Shocking Blow To Yahapalanaya From Sirisena: Asks SC If He Can Continue As President Until 2021

In a shocking blow to the supporters of Yahapaalanaya, President Maithripala Sirisena has sought the opinion of the Supreme Court whether he could function as the Executive President until 2021 – 06 years from the day he was elected as the President.

This comes on the day the unity government celebrates its 3rd anniversary. Sirisena and his government came to power with the promise of abolishing the Executive Presidency in 100 days.

According the 19th Amendment to the constitution, which was introduced a few months after Sirisena assumed office, the term of the President was reduced to five years.

Following the passage of the 19th Amendment, Sirisena boastfully claimed that no other leader in the world had curtailed his powers on his own.

Going back on his own promises, Sirisena has asked the Supreme Court – “Whether, in terms of provisions of the constitution, I, as the person elected and succeeding to the office of President and having assumed such office in terms of Article 32 (1) of the constitution on 09th January 2015, have any impediment to continue in the office of President for a period of 6 years from 09th January 2015, the date on which the results of my election was declared.”

The development has taken place a day after Sirisena suggested to name the newly constructed Rajagiriya flyover after Maduluwawe Sobhitha Thera – the pioneer of the campaign to totally abolish the Executive Presidency. At the funeral of Sobhitha Thera, Sirisena pledged to deliver on his promise to abolish the Executive Presidency in toto.

            Whistle blowing is acceptable only when a party is trying or covering an underhand act not when the President is asking a ruling from the highest court in the country.
            We saw during the last govt. it did according to will and the judiciary and parliament just put the rubber stamp.

          If the SC judges are dishwashers or toilet cleaners in the President House, that can be done. If those judges are public servants, their opinion must be published and the question asked from them on the matter of public verdict ( 5 year term)must be published. In this circumstances EP has a special duty towards public as he has been created an opinion that he will be leaving in five years and nurtured it until now. When he intended to stay beyond the public opinion, he has trust duty to inform public that he had changed his mind. There is no while blower policy in Lanakwe. That is why there is quick suggestion to fire the official who released a secret corruption hatching at high of EP-SC.

      Sira needs to impeach Bondscam RW who is a clear and present danger to Sri Lanka — the economy and people because Ranil Wickramasinghe works for the global 1 percent and Deep State of the sole superpower’s security interest..

      To impeach Ranil, Sira needs to be sure that Mahinda and Gota Jarapass will not creep back in the saddle through the back door.

      He is checking all options which is the smart thing to do at this time. Sira is the best of a rotten lot of politicians.

    This is a request from the President to ascertain the legal period of his Presidency as per the constitution of the country. As the leader of SLFP he should be aware of this information.

    As for the abolition of Presidency there are two schools of thought. One section led by UNP say that Presidency should be abolished while another section led by Hela Urumaya state that there was no undertaking in the Presidential election manifesto to abolish the Presidency and there was only promise was to reduce the extreme powers of the Presidency.

    Some others claim that UNP is now eager to abolish the Presidency (introduced by their own leader JRJ) simply because Ranil Wickramasinghe cannot win a Presidential election on his own as he does not have the trust of all communities of Sri Lanka. However he might be able to become the executive PM by obtaining a majority of seats in the Parliament (and become the head of state by back door)

    Even if President Sirisena wants to abolish the Presidency, it may not be practical as the SLFP does not support this proposal and he may face a rebellion in his own party (specially with `Pohottuwa’ waiting in the wings to round up unhappy SLFP members) if he forces SLFP MPs to vote for the abolition of Presidency.

    Under the circumstances I cannot understand what is the `shocking blow to Yahapalana’ by this letter.

      The answer is NO NO and NO. President cannot function until 2021. According to the 19th Amendment, his term ends in 2020. If he is to complete 6 years, there should have been a Clause allowing him to do that at the time Yahapalanaya introduced the Amendment. As obvious, there is no such thing.

      The next Presidential Election should be held one month prior to the completion of his assumption of duties. Therefore he should call for an election before the end of October. If he wants he can contest again. There is no problem. But he has to hold the next Presidential Election by November 2019.

      I can see that somebody has given the President a dead rope. Now his opponents will use it to attack him. Fool. Same thing happened to Chandrika I think.
      Don’t even think of abolishing the Executive Presidency, Yahapalanaya guys as it will mark the end of our nation. If there is any such move, each and every Sinhalese should come to the street, even kids, in protest against it.

      19th Amendment was brought to weaken the Executive Presidency with an aim to destabilize the country. One but all other politicians fell into Ranil’s trap and voted in favour of it as there were one or two good items such as limiting the term of the President to two and blocking dual citizens from contesting both of which are fair.

      Introduction of Mixed Electoral System (MES) is also another blow to the country. Aim is to weaken the Parliament.

      This system only allows a fragmented competition in electorates which will eventually lead to not having enough seats to run a government for a single party/even for an alliance. There will always be hybrid governments in future. The best example is Yahapalanaya government with totally opposite policies which only earned the wrath of the public. Needless to say a hybrid government is a hindrance to the progress of our country which incapacitates the decision making ability.
      Some people say the PR system invites brawls for preferences among contestants of the same party and allows those who have money to buy votes by having an unfair/undue edge on publicity. I don’t agree.
      The result of 2015 Presidential Election proved that eventhough Basil had reportedly distributed billions among SLFP Ministers, money could not buy votes.
      UPFA, by winning 95 seats at the 2015 General Election thanks to Wimal’s patriotic rallies began well before the election was announced, proved again that money/individual publicity was not the decisive factor in winning an election. Most importantly I didn’t see any violence/brawls among UPFA candidates when seeking preferential votes.

      Politicians should understand that there are no gullible voters anymore. Gone are the days. They need not to tell us. The general public is well aware of their selections. Unlike MES/SES, the PR system strengthens the stability of the country and Parliamentary democracy by allowing voters to choose their candidates according to their preference.

      Therefore, people should reject MES at the LG election which has been introduced to fragment voters into political parties who are at present united by the best interest of the country, irrespective of party politics.

OK Mr. President, please, resign and contest again without Ranil + UNP and show people you are genuine. Anyways, Sirisena isn’t merely checking the duration of his term. AG’s favaourable opinion may be to save his (AG’s) position. Sirisena is taking advantage of the situation in order to get a favourable response. He was in deep slumber for 3 years and suddenly woke to serve people extra one year exactly run upto LG elections. Do they think that are idiots? Ranil and Sirisena both are abusing the judiciary in an unprecedented manner, worse than Rajapaksas.

    This article is not fair to the President Maithripala Sirisena.
    President Srisena was elected under the old constitution that allows him to continue until 2021. He asks SC’s ruling in case he has to continue until the full term.
    He did amend the constitution to give more powers to the PM which no other presidents did. The SC didn’t allow him to pass on even more more powers to PM without a referendum.
    We must appreciate his stance by comparing with MR who wanted a 3rd term or even more and grooming his son in the dictatorship model of late Colonel Gaddafi of Libya and latter’s heirs of his sons.

      I agree with you. There is nothing wrong clarifying matters that are ambiquous in explaining the constitutional matters. He is not asking to change the constitution. It is very sad some of us looking for opportunity to find fault with this government. Still he is much better than our previous presidents who were almost dictators. Under the current political and structural environment it is difficult to survive as a honest politician. So far, we have not heard of Srisena is printing money on his name or building a memorial for his father or murdering journalaist friends as our previous President did.

    This is a very foolish move by My3. He is playing in to the hands of his enemies by doing silly things like this.

    This may have been suggested by people who pretend to be his friends. There are far too many professional politicians in this country. They are the guys who never retire. Kicked out of one party, they seek refuge in a party that they had been lambasting only the previous week. Who can name ten of them within five minutes? I offer no prizes, being rather a stingy guy, and the task is much too simple.

    My3 has been in Politics for much too long to be making such simple mistakes. He must retire to Polonnaruwa by the 7th of January 2020. No memeber of his family should contest an election for five years after that. It may be that after that period somebody from his family could come forward. May be the pretty Chathu, by then quite matronly.

    That is what a wise man should do, and I had always taken My3 (and Sobhitha) to be wise.

    Having condemned this move in the strongest possible terms, I must say that I have carefully read the long comment by Dan. He has written sense, but we must tell My3 that this just won’t do. How do we pass on to posterity the values and the insights that Sobitha saw towards the end of his life, having begun as yet another Sinhalese monk?

      Whatever Ranil plans, unlike January 8, 2015, this time people will come forward to thwart it. Therefore, if the President is anxious about what will happen in 2019/2020 there is no need for him to worry. Whoever who becomes the next President, he will not take revenge from Maithree. GUARANTEED.
      And no matter how much they try, Rajapaksa clan will never come back to power. Hotu Pohottuwa has already shown its colours by having Basil and Nimal Lanza who happened to the heroin kingpin in Negombo, in the forefront of Mahinda’s campaign. Even those who support Mahinda, will never want people like Basil, Lanza, Sajin, Mervyn back in power.
      There is no way people will let a repetition of 2010-2015 era where the country was run by Basil, Gotabhya, Namal, Sajin, Mervyn and the likes. Unlike 2005-2010 Mahinda’s power was only in name during that period.
      Only important thing is, the President should never let them (Ranil + Hotu Pohottuwa aka JO + JVP + TNA) abolish the Executive Presidency. For that, he has the backing of all Sinhalese. Ranil has no constitutional powers. President should understand that. 19th Amendment was not sufficient to transfer executive powers to the Prime Minister. Having 2/3 majority is only the half of the procedure which should have been followed by a Referendum for enactment.

          Rajapaksas will never come back to power. Guaranteed. If Mahinda had any dream, it was shattered by the rest of his own clan who are equally selfish and power hungry.

    We all know the history where HE said that he reduced his own term from 6 to 5 years. What then is the necessity to clarify? Oho! there is long business and it would remain unfinished. Further if the SC wishes to be bound by its own precedent then it has to follow the advice it gave to Jarapassa. That is just because he happens to be there before the amendment the pre-amendment conditions do not apply. (The opposite of what Sarath Silva said in public at that time.) Now if pre-amendment conditions did apply then not only his term of office is six years but the number of terms that HE can be President is not limited to two. Further, in the same token can Jarapassa too can contest for again and again and again? Already the 19th Amendment is gradually made a sham by adopting devious tactics to out-smart the limitations. I am amazed by HIS cheekiness in giving deadlines to give an answer. So MS is becoming an MR but the latter was not a fool to put that kind of thing in writing, instead he may ask one of his lackeys to make a phone call.

    Recently TNA M.P Sumanthiran said in parliament that 99.99% of the voters had said they want constitutional change. It was not true and nor is a proper constitutional change feasible while Yahapalanaya in power. So for the 99.99% of mountain stomach pain there was mouse had born. Its name “was” 19A. When we wrote comments about the ill will of the 19A, readers were skeptical about our will. But our main point that time was the 30 ministers’ limitation of. Because the Ranil’s minority parliament went to election after passing the 19A with 30 ministers’ limitation and came back to power and beat the 19A to extend to back again to 100, we claimed it was a fraud. We claimed it was only the “Foreign Judges and Lawyers” wording. But Yahapalanaya acolytes claimed that is what the 19A is. Then battered out Constitutional Council appointments took place. Radhika, Ranil, Sampanthar, Ariyaratne, Deal…. I don’t have to name these guys. Wimal and groups who dismissed CJ Shiranee and appointed Mokan Peiris 200% better than those guys. I was wondering why not Wimal, Marvin Silva, Udaya Gammanpila…. should not be allowed be in the CC?. So 19A’s second flop is that. Now the term of the EP is broken. If SC didn’t “YES” fire the judges and find out another way! This is the game kids play too, “Pandavas like the legs of a bed, three, Show 2, write one and erase that too.” Kids are smart they cunningly make the five Pandavas into zero. But Appe Aanduwa crooks brought the 19A only to others, that is, to keep Old Royals out of the ring while they play their game. Entire 19A is out now. Still Sumanthiran M.P. Claiming 99.99% of the mass wants the change? He is only a spin doctor of Yahapalanaya; that all.

    I hope a learned and trusted professional like Mr Nihal Jayawickrama will give his honest opinion on issues like this. Law students know that one source of law is the opinion of Jurists, accepted by courts of law. That will be helpful to lawyers, judges , magistrates and Supreme court judges when they smile more or do not smile at all when on the bench or use expressions like , Mage amme…my gourd (God)budu ammo….hapochchio…hariwadayne… etc in court proceedings due to lack of reading knowledge in English or owing to the lack of good English pronunciation spontaneously. The batches that came out after 1975 showed those lackings.

Incidently Thalayasingham was my classmate in school from lower kindergarten. When he was arrested and taken to fourth floor, I felt sorry for him as I thought he will never return alive. To my surprise he was released after a few days without any charge. I asked him how did that happen. He told me that according to police investigations the murder was a contract killing by Army sharp shooters arranged by Mahinda Rajapakse, and when government came to know that, they did nor press charges. Chandrika who was the president at that time should take full responsibility for it as firstly she did not appoint Kadirgamar as Prime Minister despite widespread support from all sections and secondly covering up the crime despite evidence.

In their assumptions Sinhalese in Srilanka are modayas. Tamils didn’t like Kathirkamar’s politics but it is the Sinhalese leadership who murdered him using the opportunity. Why didn’t Sinhala parties elected Kathirkamar as a member of parliament using Sinhala votes? Sihalese leadership appointed Karuna as a vice president of SLFP, gave him a ministerial post but why couldn’t give him a Prime Miniter or President Post?

      A non-Sinhalese Buddhist will never become the Head of State. We have witnessed with our own eyes how much damage a non-Buddhist Sinhalese second-in-command (Prime Minister) could do to our country . Therefore Sinhalese Buddhists (70.2% of the population) will never even vote for a non-Buddhist PM, a non-Buddhist leader of a party or a President ever again, let alone electing a non-Sinhalese Buddhist as the Head of State or PM.
      It is time for you and some others to wake from their dreams.

Therefore your claim of a 5000 year history will not be accepted. Recently a 10,000 year old civilisation has been found in Settikulam which is likely to turn out to be similar to that found in Tamil Nadu. According to genetic studies Sinhalese are made up of South Indian genes as the core with Bengali and Veddha input. This proves that the ancestors of Sinhalese are south Indians and not of any other ethnic groups mentioned in Mahavamsa. At one time everyone in Srilanka spoke Tamil or some form of it (Elu is proto Tamil). Sinhalese are merely Sinhalised Tamils like Malayalees being Malayalised Tamils.
