Opposition Leader Sampanthan Requests Speaker To Convene Parliament Forthwith

In a major development, Opposition Leader R. Sampanthan has requested Speaker Karu Jayasuriya to convene Parliament with immediate effect and allow the legislature to perform its legitimate functions.

In his letter, Sampanthan says the request has been made “recognizing the necessity of upholding the supremacy of the constitution of Sri Lanka and the supremacy of Parliament comprising of the democratically elected representatives of the people.”

This follows letter by the Speaker to President Maithripala Sirisena earlier today stating the continuing prorogation of Parliament will have serious and undesirable consequences for the country

“I have received a request to protect the rights and privileges of Hon. Ranil Wickremesinghe until any other person emerges from within Parliament as having secured the confidence of Parliament,” Jayasuriya said, in his letter.

Jayasuriya also said, “I consider my duty to draw your attention to the convention that a prorogation should be done in consultation with the Speaker.”

    President Sirisena has the power to postpone the sitting of parliament.No one can demand anything from him.

    In 2015 President Sirisena imagined he could take the country away from corruption and family rule which was prevalent then,

    But he did not realize that the UNP had a terminal cancer called Ranil. Soon it was obvious to Sirisena that Ranil was a different animal ,a corrupt, fraud taking the UNP and the country as a mere tool for fun making and money making with his Old royalist bedfellows.

    So finally Sirisena has decided whatever the consequences he must save the country from this cancer.

    Hope the people storm Temple Trees and remove the cancer immediately.

    Thereafter arrest Ranil for the bond scam and also planned assassination of Sirisena.

        that is because RW thinks he is still the PM despite being relieved of this post and refusing to leave. Remember how he harassed the MPs and Ministers for misappropriating Govt property. RW is toast now and should think of an honourable departure from politics. He was never destined to a President in SL. Thank god for that.

          I love Mahinda becoming the PM. This is what I fought for 4 years. But I can’t play to the gallery. I respect democracy and Sri Lanka’s Constitution.
          Both Ranil and Mahinda who are now Prime Ministers appointed by the President IN PARALLEL, should show who has the majority in the Parliament on November 16.
          Until then both can hold their posts as Prime Ministers.
          Ranil doesn’t leave because the majority which he held in the Parliament is not challenged AS YET.
          He says he will leave if he fails to muster enough MPs. Fair enough.
          You cannot remove a Prime Minister by a letter if he holds the majority in the Parliament, though it was done once by the same President in January 2015 which is totally undemocratic and unconstitutional.
          The President has done the same thing again, but there is 19A now, which further strengthens the rights of the existing PM (Ranil.)
          In all fairness, Ranil should be allowed to see whether he has the majority in the Parliament or not.
          We are not talking about a mere citizen. We are talking about a Prime Minister who was in High Office for 4 years! I can’t stand his politics. But he deserved to be treated with dignity and respect fit for a Prime Minister until November 16.
          Any forcible removal of him from his office (Temple Trees) before November 16 is undemocratic, unconstitutional and against the law.
          In the meantime, Mahinda’s rights SHOULD ALSO BE PROTECTED as he has DULY sworn in as the Prime Minister, before the President.
          In my opinion, Mahinda should be provided with a fully equipped office complex fit for a Prime Minister until November 16.

            I agree with most of what you say, but with RW there will not be a clean fight. Anyone who tried to challenge him was dealt by dirty tricks. He bribed wavering greedy MPs to force them to back him. He is a leader who blackmailed others to get his way. Her lacks morality and empathy.
            I think he has drawn his last straw now. If he is implicated in the coup to assassinate the president he has reached the end of his political carrier.
            MS may not have done everything correctly, but if you were in his position and discovered your trusted allies are attempting to bump you off would stay with that lot? MS had no option but to seek help from his enemies. It turned out to be a good move. Had MS resorted to clean politics he would not have much time left. That is the truth. He sensed it and he took a wise decision. Now the hawks are after his blood and carcass, so wait and see what is coming out soon. When ministers trying to force themselves to remove material detrimental to them is a classic way how RW ruled .

              If there is an assassination plot, it should be the President who should have called for an investigation. After all PM and Ministers are below him. Honestly, I am not interested in his personal issues with RW.
              President should have done this differently if he was confident that he can obtain majority in the Parliament for MR. This tension is totally President’s creation.
              Now we have Co-Prime Ministers until November 16 as the President has prorogued the Parliament.
              I wish MR could go to Temple Trees right away. However, I prefer him follow the proper channels to do it, as the President has created a turmoil for no reason.

            You must be living parallel planet or a “KAPUWATH KOLA” UNPer. My forefathers, my parents and I too were proud to call ourselves UNP, but sadly that era is no more . Ranil brought the once respected party to gutters. His main priority was to defeat Mara and didn’t care how he achieved it. If he was a true politician he will not have told Ambassadors who met him yesterday to impose sanctions on SriLanka. Do you think this is what founding fathers of once proud UNP would approve? He began to sell our national assets to other nations. This was not privatisation but destroying our national assets. What he should have done was to improve our them even borrowing because in the long run if the productivity improves paying interest and loan is worth it.
            Once assets are sold to another country it is gone forever and why should he assist other countries to profit from our silverware. Even in Europe they see wholesale privatisation isn’t working so dig head out of your back side and see the reality.

How many attempts were made by the party faithfuls dethrone him from the leadership of the party that he managed dispel by devious methods. Even MR helped him once to hang on to his post. He ignored good politicians some of whom left in disgust. His dream still is the post of presidency. Wait for more news of his cunning measures to get rid of MS and walk straight into that post. He is finished politically. He did not protect UNP but destroyed it to become unelectable. He cannot be dislodged even if he becomes mental unstable. I was once proud of this party.         If anyone can out of parliament decide like the kind of decisions without consulting incumbent speaker and other designees, why should we have a parliament.

        Accordingl to 19A, not president but the parliament has to be called and check the majority.

        Constitutional analyst like Dr Jayampathi has made it very clear today, that the appointment of new Premier is unconsitituatonal. There i too agree with him. Entire world is not respecting it. That is why not EU and other countries have, let alone india come up with congrat message yet today.

            all along MR stood against them. You know that brave lady the manner how she called all the buggers for investigations at the begining. She was sacked by PENISSLESS Sirisena but always put the blame on RW. Ranil never uttered a single word against the Sirisena. Nor UNPrs were allowed to say anything derogatory to President. That is all how they protected them.

            Even in Serbia and Croatia, it took long until high criminals were finally caught. You live in SL, should know lanken systems better right. I am a beloved srilanken living in Europe. We only worked to remove Rajapkshes from their previous regime. That is it. We are adherent of late Rev Golden Son Sobitha Thero not being part of lanken grand pary politics.

      Sampanthan with his age for a moment forgot that SL is under constitutional rule. He thought that the rule that prevailed in the pre 2009 tiger-land is applicable everywhere. It’s really a pity that most Tamil politicos don’t like to play within constitution led democratic frameworks.

      The issue is a simple one, Assemble parliament and both sides must see or show the nation who has a majority. The reason parliament is delayed is to buy crossovers to one side. As RW still clearly has a majority, and MR and HE needs time to buy the rats so to speak.

      But there is no protocol to transition in all the ministries. Goons sent to get ride of people by force as there is no clear mandate for MR. If He want a New PM no matter who it is the process and transition must be carried out according to protocol as MR did when he left.

      Hate to say but there must be strong and hard sanctions on Sri Lanka and political leaders. Foreign accounts suspended, Their assets confiscated.

      The Law of the land is not clearly respected. by the current president.

    I am relieved to read Sampanthan’s statement. This morning I was taken aback by a report in the Uthayan that Sampanthan had spoken to Wickremasinghe as well as to Rajapaksa, and the report suggested that the TNA’s position would depend on assurances by the two on Tamil demands. While the demands may be correct, to go on that course would have been to repeat once more the historical blunders of Tamil politics that took away the Tamil people’s dignity.
    I am relieved that Sampanthan is taking a principled position that is the only one compatible with the dignity of a minority.

    Well said Mr. Sambanthan. The President should let the Parliament convene as scheduled on November 5. But with two Prime Ministers on the scene it is important for Parliament to Convene immediately and resolve the problem by ballot. Otherwise the country will descend into chaos.

      The United National Party Parliamentarians gathered at the meeting room of Temple Trees began signing an impeachment motion against President Maithripala Sirisena, a short while ago.

      The impeachment motion against the President will be presented mainly for violating the constitution by appointing former President Mahinda Rajapaksa as the Prime Minister, UNP sources said.

      They also added that a No-Confidence motion is likely to be presented against Rajapaksa as well.

      National Freedom Front Leader Wimal Weerawansa last evening demanded Prime Minister Wickremesinghe vacate Temple Trees by 8 am today.

      Although the deadline has been long passed, a large number of UNP MPs and their supporters are seen inside the Temple Trees premises, protecting their leader Ranil Wickremesinghe.

      Your point is right. He did not explicitly mention that a new prime minister cannot be appointed to seat while another one is in power. Unlike it is mentioned in the constitution, where newly appointed PM, without facing any opponent, standing on the parliament floor as a higher grade individual than all other MPs and establishing his unchallenged support, but on 16th November, Old King is going to face Ranil’s opposition.
      This situation going to be unique to the 1978, constitution, which never faced one like that. Those who many didn’t understand Jan 10th, 2015 is comparing this with that. In 2015, D.M.Jayaratne was not refusing to resign. Nimal took parliament leadership for SLFP. He did not withdraw the support. Above and all, as soon as New King become the President, he was the SLFP chairman. He did not look at the situation as UNP and SLFP. He even supported UNP in the August 2015, election. So, he selected Ranil as the PM. 19A was not there. EP can fire PM anytime. So Article 42(4) was not conflicting with itself by appointing a new one while Old one has not vacated. Under the earlier arrangement, when a new PM comes in Old ceases to exist. But 19A has specific provisions when a PM can lose his position. So, without old PM ceases a new PM cannot come into existence. Here President violated constitution.

      Sampanthar is indirectly saying the Constitution is supreme than, EP who it create. So, he want to limit EP under the constitution, i.e. EP cannot violate constitution. He is assuming here the EP may be violating the Constitution, so one way of restoring stature of the constitution is reconvene the parliament and prove the majority. Interesting, we not had seen anybody approaching Supreme Court. In this circumstances that should be applied first before matter finalized in parliament. Court may not take it while the matter in Parliament, but going to court at this juncture establishes the victim’s good faith. Possibly PM can ask injunction EP arbitrarily firing him until parliament sits and another NCM presented. Then the procedure would be one voting to remove Ranil in Parliament and other to confirm Old King. Even that may encounter problems because during the last NSM experts opined a NCM cannot work on PM but it can be used against EP with 2/3.
      Let’s run over this one again: Unlike it is mentioned in the constitution, where newly appointed PM, without facing any opponent, standing on the parliament floor as a higher grade individual than all other MPs and establishing his unchallenged prowess, but on 16th November, Old King is going to face Ranil’s opposition. If voting is called on Old King, not on NCM against Ranil that means parliament recognizes Ranil’s dismissal. If Ranil’s dismissal is recognized, and Old King loses the vote, still Ranil would not become PM without EP reappointing him.

    OMG, the tension among people is too much.
    An electronic blog openly says UNP MP, who crossed over, was paid Rs. 250 million. The news anchor is taking the responsibility for the veracity of the news. He said he will reveal more about both sides.
    Oh, man, what a corrupt Parliament do we have? I don’t know how much Ranil will have to pay to bring his own MP back to his party. The blog says both sides are bundling money. I don’t know whether it is true but this is disgraceful. What will the world think of us?

        i think it is going at 1000 million per MP.The currency has depreciated a lot since former UNP general secretary,i think athanayake or some name got 500 million from MR to cross over and also forge a document signature of ranil,for which yet he has not been jailed by ranil,who is probably worried about his own skeletons in the cupboard which athanayake will vomit out if charged if jailed.

    This is fuel to the fire. Under the constitution, president has the power to prorogue the parliament. To resolve the current constitutional crisis he has to assemble the parliament. If assembles it , the speaker himself is breaching the constitutional law.

    In summary, to uphold the constitution ,he has to break it.

    I’m glad Sampanthan has finally realized the value of democracy, after having once declared in Parliament that the LTTE was the sole representative of the Tamil people. The irony is, it is the southern polity that is now sinking into authoritarianism, and it is Sampanthan’s turn to be the guiding light.

    Sampanthar is little bit far away from reality. There may no lawyer like Sampanthar in Lankawe at this time, so if he talk a legal point that he might well thought of it before he utter it outside. But what is the use of clinging on to dry logic?
    Yes Karu wants some action from New King. One is Ranil’s protection. That is even many anti-UNP commentators are saying that Ranil should go, but they should send him off decently, no manhandling. Then Karu says Proroguing parliament under conventions (Possibly in constitution too) with the consultation of parliament. That is perfectly logical and any other methods can be interpreted from “over using the power “to “attempting coup”. Here it is clear coup, because proroguing parliament here is only one action in the many sequences of action, including the latest of withdrawing Ranil’s protection. Karu had two point and they both are valid.
    Though Sampanthar too is talking the same subject, he is in fact coming from another direction. He is not with Karu at all, where Karu insists while Ranil is being manhandled for revenge, Karu should have been let alone and he should have been informed of this proroguing. Otherwise his Speaker position is not recognized. (As a side point, we must remember, this is not just on Ranil but on UNP too). Karu is not saying that Donkey trading is an illegal business as far as Parliament is concerned. MPs should represent people not the Business owners inside the Parliament. If the Donkey Trading officially recognized then the parliament is defeated. The Lankawe’s current status is any Great Train Robber can walk into the parliament; spray the bills and buy the PM position. I would like to remind a contemporary American Senate procedure, when a bill becomes they close the Senate, talk behind the door and come to the senate to vote. But there is no horse trading, but a mechanism to keep out Filibustering.

    But closing the Parliament until the prices haggled over is not any kind of valid game. This is why Sampanthar is saying the people elected Parliament is supreme and it should be allowed to function as it was expected, cannot be stopped for donkey trading.

    That is why he is not coming through the same door Ranil or Karu is coming. He is saying now urgently there is a need to establish the Supremacy of the constitution and the parliament. One need to understand they both their, constitution’s and parliament’s, stature are intertwined and now parliament has to act to re-establish both of their supremacy. He is seeing an emergency like a tyrant overturning the country’s constitution. He is challenging Ranil’s dismissal through the side, instead of the main door. Because he is neither speaker nor the PM to directly take this to President. All what he can doing taking it in Parliament and send to president from there. This urgency is not coming out of Karu’s or Ranil’s. Specialty Ranil’s statement is, if Old King’s majority is proved on Nov 16th then he will quit. There is no retaliation from them two for procedure violation of the constitution or President bringing in a donkey trader inside the sanctimonious chamber of Parliament and publicly trading donkeys.

    The truth, as I have already said, they two don’t care about losing their position, countries democracy, people’s wellbeing, but not Old King’s Hero pride. It shouldn’t be hurt by any of their action. Of cause they stood against him on the election, but that is only when they recognized that he may no longer be able to protect himself, so they wanted to protect him. That is why Sampanthar is much behind in guessing the intention of Ranil, Karu, and New King

    When the last Presidential election campaign was being conducted it was Ranil who went to Maithree and gave protection to put him on the stage. Its Ranil who got UNP, TNA, JVP and other parties to vote for Maithree to make him the President. Even when Mahinda lost its Ranil who gave him the protection. Now the thankless Maithree and Mahinda get together and even go to the lowest level to cut Ranil’s security and cut power shows the breeding and shows how low they have gone.

    Mr Sampanthan should be commended for requesting speaker Karu Jayasooriya to reconvene the parliament to preserve democracy and supremacy of the constitution. However having listen to President’s speech addressing the nation it seems that allegations against the prime minister are so strong it is questionable whether he can remain in such a high office. Of course there is a great deal of mistrust and recrimination. It was his excellency the president who said this time 2years ago that former defence secretary can not be shepherded in to the courts without his permission! His comments also led to resignation of an eminent Bribery commissioner at the time. Honurable Mr Wickeramasinghe is not new to dismissal having been once removed from office by a previous President.
