On Navi Pillay’s ‘Open-Mind’, Mildly

Navanethem “Navi” Pillay, the United Nations High Commissioner for Human Rights, is due in Sri Lanka today.  Minister Mahinda Samarasinghe expects Pillay to come with an open mind.  Pillay, for her part, said on Friday (23rd) that she has an open mind and will not be pre-judging anything ahead of her visit.

Well, words are words, can be used to communicate, can be used to miscommunicate, to lie and distort, play down or exaggerate.  Pillay knows words.  Pillay employs them.  And there are times she’s silent.

Navi Pillay says she won’t pre-judge and that’s a good thing to say.  On the other hand she has pre-judged before and has shown a clear penchant to believe tall stories cooked up by pro-LTTE elements and regurgitated by the naïve or else sour-graped, i.e. those who prayed for a different military outcome in May 2009, backed a different horse or bet on a different political winner in January 2010 and April 2010.  None of the claims treated as fact by Navi Pillay are substantiated; dig from source to source and one ends up with an LTTE spokesperson or someone held hostage by the LTTE as Source No 1.

But Pillay is a human being; she can make mistakes.  There are things Pillay’s confidantes have not told her and things she is not ready to give ear to because she is not ready to believe anything contrary to what she has decided was the truth.  That’s human too.  She cannot with finger-snap divest herself of all the judge-baggage she’s accumulated over the years.  So let us not entertain any illusions about Pillay’s open-heart.

On the other hand part of being human is being able to recognize error and having the humility to acknowledge.  Pillay can compare and contrast. She must.  She can take into account context. She must.  She can be fair. She must.  She can visualize the what-might-have-been if things didn’t happen the way they did.  She must.

All this time, she’s clearly been fed by mischievous elements in the I/NGO sector that sided with the LTTE (for a variety of reasons of course, not necessary because of love for terrorism or Tiger but perhaps in accordance with the adage, ‘my enemy’s enemy is my friend’).  There was that infamous and laughably flawed ‘Darusman Report’.  There were scurrilous documents authored by pen-for-hire ‘scribes’ who are either utterly naïve or incompetent or else suffered traumatic childhoods,  not to mention great television productions by Channel 4 (key word: productions).  Can Pillay shed all that? Let us see.

Pillay must, most importantly, take care not to confuse issues.  This regime is not the best on earth.  It has erred horrendously on many counts.  In this, there’s very little to pick between this regime and its predecessors going all the way back to 1977 at least.  Pillay’s project however is not regime change.  That’s the business of the people of Sri Lanka.  Now there are people who want regime change (for right and wrong reasons), but it is the most pernicious and politically bankrupt among them who would deliberately tag regime-change-need to a tall, uneven and politically tainted narrative about the last stages of the struggle against terrorism.

Pillay is going to be here for a week. That’s a short time to walk the length, breadth and depth of thirty years of a nation, so it would suffice for her to acknowledge that she is but tiptoeing on the corner of a territory that is mapped out according to cartographer’s political preferences.  But blood is blood, terror is terror.  Even Pillay won’t find it impossible to imagine a 2013 with the LTTE (by briefing herself about a Sri Lanka that had to contend with the LTTE) and contrast it to the LTTE-less Sri Lanka she is visiting.

She can think ‘resettlement’ and think of IDP camps she’s known and re-settlement programs that haven’t got off the ground in countries with immense resources. She can think rehabilitation and integration and ask herself which country held to ransom by terrorists and terrorism rehabilitated and reintegrated into society more than 10,000 terrorists and terrorist suspects, against whom there hasn’t been even a single police complaint since.  She can walk around Colombo and imagine a city that had roadblocks and checkpoints at almost every junction, and get a rough idea of freedoms gained.

There are a lot of things Pillay can do.  If she can open her mind (yes, she can say she is coming with an open mind, but few will buy that).

One thing she can be assured about is that whether she comes with open or closed mind, whether she sheds her biases or not, she will see a lot of smiles.  From total strangers, especially those who don’t know what on earth she’s doing in Sri Lanka.  That smile has a name: Resilience.  We have survived all kinds of invasions.  We will not be deterred by judgment, especially by the partial (even if they tell themselves ‘We are fair’).

    Pillay will see only what she will be allowed to see, and hear only what she will be allowed to hear,and speak only with those ‘approved’ by the government.
    Her predecessor Louise Arbour watched as the army beat back civilians in jaffna who wanted to hand over writen submissions to her.
    Now the government is jittery that Ananthi Sasitharan a TNA candidate may tell her how her husband along with hundreds of others ‘disappeared’ after beng seen surrendering to the army.
    Suddenly the president has established the usual ‘dummy’ commission to look into this – four years after it happened.
    The army wants war widows to come all the way to colombo to meet Pillay (!) – knowing that they cannot do so.

    If Malinda thinks that Pillay is a fool,he should think again.
    He is worried and is trying to cover up what may happen – Pillay discovering the truth about Malinda’s boss and what his army & police did & are doing.

    Ms Pillay has good credentials. She is known to be a fighter for the underdog. Whether she succeeds depends on how she perceives the Tamil nazi’s in the region. For this she needs to rise above her tribal conscience.

    As Tamil nazi would have it, the army killing surrendering LTTE leadership tantamount to a “war crime”. Keeping to contemporary laws and values governing war this would be a crime.

    Although LTTE policy was no surrender under any circumstances. The LTTE leadership violated their own code of conduct by surrendering. They forced others in lower ranks to commit suicide without surrendering for almost 3 decades. When its their turn they come out waving the white flag embarrassingly. What the army did was in fact ensuring LTTE leadership follow its own code of conduct. Therefore there is no standpoint from a moral standpoint.

    Secondly, the constitution only affords protection to those who obey the 6th amendment. There is no constitutional obligation to follow due process to anyone who do not accept sovereignty of the Sri Lankan republic. They can certainly take it to ICC although Sri Lanka is not a signatory. Therefore from a legal standpoint there is no case worthwhile to pursue either.

    I am glad that Navi Pillay was even conscious enough to say I come with an open mind, when her mind really should be pretty closed up about a seemingly civilised but violent set of rulers. Forget the war for a moment, what have we Sri Lankans seen since the war? FTZ furore, Prison bloodshed, FUTA, Rathupaswela, intelligence personnel hovering around every lane and culvert, UDA developing cities sweeping aside and bulldozing buildings with no advanced warning, useless white elephants being built, corruption, media clampdown,religious hate and extremism, Violence against women and children reaching unprecendented levels, local government politicians on the rampage every day.

    I wonder how she can open her mind being weighed down by all these. Paradise Poisoned, Governance Disappeared. We might have to use forceps to keep her mind open.

    Navi Pillai was a highly respected Judge in South Africa who dished out justice against gross abuses by the Apartheid regime for people of all walks of life.

    The attitude of the author shows how the so-called writers in Sri Lanka value judges with integrity both inside and outside Sri Lanka.

    She has discharged strikingly her duties as prosecutor of war crimes and genocide in former Yugoslavia and in Rwanda.

    This Malinda is prostituting what ever English language and journalistic skills he has, ever since he obtained a virtually free education at Harvard University, USA. He was part of various extreme left and Sinhala Buddhist supremist organizations when he was a student at Peradeniya in mid or late 1980s.

    The ultra useful internet has details about this Malinda’s past escapades – there are reports, affidavits, and documents about him hiding in a Sinhala Buddhist temple with a Sinhala terrorist group during the brainless JVP’s Sinhala terrorism in the late 1980s. Malinda had been tipped off that the Sinhala terrorist Sri Lanka army was going to raid the hideout in the Buddhist temple. This Malinda’s Extreme Left Sinhala Buddhist comrades fume and froth that Nalin Seneviratne Commander of the SLA from 1985 to 1988 was probably the one who tipped off Malinda about the impending raid. This Nalin is Malinda’s father, diplomat Gamini’s brother.

    So he had abandoned his fellow JVP terrorists and fled! The remaining pathetic JVP terrorists hiding in the Sinhala Buddhist temple of all places (and using the Sinhala bikkus as a human shield), had to face the terrorist Sinhala Buddhist army after Malinda bolted! I advice CT readers to research this eppisode to find out for themselves the calibre of this Malinda’s character.

    This hypocritical Malinda abondoned his studies at Peradeniya (I am not sure of dates and details), and greedily grabbed a huge scholarship award to do a Bachelor’s degree at Harvard Univesity in the Ultra Capitalist USA – without practicing the extreme leftism, JVP terrorism he was preaching to other Swabasha (Sinhala language) educated JVP terrorists. But this hypocritical Malinda ran away to the Ultra Capitalist USA and had no qualms accepting a huge scholarship from Harvard – out of his pocket he would have spent only around $10 thousand over 4 years for the extremely expensive Harvard bachelor degree.

    This hypocritical and ungrateful Malinda then came back to Sinhala Buddhist Lanka and rarely misses a chance in his warped English articles to denigerate the USA! He cunningly obtained his Harvard education by going against whatever Marxist principles he has. Ever since then he keeps constantly winding up his stupid and lazy Sinhala extremist comrades (who don’t speak or understand any English). These lazy Sinhala Buddhist masses then turn ultra green with envy when they see hard working Tamils or Muslims doing well in life (90% of the Burgers have been successfully chased out of Shri Lanka).

    So from 1958 to 2009 these lazy Sinhala Buddhist masses looted and stole from Tamils with the blessings of their governments and Sinhala Buddhist police and army who cheered them on. Now these lazy Sinhala Buddhist masses want to loot and steal from Muslims and their goverment is delighted abouth their plans!

    I was a student at S. Thomas’ College Mount Lavinia, the same time this Malinda (1983 A Level Class) was a student at the rival school Royal College. Vasee Nesiah knew me at STC. Most of my family studied at STC, but we had had many Royalist friends.

    I was very surprised to hear that this Malinda’s mother, the Royal College English teacher Mrs. Indrani Seneviratne, was a decent and respected lady who even treated quite well, the Tamil students in the racially segregated (thanks to SWRD) Tamil medium class!

I was not a member of any organization, Sinhala Buddhist Supremist or otherwise, when I was at Peradeniya. Internet: be careful where you go and what you take, there’s as much crap as there is useful content. If you don’t have brains, you could get it all wrong and sound a perfect idiot. That’s what has happened to you, unfortunately. I was never in a temple, ‘Sinhala Buddhist’ (sic) or otherwise, in the 1980s. In the late 1980s I was in Boston, MA, on a full scholarship from Harvard University, the political economy of which I wouldn’t waste time explaining to an ace moron. My father’s name is Gamini Seneviratne. He was in the administrative service. He was not a diplomat. His brother’s name is Upali Seneviratne, formerly of the Police, retired in the early 1980s.     The writer writes about Navi Pillay’s statement about being open minded, with some denial and blindness.
    He writes as if he is unaware that Navi Pillay has been demonized, insulted, and accused of being in the payroll of Tamil lobbies, even before she decided to make this short trip. Talk of pre judge! As if the Sri Lankan regime, has been straightforward and welcoming of investigations, regarding the horrible atrocities someone had authorised in the North. How can ANY international official NOT have doubts about a government that stalls, avoids, lies, and dismisses any credible proof, that pertains to said atrocities? The Rajapaksa regime has earned for itself the dubious reputation of being guilty of crimes accused of, by their OWN responses and actions. The writer obviously one of their faithful supporters, has already shed a negative light on an UN official, the predictable response to most UN officials who have asked the Sri Lankan regime for investigations and accountability.
    The Rajapaksa’s with the help of their merry men, seems to have mastered the art of dodging.
    As for Navi Pillay, a few days will not be sufficient to reveal all the atrocities Sri Lankans had to endure up in the North.

    I do not think casting aspersions on her is fair. Just because she is Tamil does not mean she is a LTTE-er. That is not fair by her. She was fed reports from many sources and she chose to believe the most sensational ones just like many liberal minded westerners. Lies repeated oft become truth by that repetition. However, she cannot be blamed for going by unverified and uncollated reports during a time when the fogs of war were so thick that no one knew what was going on. However she is best if she looks to the future and look at the current state of HR and plight of tamils than digging up the war;s conclusion which has brought so much relief to everyone. LTTEers pretended to be civilians and did not fight in uniforms. They conscripted thousands. A lot of those killed were LTTER fighters and their civil defence personnel. They were not civilians. Those who surrendered really did so too late and it seems they were disposed of just the way JVP leaders were disposed of and even in the way the US has disposed of terrorist leaders. Again, those people could have surrendered in January. They did so only at the last minute when they realized the US and India were not coming to bail them out. They did disappear but that was grobr. i am sadder by the tragic civilian deaths than that of surrendered terrorists. Look at how the US shot and killed hundreds of Japanese who surrendered in Okinawa and Iwo Jima. They did not know what to do with these fighters.
