President Gota’s First Blow To Rule Of Law: Top CID Cop On The Chopping Block

President Gotabaya Rajapaksa‘s decision to unceremoniously sack SSP Shani Abeysekera as CID director has sparked grave concern particularly since the Department was leading several murder and abduction investigations carried out by death squads allegedly operated by the former defence secretary.

The decision to remove Abeysekera from the CID was lightning quick with President Gotabaya only four days in office.

The National Police Commission said the transfer was executed within hours on the request of Acting IGP Chandana Wickremaratne. In a particularly despicable attempt to humiliate the former CID director, he was transferred as Personal Assistant to the DIG of Galle. Police sources said PA positions to DIGs were usually restricted to police officials at CI rank.

Ironically the President Gotabaya Rajapaksa made this deliberate attempt to interfere with law enforcement despite claiming that his Government would not engage in political vengeance.

The move was roundly criticized on social media, with the Sri Lanka Young Journalists Association issuing a statement denouncing the actions of the National Police Commission which the Association claimed was showing a grave loss of independence.

“SSP Shani Abeysekera is one of the country’s best investigators. He has always worked independently, irrespective of the Government. He is a fearless professional. His transfer is a massive victory for murderers and criminals,” said UNP MP Ajith Perera, the sole voice in the UNP raising the issue of Abeysekera’s sudden transfer.

TNA MP M.A. Sumanthiran said the transfer smacked of being politically motivated and questioned why the main opposition UNP was silent in the face of such a big blow to law enforcement and rule of law.

SSP Shani Abeysekera has served decades in the Sri Lankan Police and is well known for being an upstanding officer with an impeccable record of integrity. His successful case record stands testimony to the fact that he is one of the country’s top investigators.

Abeysekera was the chief investigating officer in the 2005 Royal Park Murder and helped to convict Shramantha Jayamaha for the murder of 19 year old Yvonne Johnsson. Offered pots of money to suppress evidence in that case, Abeysekera resisted the moves and complained to court that a popular cricketer had been instrumental in trying to bribe him. At the time Abeysekera was a chief inspector.

He also led successful investigations into the gruesome Angualana double murder by four policemen. He also busted a mercenary assassination racket run by former DIG Vas Gunewardane and helped to secure a conviction. Abeysekera also ran the investigation into the LTTE assassination attempt on former President Chandrika Kumaratunga. A few years ago, under his direction, CID officials arrested and secured convictions for nine men accused of the gang-rape and murder of Sivaloganathan Vidya, the Jaffna schoolgirl.

More recently, the CID was entrusted with the investigation into the Easter Sunday bombings. As Director of the CID, Abeysekera led that probe and the Department rounded up the NTJ network within 8 days of the bombings.

Colombo Telegraph learns that SSP Abeysekera’s transfer was effected on the basis that he was “too friendly” towards minority communities, especially in light of the CID’s stunning investigation into the Dr Shafi controversy which proved that the entire saga was a politically motivated, Islamaphobic witch-hunt against a Muslim surgeon, spear-headed by the Director of the Kurunegala Hospital, the DIG of the Kurunegala District and other players in the region.

The Rajapaksa regime has considered CID officers high on its list of enemies, after the Department spearheaded a series of investigations into their crackdown on journalists and activists during a decade in power. It is a telling sign that Abeysekera’s transfer was considered such a top priority for President Gotabaya Rajapaksa and signals a terrible fate for key investigations the CID was conducting under a new, more pliable director, legal experts said.

    This was not an election for Gota to win so easily, perhaps not an election to win at all. But all 34 other candidates had inflated egos, and did not educate the public on the use of Preferential Votes. They all wanted “kathires” for themselves – not 1, 2 & 3.

    Gota knows his limitations. Never participated in a debate where he would have to answer unpredicted questions.

      in the video he has pinpointed a big problem we have.The lack information communication technology.Take south korea which is the most wired country in the world and compare srilanka with it.Unlimited internet,computer skills for children and rural folk etc are the way for the future for sri lanka as he has rightly diagnosed.

      compare that with the sajit crap he talks about dying for this one and that one.People would have noticed his lack of maturity and knowledge vis a vis gota.Only problem is gota is psychotic.If he can control that aspect i think he will deliver results as he is a practical type.However i don’t know how he is going to control the hambantota clan who must be now itching to go to town again as they know mahinda will let them as long as they are a “apey miniha “.Too early now to predict,must wait and see.

        Let us not be too traditional in pinpointing our problem. If you ask me the lack of internet is not the problem in Sri Lanka.
        Sri Lanka has very good internet infrastructure. We have had a fiber optic backbone in our country for the past 25 years and presently many homes are given ADSL and FTTH connections. In addition we have 3g/4g services with the ability to stream TV programs over the air without paying for data.
        In addition to this Sri Lanka has 3 gateways to 3 major marine fiber optic highways. They are 3 of the fastest cables in the world.
        So giving unlimited highspeed internet will not change anything much.
        What needs to be changed is the mindset of the youth. First and foremost our youth should be made very proficient in English.
        This is the world language now and it is the way our people can interact and learn quickly from the tremendous knowledge base that is available via the internet mostly in english.
        I hope you can see where I am going with this. We should stop looking at things from a very traditional or ordinary viewpoint. We have to start looking at issues with a much more elevated stand point.
        Anyway I don’t blame Gota, he tells people what the people want to hear.

          if you look at the internet subscriptions as a % of the population and compare it with the most highly wired country in the worls,south korea,you will realise what i mean.Can you remember what was south korea before we attained independence.We were called the pearl of the indian ocean and they were looked down by us as koreawa when we wanted to describe some trash.How did they get ahead?

          So we have to look forward.That is why i am in favour of gota’s policies on Information Communication Technology (ICT) cos that is the way forward for the 21st century.I get your point about the english language for internet and gota mentions it as important.That was another big mistake after independence,not making it also an official language,because it is the language of business.

          I agree with you that ICT is not the only glaring and serious weaknesses we have.It is only one of many such as (freedom of the press,property rights-protection of property as well as financial assets,quality of land administration,strength of auditing and accounting standards, fibre to the home/building internet subscriptions per 100 population,internet users as a %of adult population,inflation,government debt as a %of GDP,country bond rating,competition in the provision of professional services and retail services,prevalence of non tariff barriers,trade tariffs %,complexity of the tariffs,redundancy costs,ease of hiring foreign labour,internal labour mobility,ratio of wage and salary earning women to male ratio,non life insurance premiums -volume to GDP,credit gap-measurement of credit to GDP ratio and its long term trend,banks regulatory capital ratio,insolvency regulatory framework, low research and development expenditure as a % of GDP,)
          as you can see regardless of who comes to power,it is going to be a monumental task to clean up the mess with so many terminal illness points in the country.

Then you said Gotabhaya was not worthy of being called a Homosapien and joined the gang who moved all corners of hell to block the majority of majority exercising their will by eliminating him out of contest.         The Tamils emerge from this much better. After all, they voted en bloc, not for a fellow Tamil (Sivajilingam was there, after all, and that guy named Guneratnam of whom we know nothing except that he doesn’t in any way appear to be related to Kumar Guneratnam, the Peratugami leader). The Tamils (and most Muslims) all voted for Sajith, very much a Sinhalese. That Sajith ran a gimmicky campaign is true, but that was not what mattered in the final analysis.

      If the government gives not 1, but 10 internet’s, unlimited, superhighway speed for free, do you think that it will help the buffaloes who got carried away by Iraj gimmicks?
      When people don’t have rational reasoning or rational reflection as the basis of their decision making process and they use sentiments and emotions instead, what would you expect?
      The Buddha taught us the concept of wingnanaya to handle this. With wingnanaya you can easily decode the underlying truth in most situations.

      I think, I have a greater reespect on you. You are one of the few that made hearted efforts to improve the awarness of preferential votes (manapaya). But not except SIRASA TV, any other channels I think brought any kind of programs on that.

      Very lately, I got to know a family from Germany that should have visited srilanka for their vacation. Even 18 year old boy in that family thought that sinhala people would not take any thing serious. According to him, many in SL, spoke to him in English. But whenever he or his father tried to find an address, there not many could provide them with the proper (exact) information how to find the place. Meaning… all appeared to be well aware of everything, but they are far from exact info supplies.

      But this has nothing to do that the family from Germany would not travel back to SL. They really enjoyed the vacation as they repeatedly told me.

    The vindictive Rajapaksa’s are back. It is a shame that officials have to live in fear of the unknown. We will now return back to silence, and the dark days when people have to stop criticizing, and pointing fingers at the Rajapaksa’s. The days of feeling free to speak out, are gone. Human being don’t realize the good things they have until it is gone.

      In countries such as ours, the outcome so called elections are no different to that of Pakistan, where over 60% are illiterate. Ours has been a nation making up 22mio, but free education across the country has given the chance over 95% or even more to be literate.     The demotion and transfer of a conscientious senior police officer is just the start.

    They will then release many criminals who were in the military, saying they were ‘war heroes.’
    And the criminals will then be part of the ruling mafia family’s white van brigade.

    Irrational voters have brought the mafia family back to power. Will they at least use the general elections in March to provide a check in the form of a strong opposition?

        I think Sajith Premadasa needs to toughen up a bit. He needs to find someone as effective and dependable as the late Sirisena Cooray and Ranjan Wijeratne were for his father ( they might have been involved in extrajudicial killings of JVP and I didn’t like them a that time, but outside such actions, they were still considered effective organizers and shrewd political operators, unlike the current lot in the UNP) and wrestle the party leadership from RW.

        He should be mindful of the fact that he owes a duty to the 5.5 million people who voted for him and provide effective opposition in and out of parliament. Instead of indulging in blame games and becoming disillusioned, he should seize the mantle of opposition leader. Then the UNP can face the parliamentary elections with renewed vigor.

    Why Sumanthiran is the most hurt here.
    How about Mangala. I heard he may have been involved in foreign exchange and financial irregularities. that is why he quit the position ASAP after the election.
    I here, in the North Some Tamils voted even without the Identity papers or cards. IT had been happened even in the south definitely should be by UNPers.d been transferred from Colomba to Galla. What is wrong ?

    This was so much a no brainer what will happen to nations top cops who did their job as government servants to whichever the govt in power in a regime of ‘Keeping up with the Rajapaksas’.

    Whatever little we got as good governance from Yahapalana like independent bodies/ RTI act and all that has gone down the water with the Nandasena’s junta regime.

    What is more painful is to see the main opposition party and its leaders who were the part of Yahapalanaya (except for Mangala S.) have no word and doing the deals with Rajapaksas to keep their loot in safe hands.

    It appears that the National Police Commission approved this transfer. If this were politically motivated where is the independence of that Commission? It is the Commission that owes an explanation as to why a Director of a division becomes a PA to the DIG. Somebody must file an RTI application on to the commission to give reasons. I am sure MP Sumanthiran can and / or raise
    question in Parliament instead of lampooning. Oh! Yes! the record of Shani is impressive and done a quite a good job. But the unsolved ones cannot be swept under the carpet such as the bumping off of Lasantha Wickramatunge and Wassim Thajudeen. Unfortunately these have been used as political ammunition to prop up a political image of some and downgrade others instead of solving the mystery with a successful prosecution. I am aware that the Attorney General required the files of these unsolved crimes and the reports in it were scanty. If Shani was the boss even for one day he must explain to the public as to why it is in that state. HOW SAD.

    What is important is who supervised this CID director. I do not think Officials are bad. When they work for others, Govt needs to find whether the supervisors included both the politicians and foreign groups. I heard FBI and Australia were in front of the CID door step in the next morning after Zaharan blew up and they took away some evidence also with them.
    The same way, Some top officials who got accused in the Zaharan scandle had been rumoured to be getting money from some unknown source.
