Situation Report: Desperate Sirisena Contemplates Illegal Dissolution Of Parliament As Numbers Game Collapses

Running out of options President Maithripala Sirisena is getting ready to push Sri Lanka to the brink of lawlessness by dissolving Parliament unconstitutionally on Wednesday night Colombo Telegraph learns. If not on Wednesday night, President Sirisena is contemplating dissolution on Thursday the sources claimed.

On Wednesday afternoon Sirisena met with a group of lawyers to discuss his options as political party after political party declined his requests to join the Rajapaksa Government or at least abstain on a Parliament vote of no confidence against Rajapaksa. Some reports also said he had summoned Chief Justice Nalin Perera to discuss the constitutionality of the move. It was not confirmed if Chief Justice answered the summons. The President can refer questions to the Supreme Court on constitutional matters but officially and not by summoning supreme Court justices legal sources told Colombo Telegraph. Sirisena’s lawyers are arguing that while Section 70 of the Constitution (amended by 19th Amendment) explicitly states that Parliament cannot be dissolved by the President until it has completed 4.5 years of its term unless a resolution is moved by a two thirds majority in parliament requesting dissolution that provision is superceded by Article 33 (2) which outlines President’s general functions, including to summon, prorogue and dissolve Parliament.

Heavy movement was visible at President’s House late evening sources said with senior bureaucrats being summoned for urgent talks. Another option being discussed is a referendum of the people to determine if his actions to appoint Mahinda Rajapaksa as PM were legal.

An increasingly desperate President Maithripala Sirisena had taken over negotiations to build a majority for his illegally appointed Prime Minister Mahinda Rajapaksa, Colombo Telegraph reliably learns, meeting several Party leaders over the past few days to convince them to support the new Government.

On Wednesday November 7 which was the day Sirisena promised Speaker Karu Jayasuriya he would convene Parliament, before he issued a gazette declaring November 14 as the day, the President met with the Tamil Progressive Alliance led by UNFGG MP Mano Ganesan and the main opposition Tamil National Alliance (TNA). Both parties declined his request to abstain from voting. And also told the President that his actions were unconstitutional and illegal. President Sirisena was also informed that the Tamil people of Sri Lanka had voted in 2010 and in 2015 even supporting the former Army Commander who prosecuted the war against the LTTE in 2010 just to defeat Mahinda Rajapaksa as president. The Tamil representatives told the President that their people would never support their neutrality in the face of a real threat of Rajapaksa becoming Prime Minister. After SLMC Leader and ACMC Leader Rauff Hakeem and Rishard Bathiudeen have also declined support when invited for talks with President Sirisena over the weekend.

President Sirisena’s body language was bad during the meetings and he looked increasingly worried sources said adding that this might drive him to take desperate and willfully unconstitutional measures in order to break the deadlock and justify his actions on October 26.

This was in the aftermath of a major dressing down by former President Mahinda Rajapaksa at a meeting with UPFA MPs on Tuesday evening. Rajapaksa blamed S.B. Dissanayake for pushing him into the position without having the requisite numbers to defeat the country’s legal Prime Minister Ranil Wickremesinghe in Parliament. The Rajapaksas are showing signs of bowing out of negotiations to win MPs for a parliamentary majority Colombo Telegraph learns leaving President Sirisena and his agents to continue with this task.

A relative of UNP MP Hirunika Premachandra was also called about a cabinet posting by an agent of President Sirisena who also threatened to ruin her career.

Once Sirisena was addressed as ” your his excellency, he had been very upset not knowing what that was supposed to be. Likewise, this man is utter fool, not knowing what he is talking about.
        Now all is becoming clear, that he has been harrassing women in Presidential Secretariat. That poor Ms Sirisena looked as if she has not the least exposure to anywhere out of her kitchen. All in all, this ballige putha should be well aware of what to be droped down from his cesspit what not.

        Now him to send the message across that the parliament could be dissolved is a joke. Wait and see, this bugger, will create an another war within srilanka now.

      Ranil had no chance of winning a Presidential election. They gave the carrot ‘Yahapalanaya’ to Sirisena and fielded him as ‘Common Candidate’ with the expectation that he will abolish Executive Presidency. If that happened, Ranil as PM could do everything in his way. Once they realized that things are not going according to plan, they thought of eliminating him so that Ranil can be the President. If that happened, take my word, NO ELECTIONS in 2019 or 2020. These plans are hatched not in Sri Lanka but in places far far far away from this country.

        Whatever is the matter before, now Ranil Wickremasinghe is the most popular character in the country for which the credit should go to Basil, Maithri and JO. People have started expressing sympathy now.
        I saw a cartoon in which Ranil is tied to one of the posts in the boxing ring and made to fight with Mahinda, who is free!!!! Many people now share this sentiment.

    Negotiation-101: All parties must feel they have an interest in the eventual outcome. Otherwise, one party can mess up everyone’s expectations!

    The UNP Royalists thought they had Gamey Sira in a bind by ignoring him. Gamey Sira got into the position by promising to be a one-term President and was hood-winked into believing he had a future beyond the single-term. The racketeers who were advising him told him the lie that he was all-powerful. I doubt he read the 19th Amendment at all!

    MR was panicking with all the criminal cases coming up for expedited hearinginthe newly formed High Courts.

    It was a perfect storm to be exploited by all the riff-raff that hang about Temple trees, Janadipathi Mandiraya and Medamulana.

    Sri Lanka and Sri Lankans are suffering. But then, none of the above-mentioned care of about any of it.

The bond scam for example is not the PMs fault and he certainly did not earn a cent from it. Those that did either went to jail or in some cases were in the opposition. Nobody is perfect but the insinuations and the attempts at lumping the UNP, Royalists, Temple trees with this bunch of uneducated, lawless, greedy, power hungry scoundrels is nothing but disingenuos and a sin commited against this nation.

      The UNP led government is the legitimate government of this country. The legitimate prime minister is Ranil Wickremasinhe.     Lankawe demography is 70 % Sinhala Buddhists who are the rural poor in the main , including that 5 Million on Less than Two & Half Dollars a Day.

    Dr Ranil & his Yahapalana Ministers only looked after the 30% for Three and a Half Years.
    This 30% are made of the TNA, SLMC , Mano Ganeshan, Bathudeen, Modi NGOS, US Consul , British Ambassador and of course the UNP Rich….

    Even the naive Baiyas from the Majority, who go behind UNP bosses like Keselwatta Kid and Uncle Karu didn’t get much from Dr Ranil.
    But they are so thick that they have no idea what is happening.

    If Dr Ranil was allowed to continue Lankawe would have been divided into 9 Cantons.
    One for Muslims, One for TNA and may be Two for the Elite , Anglicans and Rich Sinhalese..
    The rest would have been confined to the 5 to share with even the UNP Baiyas whod wouldn’t” make the cut “..
    And the Hakka Chinese and Hindians would have owned every conceivable source of Income in Lankawe .
    But Rich Sinhalese couldn’t have cared less as long as they got their ” Cut” from the Hakka mates and Hindians.
    And that is the situation in a Nut Shell.

          The president jumped the gun by circumventing the constitution which is a grave mistake.I suppose mahinda had no other choice but to go ahead with it to humour this man because of the number of charges against his family and friends.he could have come with dignity to power in a step by step process if as you say ranil is unpopular,w/o using the back door like this.He himself has now said he would not have made such a decision if he was in charge.

      Tell us how the country became impoverished between 6 April 2004 and 9 January 2015? Was there a large scale leakage in the economy between 6 April 2004 and 9 January 2015 other than, saving, taxes, ……. and imports?

    Maithripala must remember that what ever he do is illegal according to the mandate he received in 2015. He betrayed the voters and support groups and parties. Even if he continue with the present parliament or he dissolved it ,he will not be given peace of mind until his last moment by his conscience. We also will not stop our struggle until Rajapaksa gang disappeared from our country.

      Maitripala will not have to wait until he is troubled by his conscience if he has one. He has to be careful long before not to violate the Constitution. He is on slippery ground and will most likely be held to account for his actions under the law unless he can vindicate his actions which are prima facie unconstitutional if not unlawful.Otherwise he may face imprisonment.     Dissolution of the parliament and a general election is the definitive solution. Every eligible voter, regardless of party affiliation, could express their opinion at the polling station. We read too much partisan garbage spouted out by paid and unruly bloggers here, most of who do not have any voting rights in Sri Lanka. There are a lot of conceited writers here assuming that they are all powerful and the governance of Sri Lanka is done according to their ideas and wishes. They scream with capital letters or hurl abuse when they run out of reason as if the President is listening to them. How sad that they have lost their heads.

      1) The president in power has no authority to dissolve the parliament until Feb 2020
      4.5years should have been passed, in order him to go fo rthat

      2) And there exist a serious situation, there over 150 Parlimentarians should support him to give the to dissolve it.

      3) Now may be over 130 would agree with UNP to stand against Kalawaddas led by Sirisena ( his behavour reminded me KOLAMBA SANNIYA) buruwa is not good enough to work in Colombo, how can a man with that low profile to govern this country ?

          We would never realize as to why Srisena to sit with his bitter enemies and ho would he ever be able to explain anyone with some knolwedge ?.

          And It is becoming clear, that Sirisena should have been against all YAHAPALA priciples from the day one. If he had guts to work as apresident, nothing would ahve reached this worst to this day.

    If the Parliament was convened I do not expect it would be an orderly sitting. Chaos will be the order of the day. Parliamentary staff would not be cooperating with the Speaker. So MY3, will most likely put a question directly to the people as to whether the house be dissolved or not. Obviously the people would not answer the question on constitutional merits but on political lines and the result cannot vary much from the local government elections. So that would be the end of the value of votes casted in 2015 for “Yahapalanaya”, like in my case. People have been cheated mainly because MY3 and RW could not work as a team and carry on the agenda it promised.

    The Best option we have is to request all politicians who are over 60 to retire and go home! have general elections so that democracy prevails in the country! Bring in a rule to have minimum educational qualification from a recognized university to contest for a seat in the parliament ! This should apply to the presidential candidate too! if the President is electing the Prime Minister then he should be able to change him too as the President and PM not working together is not good for the country! The 19th amendment should be changed as it has too many loopholes!

    President Sirisena made a very smart thing by referring to Ranil and his Royal Gang as ‘Samanala Kalliya’. Until President revealed the sexual orientation of Ranil and his gang, only few people knew about this. Now all the people know that. For most of the Sinhala Buddhists who support UNP, a married/Gay leader and politicians will not be acceptable. At the next election, definitely they will take this into consideration when they vote.
    Already, most of the people consider UNP MPs who are protecting their leader who is popularly known as ‘Maha Benku Hora’ as traitors. Revelation of President will put another nail if not the last in the coffin of Unpatriotic National Party.

    Pohottuwa/Basil/sidekicks are trying to intimidate the Speaker.
    Now some academia have gone to the Bribery & Corruption to file a case against the Speaker. Do you know the reason? For changing his word! They say the Speaker has first agreed to provide seating to MR and then backtracked!!! That is absolutely nuts!
    As far as the public know, there was a one-on-one meeting between the Speaker and the President. I am 100% sure it was a request by the President. Then the Speaker and MR both said that they (President + Speaker) have agreed to reconvene the Parliament. That’s all. The Speaker issued only ONE statement and that is to inform his unwavering stance to recognize the previous setting until one side proves the majority which is very reasonable and fair.
    Now what is this bribery case? I totally denounce all intimidation tactics against the Speaker.
    C’mon, people, all law abiding citizens who respect the democracy; we should raise our voice in support of the Speaker, who is the most important person right now.!!!

    Sirisena’s request to the TNA was to refrain from voting in the no-confidence motion against Rajapaksa. There was also a report that Dayasiri Jayasekera had claimed, in order to get TNA support, that if the TNA wanted a political settlement only Sirisena and Rajapaksa could deliver it.

    I think what the people of Sri Lanka is waiting for an early election. They have been hoodwinked by the Gang of thieves headed by the former premier and his Royal College friends. All these CT articles and situation report is about backing the former government. Sri Lankan people have rejected that government. They want an early election. That is almost similar to a referendum. Then any party can test their acceptance through public opinion not by the gang of thieves surrounded by the previous government.

    Early election is the best solution for the current situation. Then we can see how Yahapalanya “Ata delaksya” going to vote.

    1) The president in power has no authority to dissolve the parliament until Feb 2020
    4.5years should have been passed, in order him to go fo rthat

    2) And there exist a serious situation, there over 150 Parlimentarians should support him to give the to dissolve it.

    3) Now may be over 130 would agree with UNP to stand against Kalawaddas led by Sirisena ( his behavour reminded me KOLAMBA SANNIYA) buruwa is not good enough to work in Colombo, how can a man with that low profile to govern this country ?
    If the bugger would have been a leader in EU countries, by today he should have sacked. Sirisena should be made responsbile for today s situaton.

    Today Sirisena has made us jokers to the world. Ranil did not nothing, Sirisena could remove him in compliance with the norms as the parliamentarians agreed upon
    The very reason has been, Sirisena has not the least knoweldge about making decisions, that comes from his background. He had never been opposition leader, prime minister or president or any other higher positions in this country, so his behavour has been akin to an absurd man took the scalpels and knives in a major human surgery, his behaviours is beyond all bearing, how can he ever iron out his mistakes , only god knowssssssssssssssss

    I believe this whole crisis has been brought about by former CJ. Sarath.N.Silva.,who has been the Legal Adviser to President MS. Further,apparently he has advised there is provision to dissolve Parliament as per clause 33[2] of the constitution.
    Rasputin is back in the court,it seems.

    Once again Sri Lanka proves that democracy as implemented and implanted on us is not a suitable method of governance for us. Everything that can be manipulated and bought is done to twist and turn the democratic outcome of elections. What is this joke really? Now we have to sit and listen to lowly people like Hirunika? Does Hinrunka have a political career for the President to ruin? What are her qualifications? She only talks about personal politics with her lipstick running down her chin. Really what a joke.
     
    Our society is too divided and polarized along rich-poor divide, ethnic and at political party levels that this democracy project will soon be the end of all of us. Elections and governing is like a popularity contest than electing the most suitable persons to run our government. If democracy has any chance in our country we must have laws and mechanisms in place which can disqualify this whole bunch of top politicians immediately and we should have minimum educational qualifications for everybody who runs for elections. Some of the MPs, municipal MPs and even ministers we have are just thugs and many of us live in fear of these thugs. How can we live like this?
     
    Just think – if we are to have presidential elections or general elections today, what choices do we have? We will be voting for the same bunch of cheating corrupt dumb rogues.

    Can some somebody tell me how much Old Royals paid to Ranil and Karu. Now those two stooges have turned against citizens of the country and trying to re-patch with Old Royals to keep their position. Unless somebody find a way to make Ranil retire from UNP Lanakwe politics can never straighten it back. He is worse than Don Stephen on his Nariya games. He is sitting in TTH and predicting what is going to be Supreme Court verdict if he file a criminal action case against New King. What is he saying Court is going to tell him to settle in Parliament. What about if the Old Royals never wants to convene the parliament.?
