Post 19A Political Scenario: Parliamentary Elections & After

There was a struggle against the model of 19A first presented by Ranil Wickremesinghe, but there was no struggle against 19A as such—by which I mean the idea that the executive presidency required downward readjustment. The UNP-CBK-TNA-JVP Quartet had envisaged decapitation of the Executive presidency while the masses, the SLFP-UPFA and JHU envisaged trimming; downward revision. Thus, there was no struggle against 19A; there was a struggle over 19A; its scale and scope.

The struggle against Ranil-CBK’s 19A model was waged in several stages by several forces:

  • The civil society petitioners and lawyers who moved the Supreme Court and thereby succeeded in neutralizing the worst of the original draft;
  • Champika Ranawaka and Rajiva Wijesinha who fought the battle against Ranil’s subterfuge and kept the reform on the right track;
  • The UPFA whose fight-back forestalled an SLFP sellout and pulled the SLFP from CBK’s para-UNP stance onto the traditional anti-Ranil, anti-UNP track.

The UPFA’s game-plan was never to wreck the 19th amendment, because its own members had been decades-long opponents of the Jayewardene presidency and also because it harbors hopes of a Rajapaksa return as Prime Minister. Thus, wrecking 19A was sharply contrary to both its ideological sentiments as well as its project. However, the UPFA was determined to prevent a CBK-driven SLFP surrender to Ranil’s model of 19A and his surreptitious maneuvers to bring it to fruition. The SLFP-UPFA’s decades-long opposition to Ranil’s rightwing UNP brand was reactivated by his own arrogant political behavior and discourse, in the parliamentary chamber and backstage, during the entire 19A process.

In the battle for the soul of the SLFP, both Ranil and CBK lost, while the two tendencies of the mainline opposition, owing loyalty to Maithri and Mahinda respectively, overlapped, converged and prevailed. Thus, instead of a smooth and automatic passage for the version of 19A which the UNP sought, with CBK-TNA-JVP support, the outcome was a negotiated 19A which retained and protected the core of the executive presidential system. Ranil-CBK’s original 19A model sought to dismantle the “Gaullist System in Asia” as Prof AJ Wilson termed the Jayewardene Constitution, replacing it with a restoration of the Westminster model. Ironically yet fortunately, what the 19A as finally passed by Parliament did, was to hit the delete button on the imprudent Rajapaksa attempt to stretch that system with 18A, while reshaping the ’78 Constitution in such a manner that it is a far more faithful version of the Gaullist Presidential-Parliamentary Fifth Republic than it was before!

The PM indicated that he regarded 19A as a less than satisfactory compromise and entirely as an interim measure, which will last only until he wins a parliamentary election and converts the Parliament into a Constituent assembly which will fashion an entirely new Constitution, transferring executive power to the Cabinet and the PM. The PM’s perspective was presaged by a hard hitting speech by Deputy Minister Eran Wickremaratne.

The PM’s remarks proved that the 19th amendment as passed by the legislature was a retreat from the program that he was committed to and that he would resume the process upon winning the upcoming parliamentary election.

It also proved that in terms of the realities of power, the main political danger to President Sirisena comes, not so much from ex-President Rajapaksa whose supporters, by all accounts, strove to protect the executive presidency, but precisely from Prime Minister Wickremesinghe who reiterated his commitment to abolish it and transfer executive powers to the Prime Ministership.

Mahinda Rajapaksa does not seem to be making a bid for any real estate the President has. Or if he did, his supporters haven’t shown it. There is almost no pathway to achieve such an objective. It is out of his reach. If at all, he will be making a bid for a prime ministership, which, thanks to his supporters in the UPFA, has much less power than it would have, had Ranil’s model of 19A gone through as CBK and “civil society” advocated.

In sharp contradistinction to Mahinda Rajapaksa, Ranil Wickremesinghe wants a real transfer of executive power, which would turn President Sirisena into a lame duck. Indeed, had the Supreme Court not struck down several provisions, Champika and Rajiva not sniped away and the Opposition pushback stymied the rest, President Sirisena would already be a lame duck—not thanks to Rajapaksa and his loyalists, but to Wickremesinghe’s draft of 19A.

The commentators who depict 19A as a thwarting of Mahinda Rajapaksa’s return to the Presidency obviously endow him with quite extraordinary physical capacities, because he would be 75 years old at the time of the next presidential election! The simple fact of age always ruled him out as a presidential challenger in 2020. Even in the exceedingly unlikely event that he was fit enough for a grueling campaign he wouldn’t want to lose to Sajith Premadasa.

Does it make sense that Mahinda Rajapaksa’s supporters would try to demolish an amendment to shift power to the Prime Minister, when they hope that Rajapaksa will be the next PM and would perceive it to be very much in their interest to have an empowered Prime Ministership?

The only sense that can be made of the UPFA’s resistance is that their collective commitment to a strong state and their consequent opposition to a dismantling of the Executive Presidency as envisaged in the original model of 19A which the Ranil-CBK combo was pushing, was somewhat greater than their loyalty to the vision of Mahinda Rajapaksa as PM, and indeed their option for Mahinda stemmed precisely from their statist-populist ideology. (I say ‘statist’ rather than nationalist because Vasudeva’s conspicuous contribution in the struggle over 19A must be understood.)

The enhanced role of the Prime Ministership in post-19A politics means that the issue of the Prime ministerial candidacy assumes a salience that it would otherwise have not possessed. Who will be the Opposition’s alternative to Ranil Wickremesinghe? If the SLFP is not to succumb to the dark repressive age it plunged into in the 1980s, it would have to opt for Mahinda Rajapaksa. If the majority Sinhala nation is not to be plunged into the same situation it was under Ranil’s CFA (and CBK’s Sudu Nelum-Package-PTOMS years); if it is not to wind up in the same situation as in the pre-1956 period or worse, the colonial centuries; it would have to raise Mahindra Rajapksa to the prime ministership. The Sinhalese have to press the re-set button on the emerging socio-political, economic and external configuration. The increasingly marginalized majority has to re-balance the equation. That is what a Mahinda Rajapaksa Prime Ministership is about. It is not about a Rajapaksa presidency, that of Mahinda or any other family member.

Had the Ranil-CBK attempt succeed and if it were to succeed after a UNP victory at the upcoming parliamentary election, there would be no chance of Sajith Premadasa ever leading this country and resuming the grand developmentalist project of his father, who was utterly committed to the Presidential system as unparalleled agency of pro-people initiatives. The retention of the core of the executive presidency in the “19A Lite” that actually made it into law retains the possibility of yet another patriotic-populist President who can protect and uplift the nation.

If time stopped, President Sirisena would go down in history as a decent, moderate reformer. But time doesn’t stop and history’s verdict on President Sirisena will be determined by the success or failure of the radical reform project announced by Prime Minister Wickremesinghe in his parliamentary speech on the occasion of the passage of 19A.

I was in Moscow, together with Ranil Wickremesinghe and Vijaya Kumaratunga, in the summer of 1985, attending the World Festival of Youth and Students. Mikhail Gorbachev was regarded as a hero, almost an angel or saint. A mere five years later he was considered a villain or at best, a pathetic figure. The role of a modernizing reformist leader in history depends on where his reforms take his state and nation and leave it. Is it stronger or weaker vis-a-vis its rivals and challengers? A leader is finally judged not by his intentions but by the outcome of his actions: whether his state and nation are strengthened or weakened in terms of power; whether the unity of the state is strengthened or weakened. That is how Mahinda Rajapaksa his predecessors and his successors will be judged. That is why Mao and Deng, Stalin and Putin are heroes in the eyes of their nations, while Khrushchev and Gorbachev are not.

President Sirisena’s role in history will be judged positively if he stops the 19A process from going further as the Ranilist UNP explicitly envisages; whether he resists intrusive Western calls for war crimes accountability and protects national sovereignty; whether he resists the CBK surge towards a federal Constitution which, given the proximity of Tamil Nadu and resultant ideological osmosis, will tilt the balance on the island against the Sinhala community. President Sirisena cannot do any of these with a post-election Ranil Wickremesinghe Prime Ministership. Indeed he will be unable to protect his own Presidency from being turned merely titular by the threatened second wave of Constitution-making by a victorious UNP administration.

In order to protect his power base, Maithripala Sirisena has to reconstitute it with a broad anti-UNP government, which means the SLFP-UPFA simply has to win the election. He will need to play the Mahinda Rajapaksa card. His role in history will be judged by whether he re-balances the equation for the nation, by standing with rather than against the ’56 type backlash that is building – with or without the SLFP; within or outside it–to have Mahinda as our PM.

      This is the first time ever Tamil representatives supported for a common agenda. That alone says everything actually, but balligeputha representatives to interpret this way – is exclusively based on their abusive agendas. This country belongs to all srilankens – enough is enough we dont need to make groups such as TNA, UNP, SLFP, JVP , MC etc.. we all should have the equal rights. Nationalists like DJ and Buruwanse should be jailed for their illegal acitivites – making every efforts to twist the realities for their future plans.

      Nationalists in general are seen not accepted in civlized societies, but rotten abusive cultures such as of ours seem to be instrumental for their political targets. Mahinda Rajapakshe should be kept away from lanken politics – is what I feel looking back the last 10 years of the oligarchs politics.

    As a political analysts or whatever, you are supposed to explain to the populace for what 19A really is; what it does for good governance; how it protects democratic values, etc.. Instead you kept on to your same old MR Vs Ranil plus CBK contest. This kind of taking on individuals rather the problems the country facing is increasingly becoming a bad taste even for the SLFP rank and files, and this was sensed even by those notorious Parliamentarians, perhaps this was the reason for them to raised their hands and making the “yes” tally to whopping 212.

    You put forward your prediction about the presidential election, failed miserably, dishearten, wanted to take a short break but reemerged as time healed you. Predicted 19th would be derailed by MR faction, disappointed and now betting on MR becoming the PM. Let see how it turns out. No doubt, as always, the opposite of your wishful thinking.

    This man is disgrace to political analysts and journalists in SL. Even a 10th grade school kids can see that RW’s position as PM is very temporary, how many more months?     Mahinda had already contested and lost to Maithripala! What harm will befall on Mahinda if he contest against Sajith and loosing. After all Sajith is the son of a former President whereas Maithripala is only the son of a poor farmer!

    Had Mahinda any honour he would not have thought of manipulating the constitution with 18A and contesting after the end of his second term.
    He would have honourably retired and led a peaceful life as an elder statesman.

    Poor Mahinda he did not have a single real advisor. He had only astrologers to advice him and pseudo political scientists like Dayan to mislead with poor judgments!

    Mahinda had the ignominy to witness his own faithful followers voting for 19A minus discarding his hard won 18A to the dustbin of history almost unanimously.

    If you and other supporters had even an inkling of Mahinda becoming Prime Minister after the next parliamentary election, you would have supported conferring of executive powers to the Prime Minister.

    On the contrary, your behavior during the entire debate of 19A clearly validate that you were certain that Ranil would become the Prime Minister after the next election and somewhat you must do everything possible to truncate the powers of the Prime Minister.

    You had almost conceded victory to Ranil even before a vote is cast.

    SLFP-UPFA, JHU trimming down 19A, what a lie. As per the promise of the President Maithripala Sirisena 19A was meant to be a much stronger amendment further reducing the powers of the President. SLFP-UPFA and to certain extent JHU tried and won not to make the 19A a strong amendment.

    People like Dayan are a curse to this Nation as they appear to be speaking the truth but in fact people like him are only interested in creating trouble by making wrong statements in order to show that they are still relevant in the political scene. They do not realize that they are a spent force, an empty shell.

    This political pundit is advocating MS to play MR card to win the Parliamentary election and he stopped short of suggesting to nominate MR as the prime ministerial candidate.

    He has a short memory that MS came to power by playing against MR card and the people voted for him to expose all of MR atrocities and abuse of power during his tenure as president.

    For his information MS has just appointed a task force to look into the swindling of country resources by MR government. Soon we will see MR and his gang in the Parliament will be rounded up. They fought a losing battle to sabotage 19A knowing very well once passed it will work against them. Whether DJ likes it or not MR and his gang will be on the dock even before the Parliamentary election. MR will be a lame duck when the election will be declared.

    Smart patriot DO, as usual praising MR and putting down Chandrka and Ranil. Praising JHU and putting down every party in the current national government. Putting down Ranil and praising Sajith and Rajiva.

    He talks about majority Sinhala Nation and why the Sinhala nation must bring MR as the executive PM. He frightens the Sinhala nation with Tamil Nadu card by conveniently forgetting India is a politically united country with so many states like in US and China.

    Hope DJ is not creating or contributing to create a situation like 1958, 1965, 1969, 1970, 1983, 1987, to put the minorities under threat or become victims, inorder to make MR as the new PM after the next elections. But I strongly believe that the majority Sinhala Nation are politically savier now to reject the political leaders who put their self intersts first by ussing the Sinhala- Buddhist card.

    The Sinhala Nation wants to go forward and come out of the rut they have been in for the last 67 years. Defintely they will vote much more wisely in the forth coming election having tasted the democracy again after 8th January

    Though the total abolition is not in place yet some presidential authority becomes necessary for the time being. It is akin to having a stick to keep away the bulldogs and the likes of Dayans who are wanting to taste blood. In their desperation they are even calling for communal troubles.

    DJ has again come to show his support for Mahinda and Sajith both lost cases.

    MR’s political career is over. He cannot again have any hope of presidency with the 2 term rule and
    He would like to succeed now as P.M. Forrtunately, SLFP high command will not consider him
    for this position. He may be allowed to contest as an ordinary Member of Parliament. On the other hand he is trying to muster support through a breakaway group, led by Wimal, Vazu, Dinesh, Udaya
    Etc. These guys have no place to stand on their own and therefore look to MR’s popularity. They are talking about 5.8 million voters behind him. How was this secured is well kmown to MR himself. With all give aways, including Sil cloth, and others, these not going to gather votes forhim now. Further,
    SLFP will stand on its own and will separate their vote bank. The days white van, nepotism, corruption, misrule, etc will be buried with tge eviction of MR.

    In todays context, UNP under Ranil will regain power with majority of seats in the parliament and may collaborate with the good SLFP members to be elected and form a strong government for the next 5 years. RANIL w as a leader, is very intelligent, absolutely honest, with good recognition from all our friendly nations together President Maithree Sirisena will create a formidable country where all communities will, live togetber in peace and prosperity. Further, all minority groups will join forces with the government.

    DJ as usual wants bring Sajith into the equation. He may be liking him and wanted to support and promote him which he is doing because of the support he received from President Premadasa.
    but already there are accusations of misrule by Sajith in this short period and we have to waitfor a little more to see his deeds. I do not expect him to go further up and what he has achieved is the limit. UNP will build up new leaders to take the party forward and with mire decency coming into politics, there will be very good young professionals will join the UNP.

    You are correct in whatever you mentioned in your article. But your mind set should have been different. The TNA’s part in the 19A is completely was out of place and their participation was not appreciated by the majority Tamils. The Tamils have nothing in the introduction of the 19A as the provincial councillor Ananthy said. The Tamil people are not either supportive or against it. They only want their freedom from the oppressive Sinhala regime. Initially they want the Army withdrawn from the North. Secondly they want a referendum to determine their fate either to be within or out. That is the only way the problem of the Tamils in Sri Lanka would be solved.

    So you are concerned that MS protects his power base? Questions is, is this what he wants? Maybe not.

    It was not MS who opposed Ranils executive power play. Obviously MS is not power hungry, in fact as far as power is concerned he is on a diet.

No matter you belong to other parties but you work together you can work for the progress of the nation is being proved by great son of the nation -MY3: No doubt the country will march towards a cilized nation – a nation who rights have been eroded by a groupd of people born to Madamulana area. – Even today groups led by DJ and Buruwanse and several few others – specailly ones that have all kind of allegations being levelled have been making every efforts to get their Mafia leader back to give them a lead.

    MR was the prime minister from April 2004 until he was elected as president for 9 more years. During those years he stirred up communal hatred and white van culture of eliminating dissidents both political and communal. He appointed crooks and criminals as ministers and to powerful positions. He was wasteful and corruptive at the expense of poor people.

    He used principled intellectuals for holding on to power and blinded them to reason and common sense. They are in turn loyal to him now to the extent of manipulating the masses to bring him back to the dark days.

    He watched BBS destroy destroy churches, mosques and temples. Even after he lost the last election he blamed Tamils for his defeat knowing fully well that his winner had 90% of his votes from majority Sinhalese. This was just to create riots to target the ethnic minorities with his thugs.

    Are their not any other capable good men and women in among the ethnic majority (because the Sinhala-Buddhism would not vote for any other) who can lead this country away from dictatorship and corruption? The country is fortunate to have the good president in the name of Maithreepala Srisena and do not try to corrupt him with the old president in charge of the legislature though it is very unlikely that even the ethnic majority that is beginning to understand how misdemeanours of MR will vote for him back to power.

    DJ is not a political analyst and never was; he is apolitical PROPAGANDIST, at the moment for MR. He still want to present MR as the savier of the Sinhala nation. If this is so, how come that MRs sibilings and colloborators are spending their time in the jails or having a recommendation to be arrested for the abuse of power, corruption and much more and the list is long. Has DJ ever asked what was the almighty President MR was doing during his tenure… taking it for granted that it was his clan robbing the country and it is their birth right?
    MR was telling in an interview recently in Al Jasiera, if he would candidate for the election for PM he would win, but he would not! what a laughing stock.     DJ is one of the handful of intellectuals who understands Sri Lankan self interest. Many are just blinded by their hatred for MR, or some other insignificant matter. DJ is not a lover of MR. Far from it. DJ fought very hard for Sri Lankan national interests, at the height of Eelam war. Then he got kicked out by MR. DJ is a hero just like MR is a hero and just like SF is a hero. They all did their duty for SL, despite all their weaknesses. Ranil-CBK – these are traitors who took the side of our enemies. I do not mean Tamils. Tamils are part of our country. They are our brothers. Our real enemies are the ones conspiring from far off places. We need to be watchful, very, very watchful. And Tamils need to understand that as well, if they are patriotic towards the SL nation.

      MaRa and his den of thieves were looting the country for their own self interest national interest was far from their mind. They made pact with the devils just to stay in power. The Eelam war was not out of national interest but it was due to their racist ideology and the extremists rallied behind them. The so called enemies that you mentioned were friends then. DJ was very much part of the gang and shares and promotes their ideology of sub human level. I am sure he is all for toppling this Govt. Hook or Crook or even worse treason.
