Royal Institute: Recruitment Of Retired Major General Kamal Gunaratne Backfires – SC Orders Nugegoda Branch Demolished

Royal Institute’s gamble of recruiting Retired Major General Kamal Gunaratne as its Administration Director to boost its business backfired, as besides unlawfully terminating children and causing disharmony among parents, the Supreme Court of Sri Lanka in a ruling ordered the demolition of its unlawfully erected Nugegoda Branch building and cancelling of its operating license yesterday.

Businessman Chairman of Royal Institute G.T. Bandara’s recruitment of an Administration Director in retired Major General Kamal Gunaratne continued to make negative media headlines ever since he was hired.

In series of articles published recently, Colombo Telegraph revealed as to how the Retired Major General Kamal Gunaratne began unlawfully terminating school children, incarcerating and intimidating kids for nonpayment of school fees and attempted to muscle his way using emotional blackmailing tactics to extort exorbitant school fees from parents.

The enormous hiking of school fees annually against contractual obligations, to incarcerating and intimidating children in classrooms and refusing them to follow classes for non-payment of school fees and the illegal termination of two children whose parents were the spokespersons for their kids respective branches brought negative publicity to Royal Institute, which has been in business since 1971.

One such tactic that the Retired Major General Gunaratne attempted, saw the wrath of many parents who went in numbers and filed cases against the school at the Women and Children’s section of the Mirihana Police Station for the unlawful punishment meted out to their kids, besides having them subjected to intimidation by external Security Personnel specially brought in for the day for this purpose.

Cases have now been filed against the school at the Children’s Court in Battaramulla, Ministry of Education, President’s Office, the office of the Inspector General of Police, Human Rights Commission and the National Child Protection Authority.

A further case was filed by the parents with the Consumer Affairs Authority stating 34 reasons, ranging from illegal collection of funds and being provided with bogus receipts to unsafe safety practices maintained by the school at its Nugegoda Branch.

Meanwhile one of the parents who was a representative for the parents group at the Nugegoda Branch suffered the consequences for the vocal role he played.

This is as the Retired Major General Kamal Gunaratne ordered that his 12 year old child be ejected from the school barely two months into the term for non-payment of term fees and also stating that the parent was causing too many issues with the school’s management.

The referred term for non-payment of term fees was from January to April 2019 and the child was terminated midway on the 26th of February 2019. Whilst Royal Institute offers parents to pay term fees during the term, even though late but with a penalty, this facility was not offered to this parent.

The parent speaking to Colombo Telegraph on condition of anonymity as he himself has now filed a case against the school said “I sent a letter by registered post requesting the school principal to provide me with the leaving certificate for my child. As I got no reply I proceeded to meet the Principal in his office at the Nugegoda Branch. He then said that he has got strict instructions not to provide a leaving certificate to me until I pay a whopping amount of Rs 54,000 as the so called pending school fees as claimed by them. In December 2018, I got an Invoice for Rs 37,000, which I delayed paying for the term January to April. However on the 26th of February 2019, I received a letter from the school stating that they have terminated my 12 year old son, as a student for non-payment of school fees. Now in March 2019, I get another invoice asking me to pay an increased sum of a further Rs 17,000 despite them not allowing my son to finish the full term. The Principal told me that Kamal Gunaratne had provided firm instructions that if ever a leaving certificate is to be given for my son, he wants me to come to his office personally so that he could intimidate and belittle me before providing the leaving certificate. This is the current predicament I am faced with. I was the voice for all the parents of the Nugegoda Branch and now I am pretty much on my own having to fight my own battle”.

Meanwhile yesterday the illegally constructed building that housed the Nugegoda Branch of Royal Institute was ordered to be demolished and the business license to operate an international school in that premise was also ordered cancelled by the three member judge bench of the Supreme Court comprising of Justices Sisira de Abrew, Priyantha Jayawardena and L.T.B Dehideniya.

The ruling was given by the judges as 16 residents of Chapel Lane Nugegoda filed a Fundamental Rights case bearing number SC/FR 621/2010, for the illegal manner that the school had been built besides operating an International school illegally without a license.

The complainants sought relief to demolish all illegal constructions pertaining to the buildings on premises bearing assessment Nos.10 and 12 Chapel Lane Nugegoda, to cancel all the permits (if any) granted to Royal Institute to carry on business of International School Chapel Lane, Nugegoda and an order to take steps to evict Royal Institute from premises situated at Chapel Lane, Nugegoda.

This was as their fundamental rights as residents of the neighbourhood were being violated in many ways.

Citing certain technical clauses to substantiate their case, they highlighted the fact that Royal Institute Nugegoda Branch was wrongfully carrying on a business of an International School in contravention of the Development Plan – Sri Jayewardenepura Kotte Municipal Council Area (Zoning Regulations) 2008-2020 and that the said Chapel Lane is situated in a Mixed Development Zone and educational institutes are not permitted to be established there.

The complainants also stated that the school was illegally constructing a fourteen storied building on approximately 25 perches of land bearing assessment No.12 Chapel Lane abutting a twenty feet road.

Another reason stated was that the residents were being greatly inconvenienced especially due to traffic congestion which has hampered daily activities of the residents. The noise caused by the said school and the traffic congestion have made residing and travelling along the said Chapel Lane a near impossibility.

The Judge reading out the verdict, ordered the Urban Development Authority and the Municipal Council of Sri Jayewardenepura Kotte, who as the 1st and 2nd respondents in the case to demolish all illegal constructions pertaining to the buildings on premises bearing assessment Nos.10 and 12, Chapel Lane, Nugegoda and for the Municipal Council of Sri Jayewardenepura Kotte to cancel all permits (if any) granted to Royal Institute, the 9th Respondent in the case, to carry on business of an International School at Chapel Lane Nugegoda.

They were provided three months to carry out this order given by the Supreme Court.

During the Supreme Court proceedings it was also stated that the Royal Institute did not have a license to operate an International School at the said premises at Chapel Road Nugegoda.

The license that the Royal Institute of the Nugegoda Branch had was to merely conduct computer classes and also conduct English lessons.

A parent of a student studying at Royal Institute’s Nugegoda Branch speaking to Colombo Telegraph said “We were all fooled by this liar of a businessman named G.T. Bandara. We have no protection from the Ministry of Education because this school is run as a business under the pretext of functioning as an International School. He officially has no license to operate a school branch in this premise. He is merely playing with the lives of nearly 1900 children. The business contract we have signed with him is a bogus one. He was in the knowledge of and knowingly signed this bogus contract with us. We parents must all get together and sue this fraud. He must be sent to jail along with the war veteran thug Kamal Gunaratne whom he recruited to intimidate us. Our entire schedules and programmes and our kids comfort zones have now been shattered. I am gutted and extremely sad and also very angry at the same time. What’s going to happen to our children’s educational future now? Both the cunning businessman G.T. Bandara and Kamal Gunaratne will have to dearly pay for this.” (By Janaka Ranaweera)

        In this same episode, I saw a parent of a child who had faced similar problems at this International College, has said about a Murder case involving some Army guy employed at this school. We would like to know the details of it and the present position of that issue.

      Kamal Gunaratna can do no wrong. After all he clams to have won the WAR and saved Srilanaka. If he has adopted such dirty tricks on innocent School children what dirty deeds would he have adopted to kill the civilian too to ‘win’ the war.
      The parents should be cautious in selecting private schools. It appears that private school are selected more on prestige basis rather than on educational basis. Imagine the sufferings of the little children for no fault of theirs but their Parents’ in general and KAMAL’s in particular. It is a Major crime by Major Kamal.

    Looks like our inhabitants have alredy bid Adios to another 600 Acres of their motherland to Singaporeans.

    But the SC forcing to close this Royal Branch does not make sense.
    With all those FDI pouring in, although the Yahapalana is on the death bed, who is going to fill the vacancies for even receptionists, sales boys and girls and chauffers for the Foreign Mudalalis who run these Businesses and can’t speak Sinhala..

    RI school children can eventually be fitted into the education system though the process is no doubt painful and costly for all concerned at the moment. But can you imagine the furnace Appa lit with one panic/manic stroke to cancel a smooth SAITM whose take over he attended and then wiped out a medical course approved by the UGC. 85 MBBS had already qualified and were made legally registrable thru’ Supreme Court. For the sake of GMOA head whose contempt of court is valid if the word SAITM exists and hence 85 doctors are penalized without internship. Why don’t these lawyers negotiate to cancel GMOA head court case in exchange for giving internship to these innocent 85 doctors being penalized due to no fault of their own and now having 10 years of training instead of the usual five. Shamefully gross injustice and pleasure in ruining the lives of 85 MBBS who need usual supervised internship sacrificed for 1 doctor.

        Justice, Political relationship cannot obstruct medical education, neither can gossip. These 85 SAITM MBBS qualified according to set rules and regulations and with external examiners from state faculties. They entered and exited and court approved legally before SAITM was given a death blow by TU action of GMOA whose head had contempt of court case re SAITM. They spent large sums of money on a govt. approved course, spending their youth studying medicine for about 10 years and is this the justice they deserve to get.. Students not having sat MBBS were eligible for KDU transfer, but these are graduates who only need internship. MBBS were not eligible as undergraduate offer in KDU. If one year internship is not enough, 2 years could be added without destroying them surely. But then GMOA head is wired to court case against the word “SAITM” Incinerate the wire.

    Businesses would do ANYTHING to promote their business. Ethics, decency and the law! Pooh! In this century they are a part of the dustbin. Major General’s conduct in relation to students is one thing and the illegal carrying out of businesses in premises, including constructions is another. It appears that the Royal Institute is approaching a dark era. Since it is on record that it was carrying out since 1971, it is obvious that many have benefited out of it. The real issue what is the regulatory framework these institutions should operate? Now with respect to schools at least by law and judicial pronouncements every Dick, Tom or Harry cannot be a school principal. Who is the authority that issues licenses to conduct and education institution like this? If such an authority exists what is the requirement that they have spelt out with respect to personnel who ought to be recruited for various positions. It is well known that some service bigwigs are recruited as the CEO of companies from time to time for a few years mainly to “discipline” the work force introducing some militarization of the institution. In reality what are the regulatory stipulations for such activities? In fact, way back in 1977 when the market was liberalized the need to establish regulatory bodies for various industries cum institutions were ignored. It is clear that at least this type of institution in Sri Lanka is operating under a “naked – economy” frame-work and not in an “open-economy” frame-work.

    Royal Institute? what a bumptious name for an institution. A throw back to medieval times when we bowed and scraped. We are a Republic now – has been for nearly half a century. Clearly Mr Bandara is intent on setting a new tone for the business, and the Maj. Gen (Rtd) fits the bill as his enforcer. After all, following his ‘ranaviru’ exploits in the heat of the norther theatre, a bunch of parents must be chicken feed. No? Well, I have news for Maj. Gen (Rtd) – there are few creatures more dangerous in Sri Lanka than a cornered parent fighting for the education of a child. Run for cover, Maj. Gen. (Rtd)!

    Very sad the educational future of thousands of children is being destroyed. I empathise with the parents. Not only their painful investment on their children is
    wasted but now is the greater issue of finding them places in good schools -which are simply non-existent. One further illustration this great “sacrifice” by our majority political leaders to serve “jaathiya and aagama” is an engineered hoax. Most of these political leaders, most of whom came “in Bata slippers and broken bicycles” – on the loud promise of “solving the many problems of the “suffering people” are now multi-billionaires “emerging from their modern mansions in super-luxury vehicles” They are busy building careers for their children as future leaders in the country.

    The plight of patients in Govt hospitals is worse. In many cases, there is no medicine for patients that was given free previously. If only our politicians did their expected duty by voting additional funds each year for schools and hospitals, the vast mass of people will not be subject to the unbearable suffering they are called to bear today. But what did they do? Our corrupt politikkas joined hands surreptitiously with champions of the private trade and encouraged the coming of private schools and hospitals – as “businesses” Money-making machines is a more apt term. The foolish voter, instead of clamouring for his rightful dues, joined hands with the politikkas – for minor temporary favours. The country, with a hitherto admirable free hospital and education service went down the drain.

    For all the suffering, the politician badly needs “the other” to blame during election times. The Sinhala voter was told of course it is “the Tamils, Tamilnadu, India and the LTTE” that is the cause of all our troubles from the 1950s. The yakkos swallowed the guli mindlessly then and now.

    The probable reason , why Royal Institute (RI) has recruited Major general (rtd) Kamal Gunaratne is because their senior management lacks any key strategic decision makers. I came this conclusion by, reading through the curriculum vitiates of the senior and top management of RI.
    I know Mr GT Bandara personally ( in fact i have studied under him). He is an excellent teacher but a very poor administrator due to his lacking of basic management skills.
    Looking deeply into the profiles of the directors, and the top management of RI, they lack the strategic envisioning of the future of the organization (even in the short term).

    Recruiting aristocratic top managers like Kamal Guneratne is the result of the top management of RI not being able to focus on their medium and log term strategic objectives, but trying remedy operational issues such as delayed payment of term fees.

    As such RI is attempting to resolve minor issues with a sledge hammer approach, and such management approaches will always result in the organization receiving the reverse blow of the sledge hammer. It is not as strong as the forward flow, but the reverberations will be felt for long.

    Kamal Gunaratne can easily get employed. But, what about the children who are currently studying at the school?
    Within 3 months they have to find another school. Their education will be disrupted. The parents will have heart attacks. Almost all schools have completed their enrollment by now. Which school or schools have space to accommodate all the children studying in the Royal Institute?
    What an unwise court order to close down the school within 3 months!!!
    The court should have given the time until the end of the year or the end of the current academic year (September, I guess) so that parents have time to find new schools for their children.
    This school existed in this location for 26 years!!!! Why nobody bothered all this time?

    Who said that he is in hero by defeating LTTE? Sri Lankan Army would not have won the war if not because of the support given by India, China, Pakistan. US and more than 14 countries. If they would have fought a face to face face battle with LTTE the outcome of the war would have been different. This guy so called hero wrote a 700 pages book while on duty and made money.     Retired Major General Kamal Gunaratne was conditioned to think inside a square vertically.
    Kamal beat the hell out of a student in public for quarrelling with his son.
    He expected a diplomatic posting which did not eventuate.
    He wrote a book but has not realised that portions went against him.
    Then he saw Porter/Ambassador ASP Liyanage’s tenure in Qatar. Dream job!

You talk as if your hero armed with his Almighty gun – like the Nordic God Thor with his thunderbolt – went to the north and vanquished LTTE single handed! What an idiot you are! This reminds me of the third class filmgoers of a few decades ago, worshiping MGR for his `heroic actions` he performed on the screen. This court case reveals that your so called hero has bullied not only the innocent students of that `Adyaapana Kade` but their parents as well. This savage behaviour gives an inkling to any sensible person – other than servile flatterers like you – as to how he might have performed his heroic acts in the north. He may be your sole – or soul – saviour. but we never wanted his `single handed` service! Being 6 ft under soil , as you say, would have been more comfortable to me , than living in this god forsaken land infested with bloody sycophants like you , where rogues become heroes and scoundrels become saviours and patriots!

      A simple answer.
      Kamal Gunaratne fought the war right on the battle field. That makes a big difference. It was the steel determination of the Major Generals who fought on the battle field along with solders that saw to an end of the LTTE.
