Situation Report: Speaker Faces Mutiny From Parliamentary Staff Siding With Sirisena

Speaker of Parliament Karu Jayasuriya is getting flack from democratic minded Sri Lankans all over the country for failing to act to end an ever deepening political crisis caused by President Maithripala Sirisena‘s illegal sacking of Prime Minister Ranil Wickremesinghe. Colombo Telegraph reliably learns that the third citizen of the nation and head of the country’s legislature is facing a major mutiny by Parliament staff led by Secretary General Dhammika Dassanayake.

Dassanayake is reportedly leading his staff to openly flout directives from Speaker Jayasuriya constantly using the refrain that he was bound as a public servant “to follow the directives issued by the Presidential Gazette”.

The resistance has also prevented the Speaker from moving to reconvene Parliament in defiance of the President’s illegal prorogation of the House despite mounting calls for him to do so, since SG Dassanayake and the staff have made it abundantly clear they will not cooperate.

On Monday (5) when Dinesh Gunewardena stormed into the Parliament complex with a group of Buddhist monks and decided to “assume office” as Leader of the House highly placed sources Dassanayake opened the doors to the office still legally occupied by Lakshman Kiriella. This was in spite of a specific direction from Speaker Jayasuriya that Gunewardane should not be allowed to do so. When Kiriella called the Speaker later to request him to safeguard the rights and privileges of Parliamentarians, Jayasuriya said he was “powerless” to stop the encroachment and forcible entry. Confidants to the Speaker confirmed that he was unable to rein in the bureaucrats in Parliament because Dassanayake was insisting that he was compelled to follow the Government Gazette and was openly flouting the Speaker’s directives in a bid to please President Sirisena and his newly appointed Prime Minister.

At a meeting of Party Representatives last week SG Dassanayake and his staff attended the meeting last Wednesday only as long as representatives of the illegal Government appointed on 26 October were present to submit a list of decisions made at their ‘cabinet’ meeting held that morning to the Speaker. Once Mahinda Samarasinghe, Dinesh Gunewardena and Nimal Siripala De Silva and Sarath Amunugama handed the memo over and left, Dassanayake and other staff members also walked out of the meeting. Incensed members of Parliament pitched into the Secretary General reminding him that he was an employee of Parliament and did not report to the executive.

Dassanayake has reportedly informed the Speaker that if he chooses to reconvene parliament ahead of the date declared by President Sirisena – which is the wish of over 118 MPs – none of the staff would make necessary arrangements to hold the sittings. In other words staff will refuse to bring in the Mace, record proceedings or conduct any administration work necessary to hold a session.

Meanwhile Sergent at Arms of Parliament Narendra Fernando told the Mawbima newspaper this weekend that officials in Parliament would only abide by the Gazette issued by the President. In a bold statement Fernando also said seating arrangements in Parliament would be made in line with the Gazette notifications – meaning that they would assign the PM’s chair to former President Mahinda Rajapaksa, and the Leader of the House seat to Gunewardena etc – and added that “there would be no need to consult the Speaker on such matters.”

The mutiny by Parliament staff has sparked criticism about public officials being party to intentional violations of the constitution and assisting President Sirisena to execute his coup d’etat.

Director Edinburgh Centre for Constitutional Law Dr Asanga Welikala took to Twitter on Tuesday to point out that the Secretary General of Parliament and the Serjeant at Arms had fundamentally misunderstood the point that their master was Parliament, and not the executive.

‏”Their mulish insistence on the proverbial gazette could be simply bureaucratic cussedness, or even a figleaf for partisanship. But the Speaker and the majority of MPs have made the position of Parliament clear, which is that it should be recalled to determine the legitimate govt. The duty of parliamentary officials is to serve Parliament, not the executive. If not, they become instruments of the destruction of parliamentary democracy. They should remember that that is very serious misconduct,” Dr Welikala said.

Executive Director of Verite Research Dr Nishan De Mel said that #coupLK bureaucrats need more scrutiny. “In facing off #CoupLK the office of the Speaker @KaruOnline has faced intense scrutiny. @HarshadeSilvaMP has fine tuned that focus to the bureacracy: even Speaker might be constrained by responses of Secretary General to #lka Parliament (?) #CoupBureaucrats need more scrutiny,” Dr De Mel tweeted.

UNP State Minister Harsha De Silva slammed Secretary General Dassanayake in a tweet yesterday claiming the bureaucrat had “Welcomed with glee” MP Dinesh Gunewardane to illegally occupy the Office of the Leader of the House. “Merely there to assist Speaker he is abusing power to overrule decision of Speaker Karu Jayasuriya to side with #CoupLK and President Sirisena” De Silva tweeted.

Rumours are swirling that Dassanayake had already met with a sibling of Mahinda Rajapaksa to discuss non-cooperation with the Speaker of Parliament and arrangements for when Parliament eventually reconvenes.

          Before we establish democracy we should have a country for us to say — this is my country – Culture of this country has its roots in Buddisum – anybody who is trying to undermine Buddhism should be considered as an enemy of this country

          In my opinion yahapalanaya was trying hard to discredit Buddisum in this country – unfortunately certain rouge elements in the Sasanaya itself provided opportunities for the Gov. to do so

          So I think majority Buddhist in this country should support MR Gov. – because he was sensitive towards the feelings of majority Buddhist.

          Should line up to show Ranil and his Royal cohorts – “Sanhidiyawa” cannot be achieved by hurting the sensitivities of majority to satisfy the minority

      Maithripala Sirisena and Mahinda Rajapaksa illegitimate government is fast turning into a Sinhala Buddhist Terrorist rogue Government. The release of the Buddhist Terrorists behind the Kandy riots was a troubling sign.

      Now The Bodu Bala Sena requesting President Sirisena & newly appointed illegitimate terrorist government to give a presidential pardon for Gnansara Thero & Former MP Duminda Silva who was sentenced to death over a murder is serous. If pardoned this will add to the growing list to justify International intervention. This illegitimate terrorist government is fast becoming a serious threat to stability in the region.

        Basically, it is because of their double standards, GL’s and JO’s misinterpretation of the Constitution in favour of their case, horse trading and MAINLY;
        (1) Mahinda’s turning to TNA to form a government,
        (2) Namal’s twitter message about Mahinda’s decision to release hardcore terrorists, and
        (3) Mahinda’s and Wimal’s hasty decision to plug with Maithri and whitewashing him on stage without a shame.
        All the 3 are a complete U turns of both of them, which is unbelievable.
        The double standard applies to accepting a “D M Jayaratne style” appointment from the same President, something Mahinda/Wimal/JO vehemently condemned in 2015. What is wrong is wrong, whether it happened to DM or Ranil.
        From the very beginning I maintained that Mahinda’s appointment is legal while Ranil’s removal is illegal, unconstitutional and undemocratic.
        In addition, I consider President’s decision to prorogue the Parliament amidst a political turmoil is dictatorial.
        Finally, the country will run by Basil, not by Mahinda.
        Mahinda is only a ‘captive’ of Basil’s and Maithri’s web.

            Having Rajapaksa as last name doesn’t give any MP to issue messages on releasing Tamil prisoners, which is an undue interference in the judicial process. There are Sinhala and Muslim prisoners too. Is he going to release them all? No, he was referring to Tamil terrorists who are in jail under PTA. Namal tends to refer them as political prisoners (heard him saying in the Parliament recently) wondering me why. Terrorists didn’t engage in politics. They engaged in crimes against humanity. Now I know this was on the card for months to use this issue as a means to gain political advantage which is cheap.
            Many of our army officers are in jail under PTA. I wonder why Namal didn’t remember them before Tamil prisoners. A case of one LRRP sergeant who spent his whole young life fighting against LTTE was heard only after 13 years and was sentenced to death on flimsy second hand evidence while many LTTE terrorists who were in jail were released giving various excuses recently. High ranking Army and Navy officials who risked there lives fighting against terrorists are in prison without bail. I want to ask them how fair is to release hardcore LTTE terrorists just for political gain?
            Even the land issue. There is a process to follow when releasing lands. Removing army camps and relocating them elsewhere involves lot of expenditure. And if they are located in strategic places, removing them is unwise. The government should have offered alternate lands to people in the first place.

        What is unfolding before our eyes at this very moment, is the ‘King vs Parliament’ episode of Charles I in England in January 1642. His Majesty the King came into Parliament and took the Speaker’s chair. That was in the Mother of Parliaments. Now
        His Excellency the President of Sri Lanka wants the Speaker himself to submit to his caprice.
        What was the Speaker Lenthall’s reply to the King? “I have neither eyes to see nor tongue to speak in this place, but as the house is pleased to direct me, whose servant I am here”. The speaker proclaimed the primacy of Parliament over the King.
        The King was inclined only to exceed his limits. He fell into the hands of Cromwell, who had him tried and executed. In current times, excesses are met with impeachment and even more when the primacy of the legislature is sought to be violated..

    The Parliament should be reconvened FORTHWITH.
    Nobody should be allowed to held up the Speaker as an object of ridicule!
    I saw some legislators “criticizing” the Speaker for his decision to “accept the previous administration until the majority is proved by one side,” which is the best decision at a time the Parliament is prorogued arbitrarily and dictatorially, without even informing him.
    Some “senior” legislators have gone to the extent demanding Speaker’s statement be withdrawn!!!!!!
    I wish to remind everyone, the Speaker is the highest authority who controls House business.
    In other words, he is the “Referee” in all crucial or other Parliamentary matters whose decision is FINAL. The President or the SC has no power to question or intervene with his decisions. Therefore, when the Parliament meets AGAIN, the Speaker will CALL FOR AN OPEN VOTE, “at his own discretion” to decide which side has the majority. He doesn’t need the approval of the legislators to do so.
    The Parliament is the highest Representative Body (the voice of all citizens – “parle” means “to-speak” in French) which determines the democratic legitimacy of any government based on the majority in the Parliament. It is not “anybody’s private property” to decide how to carry out its business. The Speaker is the Legitimate Decision Maker in the Parliament whose decision is UNCHALLENGED.
    As a citizen, I urge the Speaker to EXERCISE HIS AUTHORITY TO THE FULLEST when the Parliament is reconvened. He should not be deterred by the chaos, but call for a Vote, which is a MUST, and decide which side holds the legitimate government in order to continue its business. If there is any unruly behaviour, he SHOULD NOT HESITATE TO NAME SUCH MEMBERS, who are breaking the rules of conduct of the legislature.
    I wish the Speaker lot of strength!!

    How could Secretary General Dhammika Dassanayake, who is a senior official act like this?
    In a crisis situation, the Secretary General of the Parliament is supposed to extend his fullest support to the Speaker. The President has no business in the Parliament other than proroguing and convening the Parliament.
    When the Parliament is reconvened, the Speaker should sack him for insubordination.

    Parliamentary Staff? What a joke. They are just functionaries. It is the citizens and their representatives who decide the political fate of the country. These functionaries can play a role, if they want, as citizens with fellow citizens, but not as functionaries per se. Carry out the orders of the speaker or go home, you partisan jerks. It is like the cooks at a wedding function refusing to cook because they don’t like the couple.

They have done their homework well, studied hard and oiled all the sweaty palms well in advance to orchestrate this take over. This break in. They care two hoots for public or international opinion.     President and PM must get together and turn the Parliament equal to Welikada or Bagambara upside down. what dollar Kakkas say is we need employment. Inflation in Sri lanka is too high. They like super luxury sporty vehicles. Their fasmilies like foreign travels. It is OK farmers and their children get rotten kidneys. givt more fertilizer free.

    These infiltration not only happen in the staff of the parliament but in the Central Bank, Ceylon Electricity Board, GMOA, University Students Unions ,Three wheeler Association, canteen Association ect. That is how all the price reduction came into light in the minutes of change of power. It was from the day one to grab the power back. Now no lost in the petroleum corporation by giving it petrol in reduced price. There are layers of layers of mahinda supporters it is not easy to free any anti mahinda government to free from those elements.

    We have to give tuition to the new USA Ambassador who met Speaker.
    The Vienna Convention on Diplomatic Relations (1961) Article 41 clearly states that diplomats cannot interfere into the internal affairs in the receiving country and such interference is construed as a violation of diplomatic protocol.
    Article 4I – I. Without prejudice to their privileges and immunities, it is the duty of all persons enjoying such privileges and immunities to respect the laws and regulations of the receiving State. They also have a duty not to interfere in the internal affairs of that State
    Article 41 – 2. All official business with the receiving State entrusted to the mission by the sending State shall be conducted with or through the Ministry for Foreign Affairs of the receiving State or such other Ministry as may be agreed.
    These ‘Para Suddas’ are real hypocrites. They preach one thing and do something else like the mother crab walking sideways and asking the baby crabs to walk straight.

    This is the game of the Partner in Coup Karu Jayasuriya. He issued a statement claiming the Western Democracies are not accepting the new PM, so the other party had any alternate plan. This provoked a minister to resign and Join back UNP fearing somehow West is going to break Old King’s government sooner. The same notice enabled Matuma Bandara, PA minister to issue notice to PA officials not to follow the illegal orders. Now, it is among Old King, New King, Ranil & Karu, the partners in the coup, to draw plan of how to end the Coup Saga. Their decision is to evade the West, solve it peacefully within them. So Parliament will sit on 14th and Old Royal will allow whoever bound by coup vote for the legal government. Manusha Nanayakara is one example, who took money but will vote for Ranil if voting held. Now they have to have to present this this in acceptable form to people, West and Tamil Parties who stood strong to reverse the coup. They have been proving in EP elections as who the king makers are. Now in the coup too, they are emerging out as the coup braking army. So, Karu is acting this new Drama. Karu who has two bosses, Ranil and Old King, like a woman has two husbands, is struggling to let the world view that both are treated fairly.

    Parliament employees are not any special privileged employees than any other PA official. Any part of the gazette not directly addressed to them is not intended to them. They follow their office’s, the parliament’s order. That gazette notification is specifically for Speaker and MPs. Parliament employee cannot interpret as it is a notification for them to implement something unusual. President’s authority to provoke the parliament is only to coordinate the parliament, but not rule over the parliament. Parliament has its own decisions to convene and do its business that included even removing the President or prologue it until suitable time. When it decides to prologue President coordinate that action. There is no way when the parliament decides to convene, the employees block the sovereignty of the people not to take its cause. Matuma Bandara has to inform them that they too coming under PA employees’ code and they will be punished for any of their illegal actions. Remember this guy Matuma Bandara is the guy appointed to save Old Royals, pushing out Ponny from Law and Order Ministry. If he had shown an iota of opposition to Old Royals, he never would have got this job. These all guys are planning together and organizing the coup only to save the Old Royals from UNHRC. Sampanthar should do his best and defeat this coup. Otherwise they will defeat Tamils in UNHRC.

    I do sincerely hope that SL is not taken over by Rajapaksa and his clan. We the Sri Lankan’s want Law and order established and dictatator rule eliminated.
    I do want the SL security forces uphold the rule of law and prevent hooligans breaking the rule.

    Follow the constitution and the laws of this nation. We do not want leaders who will be considered illegitimate, and who only took over because of a bloodless coup. Silly and the Maha Raja will be looked upon as the buffoons who seized power by the international community. How about following the rule of law?

    The undertones in Sri Lanka politics is interesting. Note carefully that at the end of MY3’s talk referring to the group of close confidantes of RW as butterflies, the former made an open appeal to the Speaker of the Parliament in the name of everything possible not to convene the Parliament on the 7th. I knew that MY3 had already made arrangements not to convene the Parliament. I was thinking, would it be military barricades etc. NO. HE found an effective solution. That is the Parliamentary staff would do only anything that they consider as legitimate. Remember, all this came out of the “silredi” case. After that how many officials have told their seniors “I am sorry sir. This is illegal. Even the Cabinet HAS NO LEGAL RIGHT TO APPROVE. Hence I am not going to certify the payment.” Another chap told me that he would not be lucky as UHC Priyantha to certify and escape.

    Sad to say that Sri Lankans have proved themselves to be so many the things since gaining independence, pretty much all of them negative… where does one start?

    When it comes to the highest offices in the land, they have demonstrated both utter incompetence at management and governance, as well as no desire to build a nation for the citizens. A complete lack of principles and indulging in corrupt practices at every opportunity, sums up the rest of their characters …

    And sadly, the general public have proved themselves to be corrupt,racist ,bigoted and brainless through this entire post independence period as well.

    So it’s a completely hopeless state of affairs for anyone who wishes to live a dignified life in Sri Lanka..

    At the end of the day, you need the good and the intelligent to be in the majority, in order for a nation to progress, so it’s nigh impossible to see that happening in Sri Lanka..

      I don’t know what you will say when you hear that he had forcibly opened the Office of the Leader of the House in the Parliament and assumed duties as another Leader of the House (an overlapping appointment.)

    The Rajapaksha “maraya” behind all this thuggery is Basil Rajapaksha. Good lesson for this UNP’rs who allowed this murderer to roam freely for all the financial crimes he committed. When BasilR was in prison, he was dumped in prison hospital and medically released on health grounds. Now where are the hypertension, heart problems, and mental health issues for this THUG! If the UNP cannot control this thug, then drop a few bags of ‘candy’ to the JVP and this criminal will be taken care of.

    I am of the feeling India cannot sit and wait to see all this happening in Sri Lanka. Sri Lanka is very important to Indian security. Since Mahinda took office the violence has increased and it has come to the Parliament. Will India walk into Sri Lanka under cover of UN/Commonwealth/US/EU umbrella of protection?

      The Speaker has the power to settle the matter when the Parliament is reconvened.

      No, That IS NOT TRUE. THERE IS NO VIOLENCE. Give me an example. There was a peaceful rally near the Parliament. What are you talking about?
