Returning Land To Civilians Is A Promise That Needs Follow Up

Soon after his return from New York where he addressed the UN General Assembly, President Maithripala Sirisena ordered the return of all land in the Northern and Eastern provinces that are owned by the people of those areas. He issued these instructions during a meeting of the Presidential Task Force overlooking the development of the Northern and Eastern provinces. The President has instructed the Presidential Task Force to plan out a time frame and a proper structure in order to implement the project and to present its progress at the next meeting. This is in keeping with the letter and spirit of UN Human Rights Council Resolution 30/1 of October 2015. When the president announced that he would go to New York and propose a new course of action before the UN, it was assumed that he might be taking a contrary course of action. Many nationalists hoped that he might announce that Sri Lanka would withdraw its assent to that resolution that immediately became a political matter of much contestation within the country.

The co-sponsored resolution 30/ 1 which calls on Sri Lanka to implement provisions relating to transitional justice remains a subject of much criticism by the opposition. Among others, the resolution has called for the return of all military occupied land and a host of other reforms that would reduce the role of the security forces in the governance of the former war zones of the North and East. It also has many other features, relevant to transitional justice, such as making national laws be in compliance with international standards, including the Prevention of Terrorism Act, and also with regard to a constitutional settlement relating to inter-ethnic power sharing. In New York, the president limited his proposal to requesting the international community to respect Sri Lanka’s sovereignty and to appreciate the positive changes that have been taking place in the country.

There is a tendency within the country to downplay the positive changes brought about by the government and instead to focus attention on what has not changed. This is notable both in the North and South of the country. What the government has achieved in terms of the Rule of Law, end to enforced disappearances and killings, and the amicable working relations the government has with the political representatives of the ethnic minorities, is a break with the past. In this context, the anticipated meeting between President Sirisena and former president Mahinda Rajapaksa is unlikely to bear much fruit, let alone bear fruit for the political coalition they are said to be negotiating on. A meeting of hearts and minds does not appear to be possible at the present time, when each of these two political rivals have to be thinking of their electoral prospects.

Incompatible Partners 

President Sirisena’s declaration that all civilian land will be returned to the people, whether it happens or not, is an indicator that the current thinking of the president and former president are too far apart to be bridged. Former president Rajapaksa continues to hold to the old stance that cost him the presidential election of 2015. The unwavering stance of the former president has been that the forces of national division are on rise, traitors are becoming more prominent, and that the unity of the country is at stake. He has also held that the hard fought military victory over the LTTE in 2009 is being surrendered by the current government which is overly subservient to the international community. He has also affirmed that he will not have any alliance with those who are traitors. President Sirisena’s recent call for the return of all land held by the military in the North and East of the country is at variance with the former president’s exhortations.

With the president ordering the return of land to the Tamil civilians from whom it was taken away, the room for the president and former president to even stand together on the same political platform is remote. However, it is worth noting that the return of military occupied land has been taking place even prior to the change of government in 2015. The previous government also returned land to the people. But neither they nor the present government have been able to resolve the issue. If not for the personality clash it would seem that there is a widespread consensus among the more liberal members of parliament and the national polity and the intelligentsia of the country that this ethnic conflict needs to be brought to a mutually acceptable end.

The problem for the president is that his words have suffered a crisis of confidence. This year alone the president has promised to return the land in January, March and August at different platforms. Three years ago the president visited the North and made a passionate promise to return all land back to the people within six months. But now another two years have elapsed and the job has yet to be done. This has been at the cost of the president’s credibility with the very people who turned out in their numbers to give one of the highest proportions of voter participation at a presidential elections in the North and East and where he swept the polls. With presidential elections due in less than fourteen months the president needs to be more serious this time.

No Future

However, the government needs to go further than simply returning the land to the people if it is to do justice by them and win their hearts and minds. Last week I was in Myliddy in the Jaffna peninsula which is near the high security zones of Palaly airport and Kankesanthurai harbour. This was one of the first areas of land to be taken over the military nearly three decades ago. It has also been one the last areas to be handed back to its civilian owners within the last year. As it is near to the high security zones of the airport and harbor, the people believe that the military did not intend to return this land to them at all. In 2012, three years after the war had ended, bulldozers entered the land and completely flattened all remaining buildings, which in any event had become dilapidated due to being vacant for close to three decades.

Remarkably the people who had returned to their homes to find nothing remaining, not even the boundaries that separated their properties, did not show any sign of racial hatred to the ethnic Sinhalese in their midst. This is a phenomenon that most who go to the North and East would experience, that there remains goodwill and the children will be friendly which shows that their parents have not taught them to hate. But surely within their hearts there would be bitter feelings, perhaps directed more at those institutions that failed them than at individuals. The destruction of their homes, places of religious worship, convents, schools, and even cemeteries has scarred them. They even said that cesspits had been connected to the remaining wells preventing them from using the water. These are the wounds that need to be healed.

The resettled people need to be helped and the Sri Lankan state needs to show it cares. They are being helped by numerous state agencies, and civil society and international organisations. But it is only the government that can make the heavy investments in infrastructure that are urgently needed at this time. When asked to rank their top five priorities in terms of their material lives, the people gave public transport, access to nearby schools, hospitals, job opportunities, water and electricity as their priority concerns. As an example of the hardship of their daily lives, they said that to get the nearest primary school they had to walk two and a half kilometers and the nearest secondary school was twelve kilometers away. They said that the military had put up a board two weeks ago saying “No future without forgiveness.” There is also a need for repentance, reparations and justice for forgiveness, that ideal state, to become a reality.

    Why are you and you Human Rights industry silent about any lack of investigation and arrest of those responsible for anti-Muslim violence and hate speech. Mahasohon Balakaya leader Amith had connections to DIG and CID intelligence so he is being protected. The riots were organized via Facebook and social media by Bondscam Ranil’s foreign backers to distract civil society from Bondscam Ranil’s Financial Crimes at Central Bank and need for him to be impeached. Sri Lanka needs to get rid of Ranil and Mahinda who he protects and this generation of corrupt politician.

      Laxmi, TNA has been fully supporting UNP’s corruption racket, playing ball for past 3 years with New Constitution talk shops. TNA has taken duty free permits, bribes etc. from Bondscam Ranil.
      Rather than making it their highest priority to ensure that homes for war affected folk are build properly and efficiently, and exposing Swaminathan properly TNA have kicked the ball – the housing problem or years.

      The TNA’s new constitution is a huge waste of time and resources, mainly to pander to Tamil Diaspora to distract from the real problems of Tamils who are suffering without proper homes in northeast. A new constitution is the Fake Reconciliation agenda of Donors and NGO like Jehan’s..

    Land is returned to the civilians with lots of fanfare and then , after a week or two, may be even a month it is again , taken over by the armed forces with some sort of flimsy excuse that it is needed for security purposes. If not it will be the Department of Land/Forestry stating that this land is now being rezoned. Failing all this , the department of Archaeology arrives here accompanied by Buddhist monks with all the necessary fanfare , claiming that these lands , were ancient Sinhalese Buddhist lands( sic) and there is evidence of this and pretend to start digging , cordoning all these lands and barring the legal owners from entering these land but not rabid Buddhist monks planting Budda statues. Even ancient Hindu temples and their lands or not spared. They plant Buddhist artefacts and then pretend to find them and claim , there is proof that all these lands were Sinhalese during ancient times( but no history of Sinhalese ever living in these lands , even from their Mahavamsa fable) . The Occupying Sinhalese armed forces, the Department of Forestry/Land and Archaeological department all full of hardline Sinhalese extremists . closely coordinate and are in cohorts with each other , to plunder these ancient Tamil lands , that were part of the Tamil Jaffna kingdom or the eastern Vannimanai chiefdoms,. many privately owned by Tamils, under some excuse or other, security. rezoning or fake proof /history of imagined Sinhalese Buddhist presence in these lands and hand these lands to , Sinhalese colonists from South.

    contd: After the defeat of the LTTE , they are now trying to revive the plot hatched by Mahaveli Department , headed by the late Gamini Dissanaicke , who under the guise of Mahaveli development wanted colonise large swathes of Tamil lands in the north and east with Sinhalese and only leave the Jaffna, killnochchi and northern Mullativu as Tamil majority in vastly reduced Northern province , that will be only Tamil. All other areas to be made Sinhalese majority. Vavuniya , Trincomallee, Mannar, Southern Mullaitivu now called Welioya( this is what they trying hard to do to Mullaitivu). Tamil majority Batticlaoa and largely Tamil Muslim coastal Amparai to be merged as one province but separated from the vastly reduced in area northern Province by newly created Sinhalese majority district by the colonists. These were called Maduru Oya , Weli Oya and I think Yan Oya or some other Oya schemes and was kept top secret but was leaked out and was stopped and then the 30 year war with LTTE started and all these Tamil lands were saved. They are now reviving this under another guise but the same diabolical scheme. Instead reconciling and creating peace and prosperity , all most Sinhalese think is how destroy the island’s Tamil , their language , identity and history and steal their lands. They will even sleep with devil ( Hindia or China ) sell and destroy the island to achieve this.

    Jehan if your only land /house for taken away from you say for 8 years (since the end of conflict), in some cases more than 20 to 30 years what is the chances of yours and your families survival. Thousands of innocent people are facing this simple question without any answers. The actual answer is “When there is no will there is no way”. There is no point in having extensive discussions, commissions, meetings, Geneva visits and all other eye wash (SHAM)

      Yes, Chingkallams have ,been talking and talking from the time of independence with the Thamizh , or pretending to talk , whilst using the armed forces , police and state resources to steal more and more Tamil lands. It started with Amparai then Pattipallai Aru( Gal Oya) then went to Kanatalai , Komaran kadavai, Allai and many other areas in Trincomallee , then Manal Aru ( Weli Oya) in Mullaitive and many other places. All the time talking or pretending to talk but stealing more and more Thamizh lands , whilst talking and when you come to next pretend talks , Chingkallams say now too late, we have stolen all these lands from you during the last talks , as there was no solution , to our hoodwink pretend talks, that we do to hoodwink the world and buy more time to steal more Thamizh lands for Chingkallams. Now these lands are not Thamizh anymore but Chingkallam and cannot be returned or taken into account but we can still talk or pretend to talk, with regards to the remaining Thamizh lands , as we need more time to steal them too, whilst we talk and until everything is stolen and there is nothing to talk of. This is what they have been doing and are still doing . Talk, Talk or pretend to talk but no walk or pretend to walk towards a solution, as they keep on stealing Thamizh lands during their pretend talks and until there is no more and then there will be no more talk. Thamizh were 28% at the time of independence now reduced to 16% during all the pretend talk in the last 60 years. 30% -40% of Thamizh land stolen during the past 60 years and still talking to steal the remaining 60-70%

    Sinhala political leadership always threaten Sinhalese with security. There was not a single security threat from outside to Srilanka. Srilanka had rebellions from both Sinhalese and Tamil militants against Sinhalese leadership which is the fundamental threat to Srilanka. Srilanka signed an agreement with India and invited Indian military to oppress its own citizens during both Sinhala and Tamil youth rebellion. Rajapakse invited China and handed over lots of land to secure his power. Ranil Government did the same and now every citizen is in debt for China, India and USA. There is not a Sinhalesse leadership who is willing to talk about the rights of Sinhalese or Tamils who oppressed by the political leadership in this land. Every leader Srilanka had invested in many western countries and they are prepared to run away this land if a real threat to this country. They create fear among Sinhalese in order to rob this country and keep the people in continuous poverty.

    The language/religion-divide creators would never have anticipated that the issue of lands occupied by the Armed Services will turn out to be a vote catcher.
    During the civil war the Armed Services occupied civilian properties for ‘reasons of security’. MR encouraged the Armed Services to go into business ventures and turned a blind eye to the land grabbing to continue after the civil war ended.
    Lankan Armed Services has evolved into an autonomous mono-ethnic body. They are in a position to flout GoSL instruction to release the properties back to the owners.

    The MR-team is the win-win. Even thoughts of releasing the lands back has been made ‘unpatriotic. The loyalty of the Armed Services is a bonus.

    Before Sira went to UN, the TNA CM, Mr Wigneswaran demanded that the Government release all Lands from Jaffna to Pasikuda to Tamils…

    Jaffna to Pasikuda is a long way, because I did that trip last X Mas along the the Coast..
    And it is Pristine Real Estate which must be worth God Knows how much, when Dr Ranil brings in the ETCA.

    How come Sinhala People have no such Land even Inland , let alone along the Coast where the Real Estate costs Big Bux …

Chingkallams also have pristine beautiful beaches along the western and southern coasts and beautiful mountain scenarios in the central highlands, Chingkallam also occupy the fertile 70% land mass, whilst the Thamizh areas are all in the dry zone.           Balangoda man was a Mongoloid- Austro Asiatic. They spoke an Austro Asiatic language. A lot of their words still remain in Vadda , Ancient Helaand Sinhala falk spoken language. Atha, Kakula, Bada, Homba Kata Muna, Gaha , Kola, Dola, Bola, Gala, are few examples.

            Aruna Bandara! Your family name Bandara is derived from the Tamil caste name Pandarar . Like most Kandyan upper castes and aristocrats you are of recent immigrant Tamil South Indian origin. Hela is the Prakritised or Pali version of one of the ancient Tamil/Dravidian name for the island Eelam/Eezham. Meaning the land of gold/metal or toddy. Elu as well as the Vedda language, as well as old Sinhalese or Hela ( Elu+ Prakrit) were all very close to their Tamil mother in structure and pronunciation, compared to modern Sinhalese , that has now been deliberately Sanskritised. Even now 35-40% of modern Sinhalese vocabulary is purely derived from Tamil and its alphabet ,grammar lexicon and sytax is 100% Tamil derived. Stop posting garbage under various identity.

          The representatives of Tamils repeatedly have said Sinhalese and Buddhists always could buy their land anywhere in the areas where they consider as their habitat provided they pay the market price.     What the author fails to take into account is that a politician would say and act purely for his advantage. Fairness, justice etc. will take a backstage.     Lands are property of Government. Wherever Situated. That means property of the Nation. When destributed there should be criteria. I think those should be distributed as per population ratio. Not only for tamils who came here as Dutch slaves. but it should be distributed among Locals or Adivasin community first. Then if there is any balances not needed for government usage can be distributed among others as per population ratio.That is very fair deal.
