Sinister Campaign Afoot To Block Sri Lanka Using Paranagama Report At UNHRC

The release of the long awaited Paranagama Commission Report, officially known as the Presidential Commission to Investigate into Complaints Regarding Missing Persons that was established in 2013, has now come into sharp focus, because both the UN and the world at large has been stuck with the conclusions of the Darusman Report, (officially known as the Report of the Secretary-General’s Panel of Experts on Accountability in Sri Lanka), released in 2011, namely, that up to 40,000 civilians have been killed by the army in the final phase of the conflict.

In the wake of a global civil society outcry on possible genocide in Sri Lanka, the 47-member UN Human Rights Council adopted a resolution in March 2014, which requested the Office of the High Commissioner (OHCR) to undertake a comprehensive investigation into alleged serious violations and abuses of human rights and related crimes by both parties in Sri Lanka during the last phase of the armed conflict. An expert panel was set up by the UN in late June 2014 and OHCHR was to present a comprehensive report on its findings by March 2015.

In response to this, the Government of Sri Lanka, on the 15th of July 2014, issued a second mandate to the Paranagama Commission, that obligated the Commission to inquire into the facts and circumstances that resulted in the principle loss of civilian life in the final stages of the conflict in Sri Lanka and to issue a report on or before the 15th of August 2015.

After all, the unverified death toll figure of 40,000 or more has led reasonable people all round the world, to conclude that the Sri Lankan army acted in a way that failed to observe the laws and customs of war.  The term “a genocidal army” stems from here.

mullivaikkal_civiliansTherefore, in order to come to the conclusion of how many civilians were killed, the UN must satisfy, as to who was a civilian in those circumstances. The UN needs to carefully consider the role of the Tamil civilians in this conflict, including the children who were forcibly conscripted. If a civilian joins the LTTE, and becomes part of the LTTE war machine, then they have to be properly classed as a combatant. The issue is further compounded by the fact that some of the Tamil civilians were forcibly conscripted whilst others volunteered freely to take up arms and they were engaged in combat in civilian clothes. According to reports, many of these civilians who were in the front line as LTTE combatants were killed.

To get any definitive answer on the question of the exact civilian death toll, it is important to determine to what extent did the civilians go voluntarily with the LTTE or by force?   At the moment the world has only got the Darusman conclusions.   It is important to know what conclusions the Paranagama Commission has come to, as they have been specifically asked to answer this question. Thus, in order to determine whether there is any truth to the allegations made in the UN Darusman report, the immediate release of the Paranagama Commission’s conclusions on the second mandate is vital. 

Considering that it received its legal advice from some of the foremost international practitioners who have helped to shape international law in the course of their duties, the contents of this report are hugely important not just for Sri Lanka, but the international community as a whole, who have got to view the conduct of the Sri Lankan army and decide on the extent of guilt in order to impose punishment that is appropriate to the crime, if indeed one has been committed.

The fact that the former Rajapaksa regime rejected the Darsuman Report and did not cooperate with the UN during the inquiry, forced the Darusman panel to rely exclusively on unverified information that was provided to them by the Tamil diaspora funded NGO groups.

The former Government failed to make any credible response to the complaints made in Geneva at the inception, and then finally, it was only at the behest of the Chairman of the Paranagama Commission, who needed assistance with regard to international humanitarian law, international human rights law, and customary international law, an advisory council of international legal and military experts came to be appointed on the 15th of July 2014.

Thus both the authors of the Darusman Report and the UN should welcome the credible analysis of the events by these experts, as that would enable them to arrive, finally at the truth. After all, Sir Desmond De Silva Q.C. and Professor David Crane, were both chief prosecutors of an international criminal tribunal.   They were both picked personally by the Secretary General of the United Nations to discharge those roles.   In that role, they were both appointed at a level of an Under Secretary General of the United Nations.

Sir Geoffrey Nice Q.C. was the lead prosecutor in the case against Slobodan Milošević, the former President of Yugoslavia.  In fact, all three of them, have each prosecuted a head of state.  Sir Desmond prosecuted the former President of Liberia,  Charles Taylor, and had him arrested  and prosecuted for war crimes, for which he is now serving 50 years in prison.  Professor David Crane, who was Sir Desmond’s predecessor of the UN sponsored court, drew up the indictment against Charles Taylor.

It is unfortunate that due to the animosity towards Rajapaksa regime, appointment of these experts with impeccable international reputations, who are independent professionals, have been wrongfully and unjustly maligned. Politically motivated attacks on Sir Desmond de Silva in the Sri Lankan Parliament and in the national press in Colombo were seen as attempts to undermine the Paranagama report and prevent it from being submitted to the UN.

In a petition that was recently sent to the President, signed by some prominent as well as controversial civil society personalities in Colombo, called upon the President to rescind Sir Desmond’s appointment and to disband the advisory council to the Paranagama Commission.

A study of that petition would reveal that when the petitioners lobbied to rescind Sir Desmond’s appointment, it was based upon the allegation that his conduct in his role as a adviser to the Government of Sri Lanka was being examined by the Bar Standards Board in England.

The petition concealed the name of the complainant. Research done by this writer, has revealed that the complainant was none other than the Sri Lanka Campaign for Peace and Justice, set up in the aftermath of the LTTE defeat in May 2009. The stated objectives of some of its advisers is a separate state.

Most intriguingly, it turns out, that on the advisory panel of this campaigning NGO, sits Ms. Yasmin Sooka! She was on the Darusman panel that made these unsubstantiated findings against the Sri Lankan army. She too would have a clear interest in seeking to preserve the Darusman conclusions from being challenged.  Of course, if the 40,000 civilian deaths figure, advanced by Darusman turns out to be untrue, one of the principal allegations against the Sri Lankan army, ‘genocidal army”, drops away.

It appears that Yasmin Sooka and the Tamil Parliamentarian M.A. Sumanthiran, who is leading the campaign against Sir Desmond, is afraid that the release of the Paranagama Report would seriously hurt the Darusman “genocide” narrative which helps to justify the call for establishing a separate Tamil state in the North. Therefore, it is manifestly obvious, that sinister attempts are afoot to keep the unverified Darusman conclusions in place and undisturbed.

It is astonishing that an independent UN panelist is a member of a campaigning NGO. In 2013, Yasmin Sooka and M.A. Sumanthiran MP both appeared at a meeting organized in the House of Commons in London by the Global Tamil Forum, where she spoke and was welcomed as “comrade Sooka”.

Is all of this purely coincidental?   Or part of an elaborate scheme to discredit the advisory panel of the Paranagama report in advance and preserve the Darusmann narrative that helps to justify a separation between the communities? We Sri Lankans want closure on this issue by arriving at the truth. Vested interests should not be allowed to prevent the truth from coming out.

Clearly, we expect the Paranagama Report that has received inputs from international experts to call a spade a spade, and hold the Government and the LTTE accountable impartially, and state the facts and debunk fiction, so that the international community and us Sri Lankans can come to the correct conclusions about the last phase of the conflict.

Those pushing the unsubstantiated claims of 40,000 civilian deaths in the Darusman report to keep the Tamil diaspora enraged against Sri Lanka, and those in denial about civilian deaths, holding on to ridiculous “zero” civilian death figures may well be disappointed by the Paranagama report. If indeed the report is prepared impartially.

We hope that both Mr. Sumanthiran and Ms Sooka, and the civil society personalities who signed the petition, pluck up enough courage to have an open mind and display sincerity in their intentions when they say they want to get to the bottom of this issue of civilian casualties during the last phase of the war.

We as citizens, irrespective of our ethnicity, need closure on this subject by getting to the truth of the matter, so that we can either feel totally outraged or somewhat reflective to adjust our outrage, if indeed the claims that riled us up were not exactly what we thought them to be.

It would be a historic injustice to our country, if the truth was suppressed and we were misled by exaggerations and untruths. Thus the international community has a moral duty to give the Sri Lankan community a chance to discover the truth and the time and space to reflect on that, and help us in our reconciliation. Let’s hope the Paranagama Report does not also not suffer the same fate as the Sansoni Commission report.

However unpalatable the Paranagama report might turn out to be, when we eventually get to read its contents, we expect the truth and not fiction. Equally we need accountability, regardless of whether justice is going to be retributive or restorative in the way it gets dispensed.

    The accused can not be the judge. All Sri lankan officials and the supporters are the participants of the crimes. A fair trial is not possible in Sri lanka. There is no witness protection. The International trial should take place before rest of the witnesses die naturally or unnaturally. It is impossible to changes the mindset of the Buddhist church and a fair solution or redress for the Tamil grievance is very remote.
    Participants and supporters of Tamil massacre do you all have conscience?

      Has he got any idea as to what had happened to those reports that were submitted to Chandrika by those three commission she set up to investigate disappearances from 1987 to 1992?

      The three commissions were interlinked and official title was

      “Presidential Commission of Inquiry into Involuntary Removal or Disappearance of Persons”

      On the principle that an accused cannot be his own judge, Paranagama commission or any other investigation conducted by Srilanka government will be fundamentally flawed, because Srilanka government and security forces are standing charged with war cimes committed on Tamil people.
      Secondly there is no witness protection given. Several people due to fear have not come forward and some who did have been threatened by the security forces. To calculate the number of disappeared on the basis of complaints is trying cover up. It is well known that some families have been wiped out completely with no one to make complaint about, and there are several orphans who do not have the capacity. Therefore dabbling in numbers is not going to expose the truth.

      There is ample circumstancial evidence of large scale massacre, though the government is not accepting it. In any war, there will be all categories of wounded, but those who were allowed to cross over to IDP camps were mainly walking wounded and a few moderately wounded who were carried by their relatives. It is common knowledge that badly wounded, especially those with thermal burns and shattered injuries were killed to prevent the truth about use of chemical weapons and cluster bombs. We gather that barrels of sulphuric acid were imported from a far eastern country and used to dissolve dead bodies to erase the evidence. The Bishop of mannar claied that around 140,000 people are missing from the original population during war in the last few years, which the government is denying. in the last election, the fact that two parliamentary seats were reduced in Jaffna electorate tallies with this figure about the loss of Tamil population.

      Adressing a gathering in London I said, “There cannot be peace without justice or reconciliation without truth. Legally what happened to the Tamils in the past may or may not be called genocide, but morally it is so, because there was a clear intent of successive governments to reduce Tamil population in Srilanka, as evidenced by the ddeportation of Indian Tamils under Srima-Shasthri pact and the forced eviction of Ceylon Tamils under the guise of the war with LTTE. I have been a civilian witness to the three major riots unleashed on Tamils as well as a medical witness to the atrocities committed by security forces on non-combatant Tamils. In none of these instances Sinhala perpetrators were brought to justice. Due to this poor track record, it is natural for Tamils to to have scepticism about the outcome of any internal investigation to be carried out by Srilanka government on the alleged war crimes committed by their security forces. Like in the past sham trial will be conducted by a panel of lackeys, where witnesses will be threatened, false evidence led by security forces, some scape goats found to apportion the blame, and main culprits allowed to go free”

      In war crimes investigation carried out in Liberia, Bosnia or Rwanda, the process was not conducted by the accused, and investigators were not from those countries in order to make it look legitimate. How is that a double standard is being established as for the war crimes that happened in Srilanka. Reconciliation has to be between Sinhalese and Tamils and not between Srilanka and USA. If in the minds of Tamils the process lacks credibility, you cannot in any way expect it to be a fair one, because as I mentioned above real truth about the atrocity will never come to light, retarding any progress in reconciliation. The full investigation must include visit to the war zone, taking soil samples for chemicals, exhuming mass graves for undissolved parts of bodies and exploring sea bed around for dumped bodies. Any chance of such examination to be allowed by Srilanka government is far fetched.

        I actually heard that it’s common knowledge that Sri Lanka actually used left over tactical nuclear weapons imported from Russia to vapourise the remains dissolved in sulphuric acid imported from Malaysia of the bodies of 100% totally innocent We Thamizh burned in industrial incinerators imported from China who were killed using chemical and biological weapons imported from Iraq after they were injured in the initial nuclear attacks. So the whole thing kind of went full circle.

        Now if only The Hague accepeted We Thamizh wet dreams as evidence :D

        Just in case you cant make the distinction-there is a big difference between a “Sinhala government” and “Sri Lankan government”. Sinhala governments are typically people like MR, Dayan & Wimal & Co who drum-up Sinahala nationalism to pursue their own agenda. They are oppressive to the core and also use groups like the BBS to silence the Muslims and other minorities. There is no other term other than to call them -SINHALA GOVERNMENT.

        Dharmakeerti should also know not to emphasise the term “Tamil Politician”. I am very skeptical of people who place emphasis on any race whether it be Tamil, Sinhala or Muslim or Burgher because we are all Sri Lankans.

But you Tamil extremists are wrong in stating that the Government of Sri Lanka is a “Buddhist Government” or a “Sinhala Government” , because that is not a fact. The writer Chris Dharmakirti is quite objective in his analysis. It is Tamil racists like you Mr. Pot Shot, who have polarized our community. The Tamil community has many moderates, but then you got your “boys” to kill them and lamp post them. Now there are no more moderates left who dare to speak, because you run them down.     It’s telling that there have been no legal, factual challenges from We Thamizh quarters to the professional opinions expressed by Sir Desmond and co. The best they’ve come up with so far is something along the lines of “he was paid a lot of money for his services, so what he says doesn’t count!!!11!” :D

    While you want to get to the “truth of the matter”, and of the stones thrown at Sir Desmond, you failed to understand or you refuse to understand that ALL commissions and inquiries held during the Rajapakse reign were shams. After spending much time and money, all Vitarana could do was to dance to the tune of Rajapakse. The terms of reference of the appointments were much to be desired. The architect MR and any commissions or experts appointed by him will be in the direct line of fire. MR mad sure of that, not forgetting how an earlier panel, in which Marzuki was a member, left in disgust. In short, MR never wanted the truth to be out. So, admittedly, how on earth he would allow any report to be published that may have held him culpable.

    Let us first try to get some rough statistics of children below the age of twelve, elderly persons both men and women who got killed. That will give a rough idea of the total number of non- combatant civilians who were killed.
    No sane person could claim that such people too were ‘combatants’.

    When was the Ceylon/ Sri Lanka state government accepted the wrong doings ever since 1947 ?
    Even during the two JVP uprising against the ruling governments , the governments at that time were not wrong .

    Who changed the constitution so many times and with two third majority, since 1947 ?
    Who created the many racial riots since 1947 ? The minorities and their political leaders ?

    Who were responsible for the uprising of Tamil Youth Militancy ? It was the Tamils and their political leaders .

    Who were responsible for wiping out all the grave yards in the wanna region ? Who banned all the , media, International organisations and local NGO s from the South, visiting the war zones after May 19th 2009? It was Sumanthiran and other TNA leaders & MPs.

    Who were responsible for the abductions, tortures, ransoms , killings etc even in the South ? The Tamils.

    Chris (t) Dharma (kirti ) , why then people rejected MaRa to be the President again and also he becoming a PM again after 10 years ?

    As they say in my country I have no skin in the game. I only have my memories and impressions from visiting the resplendent island in 2007/8. My host introduced me to his Buddhist, Hindu, Christian and Moslem friends and we all got along. Then some Tamil militants would blow up a crowded market or waylay a bus with pilgrims. In that land where dogs are left to sleep in the street and the humans navigate their path around, this sort of extreme measures got my attention. It never seemed like a fair fight, and certainly it never is when one side wants peace. This latest ploy seems to me, again as the neutral outsider, to be an attempt to stretch it further, effectively taking the war into the arena of debate, with the end game being the same as that of the war: a partition of the land. A jewel Sri Lanka certainly is, so to cleave off a chunk to mollify one facet will not increase the illumination of the world.

    I recall that some of those who signed this petition against Sir Desmond and the international advisers, and the same MP Sumanthiran were quite vocal and raised objections in international forums against the LLRC (Lessons Learnt & Reconciliation Commission) members. Once the LLRC came out, they all went silent, as their fears were proven to be unfounded. Is that the case here with the Paranagama Report as well?

    The release of the long awaited Paranagama Commission Report, officially known as the Presidential Commission to Investigate into Complaints Regarding Missing Persons that was established in 2013, has now come into sharp focus, because both the UN and the world at large has been stuck with the conclusions of the Darusman Report, (officially known as the Report of the Secretary-General’s Panel of Experts on Accountability in Sri Lanka), released in 2011, namely, that up to 40,000 civilians have been killed by the army in the final phase of the conflict.

    In the wake of a global civil society outcry on possible genocide in Sri Lanka, the 47-member UN Human Rights Council adopted a resolution in March 2014, which requested the Office of the High Commissioner (OHCR) to undertake a comprehensive investigation into alleged serious violations and abuses of human rights and related crimes by both parties in Sri Lanka during the last phase of the armed conflict. An expert panel was set up by the UN in late June 2014 and OHCHR was to present a comprehensive report on its findings by March 2015.

    In response to this, the Government of Sri Lanka, on the 15th of July 2014, issued a second mandate to the Paranagama Commission, that obligated the Commission to inquire into the facts and circumstances that resulted in the principle loss of civilian life in the final stages of the conflict in Sri Lanka and to issue a report on or before the 15th of August 2015.

    After all, the unverified death toll figure of 40,000 or more has led reasonable people all round the world, to conclude that the Sri Lankan army acted in a way that failed to observe the laws and customs of war. The term “a genocidal army” stems from here.

    mullivaikkal_civiliansTherefore, in order to come to the conclusion of how many civilians were killed, the UN must satisfy, as to who was a civilian in those circumstances. The UN needs to carefully consider the role of the Tamil civilians in this conflict, including the children who were forcibly conscripted. If a civilian joins the LTTE, and becomes part of the LTTE war machine, then they have to be properly classed as a combatant. The issue is further compounded by the fact that some of the Tamil civilians were forcibly conscripted whilst others volunteered freely to take up arms and they were engaged in combat in civilian clothes. According to reports, many of these civilians who were in the front line as LTTE combatants were killed.

    To get any definitive answer on the question of the exact civilian death toll, it is important to determine to what extent did the civilians go voluntarily with the LTTE or by force? At the moment the world has only got the Darusman conclusions. It is important to know what conclusions the Paranagama Commission has come to, as they have been specifically asked to answer this question. Thus, in order to determine whether there is any truth to the allegations made in the UN Darusman report, the immediate release of the Paranagama Commission’s conclusions on the second mandate is vital. 

Considering that it received its legal advice from some of the foremost international practitioners who have helped to shape international law in the course of their duties, the contents of this report are hugely important not just for Sri Lanka, but the international community as a whole, who have got to view the conduct of the Sri Lankan army and decide on the extent of guilt in order to impose punishment that is appropriate to the crime, if indeed one has been committed.

    The fact that the former Rajapaksa regime rejected the Darsuman Report and did not cooperate with the UN during the inquiry, forced the Darusman panel to rely exclusively on unverified information that was provided to them by the Tamil diaspora funded NGO groups.

    The former Government failed to make any credible response to the complaints made in Geneva at the inception, and then finally, it was only at the behest of the Chairman of the Paranagama Commission, who needed assistance with regard to international humanitarian law, international human rights law, and customary international law, an advisory council of international legal and military experts came to be appointed on the 15th of July 2014.

    Thus both the authors of the Darusman Report and the UN should welcome the credible analysis of the events by these experts, as that would enable them to arrive, finally at the truth. After all, Sir Desmond De Silva Q.C. and Professor David Crane, were both chief prosecutors of an international criminal tribunal. They were both picked personally by the Secretary General of the United Nations to discharge those roles. In that role, they were both appointed at a level of an Under Secretary General of the United Nations.

    Sir Geoffrey Nice Q.C. was the lead prosecutor in the case against Slobodan Milošević, the former President of Yugoslavia. In fact, all three of them, have each prosecuted a head of state. Sir Desmond prosecuted the former President of Liberia, Charles Taylor, and had him arrested and prosecuted for war crimes, for which he is now serving 50 years in prison. Professor David Crane, who was Sir Desmond’s predecessor of the UN sponsored court, drew up the indictment against Charles Taylor.

    It is unfortunate that due to the animosity towards Rajapaksa regime, appointment of these experts with impeccable international reputations, who are independent professionals, have been wrongfully and unjustly maligned. Politically motivated attacks on Sir Desmond de Silva in the Sri Lankan Parliament and in the national press in Colombo were seen as attempts to undermine the Paranagama report and prevent it from being submitted to the UN.

    In a petition that was recently sent to the President, signed by some prominent as well as controversial civil society personalities in Colombo, called upon the President to rescind Sir Desmond’s appointment and to disband the advisory council to the Paranagama Commission.

    A study of that petition would reveal that when the petitioners lobbied to rescind Sir Desmond’s appointment, it was based upon the allegation that his conduct in his role as a adviser to the Government of Sri Lanka was being examined by the Bar Standards Board in England.

    The petition concealed the name of the complainant. Research done by this writer, has revealed that the complainant was none other than the Sri Lanka Campaign for Peace and Justice, set up in the aftermath of the LTTE defeat in May 2009. The stated objectives of some of its advisers is a separate state.

    Most intriguingly, it turns out, that on the advisory panel of this campaigning NGO, sits Ms. Yasmin Sooka! She was on the Darusman panel that made these unsubstantiated findings against the Sri Lankan army. She too would have a clear interest in seeking to preserve the Darusman conclusions from being challenged. Of course, if the 40,000 civilian deaths figure, advanced by Darusman turns out to be untrue, one of the principal allegations against the Sri Lankan army, ‘genocidal army”, drops away.

    It appears that Yasmin Sooka and the Tamil Parliamentarian M.A. Sumanthiran, who is leading the campaign against Sir Desmond, is afraid that the release of the Paranagama Report would seriously hurt the Darusman “genocide” narrative which helps to justify the call for establishing a separate Tamil state in the North. Therefore, it is manifestly obvious, that sinister attempts are afoot to keep the unverified Darusman conclusions in place and undisturbed.

    It is astonishing that an independent UN panelist is a member of a campaigning NGO. In 2013, Yasmin Sooka and M.A. Sumanthiran MP both appeared at a meeting organized in the House of Commons in London by the Global Tamil Forum, where she spoke and was welcomed as “comrade Sooka”.

    Is all of this purely coincidental? Or part of an elaborate scheme to discredit the advisory panel of the Paranagama report in advance and preserve the Darusmann narrative that helps to justify a separation between the communities? We Sri Lankans want closure on this issue by arriving at the truth. Vested interests should not be allowed to prevent the truth from coming out.

    Clearly, we expect the Paranagama Report that has received inputs from international experts to call a spade a spade, and hold the Government and the LTTE accountable impartially, and state the facts and debunk fiction, so that the international community and us Sri Lankans can come to the correct conclusions about the last phase of the conflict.

    Those pushing the unsubstantiated claims of 40,000 civilian deaths in the Darusman report to keep the Tamil diaspora enraged against Sri Lanka, and those in denial about civilian deaths, holding on to ridiculous “zero” civilian death figures may well be disappointed by the Paranagama report. If indeed the report is prepared impartially.

    We hope that both Mr. Sumanthiran and Ms Sooka, and the civil society personalities who signed the petition, pluck up enough courage to have an open mind and display sincerity in their intentions when they say they want to get to the bottom of this issue of civilian casualties during the last phase of the war.

    We as citizens, irrespective of our ethnicity, need closure on this subject by getting to the truth of the matter, so that we can either feel totally outraged or somewhat reflective to adjust our outrage, if indeed the claims that riled us up were not exactly what we thought them to be.

    It would be a historic injustice to our country, if the truth was suppressed and we were misled by exaggerations and untruths. Thus the international community has a moral duty to give the Sri Lankan community a chance to discover the truth and the time and space to reflect on that, and help us in our reconciliation. Let’s hope the Paranagama Report does not also not suffer the same fate as the Sansoni Commission report.

    However unpalatable the Paranagama report might turn out to be, when we eventually get to read its contents, we expect the truth and not fiction. Equally we need accountability, regardless of whether justice is going to be retributive or restorative in the way it gets dispensed.

    The writer does not have to go far north to disclaim the killing of 40,000. The MR regime killed people from its own race, Lasantha, Pradeep, Sripathy, Bharatha Lakshman and a host of others from the Sinhala community. There were others like Thajudeen from the muslim community attempted murder of Keith Noyar (Burger) and many other journalists who fled or otherwise would have been slaughtered by the forces. Raviraj whom we now know was killed by the Navy in Colombo….none of these were investigated but pushed under a carpet and denied as government sponsored killings, mostly conducted by the armed forces. What has Paranagama have to say about this? I can only conclude that if these brutes can kill their own what is it to them to slaughter 40,000 Tamils and call it an exaggeration. Any Sinhalese who can kill 4 of their own in the south and denying it are very capable of killing 40,000 in the north and denying it too.

    So Mr Chris your shallow observation his heavily bent to save your Government from disgrace. I will not use the term Sinhala Government because I will be implicating the Sinhala Community.       If you have call the Traffic Police who will be speaking Sinhalese. But if you hear them speak Tamil call the Army as they may be ex LTTE regrouping.

    Since you are a Civilian, I suggest that you do not comment to specific questions asked by certain individuals. Instead, keep providing the facts to the worldwide audience.

    As a sustaining member of Public Broadcasting Station (PBS)So Cal, I wonder whether they would like you to provide them with additional info for future broadcasts.

    There is a large population of Sri Lankan “Baby Boomers” in Southern California who fall under the “Ex Pat” category. However, we most certainly are concerned about the well being of ALL persons residing in Sri Lanka.

    Should We, the “Ex Pats” were to decide on expanding “Senior Retirement Communities in Sri Lanka”, then, we all need to actively participate in establishing/maintainig a war/worry free atmosphere.

    Mr. Dharmakirti,

    In the comments pages of CT itself, Lal Wickrematunge, the brother of Lasantha, whose killing under the Rapjapaksa regime remains unresolved, questioned the integrity of Desmond de Silva, who is a relative of the Wickrematunges.

    Not only was Desmond de Silva charging an insane amount of money from a poor country like Sri Lanka, but he said nary a word about the then regime’s suppression of Lasantha’s murder investigation.

    There are others from the UK who have shown evidence of de Silva’s partiality and prior bias in favor of the SL regime on the war crimes in Sri Lanka.

    Sumanthiran on the other hand had fearlessly taken Lal’s case against Gotabhaya Rajapaksa, the monster widely known as white van abductor and torturer, on an issue related to the Sunday Leader, and Lal knew his integrity.

    As others have noted above, any commission appointed by the Rajapaksa regime lacks credibility and would only be serve to whitewash crimes. The history of blatantly thwarting justice in the case of Lasantha, Ekenaligoda, even Sarath Fonseka, the Trinco-5, ACF-17, and others, as well as vast under-counting of the number of civilians in the Vanni during the war, all buttress the argument that the regime absolutely lacked credibility.

    We also remember how the IIGEP investigation was thwarted by none other than the then attorney general, C.R. de Silva, the man who would later become part of the LLRC, making a mockery of it.

    But more generally in Sri Lanka, even the earlier governments used to do nothing in response to findings of such domestic commissions.

    That is why activists argue, quite rightly, that only an international investigation can bring out the truth.

    If the new regime in power comes up with any valid alternative ideas to an international investigation that will be given due consideration. But it will be a travesty to push the report of a commission appointed by the Rajapaksa regime itself.

    Only a diabolical character would hide under a name like “kali” to post comments on this page because of his inability to reveal his true identity. The insult filled response by Kali, with several repetitive posts, clearly proves that it is Kali who is clearly demented and should be in an asylum like Angoda. The writer provides a balanced viewpoint whilst Kali and his band of venom filled liars, are clearly wanting to keep the diabolical claim of “genocide” in the pro-Darusman intact.

    What a hypocrite MP Sumanthiran is. Thanks to Chris’ s detective work we now know that the MP iwho attacked Desmond de Silva in Parliament is working hand in glove with Yasmin Sooka who is a senior advisor to the Campaign for Peace and Justice that has reported de Silva to the Bar Standards Board in the UK.
    Yasmin Sooka is meant to be an INDEPENDENT UN pannelist! What was she doing with Sumanthiram at a GTF
    meeting in London? Why does Sumanthirsn not critisize Sooka for bias?
    The complaint against de Silva is and the other members of the Paranagama legal advisory team are cheap and disgusting because it it shows a cunning plan to try and injure the reputations of persons who enjoy the confidence of the UN and the international community.
    This will backfire on the aims and plans of Sumanthiran and the Sri Lanka Campaign for Peace and Justice.
    Sooka should be removed from whatever UN panels she serves on and the Darusman Report should
    be thrown into a dustbin.

    Pro-Tiger terrorists are in a panic, fearing Paranagama report would divulge the truth to the world, that the Sri Lankan armed forces only defended the nation, irrespective of ethnicity, when they eliminated the mindless LTTE separatist terrorists, who refused to negotiate in good faith nor surrender.
    These same people are trying hard to project people like Yasmin Sooka, Dharusman etc who have closely associated with the separatists, as independent panellists. What a joke, what a sham, what a shame we have to tolerate these con artists.

    Paranagama report, with submissions from eminent, independent, world renowned experts, must be published and presented to the UNHRC to expose these separatist liars. Paranagama commission reminds me of the Sansoni Commission which was set up on Federal Party demands under Amirthalingam, but the report turned out to be a scathing indictment of the separatist racist elements, which was represented by the then Federal Party. Paranagama report could be the same as truth must prevail. USA knows the truth, though they may do wrong things to achieve their political aims, such as regime change.

    Wow…to call this writer Chris Dharmakirti names and label him when his views are anything but racist or pro-Rajapaksa, shows how desperate the extremists in the Tamil community have become to hold on to the Darusman findings. It is commentators like Kali and others who are racist and intolerant by the very outburst of insults they have expressed here on this page. Sad that there is no space for moderate points of view. In reading the article, it is quite clear to any rational person that all what Chris Dharmakirti is asking for is for our society to have the true facts verified and placed so that the community can come to the correct conclusions instead of being misled with wrong information. The write is quite clear in stating that those who are guilty should be investigated and dealt with according to the law. The labels and insults only go to prove how desperate the extremists in the tamil community have become.

    It is ridiculous to attack Yasmin Sooka.She was a member of the UN Expert Panel way back in 2010.She joined Campaign against Srilanka which originated years later.Having served the Panel as an independent person,she was so sick and enraged at the atrocities committed by Srilankan state,Yasmin Sooka decided to join the campaign against Srilanka like so many honest and reasonable persons.What is wrong in that?

      Can you link me to anything she said during that 30 years?

    Surely the point it that while Sooka is entitled to join any campaigning group she likes, she is still on the list of UN independent panelists! She is still exploiting that status to advance her political cause. Should she not resign first? If not,
    should she not be removed? She is continuing to make allegations against Sri Lanka to the UN even to this day. If what is said here is wrong I hope that the Sri Lanka Campaign for Peace and Justice for which she works , will correct this.
    if not, we will draw our own conclusions!
