Pandora Papers: ICIJ’s Questions To Nirupama Rajapaksa & Thirukumar Nadesan

Former Sri Lanka Minister and a niece of President Gotabaya Rajapaksa, Nirupama Rajapaksa’s name has been mentioned in Pandora Papers.

According to the ICIJ report Nirupama Rajapaksa and Nadesan together controlled a shell company they used to buy luxury apartments in London and Sydney, and to make investments. Nadesan set up other shell companies and trusts in secrecy jurisdictions, and he used them to obtain lucrative consulting contracts from foreign companies doing business with the Sri Lankan government and to buy artwork.

In 2018, one of the companies, Pacific Commodities, transferred 31 paintings and other South Asian art pieces to the Geneva Freeport, an ultra-secure warehouse where assets are not subject to taxes or duties.

In confidential emails to Asiaciti Trust, a Singapore-based offshore services provider, a longtime adviser of Nadesan’s put his overall wealth, as of 2011, at more than $160 million. ICIJ couldn’t independently verify the figure. Asiaciti Trust managed some of Nadesan’s offshore companies and trusts, with assets valued at about $18 million, according to an ICIJ analysis.

The questions below posed to both Nirupama Rajapaksa and Thirukumar Nadesan by the ICJI. They were failed to answer by September 20, 2021:

Questions for Nirupama Rajapaksa:

Documents we have seen show that from the early 1990s until early 2010s (during part of Sri Lanka’s conflict) you were a “controlling party” of Rosetti Ltd, an offshore company used to receive consultancy fees and buy properties in Sydney and London. Is this correct? What was your role in Rosetti?

Did you declare your ownership of Rosetti when you became a member of parliament, if required to do so by local law? Did you declare your ownership of the properties?

Did you disclose ownership of Rosetti to the government agencies that hired your company as a contractor? If no, why not?

Documents we have seen show you are one of the beneficiaries of the Pacific Trust, which holds a $51 million art collection. Is this accurate? If so, did you declare the trust to tax authorities, if required to do so by local law?

What was your role in the offshore companies and trusts set up by your husband Nadesan, namely Sri Nithi Trust, Pacific Trust, Pacific commodities, Pallene, Chalan Oil and Red Ruth Investments?

In a 2014 interview, you said “As women, we have better qualities than men and are more honest and are less vulnerable to bribes and corruption.” Can you elaborate on that please?

Questions for Thirukumar Nadesan:

A 2011 document we have seen says your family fortune amounts to 100 million pounds ($160 million) while, in 2017, the Sri Nithi Trust and the Pacific Trust combined held about $18 million in total. Is it accurate? What is the source of your wealth?

Documents we have seen show that you set up consultancy companies called Rosetti and Pacific commodities in Jersey, a known tax haven. The companies provided consultancy for government contracts in Sri Lanka. Why did you establish the companies offshore instead of incorporating them in Sri Lanka?

Your company Pacific Commodities Ltd. provided services to Sumitomo Corp, as well as to German company Contract GMBH. What was your company’s role? What type of consultancy did it provide? Did you use your political connections with the Rajapaksa family to obtain the contracts?

According to records, Rosetti was used to buy apartments in Sydney and London worth more than $4 million. Is this accurate? Why did you use a company to own properties instead of buying directly under your name?

Documents show you retrieved thousands of dollars in income from London property in cash – why cash?

Files show that in 2013 you applied for Cypriot citizenship, and that your children’s application was successful. Why did you apply? Did you obtain it?

Documents show that you own an art collection with 51 pieces, including artworks by Raj Ravi Varma and George Keyt, worth about $4 million, and that, in 2018, you moved it to the Geneva freeport — a tax free warehouse — using your Pacific Commodities company. Is it accurate? Why did you store it in the freeport? And why do you own it through an offshore company?

In 2015, you requested Asiaciti to send your documents via courier saying that your source of funds could be “challenged.” Can you please explain what you were concerned about?

In 2016, you were arrested and charged with embezzlement. Authorities alleged you acted as proxy for Basil Rajapaksa and helped him build a villa on your property in Malwana, using Rs. 250 million from public funds. How do you respond? What was the outcome of the investigation?

What’s your relationship with government officials: Basil, Mahinda and Gotabaya Rajapaksa?

In an 2016 email to Asiaciti trust officers, you told them not to disclose information to a Dubai banker who was assisting you in opening a bank account for your company FP FZE. Why didn’t you want to provide details of your activity to the bank?

Files show that, from at least 2002 to 2007, your company Rosetti made annual $140,000 loans to Red Ruth Investments, another company of yours. Red Ruth then distributed the funds to your Cook Islands trust Sri Nithi and other shell companies. What was the purpose of those transactions? What was the source of those funds?

According to media reports, in 2018, Red Ruth was investigated by Sri Lankan authorities who found $22 million in a Hong Kong account associated with the company. What was the outcome of the investigation? What was the source of those funds?

Why did you choose known tax havens such as Jersey, the Cook Islands and Samoa to incorporate your companies and trusts?

Have you declared any of your companies and assets to the Sri Lankan authorities?

What was your wife’s role in all of your companies and trusts?”

      LM. I can name six judges who issued orders not based on the material facts of cogent evidence pegged firmly laid down to ground without a fraction of an iota of doubt in court. Instead they got paid handsomely to turn fiction to facts and facts to fiction. Not one Srilankan dared to question the corrupt justice system because the BASL is in the thick of it.

            With this being the reality, how can the youth ever dream of a better country. I see something … I really dont know what it is….

            Sociologists, society experts, psychologists, and the like authorities should join together to rebuild from scratch in order to make a real chanc, but by placing the law and order above on the top of the list. No physical R & D would help so long people remain – highly corrupted- be it minor or major any crimes should be punished.
            That video of a POWERFUL secretary of defence ministry is said to be offended by an interogation of a police officer…… as if the kind of buggers would do real good work loads…. the kind of police officers should be given ” janapthi sammana”…. however, the consequence has been – giving him a change to his working location.             LM. The entire issue is solely technical. The rules governing the courts of law have been shredded and incinerated. The Defense Counterclaim is highly toxic which should have landed both the defendant and the defense attorney in jail without question. I put it to JVP and NPP based on the rudimentary principle which is gospel in a court of law that it is only the truth and nothing but the truth that counts. In this exceptional case what is established is concocted lies and refined lies. Every citizen’s right to a free fair trial is guaranteed by the Constitution, is audaciously violated by the amalgamation of highly corrupt individuals. It has nothing to do with any particular individual or party. Surprisingly, the two entities who are supposed to be white knights standing up for citizen’s rights remain like dead mules. Here is another Pandora’s Box. Which of the Boxes for the discerning voter to put down the “X” at the polling booth?

              Dear L: Thanks. I never said or assessed “RR” and “NK” as “Dishonest”. Please read through the words I used to describe (as per my understandings) in my comment to “Sinhala_Man”. Re. “RR” – Do you approve (especially a politician) resorting to “Recording” telephone calls without informing the person on the other end? Can that be rated as “Self Discipline” or “Decorum”? It is nothing but, “Immaturity” and “Indiscipline”. I was living in a foreign land for a long time. In that country, you give a telephone call to the public/private outfit, they say: “Your call will be recorded for quality and training purposes”. Those are “Standard” courtesies that even being an “MP” didn’t know and practice. What more to talk of. He put a lot of people (holding positions of Judges and High Govt.                   I agree with you NK being bit naive as many returned home after spending years in a developed country. Anyways, I dont think that he is no right to have raised that issue against ” pattapal hora ” MACO, never did his job respecting the EC guidelines. In the same time, pertinent question arises is what did all other PE candidates stayed as if their senses were fully impaired ? Not even Sajith Premadasa, nor AKD had the bravery to question whether Gotabaya renounced his US citizenship by the time, he was given the nomination. If the kind of ignorance would have been found in German elections, entire nation would have gone mad. I am not German, I have been working with them for such a long time, and they would not tolerate even any minor deviations of that nature.

            Consider this as well.
            It is this ‘team playing’ that CORRUPTS. For the sake of a “perceived unity of team” everyone is made to tone DOWN to a ‘mean’ or ‘basic average’. It is the party system that corrupts even the best-intentioned.
            In the end, you are left with “diluted ideas to fit all” for the team.
            Real progress is from a very few like-minded individuals with good leadership and ideas for progress.

At least I have confidence in them (NPP Team) for being against “Corruption”, “Waste” (Public Funds) “Mismanagement” (of Public Property), and for implementing a sound “Economic Policy” (plus executing that policy) “Cleaning” the present “Corrupted Political Culture”.       Your first sentence is not really correct.

      You are putting the cart before the horse. It is the other way round. The country is NOT made for the survival of the high criminals. It is high criminals are made because of the weakness of the law and the weakness of the system. The Parliamentarians have been given a hand to be both a lawmaker and also a law administrator, which should not be. One cannot have a hand in both, it is the ideal grounds for germination for ‘corruption with impunity and immunity.

      Take my word a judge cannot have also police powers. An accountant cannot also be a cashier. You can only be one NOT both. Take away the administrative powers from lawmakers and ensure it is implemented then the politicians will know they cannot hide behind their dual rights, the rights to make law, and also retain the rights to administer and commit unaccountable corruption, if they do they will easily get caught and be charged without any fears by the law enforcement agencies of revenge.

      None of these politicians were corrupt before they became parliamentarians. It all started after they became lawmakers and they saw the ideal fertile grounds to mint money.

        A legislator (or lawmaker) is a person who writes and passes laws, especially someone who is a member of a legislature. Legislators are often elected by the people of the state.

        This Ranil factor is surely a cancer if not removed from the body
        sooner . However talented he is , if people don’t want him , he must
        step aside at least until his worth is felt by the people or forever !
        We all forget that there’s a ” dog in the manger ” in Ranil . I like his

      The only reason we need a shady, China-friendly, Western-unfriendly Port City in the first place – one that will handle laundered money via Cryptocurrency, is because these Lankan Monopolists take the money of the struggling masses who work for them, and place it on Investments out of the country, to make more money for themselves, and those they are affiliated to.

      If that money was handled like other advanced countries are doing (e.g. America cut out its Monopolists of the 1800’s and early 1990’s), the money would flow for country prosperity. Workers would get paid better and won’t need to slave in the Middle East so as to survive the ever-escalating cost of living in the Motherland. Tea-estate workers who bring in billions to the country would get some decent living quarters.

      At least the American monopolies created something for the rest of the world to purchase. Lankan monopolies use the labor of the Lankan worker to amass wealth or themselves and those they are affiliated to. There are little laws in place to ensure the rights of the citizens monetary value. The judiciary is stifled and ineffectual.

    You can be sure money has been laundered, stashed in tax free havens, houses and properties have been illegally bought in other countries, including the US, UK, and even Dubai, and while this country falls, these crooks will get away with all crimes, and the Aiyah’s and Malli’s and their families would have amassed Billions of Rupees, enough to last for the next few generations. The Rajapaksas will solidify their power, and we will have no brace ourselves and be prepared to live in a monarchy like North Korea.

    To my knowledge Lanka has always been a corrupted country and JR’s open economy not only made it worse but normalized. Ministers who played out then are now remembered as saints. What was just a wound became a ulcer and now a gangrene. Our treasury is now shifted to various shell companies around world and the country is running on borrowed loans.     Here is yet another Rajapaksa money making food scam. See former CAA executive director interview published in Daily Mirror. A stagnant consignment of 56,000 kilos of garlic worth 135 Rs/Kilo was released by Minister Bandula . G to Sathosa. Instead of direct public distribution they in turn sold to private party which re- sold, back to Sathosa for >400 Rs/Kilo for public consumption. This came to light only because of the raid conducted by CAA director who obviously had to quit after raid. Calculate the loot on just one consignment. This has been the case before with sugar and dhal , but the books are immediately destroyed/deleted so that no paper trail is left behind. With all the restrictions private parties which had been buying and releasing essential food items for a profit are now made defunct, where as Rajapaksas have found a way to make the profit amid bankruptcy by getting control over the whole distribution of essential food items under their control. This is exactly I said before “Rajapaksas are mother of all crooks ,who could exploit any adversity.

Now we know how they make money in each consignment using Sathosa. 2) Being aware of this scam, Local rice mill owners decided to protect their profits by refusing to release the rice to govt at a lower price. 3) When Rajapaksas tried pull a fast one by threatening to import rice from Pakistan, mill owners called it a bluff. 4) From now, Rajapaksa mafia will have total control on food distribution instead of usual private businesses(like Maharaja), middle man and distributors. 4) Now that due to cash crunch, there is no infrastructure or other mega projects Rajapaksas are improvising ways to make their regular illegal income.

Gotha on his part gave presidential orders for immediate inquiry ???     Pandora Papers is just the tip of the iceberg and what came out, as proof. It’s just the small potatoes given to the cousins. If that’s $160 million, just imagine the main loot that the big-boss has taken.

    When people in Sri Lanka are suffering and dying from COVID and the economic crisis, reading about this looting makes me sick to the stomach. How could any human do this to vast majority of people. But our stupid people will continue to elect them and put them on a pedestal.

    In a way, Sri Lankan people deserve the suffering they are going through. It is sad but the lack of principles, the shortsightedness and the self-centeredness of our people is what brought about our demise. Our great “sistachaaraya” and our proud history, unfortunately has led to this. Sad…

      Avoiding tax is absolutely legal whereas evading is not. But amazing illegal wealth is now an international crime. That is the reason countries are able to freeze such assets. Nadesan was already taken into custody for corruption charges but now free and continuing because he is a Rajapaksa family member and not just his, but all Rajapaksa members cases have been closed. All he needs to do is show his legal income which are appropriate to questionable assets to clear his name. Also whether income is made through illegal means ?? In Lanka every thing including crime , murder and torture are normalized by Rajapaksas and people who elect them.
