Sirisena Wants First Clause Removed From NCM: Requests Party Leaders To Go For A ‘Vote By Name’

President Maithripala Sirisena, at the meeting with political party leaders, has informed them to take another vote on the No Confidence Motion against former President Mahinda Rajapaksa, without its first clause.

The first clause says the gazette notifications issued by President Maithripala Sirisena appointing former President Mahinda Rajapaksa as the Prime Minister and proroguing Parliament be declared null and void.

Sirisena has also informed that he is in a position to accept the verdict of the legislature if the vote is conducted by name, according to Parliamentary traditions and procedures.

In return, he has promised that he will not obstruct the functioning of the legislature again by proroguing Parliament. “He said he would not prorogue Parliament again and will support the ‘majority’ group in the house to obtain ‘government’,” Tamil People’s Alliance (TPA) Leader Mano Ganesan said, after the meeting.

The President, at the meeting, had promised that he would resolve the political crisis in the country within the next “two-three days.”

“From what I see, the political crisis in Sri Lanka is still far from resolution,” an informed source familiar with the matter told Colombo Telegraph. “The President has requested the vote to be taken by name but has failed to give any assurance that his MPs will act with restraint. Also, this discussion sounds like a negotiation with a mafia leader. In exchange for the removal of the first clause, he has given an assurance not to disrupt the Parliamentary proceedings. Accepting the functioning of the legislature is the duty of a President. If he doesn’t perform this duty, he should be impeached,” he explained.

      Do not trust Sirisena. He is a known Traitor, Sevalaya, Mala- Pererhaya, Patholaya and PACHAYA. Do not remove the First Clause, that had been approved by the Supreme Court.Stuck to your guns. Consider an impeachment motion.

      Get another vote of NCM against Mahinda Rajapaksa, BUT KEEP THE FIRST CLAUSE. Thee Supreme court has affirmed the first clause.

Actions and gazette notifications issued by the President contrary to the provisions of the Constitution, appointing the Prime Minister and proroguing Parliament are IMPEACHABLE OFFENCES and will be dealt in accordance to the Constitution and Constitutional amendments of the Democratic Socialist Republic of Sri Lanka.

      Let Sirisena’s balls dissolve more.

    If this amendment is made to the No Confidence Motion at the request of President Sirisena, does he realize that it becomes its a No Confidence Motion proposed by him! Who are the donkeys who are his advisers?

      The President may be trying to justify his dissolution of the parliament, when the Supreme Courts hearings resume in December. If there is a no-confidence motion passed by a majority in parliament ……. what does the SL constitution say?

      It looks like the UNP has no other option but to prepare for an election. Their chances of victory would massively improve if Sajith takes over the leadership of the party with strong backing from Ranil, Navin and Karu. If the UNP is victorious they can nominate Ranil to be the next presidential candidate with promise to further transfer presidential powers to parliament.

      On the other hand, if SLPP wins the parliamentary election, they can immediately launch impeachment proceedings against the President – which may be supported by all parties in the parliament. Such a course of action may eventuate even if the UNP is successful at the parliamentary elections.

      In that eventuality, the next presidential election will be a contest between a Rajapakse and Ranil, with the added attraction of a JVP candidate. Should be very interesting!

      All this is if democracy survives. Let us wait and see.

      The donkey advisers think that the SC based it’s interim order solely because of the Gaztte notification, that is why My3 want’s another NC vote.
      He has swallowed that without having the basic notion that then it wouldn’t be a parliamentary NC vote but his own. What a mutt he is?

      Doesn’t MR have any shame after having been President for two terms and thereafter getting electorally defeated in 2015 to come back via the the back door on Oct. 26th 2018 as PM briefly until the SC’s interim order on the President’s dissolution of parliament following which his failure to have the required number of parliamentary candidates that saw him automatically out.

    At least Gamaya talking sense after all this HAVOC he created in the country. The idiot did not think this will hurt the economy? All gas gembas who acted violently should be dealt with law in the parliament on 11/15 no matter which party. The guy who had the knife, people who threw things at the speaker and each other should be legally punished and should be kept away from any political activities for certain number of years.

    Once again Mahinda should not fall into the trap of Maithree who flip flops. Mahinda should resign his PM position today or early tomorrow morning than facing a no confidence motion and losing PM seat.

      He already lost it when he got Sira to dissolve parliament. The NCM is nothing but a formality in what is a complete damp squib of a coup.

        Your point is valid; but it make complicated when added with injunction. This Injection is not for illegally dismissing or appointing the PM. it was for dissolving the parliament. Under an uncontested dissolution, Cabinet survives, but MPs and Speaker go. So the dissolution of Parliament has not touched Old King, this time. So when the parliament is restored, logically he comes back as the PM. If SC case is won in Dec. 15, the other parliamentarians will show a knife & chase him out of the PM seat, even if EP refusing to appoint a new one.

    He’s buying time to wipe out the coffers from each ministry , sabotage all incriminating
    Evidence / destroy as necessary.

    The officials in departments who had colluded with criminals from the Fake government should be punished in court of law.
    This can be done by criminal law to charge those officials from every department and organisations.

    In fact the clear out will take place in partnership with the fake government members, ministers and others.
    The clearance must have started from day one since the manic decision was made by the President about 3 weeks ago.
    Wonder whether the furnitures are left in those departments when the elected ministers takes charge after this mayhem.

    Another thing that may have moved him must be the behavior of his ally MR in Parliament today. MR was just a toothless Lion or at least an old lion with a few bad teeth. I felt sorry for the man when he read word for word from a paper. Even the rhetoric was al written down. He read it as if he was reading from the scriptures.

    Poor guy was clearly disturbed. Yesterday when he ran away from the Parliament with Namal, it must have been to meet a script writer. It was badly written, unconvincing and badly delivered.

      Ranil and MR are both made for politics. They will always be in Parliament. Don’t expect them to go back to civilian life just yet. Right and wrong is very clear in this crisis. No question. Silly Sena knows he blundered as he has gone a step too far. He has set the whole country on fire. He needs to now figure out how to save face the prestige of the office of President, without compromising his own ego. A tough ask. Ranil can only reap the benefits of MS and MR’s greediness to return to power through the backdoor. They both didn’t ask for it, but it was just thrust upon them.

      The first battle must be won before starting the next. What you suggest will only split the Grand old Party into factions. Easier said than done. Old glory must be restored before taking on new challenges. This is a battle of principles and restoring democratic rights, not about Party leadership. Maru Sira has no right to change the leadership of a Party that he does not represent. Basic stuff.

    People verdict vs one man,I wouldn’t trust his word,tried through the back door,may be windows open some where!
    He is up-to something.do the NCM for prez as well ,call for presidential election let contest with the siblings Sajth,Namal,Dhanam,etc

    It is not clear if the president was negotiating with Mano Ganesan or asked him to become a negotiator between him and JVP (Or better UNP). UNP holds the decisive votes and JVP brought the Resolution in the parliament. JVP doesn’t take any leadership. It refused do anything that will end up as supporting UNP. TNA could become the negotiator because they, from the very beginning, insisted New King to act to the Law. The Appointment, Dismissal, Prorogation and Dissolution all are constitutional violation. TNA would not easily get into a negotiator position to legitimize, but it kept insisting to Ranil if he wins, then the status quo should prevails (including TNA and UNP’s position that no legal action against Ep and TNA position of UNP-SLFP National Unity Government will be the one back in power). You guys may be getting from where the TNA is coming – though it is not very relevant. The point is, if Ranil didn’t win in this Sampanthar stand to lose everything because the other party will never ever go by law for another millennium. So if Mano Ganesan is not turning into a negotiator, I don’t see any use for this letter. But the matter we show was, not willing to negotiate, New and Old Kings were going on donkey trading to turn things into one side- i.e. a (rather Mullivaaikkaal) war without witness. We saw all he party leaders and members individually were called and offered bribes to become their acolytes. Muslim leaders took a religious opportunity and had transported their MPs outside of Lankawe. TNA who did have any opportunity like that have lost a wicket. Hard core JVPyers managed to hold together. Though Mano Ganesan didn’t lose, but on a broader perspective, Up Counters didn’t escape either. Loosely formed UNPyers are still going and coming into the saloon. This is a clear demonstration of no a conducive environment to believe each other.

    If the environment is not good, then at least the offer should bridge all gaps and go beyond to create a stable government. But, what the offer attempts here are to legalize the illegal and invalidate the 19A by the acceptance of the parliament. This will leave parliament had confirmed any illegal actions of EP is legal. Even the EP’s promise of not proroguing in return for giving up that written “Null and Void” is only by mouth. But, noticeably EP is being a person who doesn’t follow even the written down constitution.
    If JVP buy these gimmicks, then all I see is it hurting permanently any future law making operations in parliament but it will not give any better position to New King. It will, soon, decide if the dissolving of parliament is a constitutional violation or not. We do not know how that will be hurting the New King. As he had lost on imposing an election in a useful manner, he could have asked parties to withdraw the case on the illegal devolvement, with a promise of no future attempts like that. But he is seeking a rubber stamp from parliament 1).to appoint Old King or anybody else as PM without Parliament’s support and 2). he dissolving parliament as and when he wants. Some may feel, anyway, these two are on their own, not associated to coup, not illegal. His lawyers may be thinking that if these two are justified by the parliament the other two “Dismissing Ranil (because there was another legal PM existed) and dissolving of Parliament (because the legitimate minority government could not function)” can also be substantiated. If that is also works and the effect 19A is completely removed from constitution without an amendment with 2/3. But his option of leaving the “appointment and proroguing” not nullified by parliament leaves the door open to be challenged them in a court, in a future date.

    is it now possible to withdraw that and nullify that and pass another NCM to the whims and fancy of the President?

    When the NCM was presented, JO didn’t ask for a division. The Speaker tried several times to get the vote by name. But the JO didn’t allow as obviously they didn’t have the numbers. Finally he called for a voice vote. Then one side yelled “Agree” and the other side made noises. That is when the Speaker gave his final as the NCM was passed with majority votes which was obvious to the entire country as seen on TV.
    Politicians should understand that people are not deaf and blind. And they are certainly not idiots.
    I wished MR to be a gentleman and take the challenge head on. But his side acted like hooligans, joined by UNPers, and together they tarnished the good name of the country for no reason.
    President is the person who acted irresponsible and against the Constitution. If anybody to go, it should be the President.
    Anyway, this whole episode is a “very RARE PREVIEW” for voters before elections.
    Clearly, the next Parliament should also be comprised of either several independent groups or a new force which could garner at least 50 – 60 seats, for a start.

I wonder Why Ranil did not do the same procedure in his NCM and instead got MCC and Srilankan businessmen to throw money every where in the parliament. AMAZINg. New PM and the cabinet lost their existence because those who di dnot approve them made a biggest noise inside the parliament.

Because even our Karan Koku Malu specialist ladies in the Matugama area are saying that what you did is not fair. ‘Is not fair’ are not the exact words they used. They were using ‘Balu wedak’, ‘ketha wedak’ etc. with one using ‘ballekvath nokarana jara wedak’ to describe what you did.

    They are still ardent followers of Mahinda and they hate Ranil. That can never be changed. I visited them soon after MR lost the Presidential elections and asked them whom they voted for. Without a single exception, they said – Mahinda Mahattaya. I asked why? Their reasons were summarized in the answer of one of them. ‘Api oya pana nethi pendanta kemathi ne’. That is how they described you at that time – a weakling.

    Just can’t understand how a sitting President can request a clause to be removed from a NCM, surely according to the separation of powers the executive and the legislature stand on their own!! One thing for certain, both the Prez and fake PM have done terrible harm to their reputation by this charade. SriLankans may be emotional and quite fixated to their chosen political idols, but they are politically astute and can see through reality of what’s happening. Fake PM was appointed and the public was told the majority was with them, then before the truth was out, the parliament was dissolved. Punishment for misleading the public will be severe.

    I would suggest to do another no confidence motion by name and the speaker to write to sirisena that he could not do it last time because of the sabotage of parliament and the rowdinesss and this time to see that he controls his followers.Don’t take off the first clause which he wants.

    Speaker has taken responsibility of all happened from time he ascended to his chair. He wanted to obey to the Court order pave the path for the things to return to normalcy. IC is now going to accept that his manners and mode of conduct are accordance with democratic norm. Remember, Democracy is not a law, but the constitutions are the part of that modern democracy, is a written down law. Further in today’s world, Countries are members or not members, Democracy or other, obligated to sign, adopt and follow UN and other IC bodies and countries. We know the existence of Universal Jurisdiction, under which for an action you committed which in your country is not crime, would be a matter to sue you when you leave out of your country. So a citizen or an officer selected or appointed merely being complying with constitution will not make it as democratic conduct within or outside expectation. Thought some time the IC tells to follow the constitution, if your constitution is extremely faulty, they will insist to correct the constitution. UNHRC insisting on removing PTA and EU insisting on reworking the MMDA are not new subjects.

    Further, one incident or one action does not uphold or break democracy. If one reads the statements released IC, they can observe that IC looks at holistic of the operations, processes & system, not just an individual firing or hiring. For example if the firing-hiring is violating the laws and if that violation can be meet with challenge though another system, and then there is democratic system. If the challenge process restores the people’s expectation, then there Democracy is fully active. This is reason IC keep dismissing Lankawe’s individual actions ant keep supporting the illegitimate governmental actions in Lankawe. So far, though highly manipulated election laws and bribed & rigged election process, they don’t see the breakdowns the minorities are witnessing. Especially Lankawe courts have drawn an enormous support from IC, though they without missing a single opportunity to violate Tamils’ FR. So, all these time it was only Tamils who were counting the rain drops to constitute the real genocide taking place on them. Now IC, too starting to recognizing the way Lankawe’s breakdown of the democracy, that not flood gate breaking, but relentlessly soaking for days, months, years, decade & now a century on Tamils’ course.

    Please see the above. German Ambassador-Counselor has said the speaker was thrown with a garbage can, which is not very democratic. Why is he thinking so is the point here. We all have seen in TV News that Indian, Korean, Taiwan, Thailand …..Parliaments the throwing and beating up one another taking place. This time they came to know not just by accidently watching the news on the TV, but they even went to see in the parliament how the current affairs of Lankawe. Now they think, like Tamils, They too have started to count the raindrops to the systematic violation of democracy and violations of the citizens’ FR.

    One wonders how the same troubled mind that created the crisis is capable of non-crisis. Before making any decision based on his promise, it is essential and obligatory conduct a critical evaluation of this mind and the brain which seem to function independent of the will of the peole

    the unp has wonthe first battle but there are many more to come
    the unp should give up its triumphalism and meet him half way
    whatever the rights and wrongs he is still the president and he is there to stay for another year
    all he wants is for the unp to offer him a new prime minister as he cannot and will not work with ranil
    so if the majority is prepared for a change in leadership and offer sajith as prime minister the problem can be easily solved and the unp can govern for another 2 years with a sirisena -sajith govt the unp cannot force him to do anything they have to compromise other wise the rajapaksas will rule till the next elections
