Quo Warranto Case Likely To Be Withdrawn To Enable Crossover MPs To Take Up Ministries

The Writ of Quo Warranto, filed by 122 MPs challenging Mahinda Rajapaksa’s continuation in office, is likely to be withdrawn in January aiming to allow crossover SLFP MPs who held ministerial and deputy ministerial positions in the purported government to take up posts in the current government.

Government legal experts have pointed out that SLFP MPs who held positions in the purported government cannot be sworn in as ministers or deputy ministers due to the interim order issued by the Court of Appeal earlier this month. The Interim Order prevented members of the purported government from functioning in office.

They have also stated that there is no point in proceeding with the case as former President Mahinda Rajapaksa has already resigned from his purported position.

The appeal filed by former President Mahinda Rajapaksa against the Court of Appeal interim order will be heard in the Supreme Court on January 16,17 and 18. The Supreme Court has given the appeal leave to proceed but has refused to stay the interim order issued by the Court of Appeal.

SLFP crossover MPs Manusha Nanayakkara, A.H.M. Fowzie, Vijith Wijayamuni Zoysa, Lakshman Seneviratne and Indika Bandaranaike held positions in the purported government.

Informed government sources said the UNP was also working towards forming a “national government” with the sole objective of increasing the number of Cabinet portfolios.

“There are two ways of forming a national government – either we can seek the support of SLFP MPs or we can form a national government with the SLMC MP in Parliament. Both avenues are currently being looked at, ” a senior UNP spokesman said last night.

However, the formation of a national government should be presented to Parliament by way of a motion and should have the approval of the House.

The JVP has already made it clear that it will not support any motion to form a national government using “loopholes” in the Constitution.

      There is really a problem if SLPFrs would not join CURRENT govt. Those extremists led by Rajapakshe would have the more chances to win his racial thoughts, if SLFPers would not be part of current govt.       Can MPs cross over without violating the Constitution?

      In the judgement delivered by K. Sripavan CJ, SC Judges Chandra Ekanayake & Priyasath Dep, on the Constitutionality of 19A, an interesting interpretation is made.
      .
      They find that a Violation of the Mandate given by the People, affects the Sovereignty of the People and is inconsistent with Article 3 read with Article 4 of the Constitution. (see page 9 of the judgement)
      .
      Thus, the principle that a Violation of the Peoples mandate is unconstitutional is established.
      .
      Any elected MP has a specific mandate from the people based on the Manifesto of the Candidate / Party. Violation the Peoples Mandate by crossing over is then unconstitutional.

      Appointing defeated candidates is a direct violation of the Peoples Mandate
      .
      Clause 4 Article 4 (a)
      The legislative power of the people shall be exercised by Parliament, consisting of Elected representatives of the people and by the People at a Referendum
      .
      The above clause recognises TWO categories of MPs.
      1. Elected
      2. Appointed
      .
      It DECREES that Legislative Power SHALL be Exercised in two ways.
      1. By Parliament consisting of Elected Representative of the People
      2. By the PEOPLE at a Referendum.
      .
      Only elected representatives have legislative power
      .
      Appointed MPs are disqualified from Voting on legislation
      .
      There are 29 appointed MPs (including the Speaker).
      Hence 99 of 196 elected MPs must vote in favour to pass legislation.
      ANY legislation that falls short is Unconstitutional and perhaps has no force in Law.

            These “brilliant” ancient irrigation systems we gloat about are really methods and ideas copied from India. I wonder if Indian technicians were brought here by Sinhala/Tamil kings of yore.

            This image said to be of King Parakrama Bahu of Polonnaruwa in the Perakum Milk tins is really a copy from ancient Tamil Poet Agasthiyar Muni.

            My intention is not to denigrate the Sinhalese, who certainly have a history and culture they can be proud of. But, like the Sinhala language itself, a substantial portion of these originate from across the Straits. Let us remember, prior to about 9,000 years ago, there was no sea dividing this island from the South Indian mainland (I know you don’t like the mention of Tamilnadu).

            But, mark my words, going by the political-economic decline and confusion here the Kallathoni sailings will be reversed.

        It could be argued that MINNIN if the members of the party had violated the manifesto then the member should be able to cross over to a party that represents the said policy manifesto. The name of a party means nothing unless in the context of the policy manifesto.

          Many promises are made before an election by the candidate and the party. The candidate subscribes to the party manifesto and becomes bound by it.

          The people give a mandate to the candidate based on the above. Once elected any about turn from those declared principles would be a violation of the Peoples Mandate.

      Why do we need a National Government?

      The people of Sri Lanka who hold supreme sovereignty does not want one. We need our 224 members plus the Speaker to ensure that Parliament runs smoothly and the people are benefited.

      The UNP with the support of the TNA has the majority and that would be sufficient to run through the rest of this Parliament’s term. The Cabinet needs to be restricted to 30 and not more. It may be unbecoming of National List MPs to retain Cabinet positions when they are not elected representatives of the people.

      If any member from the UNP is unhappy of his ministerial position or is dis-satisfied with the ministry allocated so be it. In this time of crisis they need to show that they are built of sterner stuff and not opinionated on being selfish and wanting their pound of flesh.

      If they want to cross over that would be the time that the JVP could show what they are made of too, and ensure the sustaining of the present Parliament to ensure it runs its term. Those UNPers who cross over should be denied nominations come next General Elections.

      It seems that all these MPs save for a few are all out to suck the BLOOD OF THE NATION and would be better off kept away from our next Parliament.

      Voters need to take these actions of these MPs very seriously and NOT VOTE FOR THEM next time round. Whether we are intelligent enough is the BIGGEST QUESTION. We have been suckers and will remain suckers, and those elected by us will SUCK OUR BLOOD till we have nothing left.

    Cross over MPs are just time-servers. Sri Lanka is a small country and the number of Cabinet Ministers, State Ministers, Deputy Ministers and Non-Cabinet Ministers must be a Guinness book of records compared with the population, while the country and economy is in a bloody mess. They do bugger-all and only fill their pockets. “Nawey gilunath band choong”.

      I have been posting comments since February 2015 to various forums including Colombo Telegraph.
      Some didn’t publish my comments at all.
      More of my comments were rejected than published in Wimal’s LankaCNews. I had really a hard time in passing its editor to get my comments published those days. I had to edit my own comments many times to get them published in LCN.
      Even other Sinhala Daily, “Ada,” some of my comments were not published based on their policy. Admirably, at times they have removed some of my words and published the rest without any changes to my opinions.
      Interestingly, compared to other places, Colombo Telegraph is the place where least number of my comments were rejected . My comments are radical and controversial most of the time. Therefore, I see freedom and democracy in CT..

        do not rite bullshit answers as the Bond Scam or daylight robbery of Central bank masterminded by Ranil is investigated by Special Presidential Commission and proved beyond reasonable doubt about it s occurrence.

        Now the second action is doing the doing the Forensic Audit which is being deliberately not done by the minister in charge ith required instructions.

        The third one is amending the current Anti Corruption Bill in order to punish the culprits within one year against current position of 15 to 20 years by the parliament led by Ranil delayed indefinitely.

    Sri Lanka may be the only country where a minority community comprising 11% of the population dictating how the country should be ruled. According to them:
    • Country should not have a Unitary Government.
    • Powers devolved to the Provinces should not be taken back;
    • Powers given to the Provinces should not be reduced;
    • Powers given to the Provinces cannot be interfered by the Central Government;
    • No new Constitution can change the powers given to the provinces.

    The most absurd thing is a large majority of people in this community are descendants of slaves brought from Hindusthan by western colonial bastards to this country about 500 years ago and illegally settled in the area once the Sinhala Kingdoms flourished. Due to Demala invasions from Hindusthan, this area went into ruins.
    The effort of Demala politicians reminds me the story about the camel who was allowed to put its head into the tent.

    The blame for putting this gang of thieves back in power rests with the supreme court. They gave ‘justice’ to parliamentarians who complained of ‘violation of their fundamental rights’, but neglected the right of the poor people to have a honest government.

    This is not proper rule of law.

    So it is about serving themselves obtaining cabinet portfolios and enriching themselves using public money but nothing to do with ‘serving the people’.

    All protective clauses which was originally enacted in the constitution when Parliament was constituted at the time of ‘Independence’ had been gradually removed to steal and enjoy public money without any accountability. We could see all this happening because we lived to see the change. But the younger generation are totally oblivious to this.

    We need once again properly tighten discipline and code of conduct for parliamentarians ensuring accountability. We need to have legal experts to formulate such laws so that public money will not be swindled and not wasted on luxuries and handsome benefits for the MPs such as free travel, duty free vehicle, free petrol, free accommodation, almost free hotel quality food in Parliament canteen and pension.

    IIt is evident that RW never stood for any of the democratic values that he pleaded to uphold during the time that he was ousted.
    The main item in RW’s agenda now is to gain a 2/3 (two third) majority in Parliament for him and his cronies to pass the amendments to enable the Tamil Diaspora to rule the North & East, be it as an amendment or a new constitution, as the TNA claims that it would achieve before the 4th of Feb-2019.
    In the meantime, talking to the grassroots in several provinces, I have been convinced that JVP has totally lost its integrity due to their actions ( and moreover due to their no-actions) during the last few months of political turmoil that we experienced.
    In conclusion, RW is back his own stubborn ways of management, and it is up to the young back-benches and the Senior Stalwarts Who would dare to take a stance against the traditional, lackluster party to make a move to bring the UNP up-to-date with the developments of the late 2nd decade of the 21st century.

    MPs, who have not resigned from SLFP are going to be ministers. SLFPyer, the EP, is the cabinet Chief and holds many ministries and manage many state departments. UNP leads the cabinet. The funniest in that is a Slap Party member, who has lost his MP post as per constitution, is appointed as Opposition Leader by the Moda Speaker. These are comedians once impeached an Opposition leader because he was a Tamil. The partner in the Coup, Karu Jayasuriya, had his own court and Parliament to give back the lost MP position to a Slap Party member and appoint him as Opposition leader because he had a need to fire Sampanthar, the Tamil MP. It is a pure form of racism of Karu Jayasuriya.

    Can somebody explain, then, where the constitution is followed here? Isn’t this the “Sinhala Buddhist Comedians Club” is being called as Appe Aanduwa.

    In that farcical comedy, because of the court injunction, Ranil is not being able to appoint SLFPyers as ministers? What a shameful concocted game to withdraw the Appeal Court case! So they want to release the noose on New King and Old King by cancelling the Appeal Court Quo Warranto? The cases against the Royal Families will free for the Police department to investigate independently?     TNA should have filed the NCM case independently, with the help of NGOs, at Supreme Court instead of going to Appeal Court with these 122 comedians.

    It has been suggested that a rethink on the Presidential form of government is needed. The list MPs led to horse-trading which has seeped into our parliamentary system. It has been suggested that fence-jumping be declared illegal.
    But here we have this ~ “Quo Warranto Case Likely To Be Withdrawn To Enable Crossover MPs To Take Up Ministries”.
    One hopes this is not true. If it is, then RW is blatantly bribing fence-jumpers with taxpayer money. The cabinet positions carry fleet of cars, free fuel and above all ‘The Impunity”.
    Our only hope: The main teams must clean/preen themselves.

      Lanken Central Bank Bond Scam has been in that institution since 2008 ( President reiterates going by his experts – he himself articulated it and the size of the losses made to the country sofar- over 1000 billions rps.

During 2015-2017 – 1% of 1000 billions was reported to have lost, but CB has confirmed it not to have lost, but 10 billions are frozen once the case is investigated, it can be set for state use.

But what is with the 99% of 1000 billins – which is 990 billions of rps – that is believed to have lost during RAJAKSHE rule ( 2005 – 2015)- why President Sirisensa has no balls to call for a special investigation on that yet ?
