        Contempt of court is the accusaton on RR to be a prisoner for 4 years. But those who are in power should be prisoned for 100 years considering the size of high crimes they deliberately committed.

      Ranjan is right. He proved that courts and srlanken judges are govt lackeys. This was not the case in previous govt, however, immediately CRIMINALs took the office, almost everything in this country became UPSIDE down.

      This verdict will create lot more new crisis in the days to come. Ranjan has not committed crimes, but Gota, Namal, Mahinda, Basil and all are equally more criminal.

    This is such disgusting thing to do. Ranjan might not have conducted himself properly in certain circumstances and he might have led his passion for the cause get the better if him. But compared to the rapists, murderers, dig dealers all being set free and given seats in parliament because they’re connected to the ruling family is nothing.

    Is there any way the Judges could be judged?. If so by whom and how.? Please clarify.
    The article which appeared in the Sunday Times of 19/5/ 19 under the caption “Efficiency and efficacy in administration of Justice important for public confidence: CJ.”
    Apparently, this speech by the Chef Justice throws some light on the State of the Judiciary, as understood by a layman.

      If it is any consolation I will repeat an anecdote apparently relating to a court of law in India.
      A litigant protested to a judge about what he thought was an unfair verdict. The judge responded “Son, this is a Court of Law not a Court of Justice”.
      The Tamil term for Court of Law is misleading I guess.

    Judges make decisions. Even these decisions can be human errors. But at some point the quality of the judgement can changes from wrong to wrongful. At this point the judgement is no more a human error but an intended wrongful judgement. Ranjan’s judgement does it fall into wrong or wrongful judgement or even a correct judgement?
    If its a wrongful judgement that too from the Supreme Court, then there is no further appeal process hence only action available is the informal criticism by lawyers, academics, religious leaders and members of the civil society. Although this has no power of authority but provides a platform not only for Sri Lankans but also to the international community to display the standard of Judiciary in Sri Lanka and also would give an opportunity to ensure such wrongful decisions are not given in the future.
    In my opinion what Ranjan said was not a contempt of court but a fact even a child in Sri Lanka would say. Classic examples – the same lawyers who were acting for the accused when they become judges they sit on the bench deciding on the same case; former Chief Justice Sarath N. Silva coming out in public and asking the pardon from the people for a wrongful judgement he gave in Mahinda’s Tsunami Fund robbery case etc

        The charges against Ranjan is that he called the Judges corrupt. Which means the case is against Ranjan and the Judges. Hence, its the duty of the Judges to prove in court that they are not corrupt. But this did not happen. No Judge proved that Judges are not corrupt. So how can this be a contempt of court?

      The question here concerns contempt of court.
      SB Dissanayake was, and Ranil W made a deal with CBK about letting a very senior judge off the hook in return for pardoning SBD. Ranil honoured his words, but CBK did not and SBD served his term.
      It is risky if not reckless to make derogatory statements about the judiciary. Even questioning a judgment can be construed as contempt of court.

    These contempt of court punishments are way too high.
    In Ranjan’s case maximum four weeks would be sufficient.
    When Gnanasara hamuduruwo got SIX years of RIGOROUS IMPRISONMENT for his rowdy behaviour in court yard I felt too bad.
    Then he was fully pardoned which was the other extreme.
    What should have been done was to cut down the period from six years to something like six months.
    OBVIOUSLY PUNISHMENT MUST BE IN PROPORTION TO THE GRAVITY OF THE MISDEED.

        I don’t blame the judges.
        They interpret the law based on the arguments presented by prosecution and defence and prescribe the medicine in the book BLIND FOLDED.
        You and poor Ranjan seem to harbour a wrong notion.
        That judges are 95% corrupt.
        No. Only 5% of the judges are corrupt.
        It is our prosecution which is 95% corrupt. They get the call from the higher-ups or accept a bribe and prepare the case in such a way that it will be lost. Judges are helpless.
        As for the level of punishment it is the responsibility of the legal fraternity as a whole to amend them from time to time. Again judges are helpless, thought at times you feel that they don’t exercise any discretion left in their hands.

          I have no doubt not only 95% judges bearing SINHALA genome together with lawyers are highly corrupted. THey are called ” crows”. They would do anything and everything so long they are well paid. They are like the decaying worms in a Kunukanda. I have no doubt, divine retribution will work on RR’s imprisonment. As you added, if he is wrong, not long than 6 months imprisonment would have been more than enough. I dont live in that HELL, but this sends a message across the country that only highly corrupted men and women would have more chance among the uncorrupted or less corrupted in the country, which is now cited as number one country to have been caught by CHINESE debt trap.

He draw his gun on Marrikar while women and children watching in horror. Pillaiyan said Old King hired him as hit man to murder New King; now he is an MP direct from Prison cell. 4 SC justices recued them from Mig case. The crooks are saving each other from both aisles. A convicted murderer was brought from prison and made minister. If these not judicial corruption, hen what is it?

    Ranjan Ramanayake is a foolish man who went around saying this one is a rogue, that one is a rogue without providing any evidence that can be shown in a court.

    Telephone recordings don’t prove anything, they only embarrass.Ranjan is no investigator, only a fool out of his depth.

    This is typical Sinhalese “gon” talk, something Sri Lankans will get an A for ! ( Their only A !)

    On the other hand, the courts also have shown they are very much a part of this empty system, there is no proportionality or justice when they punish a fool for just talking.

    A general statement like ” courts are corrupt or lawyers are corrupt” is just hot air. When the supreme court of a country reacts so strongly to such a statement , we feel that civilization is now coming to an end.

    Courts are maintained with tax payer money and should be slow to punish its critics. Many of our judgements get reversed in appeal. In this case there is no appeal ! Is that justice ?

    A day will soon come when parliament also will punish its critics. Then the government, the police , the army will punish their critics.

    Perera Vs The King
    In the said case Perera being a Member of the House of Representative of Ceylon paid a visit to theRemand Prison in Colomboand made the following observation in the Prison Visitors‟ Book. “Visited Remand Prison in the company of Jailor Wijewardena. Premises clean. Adequate library facilities required. The present practice of appeals of Remand prisoners being heard in their absence is not healthy. When represented by Counsel or otherwise the prisoner should be present at proceedings. In my opinion not more than one prisoner should be in a cell (7×9) approximately
    The statement is incorrect and is a contempt of the Court. Issue a rule on Perera returnable on Tuesday the 25th. I shall sit specially on that day.”
    The Privy Council in appeal set aside the conviction and the sentence and held as follows. “Finally his criticism was honest criticism on a matter of public importance. When these and no other are the circumstances that attend the action complained of there cannot be Contempt of Court.”
    Cam somebody tell me that, if Privy Council appeal is possible in this case, what would be their decision?

    The words “corrupt” or “money” cannot be interpreted that a libel statement by Ranjan-illegally made of any illegal action on any Judges. If the court defines the money as bribe, and corrupted as criminals, then it can lead to a serious consequence in future. Those words tell what Ranjan made was an opinion, not interested to make statement under oath. There cannot be a case against a person who had avoided using word to implicate that judges are taking bribes so they are criminals. It is common opinion in Lankawe the 800,000 cases are pending because the fault of lawyers and judges. Sumanthiran PC argued that the SC had no business to investigate this contempt case as it is not investigable. The explanation given was contempt of CoA & SC can be investigated. Ranjan’s opinion included 95% of the judges so are including the Supreme Court justices, but they only a tiny percentage of all judges. The Court must give the benefit of doubt to respondent. Apex Court lacks preciseness in its statements Apparently Ranjan didn’t say that and it is obvious he did not intended to drag Supreme Court Justices- who are always s referred as justices. BASL, which convulsed to knap Ranjan, in few months will regret for their mistake for failing him to save.

    This is a very sad verdict to be shoved down the throats of all Srilankans. They have found the Messenger guilty instead of rectifying an inherent grievous aberration within the Justice System of Srilanka. As a representative of the people we must be full of gratitude to Hon. Mr. Ranjan Ramanayke to have made a bold remark without any fear or reservation as I can stand up high and vouch that what the gentleman said is perfectly true. There is definite obvious defect in the dispensation of justice in the country because it allows sharks to swim away happily but only netting the tiny sprats.

    I am a plaint of a daylight robbery because the local Police refused to bring criminal charges against the criminals because it was under their siege. Overcoming insurmountable hurdles, at the conclusion of the trial the factual evidence of the case got faithfully recorded in the court documents like it would be in a recording by a security CCTV camera in perfect clarity how the bank heist took place.

    The DC judge was bribed to accept the defense counter claim even though it was a treasonable act. This judge was forced to resign not connected with this case but other acts of similar nature and kept secret.

    The Chief Justice with vested interests prevailed on the two high court judges to confirm the DC Order.

      I see the light at the end of the tunnel on his release. I have no doubt, drans would be welcome Rajapakshes sooner than later, We perfectly know the verdict is based on REVENGEFUL acts of current govt. This was not overlooked in arbitory case such as of FM Sarath fonseka. Today, if media would work on promotion of PRO-SUPPRESSION, this country would nothave any chance to achieve anything.

The ears of the Ministers of Justice, Attorney Generals and the Chief Justices are plugged by the criminal Mafia. In addition the judiciary is covering up a murder. The complaints to the CID, OCPD, Police Commission, Presidential Bribery Commission, the Bribery Commission and The Ombudsman say they are powerless to interfere with Court matters. Judicial Service Commission informed me after waiting for 8 months to go find a lawyer. But all the lawyers I solicited tell me there is no legal provision to appeal. A country stands on three legs. When the third leg crumbles wither is the country??

    This is typical doublespeak. Sri Lanka’s justice system has become a mechanism for enabling individuals – who have high connections, political influence, or money to offer bribes – to commit crimes and go scot free. It also enables the victimisation of those who dare to lock horns with the powers that be in pursuit of justice. The entire criminal justice system – police, legal profession, JMO, judiciary, and prison – is open for games and deals as long as you have the necessary influence and money. Witnesses can be influenced, terrorized or eliminated. Evidence can be destroyed or fabricated. Those wielding power can intimidate the police officers, the prosecution and the judges. Cover-ups and obstruction of justice are not uncommon. Legal loopholes can always be found to deny justice to the victims of crime. At the same time even innocent people can be brought before the courts on false charges and fabricated evidence and wrongfully convicted. Or, while waiting for trial they can get killed in remand prison.

    So who is guilty of contempt of court? Aren’t the personnel involved at various levels of this system of (miscarriage of) justice guilty of contempt? Or is it the person who has a sense of civic duty and exercises his democratic right to criticise this massive failure of justice guilty of contempt of court?

    I write with great pain to see that judges in Sri Lanka are people with no integrity in their judicial arbitrations. There is no need to send RR for this long. They should have given 6 months maximum of accepted an apology instead.

    There is no head or tail in this concept of contempt of court and an absurd jurisdictional power which should be considered archaic and outdated in the modern world.

    If you want to go by the underlying principle that remarks regarding judiciary undermines public confidence, there are other more important institutions that should be protected too, not only the judiciary.

    Pathetic judges and more pathetic judgement. Need to carve out a mechanism to get RR out soon, but not beg the executive Nandasena.

      I think that there must be a loud public out cry by all the people in unanimity demanding to rescind this absurd sentence although it may not be palatable to the judges but what he said is the gospel truth. The Justice means establishment of the truth, only the truth and nothing but truth. My own personal encounter with them confirms that they are vultures in black coats.

    Since the new Minister of Justice Ali Sabry took over as Minister the legal system and the Judiciary has reached the bottom. The situation was never so bad ever in the history of Sri Lanka.
