Situation Report: Desperate Sirisena Contemplates Illegal Dissolution Of Parliament As Numbers Game Collapses

Running out of options President Maithripala Sirisena is getting ready to push Sri Lanka to the brink of lawlessness by dissolving Parliament unconstitutionally on Wednesday night Colombo Telegraph learns. If not on Wednesday night, President Sirisena is contemplating dissolution on Thursday the sources claimed.

On Wednesday afternoon Sirisena met with a group of lawyers to discuss his options as political party after political party declined his requests to join the Rajapaksa Government or at least abstain on a Parliament vote of no confidence against Rajapaksa. Some reports also said he had summoned Chief Justice Nalin Perera to discuss the constitutionality of the move. It was not confirmed if Chief Justice answered the summons. The President can refer questions to the Supreme Court on constitutional matters but officially and not by summoning supreme Court justices legal sources told Colombo Telegraph. Sirisena’s lawyers are arguing that while Section 70 of the Constitution (amended by 19th Amendment) explicitly states that Parliament cannot be dissolved by the President until it has completed 4.5 years of its term unless a resolution is moved by a two thirds majority in parliament requesting dissolution that provision is superceded by Article 33 (2) which outlines President’s general functions, including to summon, prorogue and dissolve Parliament.

Heavy movement was visible at President’s House late evening sources said with senior bureaucrats being summoned for urgent talks. Another option being discussed is a referendum of the people to determine if his actions to appoint Mahinda Rajapaksa as PM were legal.

An increasingly desperate President Maithripala Sirisena had taken over negotiations to build a majority for his illegally appointed Prime Minister Mahinda Rajapaksa, Colombo Telegraph reliably learns, meeting several Party leaders over the past few days to convince them to support the new Government.

On Wednesday November 7 which was the day Sirisena promised Speaker Karu Jayasuriya he would convene Parliament, before he issued a gazette declaring November 14 as the day, the President met with the Tamil Progressive Alliance led by UNFGG MP Mano Ganesan and the main opposition Tamil National Alliance (TNA). Both parties declined his request to abstain from voting. And also told the President that his actions were unconstitutional and illegal. President Sirisena was also informed that the Tamil people of Sri Lanka had voted in 2010 and in 2015 even supporting the former Army Commander who prosecuted the war against the LTTE in 2010 just to defeat Mahinda Rajapaksa as president. The Tamil representatives told the President that their people would never support their neutrality in the face of a real threat of Rajapaksa becoming Prime Minister. After SLMC Leader and ACMC Leader Rauff Hakeem and Rishard Bathiudeen have also declined support when invited for talks with President Sirisena over the weekend.

President Sirisena’s body language was bad during the meetings and he looked increasingly worried sources said adding that this might drive him to take desperate and willfully unconstitutional measures in order to break the deadlock and justify his actions on October 26.

This was in the aftermath of a major dressing down by former President Mahinda Rajapaksa at a meeting with UPFA MPs on Tuesday evening. Rajapaksa blamed S.B. Dissanayake for pushing him into the position without having the requisite numbers to defeat the country’s legal Prime Minister Ranil Wickremesinghe in Parliament. The Rajapaksas are showing signs of bowing out of negotiations to win MPs for a parliamentary majority Colombo Telegraph learns leaving President Sirisena and his agents to continue with this task.

A relative of UNP MP Hirunika Premachandra was also called about a cabinet posting by an agent of President Sirisena who also threatened to ruin her career.

      While Mahinda bent down before Maithri to gain power and now struggling to retain power, I am so surprised to see Sampanthan, Mano and Hakeem have the guts to refuse Maithri point blank.
      This is the best time for them to make their demands. But they have refused to budge!
      Even if Sampanthan makes a request for a Federal Constitution, Mahinda and Maithri will accede to it without a blink, at this point.
      But Sampanthan is not ready to sell his soul like that. I envy his guts to reject both Mahinda and Maithri and stand by Parliamentary democracy which is a hard slap to Mahinda, who had all the chances in the world to follow a legitimate path with the full support of all ethnicities to come back to power.
      OMG, I feel shocked at what I am seeing. What a turn of events!
      Minority party leaders are winning local and international recognition while our Sinhalese leaders are stooping to the lowest of the lowest violating all legitimate institutional norms that uphold democracy and rule of law.
      Maithri cannot dissolve the Parliament illegally when the SC has already recognized 19A as the decisive factor in the Constitution making all other provisions second to it.
      Though I’m not bothered about the influence of individual countries, if Maithri dissolved the Parliament against law, the international organizations where we are founding members will take stern action against SriLanka. They have done that to other countries against dictatorial leadership.
      Maithri has nothing to lose while Mahinda has lot to lose.
      It is still not late for former President Mahinda Rajapaksa to come back to decent, legitimate politics.
      I am sad to the extreme point to see the leader whom I loved very much, being under obligation to his own back-stabber, Maithri like this.

        The alternative is what a President claimed on a platform – he will

        I strongly believe that Sirisena is only acting to deceive Mahinda.
        He only wanted to humiliate Mahinda by dragging him into an unnecessary crisis at a time the latter was at the peak of his popularity.
        I am glad to hear Kumara Welgama’s decision to stand by his principles and be independent (in the Opposition) while voting in favour of Mahinda, as and when the need arises.
        We need more principled people like Welgama who is not swayed by pressure, positions, perks or benefits.

        No ethical decent politician from the majority or minority will stand by a government that tries to make a Rajapaksa Prime Minister while the whole Rajapaksa family is under investigation for several crimes and have several ongoing cases against them.

        No one will ever stand by the family responsible for the white vans, killing of journalists, extortion rackets, intimidation, rape, torture, plundering of state resources and the selling of the state to the Chines.

        Only criminals who want to protect themselves while destroying our country want the Rajapaksas back…

      They will be stopped at Plan B.
      Besides, they cannot dissolve the Parliament or abolish the Presidency without 2/3 majority. I don’t think the UNP will cooperate with Mahinda or Maithri after all they have done to them.
      There is a simple way to solve this by getting a Vote in the Parliament.
      Mahinda’s appointment is not recognized by any country or any international organization so far which is an insult to a leader who had the majority support of the country..
      He will be recognized only if he goes through the legitimate channels.

      It is not Ranil’s 19th amendment. It was President Sirisena’s 19th amendment. He shoud have gone further to completely remove executive presidency. It is undoubtedly proved by both Mahina and Sirisena became dictators ignoring the rule of law and justice, and ignoring the people and country. I think the Prime Minister Ranil should immediately ask for Indian help to avoid a bloodbath planned by both Sirisena and Mahinda. Both Mahinda and Sirisena desparately hunger of power and thirsty of blood of innocent people. If you look at the history of Srilanka since 1948, every 5 or 10 years bloodbath happens in this land and thousands of innocents life are taken unlawfully.         The Supreme court recommended that Ranil should have gone to a referendum if he wanted to transfer president’s power to him. He did not want to go and agreed to remove the clauses highlighted by the supreme court. But at the final hours of the committee stage the cunning bast*rd inserted the clause which scrapped president’s power to dissolve the parliament. So the general public was deprived of an opportunity to contest it in supreme court and vote for/against in a referendum. So dictator Ranil scrupulously changed the constitution of SL just like he did to UNP constitution. No democracy warriors and including Norwegian fund getters who ask for ‘moral intervention’ in SL write about it.

    As a prelude to General Election MR being the care taker PM although illegal, will reduce the price of fuel at a time the world prices are going up. He will also bring the prices of essential food stuff and price of rice and flour down. This will influence the tracel fares to come down too. The public will have the best Christmas and the best Sinhala/Tamil New year ever, in their living memory. His political meetings in the run up to the GE, will draw the biggest crowds. This time around he will not allow a free and fair PE as he did in 2015 Jan where, after he rigged many an election and in the end kept the Com of Election under house arrest to announce the desired result, with oozing confidence allowed a free and fair PE and lost with over 5000,000 votes. This time around he will not allow the people to fool him but he will fool all the people with a comfortable win. Once MR consolidates his power, he will get the people to pay back what he advanced to reduce the prices, to win their votes.

    Appaya’s stupid decision has been a flop and a disaster for the country and its economy. This is the first time I have seen a PM appointed and not congratulated by a single country even after a week. Aid as well as loans have been on hold. As it is SL Police does not know whether its coming or going.

    There is only one person to be blamed for all this and that is the Appaya. He should step down without destroying the country.

    Anyone with with a little intellect would interpret correctly that Article 33(2) cannot supersede 19A, for the former only outlines the ‘functions’ of the President. Whereas, 19A defines the context within which the President discharges his functional responsibilities with regard to the dissolution of the parliament. Therefore, 19A takes precedence over 33(2).

    The Old King said Parliament will be recovered on 5th. Now it is said Parliament will be reconvened only on 14th and then immediately closed for another 14 days.

    Now the Old King is saying that parliament will not be dissolved. That means there is some master plan behind this denial.

    Sinhala Modaya voters never will understand any of these.

    It is further said on 5th, Karu had written a letter to embassies to distract their attention and keeping shut down.

    Unless UN Peacekeepers comes, they will conduct the election and make another act far worse than 18A. Then they will tell to the Modaya voters that an international newspaper has rated Lankawe democracy as number one in the World.

I think Sira also has to console himself by saying the same thing after the next election whenever that may take place.     Poor countries don’t lack resources, the main issue is the gap of poor and rich, created by the elite ruling class and the main reason why poor countries are poor is money laundering (taking the country’s rightful money out) “thus forcing the country to go into debts.

    He says no nation has even done what China has, China has taken 700 million out of poverty and has approximately 30 million left which they to hope to end soon.

    Imran Khan’s main objectives are, to strengthen state Institution and eliminate poverty.

    I too strongly believe our main issue is money laundering.

    Pitting one race against another, the often played game must end, like Eran Wickramaratne most rightly said in his live social media, Politicians will never CHANGE, The people should unite together to do so.

    But we need a true leader who will sincerely unite all races and religions, definitely not jokers like Assad Sally, we had enough of him.

    One of the new avenues in consideration is New King saying that he will not appoint Ranil as PM again.

    This is a loophole we had brought at the early stages of the coup. Now it would be a possibility. New King fired Ranil. The leader of the country, EP accused PM was involved in several criminal activities. Two things here, PM is fired; because he is involved in crimes. On a bad turn, UNP decided not to contest these two in any court; neither the firing as unconstitutional nor the accusations, criminally involved, are baseless. No Confidence Motion brought to parliament and defeating Old King, in those criminally responsible circumstances of the ex PM, will automatically appoint Ranil back to PM. If UNP go for NCM on Old King, 1) He has to be defeated to get rid of him. 2) New King has to reelect Ranil as the PM new PM. 3). Then he has to be confirmed by parliament vote. Further, even if Ranil is reelected by New King, here JVP may not be willing to confirming Ranil 2nd time. Certainly they will vote to fire Old King. UNP opted not to challenge Old and New King on firing Ranil in court, because it will bring out criminal investigation on them both. This is an action against Ranil’s stand from very beginning that “No Leader, No Commander, So Soldier will be prosecuted”.

    Must say Sri Lanka has well and truly cemented her place as a banana republic and a failed state!

    All this could be a blessing in disguise though, if the end result is the termination of the political careers of MS, MR, RW and their cronies!

    However, Sri Lankans may be too corrupt and/or unintelligent to make that happen.
