Shani Retires As Senior Superintendent Of Police As Fears Mount For His Security

SSP Shani Abeysekera retired from the Police Department when he marked his 60th birthday on Wednesday, June 30, 2021, even as fears mount for his safety.

The high-profile criminal investigator with an illustrious record of solving some of the most complex crimes in the last two decades, should have been feted upon his exit from the Sri Lanka Police. Instead, Abeysekera retires this week under a cloud of allegations that the country’s second highest court has called “a result of falsification and embellishment and a creature of after-thought.

Last Friday (25) SSP Abeysekera wrote to the Inspector General of Police (IGP) and the Human Rights Commission of Sri Lanka (HRCSL), requesting protection because he was facing consistent threats of assassination and physical harm. See SSP Abeysekera’s letter to the IGP in Sinhala here.

Abeysekera told the IGP that he had made similar appeals for protection from every state agency tasked with providing protection to witnesses and victims of crime, including the National Authority for the Protection of Victims of Crimes and Witnesses, the HRCSL, the Attorney General, and even the Chief Justice.

On the day he was interdicted by the Police Department, January 7, 2020, he had received a call at 11.23 PM on his mobile telephone, Abeysekera told the IGP in his letter. “The caller threatened me and my family with assassination.” His letter added that there were criminal elements operating in the country who nurtured “deeply vengeful” feeling towards the investigator whose work resulted in their arrests and incarcerations. The letter emphasized that he was eligible for protection under the Witness Protection laws of Sri Lanka.

The presidential pardon granted to Bharatha Lakshman Premachandra’s murderer, former MP Duminda Silva has heightened fears for the investigator’s safety.

Abeysekera led the investigations into Premachandra’s 2011 murder that resulted in Silva’s conviction by a High Court Trial at Bar in 2016. Silva was sentenced to death for the crime. In 2018, the Supreme Court of Sri Lanka upheld the judgment. Duminda Silva is a long-time ally of President Gotabaya Rajapaksa. Until Premachandra was murdered on election day in 2011, Silva, a known drug-cartel leader in Kolonnawa, served as monitoring MP to the Ministry of Defence.

His presidential pardon by Gotabaya Rajapaksa was long expected. The Gotabaya Rajapaksa administration’s efforts to discredit SSP Shani Abeysekera in the public conscious and throw doubt on his criminal investigations stemmed in large measure from building the case for Silva’s pardon.

Silva’s drug connections and links to criminal elements in the underworld, greatly heightens the risks to Shani Abeysekera’s life.

Earlier this month, the UN Human Rights Council Core Group on Sri Lanka, led by the UK, called on the Sri Lankan Government to ensure SSP Abeysekera’s safety.

In an interview with a Colombo-based newspaper last week, Ahimsa Wickrematunge, daughter of slain editor Lasantha Wickrematunge also expressed fears for his safety. Shani Abeysekera would never be safe from harm in Sri Lanka as long as her father’s killers and the perpetrators of other atrocities were free men, Ahimsa said in the interview. As CID Director investigating Rajapaksa era atrocities, Shani Abeysekera came too close to revealing the truth about those behind the crimes, she said. “Powerful people have a vital interest in concealing the information Abeysekara and his team uncovered during their criminal investigations,” Ahimsa Wickrematunge added.

Earlier this week the Young Journalists’ Association also wrote to the National Authority for the Protection of Victims of Crimes and Witnesses, insisting that SSP Abeysekera is given protection because he qualifies as a key witness in high crimes. See full letter here.

SSP Abeysekara was arrested by the Colombo Crimes Division on July 31, 2020. The CCD accused him of fabricating evidence by way of introducing weapons to implicate former Deputy Inspector-General Vass Gunawardena, the main suspect in the 2013 murder of businessman Mohamed Siyam. Vass Gunewardane was convicted of the murder by a High Court Trial at Bar in 2016. In trumping up allegations against SSP Abeysekera, the CCD relied on complaints made by Vass Gunewardane’s accomplices in the murder, which the Court of Appeal said could not be trusted.

The Court of Appeal said Vass Gunewardane had admitted to ownership and possession of the weapons in his dock statement at the murder trial that the CCD was accusing Abeysekera of planting to implicate the former top cop. The complainants had waited six years to make the allegations against SSP Abeysekera, the Court of Appeal noted in its order granting bail to the former CID Director.

“On account of the said unusual and extraordinary delay, the complaint has not only lost the benefit of the advantage of spontaneity, but also smacks of the introduction of a fabricated, false version and an exaggerated account or concocted story involving a set of collaborators or conspirators, to unduly cause prejudice and harm to the suspect Shani Abeysekara, for collateral purposes,” the order noted.

    Display of utter ignorance of integrity in governance and disregard to the Rule of law and protection of the citizens of all hue and shades in Sri Lanka (SL).
    Why is this state of affairs?
    After the person claiming in seeking the top position in the executive of SL and declaring that 20th amendment is necessary for him to govern properly and effectively, to protect the security and sovereignty of SL.
    Now it appears that individual cannot provide means to ensure the safety of an officer, who has put his service to SL Police, integrity and honour ahead of his personal protection and safety, in discharging his duties..
    Does this mean anything else than that “sar-cular” is an utter and complete failure and constitutional rights do not matter and the person endowed with its protection does not understand what his oath means.
    Question is then why are we maintaining a police force, STF, Army etc., to parade and protect the politicians? Their acolytes, friends and boot lickers only qualify for protection and pardon?
    Failed State! Sad state of affairs, indeed.
    In these circumstances, I agree with Cugan, that Shani takes a boat to a far off land for safety. It is a pity that the land of your birth cannot provide the safety and security is yours by right as a citizen, although your conscience as a true police officer would not permit it.

    The most ungrateful and shameless person is Mithripala Sirisena. He does not feel any remorse or shame for the dirtiest work nobody I know has done. He pretended right from the start prior to the Presidential elections in 2015, to satisfy his greed told a damn lie to the people he would ensure justice for all the victims committed by Mahinda Rajapakse and his gang including his brother Gotapaya Rajapakse, see to it they suffer for their crimes. He also promised the people he would never again associate with them. He even dragged the clergy to bless him for the holy work he promised to do.

    It became apparent all these were damn lies, when he was elected President by the people trusting him. His pretense soon became very apparent. He went back to the Rajapakse clan who promised never to ever associate with them. Had this lier done what he promised to do, people like Mr. Shani Abeysekera, who were committed to their job would never would have fallen to this pathetic state. There are many like him who have been victimized by Gotapaya Rajapakse.

    Even at this moment, shameless Maithripala Sirisena has no remorse. He should have resigned from politics and that is very little he should have done.

        Thanks, Harischandra for your reply. I cannot get who the two you are referring to, but what Mythripala Sirisena did by his own standing is despicable. He betrayed the people’s trust. It is ok if he was unable to take action against the people he promised to do and his convenient scapegoat was Ranil Wickremasinghe. But at least he would have kept away from the Rajapakse clan. Just because of Ranil Wickremasinghe there is no excuse to become friendly again with Rajapakses. That does not make the Rajapakses innocent of the crimes he said they have done. There is no logic.

    I had given up posting comments which I feel is all hypocrisy. Ironically, I am compelled to jump into the band wagon by doing just the same right here. As I sat down with a certain Attorney at Law for a consultation, he phoned SSP, Mr. Shani Abeysekera and mentioned to him that I am seated in front of him, with the remark that I am an old man, which convinced me that the former really meant business. The AAL got me to deposit a large sum of money with the assurance that he would draft a charge sheet which actually should have been done by the Organized Crime Prevention Department of the Police, in order to frame criminal charges under the Penal Code against an individual who is guilty of a crime. The AAL pocketed the money and did nothing. Invariably, it created in my mind thoughts which are on a collision course head on with what has been highlighted of Mr. Abeysekera, as a diligent officer whose service to the Nation was highly commendable per above article but it nevertheless leaves me with an ambiguous and a schizophrenic mind.

      That’s the real problem in this country isn’t it, the lack of good morales. Right and wrong are not absolute, most people choose the gray areas because their own needs are paramount. It’s there in every caste, rich, poor, educated and otherwise. For a supposedly religious country where all our religions preach good over bad, the majority don’t seem to have grasped this concept. The notion seems to be that if some good, like giving alms or helping the poor, is done then it is ok to do wrong as well. How can this mindset be changed? Can it even be changed now?

When the phone conversation was in progress as I was listening, I cannot recall it but I interjected their conversation over a point related to my case. His junior who was taking down notes told me not to interrupt because it was Mr. Shani Abeysekera whom he was talking to.

              Dear MV. I am 100% sure the duo did a deal with the contending party after extracting a large money ransom from him to not to proceed with the case as the AAL assured me. The evidence is overwhelming and rock solid, to prove, as a recording of a CCTV camera, the staging of a bank heist, to find the criminals guilty. The whole nation must take responsibility to eradicate this kind of a crime never ever to happen.

        Thank you dear MF. It is a certain yes. The whole world knows that both of them are big time buddies. This attorney was recommended to me by Mr. Weerasinghe of Voice Against Corruption saying that it was to him that they refer their public interest cases to. Behind this crime was a one time Director of CID. My complaint to OCPD was shoved under the carpet.

We warned enough, but people in that hell-like island (though it is a paradise to the european eye going by its landscape and nature)- some people of SCP nature, behave like street WOMEN/men…. that are raped once, would love to be raped again and again…. this is what I heard from a psychologist lately… the very same is the case with SIGNIFICANT portions in our home country. This is the reason why I now chose ANIMALs.. I give a life to stray dogs in my next charity work…

    Will the Police Commission or IGP “Accept” his “Resignation”? I raise this issue because Shani Abeysekera is still under “Interdiction” and has been placed under “No Pay”. Normally, my understanding is when a “Public Officer” is interdicted and placed on “No Pay” is related to a very serious “Offence” that warrants “Dismissal” from services. Under such circumstances, a “Resignation” will not be accepted.

    How will the “Authorities” react? Would they “Refuse” the “Resignation” and proceed with a “Disciplinary” inquiry and punish him with “Dismissal” so that he will be denied even his “Pension”.

    Can someone (knowledgeable) on Rules relating to Public Servants educate me on the above issue? Thank you.

    This is the wonderland made by Rajapakshe. The kind of concerns were not there under previous govt. But that was rejected by people this is the threat to publicly known personalities. There are lot more suffer today by state persecution. Those farmers protesting not having fertilizers are double hit today. All these co continue today with the support of so called Buddhist clergy. Buddhist clergy and media mafia should be made accountable for not having done for the protection if people in this country. Growing threats on human life is a dangerous sign.now or in a few months now they have to surrender before intervention community. Average would nt remain like slaves forever.       Dear LM. To me you sound paranoid. Rajapakshes or Jarapakshes are the Crown Jewels of the Sinhalese Bhuddists, which ever way you asses them. I left this God Damn Country (people) promising myself never ever to come back. Remember every time you return to Germany when you step on German soil, to go down on your knees and kiss the German soil. I always stood up tall against corruption, crime and injustice in moral sense and in principle. When I became the victim of a heinous crime of this nature and magnitude there was no way to turn the other cheek, so to speak. When I stepped into the ring I was anticipating the entire nation to applaud me and toss me into the air. I hired around 25 lawyers who in turn stabbed me in my back bowing down there heads to the Godfather of the lawyer Mafia followed by judges overcome by insatiable greed.

    The Rajapaksas don’t like honest public officials. They’re allergic to them. They hate their guts. They prefer to work with compromised and underqualified individuals so that they can get them to carry out their dirty deeds. Just look at the people appointed by them as ministers, secretaries, judges, heads of corporations, and other top officials. You cannot fault these individuals for scruples or pickiness. They understand very well when dealing with the Rajapaksas, your focus should be on staying alive.

    Though I have not met Shani, I have met several public servants who left the service in sadness and if not disgust, on retirement upon reaching the requisite age. Political party in power is immaterial as this has occurred in every regime without any exceptions. The worst crime is that we have educated these people at the expense of the taxpayer and for some blessed reason or the other their full potential has not been harnessed for the country. Very often than not, for years they must silently watch the melodrama that is taking place. Speaking the truth is a serious crime. Fortunately, for the forest officer in Gampaha, she is a lady and still Sri Lankans have the decency for a male not to assault a woman (Wife beating excluded) otherwise serious misfortune would have fallen on the officer for taking such a stand. We have not forgotten how an officer of the Auditor General’s had to face a splash of acid blinding one eye. Although I thought this was a unique case there are instances of acid throwing for not satisfying the amorous commercial desires of the powerful. God bless Sri Lanka.

          quoted, for the different background, viz. Financing, as any change is tied down to
          funding the Rajapakses by CHINA to the hilt. These funds will trickle down to all
          village thugs and the groundwork will go smoothly with a US Citizen to be appointed as “Minister of Ministers” – There will be no political change, even if the Yellow Robes Unite against them 100%. The present cohorts will be compelled to hang on under threat of assassination, with a few samples undertaken by Chinese personnel. The future of the Sinhala community is at stake but none would realizee what is ahead. This senario is my prediction, as the SB intelligentsia will
          go into hiding.

    It is unfortunate that Sri Lanka has come to this. Journalists, activists, political opponents, and officials loyal to this country, have to live in fear, flee from this country, be afraid of political arrests, be threatened, or worse. The previous lot may have been incompetent, but we did not have to live this way. People were able to protest, criticize, and do their jobs, WITHOUT FEAR.

    What is disgusting is, the Rajapaksa supporters keep justifying all their crimes, and the Rajapaksa cronies don’t care for human rights, or that there is no the rule of law in this country, as they are enjoying all the “perks” they enjoy in their privileged positions.

    Surprised and fortunate that Shani Abeyesekera got out on bail ALIVE even through a heart attack and COVID-19 infection while in custody.

    Why have the double-Paksas spared him thus far? I think it’s the tremendous international spotlight on the country’s lawless regime and on the Shani Abeyesekera matter itself.

    As far as the Rajapaksas and their many cronies and accomplices are concerned, Mr. Abeyesekera is a walking, talking time bomb. Whether it is making them weak in their knees and caused many a sleepless night, the incompetent double-Paksa regime is a disaster on all fronts.

    Hope Shani has recorded and communicated all that he knows about the criminal acts committed by the members of the Rajapaksa family and their henchmen to all worthy parties, including foreign agencies, who can safeguard as well as use the information should the worst happen to Mr. Abeyesekera.
