With a view to suppressing terrorist act of the LTTE, Parliament passed the Proscribing of Liberation Tigers of Tamil Eelam and Other Similar Organisations Act in 1978. However, since it was observed that this Act contained a number of shortcomings, the Prevention of Terrorism Act was passed in 1979 to replace it. Here, we took Prevention of Terrorism Act passed by the United Kingdom Parliament on terrorism in Northern Ireland as our basis.
Under this Act, action was taken against terrorists in South and North, and arrests were made. Now, the war in the North is over and the terrorism has been prevented. In such a situation, there arises no need for executing Prevention of Terrorism Act. As such, this Act should have been abrogated. At the inquiries made on this matter, the government stated on several occasions in this House itself that they are not going to execute the Prevention of Terrorism Act.
After the 11 September incident, the whole world is vigilant about international terrorist acts. The British parliament passed another Act in place of the formerly existed Prevention of Terrorism Act in order to prevent such terrorist activities. That Act has banned applying its articles for suppressing political activities.
Nevertheless, now this Act is being used for suppressing opposite political groups in Sri Lanka. Mr. Azath Sally was arrested under this Act. He is a politician who has been party to political activities both in the Opposition and the Government. At the Presidential Election 2010, he distanced himself from the United National Party and Supported Mr. Mahinda Rajapakse. At no occasion during his life time has Mr. Sally been ally to a terrorist organization.
It is said that he has been taken into custody based on a statement allegedly made by him. Politicians may make different statements. We have witnessed instances in which they make statements with as well as without responsibility. Mr. Sally made this statement at a time in which the government is taking no action whatsoever regarding harassments made against Muslims; at a time when Muslim Leaders in the government are keeping quiet.
Against such a backdrop, if there are charges that the frantic statement made by Mr. Sally contains some elements of wrongdoing and irresponsibility, what should first of all have done was to inquire whether he in fact has made such a statement and to take action under ordinary law if it is confirmed after such investigations that he has made an offence. Contrarily, his being arrested under Prevention of Terrorism Act can by no means be condoned.
For this reason, the present conduct of the government raises serious questions. The conclusion we can arrive at through this conduct is that the government is abusing Prevention of Terrorism Act to suppress its political opponents. This situation may be aggravated in future. Government may even resort to misuse this Act to suppress the waves of public protest rising against its misconduct throughout the country. This is a clear indication of the trend towards an autocracy. This is a very perilous state of affairs.
Therefore, I would like to ask Hon. Prime Minister the following:
1. Why was action taken on Mr. Azath Sally under the Prevention of Terrorism Act rather than under average law?
2. Will this Act be used further for suppressing politicians of the opposition and public forces?
3. Since terrorism has been terminated by now, will the Prevention of Terrorism Act be abrogated? If not why?

Kohuwala, awarding a contract alone to a party does not ammount to corruption, unless procedure is violated. I concede there would have been some short comings during the short tenure of RW as PM. Afterall were not all these cross overs to MR under the UNP then who had issues with regard to their Integrity and Honesty? What would have happened if RW tried to instill discipline and honesty then, when the country’s economy had to be turned around as top priority? Would RW had survived? Not only this man there are so many like this in the present MR govt. who have been making money but no action taken. Not only the present administration is guilty of robbing money, they are above the Law when they Rape and Kill also. See the waste of public funds on Mihin Lanka, Mattala Air Port, Harbour to name a few. To whose pockets have all these money gone to? Is it to RW’s? This bugger MR is a first class Wheeler Dealer. He has played ball with the US and the Indians, first to get elected with the help of VP, only to eliminate VP and a section of the LTTE while retaining the KP section to share the spoils. These Socialist buggers who rode on the sweat and blood of the poor in this country are ruthless compared to the Capitalists whom they over threw in the ’50s. The extent and who is managing it? What is the return on investment of an Apple Orchard and whoever spread this canard, had he said that GD had oil wells, it would have been something to think about. Kohuwala, with reference to the civic rights deprival of Mrs. B was due to her amending figures in Land Reform, which was proved at the Commission of hearing and it was the Commission that proposed the removal of her Civic rights for misuse of power. This by no means an act of dictatorial power. There was no usurping of powers of the Constitution as done by MR today to have kicked the 17th amendment and to introduce the 18th amendment.
As for your claim why RW did not protest when youth were hauled as suspects of JVP, there were no identification tags or otherwise to find who was and who was not JVP as all those who were dealt, according to your assesment are innocent. Then who killed so many innocent bread winners of families, Planters, Police and Forces members and their families? Is it the LTTE? Had the JVP not resorted to killing, then they too would have been spared. There is very little that RW could have done in such a scenario, where the reins were not in his hands. RP did the same type of killing what MR is doing today. Had RW tried to stall, possibly he would have been a victim of JVP himself. He bided his time and today he has cleaned the UNP of all the undesirebles. Can you point one incident where he has personaly authorised any killing of anyone. Apart from the rationale upon which the PTA became part of the law in the late 1970s, what it was eventually used was to break the backbone of the Colombo Tamil business community from their traditional hold in the Pettah and elsewhere in Colombo and the Western Province. Hundreds in the Police and the Army higher tiers made huge fortunes milking the Tamils on false accusations of being linked to Tamil militancy. Taxi drivers struck up a lucrative business by spying on Tamil visitors to Tamil homes and passing on the information to the Police who quickly arrived and rounded the Tamils – most of whom had arrived in Colombo to the homes of their friends/relatives on legitimate business. Many left their businesses and others left the country. Their enterprises were bought over by other communities – in many instances for a song. The PTA was used also to wake up women and children from seedy lodging houses in the Pettah, in their nightwear, and inhumanely dumped into buses at 1 a.m. to be forced by the Police “to get out to your part of the country. You have no place here (in Sinhala land)” Now the pendulum is swinging back striking other communities as well. No one rejoices at the latter’s plight. Dtill Tamils still continue to be the greater sufferers of the PTA that has long lost its avowed validity.

the Sword of Dramocles where I can be taken, without question –
and held incommunicado for 48 hours, before being produced before a stipulated legal officer. Within the 24-48 hours many have been assaulted into submission, agreed to part with large sums of money to be relieved from the torture and so on. Dozens of Tamils returning to Sri Lanka have been thus killed at the airport. It happened to multiple thousands of Tamils all over the country. Only when it happened to Ekniligoda (?) and this loose-canon Sally does it engage the wrath and attention of the public.
One of the main demands of Mahinda Rajapajse in his several visits to UNHRC in Geneve in the 1989 period was to call for the removal of this dangerous claus from our law. I ask for the same.

Once upon a time, on a sunny morning on Idiot Island, a man looked out of the window and saw a tourist inside his chicken coop. So the man went to the bedroom where his wife was still asleep and woke her.

The wife got up and dressed as fast as she could. She was very excited, thinking about the reward she would get for capturing a traitor. So she hung the national flag from the window and telephoned the Peacekeepers and the Minister for the Prevention Of Tourism, (POT) and told them to hurry to her house as soon as possible!
When the Peacekeepers and the Minister of POT arrived, they sat down and looked at her with great interest.
“My husband,” she said, “saw a tourist inside our chicken coop this morning!”
The Peacekeepers looked at the Minister of POT, and the Minister of POT looked at the Peacekeepers.
“He told me that the tourist was hatching an international conspiracy using NGO money!” she said.
The Minister of POT looked at the Peacekeepers, and the Peacekeepers looked at the Minister of POT.
“He told me the tourist was planning on bringing disrepute on the government of Idiot Island!” she said.
At a signal from the Minister of POT, the Peacekeepers leapt from their chairs and seized the wife. She put up a terrific struggle, but they finally got her under control, just as the husband came back from the chicken coop.
“Did you tell your wife you saw a tourist in the chicken coop?” asked the Minister of POT.

“That’s all I wanted to hear,” said the Minister of POT. “Take her away. I’m sorry sir, but your wife is a threat to national security!”
So they took her away, cursing and screaming and locked her up in a “Welfare Holiday Camp” under the ‘Prevention of Tourism Act.’
And so the husband lived happily ever after.
The Moral of the story:

Once there was severe argument as to which part of the Human Body should be Boss. The Brain claimed that it should be Boss because the body can not do without thinking. Then the hands claimed that it is the hands that put the food in the mouth, for the Brain to get nourishment, therefore Hands should be Boss. Then the Legs countered stating that the Hands cannot food in the mouth if the Legs do not move the body to where the food is, therefore Legs should be Boss. Like this all parts of the body began to make their claim to be the Boss. Then suddenly a murmer was heard and it was the arsehole claiming the post and all laughed. The arsehole got angry and shut itself completely. Two days later the body went limp, the brain delirious and almost collapsed. A quick meeting was held and all agreed to recognize the arsehole as the BOSS.

Right now Ranil is the only leader who has the vision, mission and the right attitude to take Sri Lanka to the world but the stupid masses wouldn’t give him a break.
By signing the peace accord, he – in this time even a cat didn’t die – for three years quietly let the LTTE to get weaken for thousands of their harden fighter who never saw the outside world, left them. He was the one who was instrumental in separating Karuna from the LTTE using Ali Zahir Moulana. He used the long rangers, the army intelligence operatives who went deep into the enemy territory to eliminate most of their middle and low level leaders. He was fighting the war intelligently by keeping the international community along with him. Due to all these advantages only in the later part of the war, the forces had the upper hand to fight the LTTE.
If the war continued in this manner, we could have saved lot of lives, money and properties. Also the country would have come out clean with it’s image and good will with the world.
At the war reconstruction aid conference, he got the the international community to commit over US 4 Billion for reconstruction and developments. Most these moneys were grants which we do not need to repay and the rest were at very low interest to cover the administrative cost only. We would never ever get another opportunity like this again, the present bad world economy wouldn’t allow these aid giving countries to grant aids in this way again.
At that time he had a very good plan of actions to develop and up lift the economy to provide a very good stand of living for all. We lost all these, it’s all because our people are well educated but wouldn’t use their brain. Their IQ is nill, zero when things come to these kinds of things.
Its a shame that our public was so foolish enough to miss this wonderful opportunity and suffering the hell now from all the sides for they believe and trust all these gullible politician who wouldn’t be able to full fill their fake promises.

It appears to me that UK has not yet abrogated their Terrorist Prevention act, despite the threat from Terrorism is low. I do not see any requirement SL PTA to be repealed as LTTE is still a powerful force in the international sphere.
Secondly, as suggested Salley should be questioned not based on SL PTA but in the normal civilian court. I think government has taken an upper hand and show their moral high ground.

Very encouraging to note that many people have been involved in commenting on this subject by Mr. Ranil Wickramasinghe- The Leader of the Opposition. It would be very relevant to examine the track record of Mr. Wickramasinghe, since he was “catapulted” to politics by his uncle Late Hon. J.R. Jayawardene.
1. His first important assignment was as the Minister of Education. We in Sri Lanka know who ran that Ministry. He was none other than Gonawala Sunil, a well know underworld thug. When the situation got beyond even his (Mr. Wickramasinghe’s) conrol, the people took the upper hand and got rid of him. Till then Mr. Wickramasihe was supportive or fell himself a victim. He did not do anything that could be valued or to be rcorded as his and in his favour while in the Ministry.
2. The next important assignment was as the Prime Minister of Sri Lanka under Mrs. Chandrika Cumaranatunga- the ex President. In this assignment Mr. Wickramasinghe did make a name and left an “indelible” mark in signing the “Cease-fire Agreemnent” with Probakaran, even without the knowledge of the Commander-in-Chief – the President and the Cabinet. One of his architects of this Agreement today holds an important Ministery in the MR Government. Anothor who made millions on the “deal” with Norway tried to be an “Associate” through Local Government politics, but failed and we do not know where he is and what he is doing. But he would not have given up and could be behind closed doors.
3. The next contribution Mr. Wickramasinghe made to the country and the nation was “secretively” lobby for the cancellation of the GSP + given by the EU. Perhaps, you would remember, when he was questioned in Parliament by Hon.Dinesh Gunawardene as regards this involvement, Mr. Wickramasinghe gave a very “impressive” reply. He said “what is wrong even if I have done that”. (In Sinhala he said “Mama ahema korath, eke ethi veradda mokakda?).
4. The next MR. Wickramasinghe took up a national issue was against the “rising cost living”. He organised a “PATHOLA” march and protest rally where his supporters “smashed pots and pans” on the road. That was during the countary faced a devastating flood situation under which we experienced heavy damages to the crops, consequently sky rocketing the prices of agricultural products. That showed his “knowledge” and “experience” of the local conditions and tested his timing of “political agitations”.
5. The next important event was the passing of the 18th Amendment virtually making MR the “KING” in all spheres of public life. As usual the Opposition voted against it in Parliament, but did he explain this to the Public as the Leader of the Opposition? No protest rallys or even public utterances or references to it. Why? Because he knows that will also give him the powers to “control” and “manipulate” the Public Service including the Judiciary, if and when he occupys that “Chair”, which I doubt very much and wish he will not get it.
6. Now he wants to know what this Government will do to the PTA. We are just three to four years after eradicating the LTTE menace internally and still struggling with the “clearing” of those areas which were under the control of the LTTE where large “haul” of explosives and weapons are being dug out. Still, although the Government is boasting of “rehabilitation” of the ex LTTE combatants, their day to day activities have to be monitored and watched, specailly because there is a very visible and active participation by the “Diaspora” to de-stablize and make a reality of the dream of a “separate state”. In addition, various organizations have sprung up (with or without Government support) in disrupting the peace of the countrry. Has Mr. Wickramasinghe as the Leader of the Opposition and a person to take over the running of the Government affairs, considered this situation and ask this question? On the other hand what does he “recommend” to do? In my opinion one need not be a “professor” in learning to understand this situation. What is needed is “Common Sense”. Does Mr. Wickramasinghe display even that ability of “common sense”?
7. As regards his “political maoeuvres” it is sufficient to draw the attention to the changes he did to the UNP Constitution in order to “secure” his Leadership for an extended period of six years. In that respect he matches very well with MR.
