
President Maithripala Sirisena, at the meeting with political party leaders, has informed them to take another vote on the No Confidence Motion against former President Mahinda Rajapaksa, without its first clause.
The first clause says the gazette notifications issued by President Maithripala Sirisena appointing former President Mahinda Rajapaksa as the Prime Minister and proroguing Parliament be declared null and void.
Sirisena has also informed that he is in a position to accept the verdict of the legislature if the vote is conducted by name, according to Parliamentary traditions and procedures.
In return, he has promised that he will not obstruct the functioning of the legislature again by proroguing Parliament. “He said he would not prorogue Parliament again and will support the ‘majority’ group in the house to obtain ‘government’,” Tamil People’s Alliance (TPA) Leader Mano Ganesan said, after the meeting.
The President, at the meeting, had promised that he would resolve the political crisis in the country within the next “two-three days.”
“From what I see, the political crisis in Sri Lanka is still far from resolution,” an informed source familiar with the matter told Colombo Telegraph. “The President has requested the vote to be taken by name but has failed to give any assurance that his MPs will act with restraint. Also, this discussion sounds like a negotiation with a mafia leader. In exchange for the removal of the first clause, he has given an assurance not to disrupt the Parliamentary proceedings. Accepting the functioning of the legislature is the duty of a President. If he doesn’t perform this duty, he should be impeached,” he explained.

The President may be trying to justify his dissolution of the parliament, when the Supreme Courts hearings resume in December. If there is a no-confidence motion passed by a majority in parliament ……. what does the SL constitution say?
It looks like the UNP has no other option but to prepare for an election. Their chances of victory would massively improve if Sajith takes over the leadership of the party with strong backing from Ranil, Navin and Karu. If the UNP is victorious they can nominate Ranil to be the next presidential candidate with promise to further transfer presidential powers to parliament.
On the other hand, if SLPP wins the parliamentary election, they can immediately launch impeachment proceedings against the President – which may be supported by all parties in the parliament. Such a course of action may eventuate even if the UNP is successful at the parliamentary elections.
In that eventuality, the next presidential election will be a contest between a Rajapakse and Ranil, with the added attraction of a JVP candidate. Should be very interesting!
All this is if democracy survives. Let us wait and see.

It is not clear if the president was negotiating with Mano Ganesan or asked him to become a negotiator between him and JVP (Or better UNP). UNP holds the decisive votes and JVP brought the Resolution in the parliament. JVP doesn’t take any leadership. It refused do anything that will end up as supporting UNP. TNA could become the negotiator because they, from the very beginning, insisted New King to act to the Law. The Appointment, Dismissal, Prorogation and Dissolution all are constitutional violation. TNA would not easily get into a negotiator position to legitimize, but it kept insisting to Ranil if he wins, then the status quo should prevails (including TNA and UNP’s position that no legal action against Ep and TNA position of UNP-SLFP National Unity Government will be the one back in power). You guys may be getting from where the TNA is coming – though it is not very relevant. The point is, if Ranil didn’t win in this Sampanthar stand to lose everything because the other party will never ever go by law for another millennium. So if Mano Ganesan is not turning into a negotiator, I don’t see any use for this letter. But the matter we show was, not willing to negotiate, New and Old Kings were going on donkey trading to turn things into one side- i.e. a (rather Mullivaaikkaal) war without witness. We saw all he party leaders and members individually were called and offered bribes to become their acolytes. Muslim leaders took a religious opportunity and had transported their MPs outside of Lankawe. TNA who did have any opportunity like that have lost a wicket. Hard core JVPyers managed to hold together. Though Mano Ganesan didn’t lose, but on a broader perspective, Up Counters didn’t escape either. Loosely formed UNPyers are still going and coming into the saloon. This is a clear demonstration of no a conducive environment to believe each other.

If the environment is not good, then at least the offer should bridge all gaps and go beyond to create a stable government. But, what the offer attempts here are to legalize the illegal and invalidate the 19A by the acceptance of the parliament. This will leave parliament had confirmed any illegal actions of EP is legal. Some may feel, anyway, these two are on their own, not associated to coup, not illegal. His lawyers may be thinking that if these two are justified by the parliament the other two “Dismissing Ranil (because there was another legal PM existed) and dissolving of Parliament (because the legitimate minority government could not function)” can also be substantiated. If that is also works and the effect 19A is completely removed from constitution without an amendment with 2/3. But his option of leaving the “appointment and proroguing” not nullified by parliament leaves the door open to be challenged them in a court, in a future date.

When the NCM was presented, JO didn’t ask for a division. The Speaker tried several times to get the vote by name. But the JO didn’t allow as obviously they didn’t have the numbers. Finally he called for a voice vote. Then one side yelled “Agree” and the other side made noises. That is when the Speaker gave his final as the NCM was passed with majority votes which was obvious to the entire country as seen on TV.
Politicians should understand that people are not deaf and blind. And they are certainly not idiots.
I wished MR to be a gentleman and take the challenge head on. But his side acted like hooligans, joined by UNPers, and together they tarnished the good name of the country for no reason.
President is the person who acted irresponsible and against the Constitution. If anybody to go, it should be the President.
Anyway, this whole episode is a “very RARE PREVIEW” for voters before elections.
Clearly, the next Parliament should also be comprised of either several independent groups or a new force which could garner at least 50 – 60 seats, for a start.
