The Nandasena Gotabaya Rajapaksa Government continues to turn justice on its head, moving Parliament to directly interfere in matters before the judiciary after efforts to convince the Attorney General to drop the cases have proved futile.
Last Friday under the cover of the Avurudu holiday season Prime Minister Mahinda Rajapaksa tabled a resolution in Parliament that seeks legislative approval to end trials against several family members indicted for corruption and military officials accused of murder and abduction.
JVP Leader Anura Kumara Dissanayake revealed the contents of the Resolution of Parliament at a press briefing on Monday (12).
The Resolution tabled by the Prime Minister sought to end trials currently underway in the courts against former Navy Chief Wasantha Karannagoda and other high ranking naval officers who have been indicted for conspiracy to abduct and murder 11 Tamil youth in 2008-2009 by a mercenary navy racketeers, Nissanka Senadhipathi, the chairman of Avant Garde, indicted for gun-running, and Udaya Gammanpila who was indicted for fraud. The resolution also seeks to end trial proceedings against Basil Rajapaksa for money laundering in connection to a villa he owned in Malwana.
The Resolution tabled by Premier Rajapaksa also seeks parliamentary approval to end judicial proceedings against:
1. Ex-Ambassador to Russia, Udyanga Weeratunga (MiG deal) – Rajapaksa Cousin
2. Ex-Ambassador to the US, Jaliya Wickramasuriya (Money Laundering) – Rajapaksa Cousin
3. Current Chief of Staff to PM, Yoshitha Rajapaksa (CSN Network/Money Laundering) – PM’s son
4. Suspects in the assassination of Editor Lasantha Wickrematunge
5. Suspects in the abduction and torture of journalist Keith Noyahr
Colombo Telegraph learns that these were all cases the Government of President Gotabaya Rajapaksa was having trouble leaning on the Attorney General’s Department to drop.
According to Dissanayake, the PM’s resolution of Parliament recommends prosecuting judges for hearing the cases and filing legal action against lawyers at the AG’s Department for filing the indictments. The Resolution also recommends the prosecution of CID officers and investigators at the Commission to Investigate Allegations of Bribery and Corruption (CIABOC) for conducting investigations into the crimes, Dissanayake said.
He added that the resolution – which clearly draws from the recommendations of the Presidential Commission of Inquiry on political victimization – recommends the prosecution of complainants in the cases.
The JVP Leader pointed out that even SLPP MP Udaya Gammanpila, whose fraud case is on the list of trials to be dismissed by the resolution of Parliament, will vote in support of the Government’s latest move.
“In what universe,” Dissanayake asked, “does the accused in a crime have the privilege of raising his hand and voting in favour of a resolution that will see to it that his own criminal case will be dismissed? So, he becomes the judge in his own case?”
“The 6.9 million people who voted for this Government and gave it a two thirds majority in Parliament should think about whether they intended for this regime to use their parliamentary super majority to get their crooked cronies, murderers and criminals out of jail,” Dissanayake charged during the press briefing.
During a recent “conversation” with the village in Walpane, President Gotabaya Rajapaksa admitted that his Government was in the process of finding ways to end judicial proceedings of military officials and others accused of human rights abuses and other crimes. The President called the charges – some of them indictments filed by the Attorney General of Sri Lanka – “absurd”.
Significantly, several of the cases the Government has singled out for dismissal of judicial proceedings involves human rights crimes that the United Nations has referred to as “emblematic” cases. These include the attacks on journalists and the Navy abductions trial. As it battled against the UN Human Rights Council Resolution on Sri Lanka last month, foreign minister Dinesh Gunewardena pledged that the Government was committed to pursuing justice domestically in these cases, making the argument that the President had appointed a presidential commission to study previous commission findings on human rights abuses.(By Janakie Mediwake)

Well, this is in nothing new and astonishing, happened in post 1970 and 1977 elections. Leaving the pros and cons about the outcome, because this may be the aspiration of the majority voters who voted this government to power and if that’s the case, it is nothing but right for the government to accede to that aspiration, not withstanding what others may feel or state. This is what 6.9 million of SL voters dreamt about and PM is right in his act to realise their dreams.
People deserve and get the leaders (Govt.) they deserve. PM Rajapaksa should be congratulated on his desire to hold in esteem the election promises and winning 2/3rd majority. Nice to note that of all politicians he has a “back bone” unlike those others promising the world and doing nothing. (e.g. doing away of the Executive Presidency – 6 times promised in election manifesto and none had the stamina to do it)

This is also a manifestation of the will of the SL people in the Public Domain (Parliament of SL) to give credence of what the people/citizenry of SL desire. The UNHCR resolution on SL and any follow up action would and perhaps have to synchronise to meet with these aspirations.

Buying MIGs was a very good thing for SL. Only problem with it is the corruption element. SL purchased so many other weapons that didn’t end up like the fraudulent MIG deal and no one has a problem about them.

The signs are that there are jitters about an internal split that could deny it that option. It seems a clear sign of panic.

Also the amendment failed to explain what is meant by “false news,” by “state security,” or by “communal harmony.”

What are the avenues the Judiciary, prosecutors and investigators could pursue, when the pathway to independent assessment and oversight are removed and placed in the hands of a sole individual. Not the independent “many” as in the case of the independent commissioners appointment by the constitutional council of the parliament, formed by the participation of the Speaker, PM, Opposition Leader, Nominee of the president and independent minority party leaders in . Why was that done and at whose or which groups behest. These changes are the cause of the breakdown in Rule of Law and the proper and Independent dispensation of the Judicial process. Sure you know the people responsible and who are the ‘Powers behind the Throne’. Blame them and blame the sovereign people of the country who voted (6.9 million of them) who acceded to the call of a 2/3 majority and gave them to do whatever they want. Please remember the adage, “People get the Leaders they soundly deserve”. No wonder commentaries abound in this publication with, “Thang Sathututhe”. (Are you satisfied? with governance now).

Yes one man holds the power over the Judges, but that does not mean that the Judges have to fall at his feet. If the Judges wanted they could not follow the orders of the Big Boss. How many times can the Big Boss change the Judges. If the Judges give rulings on cases according to the oath they have taken then the Big Boss will not be able to do anything. The Judges, if they are hurt in any way they can come to the public and make statements this would be the solution for the 2nd Part of the problem you have brought up. People will not vote or even force their own MPs to cross over and make the Government fall.

I believe any number and as many number of times that may please him (Big Boss). Not only that, the question as to changing may not arise, as the result could be achieved by cohesion and importantly by coercion when you are the “only supreme power”, with no possible review by an independent body. No questions raised or intervention by an independent body of review. Instances are so many, in the past (2010 to 2015) to quote here. Recall the reason given for the need to pass the 20th Amendment, earlier last year – “Do not want Judicial review of my executive orders”. Furthermore, news has percolated, that another instance of backstage intervention by the Executive against a parliamentarian, (a PC to boot) who voiced opinion in respect of the Port City Bill in parliament yesterday morning with choice Signature Mariakade verbiage. As you claim “It is inconsequential and people would ignore and continue doing their duty undeterred”. I beg to disagree. There is no reason to think otherwise, when the Advocate, Jury and Judge, are all wrapped up in one bundle and no outlet for review.

Well there are people and people in a country and generally, some do not understand the fallout the is consequent in giving a concentration of power to a coterie (majority less educated than the voters themselves) of limited few. Some of these people/voters, could be reasonably enlightened by sound reasoning, debate and simple communication, or in a public rally/meeting, but unfortunately not the many, who are ill positioned to understand and not highly intelligent/educated to understand logical/rational reasoning. Otherwise, how come “Thrice bitten (1970, 1977, 2010 elections) and Not shy of the practice of giving 2/3 majority?” Don’t think majority cares.
These many (6.9 million voters), only understand when they undergo suffering such as living in abject hunger, poverty or devoid of shelter from sun, storm and rain for them/family. By then the damage has been done and Myanmar would not appear to be strange dream.
No use blaming any other than the 6.9 Million voters and the MP’s who crossed over to vote for the 20th.
Well, take a deep breadth to comfort for the time being and await the next opportunity to vote intelligently, IF that opportunity is forthcoming at all. Hope Myanmar precedent is not followed instead

Ah, the” together” should include ALL those turds in power since 1956 who have RUINED this WHOLE country (not RULED) – even continuing to do as of now. At least jvp had sincerity of purpose though by wrong means to achieve it.
There was an underlying cause for JVP to act as they did and it was not for personal benefit. However for all other turds it was nothing but personal benefit from stolen lucre to jobs for kith and kin.
