Putting to rest the sterilization hysteria in Kurunegala, the CID today informed Kurunegala Magistrate’s Court that there was no evidence to prove allegations against Dr. Shafi – that he has carried out a systematic campaign to sterilize Sinhalese women by performing tubal ligations.

The CID also sought approval from the MC to lift the detention order against the doctor who fell prey to the campaign launched by Divaina under the supervision of Kurunegala DIG Kithsiri Liyanage.
During the hearing today, the CID also informed courts that certain media reports, which claimed Dr. Shafi Siyabdeen performed sterlilizations, are untrue.
Racist Divaina newspaper dragged Dr. Shafi into the sterilization phobia when they published a lead story a few weeks ago, quoting an area Police chief about information that was being revealed of a doctor who has been sterilizing Sinhalese women using tubal ligations, while performing C-sections.
The conspirators swiftly revealed themselves as Divaina’s Hemantha Randunu confessed the information was shared with him by DIG Kithsiri.
The media campaign coupled with the push extended by SLPP politicos and the Kurunegala hospital GMOA, triggered mass hysteria in the area drawing out complaints by more than a 1000 women against Dr. Shafi. But a deeper probe into the complaints by the alleged ‘victims of sterilization’ revealed they were more concerns as opposed to complaints and less than 70 of them agreed to proceed with the mecessary medical tests involved to prove their claims.

I am sending this massage from a developed country. I worked in investigative type of work as a bean counter for many years. I am a not a medical professional but participated in many financial investigative type of work.
This doctor’s investigation has two issues as given below:
1. Accumulation of unexplained wealth.
2. Medical negligence or other type of medical ethical issues.
I have read the news items appearing for this matter and read some articles appeared on this matter. It is my opinion; a proper investigation has not been carried out on this matter so far.
I am not sure whether the following aspects have been considered these matters.
Investigation of unexplained wealth and money by the relevant doctor.
I am not convinced that the authorities have considered the following matters:
1. How he has accumulated the necessary wealth for his businesses? Money Laundering or legal means. But whether the banks have checked these things when they accept the deposits.
2. Whether he has adequate time to spend on his businesses while working as a fulltime doctor?
3. How much he paid as the income tax? This information can easily be obtained from the Inland Revenue Department. Based on the amount of income reported by the CID, the relevant doctor has to pay an income tax of at least Rs. 800,000 per month at the rate of highest tax rate of 40%. It was in the papers that he earns a month Rs. 2,000,000.00. I have read the reports, but there was no information that the authorities looked into that side.

Thank you, CT, for carrying this article. I dont remember if any of the English papers reported the CID’s findings yesterday, but as far as I can see, on the Net, none of the 3 main ones have today. This is really outrageous. So much coverage given to destroy this man’s reputation, professional life and family, but callous indifference to restoring the image of on who seems to be totally innocent of all the charges hurled against him.
It is disgraceful, to put it mildly that certain MPs — Wijeweera, for one — are persisting in throwing mud at the doctor despite CID’s report. They presented their findings for over 4 hours in court. Of course, there were lawyers & at least one monk (Ratana thero?) present who refused to accept tge findings, so the Court has asked for more details, and poor Dr Shafi is still in the dock …remand or prison.
When this is all over I hope he receives thumping good compensation & his determined detractors at least a short term in prison plus fines.

Anyone can present anything to courts. I want to know why a full inquiry on this matter was not conducted. Just because some women had complained of problems not connected to sterilization, that does not mean that you can give that an excuse not to take up the complaints of those who have complained of sub-fertility after the Caesarian section. According to statistics about 2 to 5% of women can develop sub-fertility, but the amount of women affected in this case exceeds that. Of those with sub-fertility, about 70 women have agreed to undergo tests. The correct procedure is to subject these women to tests like laparoscopy or hystero-salphingography. If it can be proved that sterilization was done even on one woman without her consent, it is a crime. If one is not guilty why should he fear of being investigated and go to courts to mislead them and stop the inquiry. Do the investigations fully and come to the conclusion according to the result, whichever way. Then only you can exonerate a person and put the matter to rest. Gana, I do not see any reason for me to discuss this matter any further with you.Looks like you have your personal axe to grind ,as a physician. The case is closed not because of Dr. Shafi,s explanation given to courts , but because there is no single woman out of thousands came forward to get tested to support their allegations. Whatever you mentioned about the Sinhala doctor who was “playing god ” years ago is still unethical and considered illegal at present, if performed without informed consent. Any doctor attempts such illegal procedures in a country like India now may end up lynched by mob (see news paper). Women who went public accusing the doctor of denying their motherhood will not hold them self from getting tested to prove their allegation (this is not rape). Regarding GMOA and in general about Lankan doctors , CT readers and my self have said enough in these columns.
