Petition Seeking Writ Of Mandamus Directing An Inquiry Into Maithripala Sirisena’s Mental Health

A writ petition has been filed in the Court of Appeal seeking a mandate in the nature of a writ of Mandamus against IGP Pujith Jayasundara and the Fort Police HQ OIC directing them to institute judicial proceedings in district courts by virtue of section 2 of the Mental Diseases Ordinance for the purpose of inquiring state of mind of President Maithripala Sirisena.

A person by the name of Thakshila Jayawardena has filed the petition as a matter of “public interest.”

Speaking to the media from the Huftsdorp courts complex this evening, Counsel Sisira Kumara Siriwardena, a lawyer representing Jaywardena said many citizens in the country had already come to the conclusion that President Siriena was suffering from a mental disability.

He said there were three possible reasons to suspect that Sirisena was suffering from a mental disability including A) The stress stemming from his natural inability to meet the demand of the job B) A history of mental health issues in the family C) Inability to cope with the stresses stemming from the arrest of I.K. Mahanama, the President’s former Chief of Staff, over a bribery charge.

Siriwardena also said Sirisena’s biography, written by his daughter Chathurika Sirisena, indicated that the President had a “family history” when it came to mental health issues.

He said the President can only enjoy his immunity only if he is of sound mind. “If he is suffering from a mental disability he can no longer enjoy presidential immunity.”

The Sri Lankan Constitution bars a person with a mental disability from functioning as the Executive President. “Any Member of Parliament may, by a writing addressed to the Speaker, give notice of a resolution alleging that the President is permanently incapable of discharging the functions of his office by reason of mental or physical infirmity,” the Constitution stipulates.

      Thank you. We all have suspected this to be the case, and that may explain how Sirisena managed to earn the Titles of Traitor, Quisling, Sevslaya, Mala-Perethays, Patholaya, Pachaya, Pissa etc. Sirisena is the madman the late Dr NM Perera presciently predicted during the condtitutional debate in 1978. This is also another reason to abolish the executive presidency.

        Sirisena was having latent schizophrenia since young (setting fire to his father’s paddy field when reprimanded – juvenile crime is one way Schizophrenics manifest) and that is why it was not diagnosed earlier. Rebuff given by UNP to his greediness to go for a second term has triggered it and it is now in the open.

        If you guys are convinced that he is indeed suffering from a mental issue, yes, certainly support taking appropriate corrective action for the needed Political chnages and administration.
        .
        However, humiliating and furthering his mental stress should not be the course of action – be respectful and let the health experts work on attending to the health problem at hand, while consitutional experts find the political solution to the issue.

        If you are not convinced it is indeed a mental health issue, and so feel comfortable humiliating him, then it will be wrong to take official action on Thakshila’s filing.

        Just my thoughts – we do need to remain a country of the compassionate – whether guided by Buddha, Shiva, Jesus or Allah! Else we become barbarians.

          Maitripala Sirisena says, Rail destroyed the Country , Govt and the party, and Maitripala as well. Later destroyed Mahinda as well . Looks like the three have destroyed each other, and the country and the people. If so, there should be no trust on the three, and this shoud be understood.

            Let the intellectual, informed and democracy loving majority among the majority take the necessary initiative to aptly educate the population and enable electing trust worthy leaders – not misguided by racists rascals and mindless promises such as finding 500 thousand “porin jobs.” If the country is to get out of the rut of populist domination promoted by the extremists, it is the responsibility and the only possibility is for the majority of the majority take action to call the shots – not stay on the sidelines impotently and allow the extremists in the minority call the shots and then just badger them purposelessly.

            On the current accusation of Sirisena’s mental condition, if he is indeed mentally ill, it is grotesquely inhumane to mock him. If you feel he deserves to be mocked, then you are truly not convinced he is mentally ill. You cannot have it both ways – that was my point. I am not just blaming you, but since many were doing the same thing I just found a convenient ‘early-comment” location to make my observation – nothing personal, I promise!

          The problem seems to lie with the brains of Sirisena and Mahinda. This petition, is regarding Sirisena’s mental health. May be there should be another petition, regarding the mental health of Mahinda Rajapaksa, the Fake PM, the MP for Kurunegala as well.

      This is all well and good ……….. but all this effort is misdirected at the weakest of the putsch conspirators.

      The other conspirators of this “historical” coup/putsch are Mahinda, Basil and Gota; all of sound mind ……… and still conspiring in the shadows to unleash more mayhem in the future.

      Already Sirisena is a spent force …….. efforts should be focused on the more dangerous culprits, the Rajapakses.

      .We the Srilankans spotted this mental imbalance of the President since the last year when he thrashed the table thumping his fingers and said he would burn the place down, following that outburst he also said something about chopping his enemies ( in that context) with a sword .
      There had been many more outbursts like walking out of the hall in dismay and anger.
      Many many more incidents to name , but the latest one is the most hilarious act of sitting/standing in front of the audience and hinting / stabbing his friend from hell in his back . The ” Kussi Amma Gossip”” publicly disgracing the ” friend in need ” in reference to ” Horse trading of democratically elected Parliamentary members ” to switch sides which was a miserable failure.
      The amusing bit is though he himself was part and parcel of this Horse trading itself , now it seems he has washed hands from this illegal ill thought of human trade . Forgetting sir??

But the most important thing is to reduce the risk of such a thing happening again to zero.     Excellent. We also have noted many an instance he has conducted himself as a lunatic. At the last SLFP Convention also, he made another broken promise. That is, that he would definitely end the prevailing Constitution crisis within a week from that day. Now it is one week for tomorrow since making that promise but we do not see any sign of a solution arrived at, of the issue. Very very precarious situation!!!

It is apparent that he is doing the things that are not suitable for a leader of a democratic country.These acts can not be done by a leader who is in sound mind.Further his speeches are also like that. He states that they were unable to form a government since the price the MPs sought were very high.That means he had tried to buy MPs to form their government.Can we expect such a discreditabe action from a leader of a country of a good governance.So I thoroughly believe that he is not in the sound mind and hence it is suitable for a Medical Board to examine the mental condition of this man.

    I think the mental health of most Lankan politicians, including ADHD affected Ranil Wick the Wimp, Sajit the Low IQ retard, as well as many ministers and members of parliament who have not completed their basic education (no school diploma) should be checked. Lankans are basically an inbred group, with the land mostly cut off from rest of the world and genetic diversity is limited. Its a country with Dravidian influence predominating among Tamil (both North East and Mid country Tamils) and Moslems who claim Arabic heritage but are in appearance and language are clearly Dravidian, Moslems converts from low caste South Indian Dravidians. In the cities like Colombo, Kandy and some coastal area among Sinhalese, some Western admixture is visible (probably Portuguese and Dutch) but that is negligible. In such a low diversity gene pool, chances for genetic diseases to emerge and predominate is high. Ranil Wick the Wimp is clearly a man with serious mental problems, he looks it as well as his disdain for everyone around him and lack of feelings shows he is very sick and also absolutely unfit to hold any position of leadership over people. Also, men who have never undergone the joy of having their own children usually have little understanding of how mothers and fathers feel about their children and Lanka should do much better to keep such sick people away from leadership positions.

    At the end of the day Lankan people have to make their choice. Unfortunately they are often emotional and seem to not know what is good for them and fall easily to malicious propaganda. The only man I see who with steely resolve is looking to fix the country and direct it in the right path is Gotabya. He has demonstrated his efficiency in previous positions and while there may be some collateral damage, he is uniquely fit for the leadership position, and Lankan would be foolish not to give him a chance.

    MS is working to a plan to gain independence from a once upon a time UNP common candidate legacy, to build up his own brand identity as the next SLFP Presidential candidate for second term.     I feel sorry for Sri Lankans. Sri Lanka has had a good tradition of electing and selecting higher officers from politics into civil service examinations. Like India we have had one of best administrative, political and civil service systems. For instance, we have had a habit of electing some best brains into parliament… You name it from SWB…to Chandirika… then quality went down. MR did a lot of damage to Sri Lankan politics. Rather than following a tradition of selecting best brains in civil service, executive posts such as University CVs and other Directors.. He selected his own people without some qualifications. Air Lanka was destroyed by him.. likewise, you can name hundreds of incidents.. for fear of life threats No one spoke about it… We have good experts, academics, intellectuals, monks and some of creams in Sri Lanka.. All are marginalised by Mahinda and co..
    Civil service examinations are tough in Sri Lanka,,, SLOS, SLES, SLAS and many more..
    We have a tradition of selecting the creams of society to all high posts.. What happened now is other around.. All unqualified people are appointed and go and see Sri Lankan universities now. many fake Phd are around there.. many unqualified lecturers are appointed from back door politics.
    Coming back to this issue of president..
    where have been all advisers to president?
    are they not qualified to advise them? Are the fake advise without any knowledge, experience and skills,
    how many people work in presidential office?

    They all have some of creams of academics and experts to advise them..
    JR, Sri ma, Premadasa all had good experts around them to advise in the interest of the country?
    Now all those qualities are gone.
    Politicians have done a greater damage to Sri Lanka.

    Thank you Thakshila Jayawardena for filing the ‘public interest’ petition in the Court of Appeal.
    It will remind like-minded, the purpose of the Judiciary.
    In non-Legalese, Thakshila wants the IGP to find out the state of the mental health of MS.
    But but…but…… Doubts have been expressed as to the mental health of the IGP.
    Will we step into the Domain “Let him who is without sin cast the first stone”?

    My3’s imaginary explanation to part C:

    MY3 wanted to block the sugar factory deal at any cost to save children from obesity so his busted sidekick asked 500 crore consultant fee. But according to MY3, the real culprit is RW. Because RW’s spin fully exposed MY3 to India and put innocent children in the risk of obesity in SL.

    Most probably the president is physically & mentally healthy.

    He doesn’t show any sign of stress as well as he seems to bear responsibility for words uttered.

    He seems to be healthier than Ranil Wikramasinghe.

    Thakshila siriwardena should have done it for RW unless Thakshila, you’d better check you brain first.

      a person who has insight only will have stress. A fellow who doesnot have any insight will not be worried about anything he does like a mad person. This fits sirisenas activities
