No Election Until Supreme Court Gives Green Light: Mahinda Deshapriya

Elections Commissions Chairman Mahinda Deshapriya is likely to wait for the Supreme Court’s opinion on the legality of the dissolution of Parliament before proceeding with preparations for a General Election, Colombo Telegraph learns.

Deshapriya told media that he would wait for the Supreme Court’s opinion on the legality of the dissolution of Parliament before proceeding with preparations for a General Election.

Deshapriya said the Elections Commission was not in a position to hold an election when Parliament is dissolved illegally. In such circumstances, Deshapriya said, he required the Supreme Court’s opinion on the legality of the dissolution before proceeding with the election.

Sirisena, when he signed the gazette announcing the premature dissolution of the legislature, grossly violated the provisions of the 19th Amendment to the constitution – which he architected in April 2015.

Strong arguments have been presented against the dissolution of Parliament saying the President has no constitutional power to do so, before four and a half years into a Parliamentary term, as stipulated by the 19th Amendment.

Update – Speaking to Colombo Telegraph, Elections Commissioner Mahinda Deshapriya said he never made such a comment to Lanka Enews nor was he contacted by the website, at any point, on the matter. However, his brother, journalist Sunanda Deshapriya tweeted the story reported by Lanka Enews expressing confidence that the Elections Commission Chairman would seek the opinion of the Supreme Court before proceeding with an election. Meanwhile, sources within the Elections Commission told Colombo Telegraph that the members of the Commission have arrived at a unanimous understanding that they would not hold an election in violation of the constitution.

    Recent inspiring speech of Prime Minister Imran Khan in China must be televised day and night to tell these corrupt and craving politicians of Sri Lanka to be ashamed of themselves.

      If MR to earn any respect from the voter then he must follow the rules of the country. Courts will refer to the Parliament and Parliament must be open for business.
      Coming through the back door is unacceptable and he should not use the legal system to release the convicted criminals or people will unite and form a front to put out committed honest and honourable people on the 5th.

        What is happening in Sri Lanka is unprecedented.

        There are a cocktail of issues to dissect with all stakeholders involved. I will give credit to Ranil’s premiership under a difficult partnership arrangement with ardent forces to bring about the much needed climate normalcy in the country.

        With the cronies around him to make himself a crony, he was able to bring about some significant changes – fundamentally, the 19th amendment that provided independent commissions, controls on the power of the President etc., The present stalemate is the product of those required to account for their own deeds and the President lacks the sharp acumen to respond responsibly.

        The alleged Mahendran’s misconduct must be brought to honest closure.

        To cut my comments short, we cannot allow what is achieved with Ranils governance. To change this, is like taking a step back to peddle on the glorification’s of white vans, Grease Yakkas etc.

        MS said soon after his election as president, that he will stand only for one term. He is now saying he will pack his bags if RW become the PM.

        It is testing time for MS and he is at the crucial juncture to honour his outright claims.

    I would like to call upon all Srilankan citizens and those of all who are interested in the welfare of the Srilankan people:
    Our political culture deteriorated day by day from the day of independence until now and now there is nothing more to worse than any more. Enough is enough and we need to change our political culture completely. I don’t think any one in the current politics are trust worthy. We need to get rid of all of them. We have to set out our standard and conditions that have to be followed by every public servants public institutions or organisations and no one should be above the law. Opportunism should be completely wiped out and bribing in any form should be stopped.
    President’s call for immediate election should be stopped or boycotted. Any urgent decision to hold election means that the same old politicians and political parties to continue with their political culture. People need the time to find the new political institutions and make their choices. Election should be allowed to create the standarads and conditions for changes. We should stop the current political culture. We can change the culture.

    Sri Lankans by habit are great theoreticians, i.e.” Pothe’ Guras”. They are not practical and like bookworms just stick to what the books say without any idea what it means in practice; they are blinkered and do not have a lateral view or the ability to think outside the box. That is why people like RW and his supporters are all just hanging on to rules in a book, which have been written by fallible men and women. They have lost sight of the fact that they must go back to the fundamentals, if lost in their own fallible rules. Democracy is not in a rule book; it is about the will of the people. For some days and weeks, supporters of RW have been screaming that there was no democracy in Sri Lanka. Even they have been egging on Trump and EU to echo their voices. But now when Sirisena has called their bluff by giving an opportunity to the electorate to vote the “Pothe’ Guras” scream that it is not in the book. What a fallacy; throw the damn book away in the garbage. Now given the chance to convince and win votes, just go and do it. If not it just proves that those who were weilding the rule book were doing so because they have no popular mandate, and were trying to manipulate the book in order to cling to power. Sirisena, good for you, thank you fo rcalling their bluff.

    Those who drafted the 19th amendment are super geniuses. First it was the PM’s dismissal and now it is dissolution of parliament. They did an excellently superficial job leaving room for ambiguity, was it deliberate?

      C.Perera, I blame RW for this mess with the constitution.He was in the opposition over a long period. He should have worked out a suitable draft which could have been the subject of a discussion. They came to power in 2015, without a clue of what they had to do to get the constitution amended. Neither of the competing parties has an iota of vision to solve this country’s problems. The solution has to be at least 90$ local-based ,I prefer 100% local-based.

      We do need a fresh lot in the parliament.These guys ,be they of the UNP, SLFP or the left have reached their dotage.

      Wijedasa Rajapakse (Dealdasa) was the Minister of Justice when 19th Amendment was presented, this proves how inefficient he is and how poor his knowledge of Sinhala and English is. Unless he planned this to eliminate Ranil and then Maithree as Maithree after dissolution of the Parliament will never win another Presidential election. Who is left, its Mahinda who will hold until his son Namal Baby is ready in 2025, but by then Dealdasa would have screwed them both and Dealdasa would contest Namal then. That is one reason why he is bribing Sanga as well. Dealdasa is the biggest CROOK.
