Report On Constitutional Reforms To Be Handed Over to Prime Minister

The Public Representation Committee on Constitutional Reforms will hand over it’s report to Prime Minister Ranil Wickremesinghe later this month, for further action.

In a statement issued today, Lal Wijenayake, Chairman of the committee said that once the report is handed over to the Prime Minister, it will be made available to the public on www.yourconstitution.lk.

According to Wijenayake, the decision to hand over the report was taken at a meeting held on May 12, where it was decided to hand over the report between the 23rd and 28th of this month, along with the Sinhala and Tamil translations based on the representations made on the constitutional reforms before the committee.

“It was also decided at the discussion that about 5000 documents presented to the committee, some of which are very valuable documents submitted by political scientists, constitutional lawyers and academics which are now in our data base, and all oral submissions made by 2216 persons / organizations that appeared before the committee, be handed over to the Secretariat of the Constitutional Assembly to be used in the constitution making process,” he said in the statement.

Wijenayake also added that it decided to discuss with the Steering Committee of the Constitutional Assembly as to how the members of the Public Representation Committee on Constitutional Reforms can work with the Steering Committee in the future.

    TNA Leader has been reported several times as having said that there will be a Political Solution with the adoption of the New Constitution! He of-course is a seasoned Politician and he knows what he is talking about;
    If it is designed to bridge the gap between Sinhala-Tamil relationship,well and Good. If not,it will be a case of too little too late!

      3. Please Reform the Sri Lankan Muslim Marriage and Divorce Act. What is in the books now is Slavery, Child Abuse, Child Rape and Chattel Trading, with the full approval of the Ulama and Quazi Judges.

      a) Do you know a Sri Lankan Muslim Girl can be married if she is 12 years of age or under?

      b) Do you know a Sri Lankan Muslim Girl’s permission is not needed to be married to an older man if she is 12 years of age or under?

      c) Do you know a Sri Lankan Muslim Girl’s permission is not needed to be married to an older man if she is One -day old, 12 years old, or 18 years old?

      d) Do you know a Sri Lankan Muslim Girl is considered Chattel, Property, by her guardian, Wali, and her permission is not needed to be married to an older man if she is 12 years of age or under or over?

      e) Do you know a Sri Lankan Muslim Girl is considered Chattel, Property, by her guardian, Wali, and her permission is not needed to be married to an older man if she is 12 years of age or under or over, and the Girl does not sign the marriage, as it is a Chattel Contract between the Wali, Guardian and the Man?

      Why not Check the Sri Lankan Marriage Registration form put out by the Sri Lankan State, the so-called Democratic Socialist Republic of Sri Lanka.

    I gave comments for very important issues. Today I have swept under the carpet.No one want to keep contact with me.Therefore I am at a corner. I do not deserve that treatment.

    Lal Wijenayake always worked for national unity, fair treatment of all communities and betterment of the ordinary masses and the country. The government must take note of his sincere work and do the needful to lift the country out of corruption and poverty for which a constitution based on fairness and justice to all must be adopted. If we had a leader as sincere and honest as Lal we would have been ahead of even Singapore in economic achievement.

    I would like to propose that the human rights adopted in the 1978 Costitution does not provided adquate provisions to the persons who are subject to violation of their FR by police and other government officers executive actions. Therefore the new constitution should be drafted giving provisions to take court actions by the affected persons specifically against(but not whole sale) , all politicians, govrnment officers, judicial officers, provincial concillors, local government officers and other officers of the public corporations etc.

    The other factor is the time given to file FR actions is limited to one month , This is no way sufficient and therefore at least 6 month period be given to file action whose FR violated.

    The other important factor is FR cases have to be filed in supreme court and there is no opportunity to the aggreived parties to appeal against such decisions and lawyers charge huge fees for such cases.
    It is high time to hear FR cases in the provinvial high courts or provincial appellate courts paving way to poors to enjoy their F Rights truely and democratically.

    Above all, going by the status of our parliamentarians, they are not suitable to draft, debate and design the new constitution. Ideally a civil organization like Bar Association should be given that opportunity and allow for general public to debate. This report could be also taken up then.

    Another issue to note is that the affected party is general public in the hands of public servants. War also is a creation against public order. Hence it is proper to decide to hand over constitution drafting to a civil professional organization.
