Rajapaksas’ Assault On The Four Pillars Of Our Democracy

The traditional three pillars on which the stability and sustenance of our working democracy rested were the Legislature, the Executive, and the Judiciary. These pillars are cemented on a hard-pressed foundation of the very source of our law, the Constitution of our country. To this robust dynamic of societal evolution was added the Free Press, the Fourth Estate. In order to dismantle this strong and firm structure, one must engineer an assault on all four elements, either individually on each pillar or as one single structure.

The Rajapaksas of the 2005 to 20014-era summoned their despicable yet formidable forces, whose existence was intricately intertwined with the survival of the Rajapaksa cabal, to undermine the pillars of a democratic State, one by one at times and all four in total at others and deliver the reins of power into the lone hands of the Executive President, Mahinda Rajapaksa. Mahinda’s fidelity to his family, especially to his immediate one comprising of his wife and three sons was excessively unyielding. At the same time, he did not have to worry about his siblings for they were all well entrenched in their own pits of corrupt and unpatriotic ventures. 

Yet, when one tries to decipher the innumerable webs the Rajapaksas had woven around their despicable cabal, one invariably finds many a move which appeared to an ordinary layman as impulsive and unplanned acts of misdeeds whose eventual target was making enormous amounts of money while getting more and more comfortable in a lap of luxurious living, bordering on erotic conduct and lustful indulgences. These luxuries were chiefly facilitated by the wealth they made at the expense of the country’s wellbeing. It was alleged that the 30%-sibling made it no secret that he would not sit down for talks with a potential dealer without 10% down at the very beginning! Then the Defense-sibling was alleged to have made it sure that all those who made it their sacred profession to let the world know about the gravity of crimes committed by his elder brother’s regime are harassed, intimidated and sometimes even killed in order to silence their voices.

When one looks at the very construct of our State- namely a Democratic Socialist Republic- sits on a fragile foundation of the ‘Constitution’, supported by the four pillars of the Legislature, Executive, the Judiciary and the Fourth Estate, it is no rocket science to find that the one most effective way to attack the stability of our State is to attack either one or all the pillars at the same time. And they did so. And they were successful until the end of 2014. At their call was the war-victory. The war-victory, most palpably, they schemed, would render them a license to ravage the country at the behest of their elder brother, President Mahinda Rajapaksa.

Let us examine how they ventured out to do just that:

The Legislature

Our Legislature constitutes of the House of Parliament. By hook or by crook, Mahinda Rajapaksa managed to secure a two thirds majority in parliament to ensure the passage of Acts and Bills to suit his egotistical requirements. MPs were bought and sold at the ‘right’ price. The honor and decorum of Parliament were debased and the likes of Mervyn Silva, who was a deranged Rajapaksa-serf but now claims to be a hero by being a critic of the Rajapaksas, were promoted to the ranks of Cabinet and States Ministers. One must never forget the way in which some parliamentarians of the United People’s Freedom Alliance (UPFA) indulged in the well of the House of Parliament, the very shrine in which the hopes and dreams of the People are shaped and realized; they desecrated the age-old traditions and profound values of a decent forum for, by and of the People.

The Executive

The Executive ran amok during the Rajapaksa rule. From ordering to the killing of the twenty seven (27) prisoners in the midst of an unarmed riot in the prison, Rathupaswela and Katunayake killings and all other dictatorial dictates of the Chief Executive, purely at the discretion of the ‘King’, the Executive branch of government during this distasteful rule of the Rajapaksas did stand trial at the 2015 Presidential Elections. And the verdict was guilty. The Rajapaksas had to retreat to Medamulana.

The Executive branch of the Rajapaksa government had one single thought in their mind. The war-victory was their cover. It’s like raping a woman after rescuing her from an unmerciful flood. That rescue was no license to rape her, period.

Following are some of the major allegations against the Rajapaksas. They were all executed under their very nose. They have been arranged in chronological order.

  • November 9 and 10, 2012 Prison attack – 27 killed 
  • On 13 January 2013 Impeachment of Chief Justice Shirani Bandaranayake
  • On 8 February 2010 by Military Police arrested General Sarath Fonseka
  • Disappearance of Prageeth Ekneligoda since 24 January 2010
  • August 1, 2013 three persons were killed including two students in Rathupaswela
  • Katunayake
  • Unanswered heinous crimes against journalists and media institutions
  • May 2008: Keith Noyahr, Associate Editor and defense columnist of The Nation newspaper was abducted and beaten up.
  • January 6, 2009: The Sirasa Depanama Studio Complex was bombed by a group of assailants.
  • January 8, 2009: Not even 48 hours after the attack on the Depanama Complex, Senior Journalist Lasantha Wickrematunge was assassinated in Atthidiya.
  • January 23, 2009: Chief Editor of the Rivira newspaper Upali Tennakoon was assaulted by a group that arrived on two motorcycles.
  • March 25, 2009: The office of the Udayan newspaper in Jaffna was attacked with a hand grenade.
  • June 1, 2009: Journalist Poddala Jayantha was abducted in Ambuldeniya, Nugegoda.
  • March 22, 2010: Attack launched on the head office of the Sirasa Media Network, leaving several of its employees injured.
  • July 30, 2010: Attack lanced on the Voice of Asia Media group which runs Siyatha TV and radio stations.
  • April 13, 2013: Head office of the Udayan newspaper attacked once again, making it the 33rd such attack on its office and journalists.

The Judiciary

Sri Lanka’s judiciary was simply taken for just a valueless pawn in the cruel and ruthless hands of those who ran the regime. The then Chief Justice Shirani Bandaranayake was humiliated and removed by a fake impeachment motion which was commenced and concluded within a couple of days. She was replaced by a Rajapaksa lackey and the independent arm of the Judiciary was within the grips of the Cabal. Unqualified men and women were appointed the Bench of Courts. Anyone who dared to oppose the Cabal were transferred or terminated. And the people just waited, not knowing how to react for the then Opposition was mute and impotent. The ‘blind lady of justice’ was molested, raped, and violated. When the judiciary in any country is being assaulted and bent to the whims and fancies of the rulers, that country becomes a ‘Rogue State’. Sri Lanka was fast approaching that state.

When the honor, legitimacy and legality of a Democratic Republic are stripped away, that Republic becomes a mere naked being. Bared open to the rest of the world, various allegations regarding the misdoings of the regime-dwellers were swept under the proverbial carpet. The Judiciary, the last line of defense of the people was being thrashed and on the verge of being demolished by the Rajapaksa regime. 

Fourth Estate (Free press)

The assault on the Free Press was unrelenting under the Rajapaksa rule. Killing of Lasantha Wickrematunge, Editor of the Sunday Leader newspaper which was merciless in criticizing the salient allegations against the First Family and its head was killed in broad daylight. And the guilty are still at large. Prageeth Ekneligoda, another critic of the Rajapaksa was abducted and the body is still missing. The two women, Sonali, Lasantha’s widow and Sandya, Prageeth’s wife are awaiting justice that never seems to arrive.

Murder of journalists of the Udayan newspaper in Jaffna stands still unresolved. From Upali Tennakoon to Poddala Jayantha, Keith Noyahr and other unnamed journalists have witnessed the brutality of a regime gone wild. 

This attack and subjugating of the four elements of a working democracy was no accident, nor was it a loosely concocted plan; it was a result of well-designed strategy aimed at total control of a people whose trust was grossly abused and destroyed.

The assault on our way of life was gruesome; it was ruthless; it was  dishonorable and ultimately it was defeated. And it must not rise again.

So, going by this one can decipher the STATE’s actions and its programs and projects to be read and understood in the context of a secret agenda working from behind that hinders the FREEDOM of the humanity to live as a kind, tolerating, supportive and a united people.

      writes under a Pen name. If he/she was to write this critique during the Rajapakse years he/she would be dead meat by now, irrespective of the anonymity. The Rajapakses of Medamulana are gangsters using every known despicable feature of the Mafiosi. As a Sri Lankan, I am ashamed there are quite a number of voters – mostly in the Sinhala South – rooting for the return of these marauding mobster family – 1st generation and 2nd. The region and the world watches wondering what a strange, twisted creature the Lankan voter is.

        I’m not going to read all of this article. How long can we go on telling our voters that selecting one of the three (My3, Ranil, or a Rajapaksa) as the next Executive President, would spell the end of Sri Lanka?

        We will end up being worse than Haiti – which was, I believe, the first independent black country in the World, following the slave rebellion? Didn’t somebody write a stirring sonnet on it, around 1810. Wordsworth was by then too conservative in his views; “mad” Shelley, may have been in terms of ideology. I’m not even googling for the information.

        Why are the enclaves of Eranawela and Kahattewela in Haputale, and not in Bandarawela? To fully understand how weird this is, please try to identify the roads on this map:

        They appear to have clearly marked “The Kahaththewela Ambalama”. I guess it’s now become a place name. It used to exist as a shelter for the poor fifty years ago. Anyway, it is about a mile from the City Centre on the road to Welimada. Residents of Sri Sangaraja Pirivena would also consider Bandarawela to be their town.

        It is worse when you consider the other main road – to Ettampitiya: the Bandarawela Hospital and the SLTB bus depot for Bandarawela are in the Haputale Pradeshiya Sabha. Greatest joke of all, the office of the Bandarawela Pradeshiya Sabha (sic) is situated in the Haputale Pradeshiya Sabha. Also in Haputale, places a “road mile” further to NNW.

        Why is this so? I ask mainly Sinhalese residents; they don’t know, but some MMCs did know, but said that it shouldn’t be openly talked about.

        The reason is this: Ariyadasa, Health Minister in the 1960s, and W.J.M. LokuBandara, who each represented the Haputale Electorate, insisted on this, so as to have some extra Sinhalese votes in the Electorate which could, otherwise, see a Tamil elected.

        I leave it to readers to work out the inconvenience to residents who have to go past the Bandarawela Divisionl Secretariat to the Haputale Secretariat which is situated in Diyatalawa. Anyone defending this?

          Dear Sinhala_Man, The is a very good info to ascertain how much damage these POLITICAL CRIMINALS have caused in their Political maneuvering and the PRESENT QUAGMIRE that the society is drenched in. If the people cannot identify the REAL ENEMY who is responsible in creating all this mess, the population will be infighting among themselves and the ELITES will be the jolly good spectators like in the ROMAN Colosseum or Flavian Amphitheatre where the RULERS pit the poor citizens fighting against one another to their deaths…. or fed to animals. This is what DS, JR, BANDA, Sirimavo, Mahinda, Premadasa, Prabhakaran, Rajapakses, Champika Ranawaka, BBS Gnanasara did by fielding their men and women in the brutal conflicts which they manufactured and delivered with devastating effects.

            I’m trying to get this corrected.
            I’m not directly affected because I’m within the Bandarawela Municipal council; Ward 1: Diyabibila, with my Grama Sevaka being Wewatenna 67G. to get in to Bandarawela town, there are two roads – both go through the “Haputale electorate” which no longer is an entity that matters.

            I’ve sent some people who live within the affected area, but they’ve shown no urgency. What has first to be changed is the Administrative Area, so the initial request has to go to the Ministry of Home Affairs at Independence Square.

            I spoke to Dr Thavalingam, the Chairman of the De-limitation Commission (the same who had their report rejected in Parliament.) He had been Surveyor-General. He told me that one of his children is married to a Sinhalese – a romance that must have developed in Diyatalawa! May there be more such.

            I’ll see if I can post couple of other weird boundaries that I’ve found, but with them I wouldn’t be able to explain the raison d’ etre. Here I’m certain. Others not so shocking, either.

              They make sense: urbanised areas often have special needs, and have Town Councils, Urban Councils, and Municipal councils. They are usually much smaller in area, and what I have observed in Uva is that the councils are packed with businessmen, who selfishly deny certain privileges to the villagers, who often commute in to the town, and provide the economic sustenance of the area.

              May I be more specific. Bandarawela used to have “Fair Square” where villagers could come any day and sell their produce. On Sunday one knew that there was a wide selection because that was the “Fair Day”. Now, a “Colombo style” supermarket occupies that space. Villagers are still allowed to turn up on Sundays, but the “Fair” is spread uncomfortably along a few surrounding roads.
              .
              There is a “Traders’ Association” that decrees that all shops must observe Saturday as the day on which all shops must give their employees the day off (that requirement was said to be owing to the “Shop Act”). If any trader tries to keep his shop open on Saturday, strong arm tactics are used against him. So, if you have some masons constructing something, and you suddenly discover that there isn’t trowel, you just can’t get one on Saturday – not even a nail, actually. This rule does not apply to Eating Houses and to Pharmacies.

              But, of course, we have one of the oldest Cargills shops in the country (it was Millers, then). Now, this year, there are three Cargills shops, – one of them is going to be huge, when complete. With a KFC and a Cargills Bank, I guess. Those are open every day of the year.

              The point I’m making is that a mafia of traders seem to control everything in the country – and end up becoming the guys who represent us in politics. I think that “the English speaking elite” ought to wake up to the fact that your problem is not with “gamaralas” who tend to be decent, but with shrewd businessmen, who end up as legislators.

              They educate their children at the local “International Schools”, so that they get te smattering of English that helps them dominate the town. Some would go for prestige rather than English, so they have transformed the “elite school” in to one where money alone counts:

      Vishwa: dream on! There is no separation of Judiciary and Parliament. Lanka is a land of Fake democracy, and bi-partisan or tri-partisan ( UNP-SLFP-TNA) corruption racket, while politics is gamed by foreign interests mainly US, India, China, Japan interests.

      So First, impeach Bondscam Ranil and his Royal college thieves as Ranil is protecting Mahinda and Gota Jarapassa.Then, arrest Jarapassa family so they can share prions cell with bond scam Ranil, then liberate Tamils from the corrupt TNA and other politicians who play money politics, US style.
      Post-war Lanka’s economy and currency is being crashed by IMF as Trumpland militarizes Lanka and Indian OCean against China.

    What would have shocked us in mid seventies have little or no effect now.
    For example the PCoI looking into SriLankan Airlines continue to unearth abject bookkeeping. This is not due to incompetence but could have occurred only if ordered from somewhere high.
    But we hardly raise an eyebrow because we have been conditioned to accept corruption/nepotism/impunity as facts of life.
    We will resign to the magic:
    Hungry hyenas IN, well-fed hyenas OUT.
    The hyenas will be fed on food meant for us.
    The well fed-hyenas will not attack us if we do not pry into….

    When one reads this kind of crap, one should be forgiven for thinking that the country is still governed by a Rajapakse. After three and a half years of a wonderful yahapalanaya, these buggers have nothing to hide their nudity & utter failure and the destruction of the economy, the governance, the public service other than continued Rajapakse bashing. It might soothe their battered egos but the populous cannot be fooled any more. They are waiting for the next available opportunity to boot this mob out lock stock and barrel.

    What about RWs assault on democracy ?

    He made the UNP into a old boys club and changed the constitution of the party to make him leader for life . Ranil keeps losing elections. The UNP has not contested the Presidency for 20 years now.

    Even today the only hope for the UNP is to not to have elections ! That is how pathetic the UNP has become with ranil

    But this so called political party keeps hoping that this old Royalist with so called family blood will take them to heaven ! Why? Because he speaks in English !

    Democracy is being destroyed by our stupidity ! Rajapakses are only abusing a system that has been perpetuated by the old elite.

    Just see the body language and the posture.All three brothers legs apart as much it goes and then see upper half of MS and MR. After years being the head of a nation still it is a give away sign of lacking etiquette and decorum.Love to see MR in this posture on a international stage sitting with other world leaders.Looks like MR is angry (not that smiling face you see in public) ,MS is getting earful ,CR is enjoying the fun, and GR is concerned.

      Exactly Chiv , Majority of cases ! And that is one reason we are either
      slow or stagnant in making any real progress . Without people looking
      at their own selves and replace wrong with right , nothing is going to
      move in the right direction . Some people are under real illusion that
      building highways will make us developed ! Just take a look at the
      Southern Expressway , Go to the Maharagama Bus stop and get off at
      Matara ! Start and the Finish ! Passengers are just without any special
      shelter at both ends for the money paid ! Old SLTB bus stands are used to
      pick up and drop off . This is the beauty of the products that we are
      offered in the name of development . Only a road for the bus ! OUR
      PEOPLE TAKE IT AS NORMAL and make the life of planners more easier
      while making their own life a nightmare with a cost ! Can you call it
      Development aimed at improving QUALITY OF LIFE ?

Expecting a disaster in the mid terms initially he tried to scar crow public by saying the stock market will crash if he loose and when that didnt make expected impact today he is predicting VIOLENCE???? following defeat.This is what crooked politicians do for a living.People like Trump (public resentment towards party politicians) and MR ( winning a war) exploited a prevailing political vacuum to grab power and are now willing to go to any extremes to hold it.Here is some more commonalities of both men, Sessions/Shirani, Comey/SF, threatening media,scare of LTTE/deep state, nepotism,surrounded by crooks , Sarath/Cohen, Eric/Namal (can go on and on).Except that US justice system and public are not the same as Lanka.Keep doing the Math.

    REMEMBERED AND THEIR FATHER MOTHER TOO !!!! It is not that easy . Their
    FATHER MOTHER NEED MUSEUMS IN THEIR HONOR and when they say
    they do things for the country , it is like the CREDIT CARD COMPANY GIVES
    MONEY TO HELP YOU ! OUR COUNTRY STILL HAS A CHANCE TO ESCAPE IF

    Why Why, I totally agree with you.With little bit of IQ and more of common sense any layman should be able to figure this out.But Lankans are so self centered and opportunistic will go against it. They who bring these crooks will be paying for the consequence.If you look at Venezuela , a country with slightly more of population and a better GDP per capita, with abundant natural resources is now brought to bankruptcy by their politicians by years of deceiving, lying, talking of communism and socialism to citizens,burrowing from China, but at the same time looting the coffers including the govt owned oil corps, and now their own citizens have been turned to refugees. See the pictures where there is mass exodus in all directions. Retarded Lankans still living in their own fantasy world not knowing the rupee is on a ventilator and dollar is on a fast moving elevator.Now in Venezuela a pound of Tomato is worth more than $500.

    When was this term ‘Fourth Estate’ invented?
    For a long time the clergy, the nobility and commoners influenced society. Of course the commoners carried the burden, the nobility the fruits and the clergy helped to keep the commoners under control and in due course made a living. With the advent of printing, the Press influenced the power share and got the name ‘Fourth Estate’.
    .
    In due course the elusive doctrine ‘Democracy’ came into vogue. The four pillars (or Estates) in that order were the Legislature, the Executive, the Judiciary and Media. The ‘Commoners’ were expected to choose the Legislature. This has turned out to be only paper-good. The Media has become a tool in the hands of manipulators. “Media’ has become uncontrollable sources of Fake-News, Alt-News etc. etc.

    In our brand of ‘Democracy’, corruption/nepotism/impunity has taken root. We continue electing the Legislature based on language/religion-divide.
    Are we going back to the ‘clergy/nobility/commoners’ governance?

    Today news. SL court orders arrest of top military official for abduction and killing of 11 civilians during war.(obviously he will be found innocent by our courts on technicality or lack of evidence??) Myanmar army rejects UN findings by producing fake photos and distorting facts in sinister move.UN found Myanmar regime and military responsible of genocide. Guys does these facts seems familiar to any one.Now the Lankans wants people to believe that these are not real facts and even so the then regime is not responsible.

    Well said, but Sri Lanka had never been a democracy. May be, there had been some elements of democratic principles but Sri Lanka is not a democratic society in essence. Rightly said it would come close to an “Ethnocracy” a society ruled by religious, ethnic priorities. Sri Lanka will never achieve the ideals of a democratic society. Call me a pessimist or whatever, I am damn sure about it.
