through the manipulatiuon of the rules. So right that he failed in his criminal activities throughout his political career, and I hope that he will never ever come back with any authority in the government.

Wijedasa Rajapakse (Dealdasa) was the Minister of Justice when 19th Amendment was presented, this proves how inefficient he is and how poor his knowledge of Sinhala and English is. Unless he planned this to eliminate Ranil and then Maithree as Maithree after dissolution of the Parliament will never win another Presidential election. Who is left, its Mahinda who will hold until his son Namal Baby is ready in 2025, but by then Dealdasa would have screwed them both and Dealdasa would contest Namal then. That is one reason why he is bribing Sanga as well. Dealdasa is the biggest CROOK.
