Sri Lanka: Families Of ‘Disappeared’ Persecuted: Renewal Of UNHRC Mandate Crucial To Counter Impunity, Abuse

The Sri Lankan government continues to persecute the families of victims of enforced disappearance who seek to enforce their rights, Human Rights Watch said today. Security forces persistently harass families through surveillance, intimidation, false allegations, violence, and arbitrary arrests.

On August 29, 2024, a court in Trincomalee granted a request by police to ban relatives of the disappeared from holding a procession to mark the International Day of the Victims of Enforced Disappearance on August 30.

“The relatives of the disappeared experience the daily torment of not knowing what happened to their family members, which state agencies have cruelly compounded by trying to silence them,” said Meenakshi Ganguly, deputy Asia director at Human Rights Watch. “Hundreds of mothers, wives, and others have passed away without learning what happened to their loved ones, and many more express fear they might not live to see justice done.”

Sri Lanka has one of the world’s highest rates of enforced disappearance, including those who disappeared during the leftist Janatha Vimukthi Peramuna insurgency (1987-89) and the civil war between the government and the separatist Liberation Tigers of Tamil Eelam (1983-2009). Sri Lankan authorities have for decades refused to reveal the fate of the disappeared or to prosecute those responsible, leading the United Nations human rights office to call for international prosecutions.

In his August 22 annual report on Sri Lanka to the UN Human Rights Council, the UN high commissioner for human rights, Volker Türk, described “a persistent trend of surveillance, intimidation and harassment of journalists and civil society actors, especially those working on enforced disappearances … and reprisals against family members of the disappeared engaging with the UN or international actors, including members of the diplomatic community.” The high commissioner also examined allegations of abduction, arbitrary detention, torture, and sexual violence by Sri Lankan security forces carried out as recently as January. The victims in these cases, whom they said were primarily men, had been involved in protests over issues such as enforced disappearances.

In May, Human Rights Watch met with relatives of disappeared people throughout north and east Sri Lanka, mostly the wives or mothers of victims. They described a pattern of ongoing abuses. Several are facing court proceedings after being arrested at protests, including three who had been hospitalized as a result of police violence against protesters.

One woman in the Eastern Province, campaigning to know the fate of her husband, who surrendered to the military in 2009, said she believes she is under regular surveillance by security agencies, including the police Criminal Investigation Department, Terrorism Investigation Division, Special Task Force, and the army. She said they offer to pay her neighbors for information about her, in tactics apparently designed to isolate her from her community.

“We can’t raise our voices, we have no freedom to move,” said a woman in the Northern Province, whose husband has not been seen since his arrest in 2008. “They [security agencies] threaten us, and even take action against our family members. We have no freedom to do anything.”

The women said that police officers habitually deliver stay orders – prohibiting them from attending memorialization events or protests – in the middle of the night when they are dressed in their nightclothes and take photographs. “If my gate is locked, police climb over the wall or cut the fence to deliver a stay order,” one said. Another showed a pile of eight stay orders, although she said she had received more. “If anything is happening in the Northern or Eastern Provinces I get a stay order,” she said.

Several mothers of the disappeared said the most frightening threats were directed at their other children. One said that when she attends protests the police tell her, “You have to look after your child who is still alive.” Another said that days after she was arrested at a protest in 2023, her son was arrested in an allegedly fabricated drugs case and sent for custodial “rehabilitation.” Criminal cases against both her and her son are ongoing.

In December, the authorities launched an abusive anti-narcotics campaign called “Yukthiya,” which the UN says had resulted in over 121,000 arrests five months later. Families of the disappeared said the authorities are increasingly using false drug cases to harass them. The mother of a disappeared man said that police – including anti-narcotics officers – began making inquiries about her surviving son in December, leading her to fear that they would plant drugs in her home. “I have already lost a son,” she said. “He is now the only one I have left. I sent him to India [for his safety].”

Relatives of the disappeared said they have little or no recourse to domestic avenues for redress. In 2017 the Sri Lankan government established the Office of Missing Persons (OMP), which is supposed to establish the whereabouts or fate of the disappeared but has resolved almost no cases. Relatives accused the OMP of pressuring them to agree to receive compensation payments that they fear will lead to their cases being closed without further investigation.

One relative said, “The OMP says ‘take this certificate, get Rupees 200,000 [US$665], don’t support this movement [for truth and justice].” Another, whose daughter disappeared in 2009, said, “When I went to the OMP I noticed that they were pressing many families like us. They said to the families, ‘we don’t want any documents, we just want the details of the [disappeared] person.’ Some people took compensation, and some refused.”

“Earlier we trusted the OMP but after they recruited certain commissioners, we lost our faith,” said the mother of a disappeared person from Mannar, in northwest Sri Lanka, referring to the appointment of former senior security forces officials to the body. She said she has refused offers of compensation because “I need to know what happened to my son.”

Many relatives of the disappeared are also skeptical of the current government’s proposal for a new domestic truth and reconciliation commission, following numerous similar bodies that have previously failed to deliver truth or accountability. “We don’t accept it. We don’t have faith in it,” one said. They emphasized the importance of international involvement, including in criminal investigations.

The UN Human Rights Council, concerned governments, and other UN bodies should implement the recommendations in the UN high commissioner’s report, including:

* Investigating and prosecuting alleged perpetrators of international crimes committed in Sri Lanka under the principle of universal jurisdiction.

* Imposing targeted sanctions on alleged perpetrators.

* Carrying out enhanced vetting of Sri Lankan officials, including those involved in UN peacekeeping missions.

* Renewing the Human Rights Council’s mandate for UN monitoring, reporting, and work on accountability for human rights violations and related crimes in Sri Lanka.

“Successive Sri Lankan governments have resisted any progress to address the terrible legacy of enforced disappearances, and instead compounded the anguish of victims’ families,” Ganguly said. “While the Sri Lankan government commits these abuses, the Human Rights Council and governments around the world need to stand with the families of the disappeared.”

You may get thousands of promises from all Sinhalese leaders and some of your representatives may come up with many reasons to support to get their benefits but you only need justice whether it is A or B. None of the leaders are new to you. So, it is time to say We wait what you do? Our request is simple. Justice !

    Just imagine appointing former security services personnel as officials in the Office of Missing Persons! In the OMP the perpetrators of the crimes are delegated the task of investigating the forced disappearances. This is utterly farcical. Unfortunately, that is the state of the law in this country.

    No change can be expected from RW & SP as leaders but interesting to know the NPP stand under AKD on the issue of missing persons & those banged up for decades without charge. With a bunch of retired military officers in the NPP membership, I doubt very much a change in the status quo. In which case, will the judiciary be truly independent as promised?

      UNHRC is bluffing. If properly investigated the UN and its affiliated agencies like UNICEF have got lot to answer. Their job is to prevent conflicts, not wait till conflicts over and make accusations. Other culprits are Indian and Western governments. “The local chach” has got a lot to answer too.

      If UNHRC were not there, the Paranagama Commission alone, with Northern Paramilitaries, completely wiped out the missing persons relatives. The Paramilitaries and Paranagama commission tried their best to hold on, but High Commissioner Prince Zeid got rid of the tyrants. We understand the paramilitaries are so depressed that their government lost some grip on those families. Two days ago I saw a video on Tamil Page, posted from YouTube. A Paramilitary rowdy riding his motorbike into Jaffna Hospital.. Hitting the chairs and furniture with the bike. Taking and throwing a printer on the head of the front desk employee. He was bleeding. The hospital guards, employees, and walkers are all standing and watching. None was able to step forward and stop that Paramilitary Rowdy! That is the case in Jaffna after Rowdy Royals and Evil liberated the Tamils, buying cluster bombs, chemical bombs and Thermobaric bombs on the $400B unaccounted loans!

      None of these Tamils’ problems are attended to. IMF and Peter Breuer, the mission Chief, are pumping the other $2T so. UNP-SLFP Union, Rapist Army and Paramilitary gangsters are going to perform the rest of the game.

    If anyone is GENUINELY interested in knowing where “hiding”Tamils are, go to western countries and Tamil Nadu. At least there are quarter million of “hiding” Tamils. They hadn’t followed the proper emigration procedure from Sri Lanka. Most of them sneaked out from the country in boats (Kallathoni methods). So is it any wonder that they were counted as missing? There are so many Tam1ls using fake name and age and some have changed their names two or three times.

      Hello Tony, since it looks like PK is not going to return to this forum, due to personal reasons, I will take her place and post something similar, that she usually does. You seem to be obsessed with Tamil Nadu and South Indian Tamils, and rightfully so, as the ancestors of most of the present-day Sinhalese including yours largely arrived from what is modern day Tamil Nadu and then from Kerala, that was also Tamil a few centuries ago or was speaking a low Tamil dialect called Malabar Tamil or Malayalama. Most of your ancestors and the ancestors of many of the Sinhalese, especially the Karawa, Salagama, Durawa, Hunu, Berewa and many other castes, as well as the Sri Lankan Muslims and estate Tamils, would have come from depressed Tamil Adivasi or Palang kudi Makkal( the original people) castes like this. Now having mixed up with a bit of Portuguese and other Europeans, some of your looks may have changed but this is your actual origin and the origin of most Sinhalese.               Definitely not 19, most probably in her very early 20s from the style of writing and humour. Just because she is young does not mean she has to be ignorant. May have been very interested from a young age about the history of her people and their language and origins. Her parents may have encouraged her and may have been politically active. Many young Tamils in UK are, and if you take an interest, all you have to do is research on the computer and young people are very good at this. We do not know what she was studying at the university, may have been languages and anthropology or history. Anyway, it is a pity she left and all the best to her. Hope she returns

        Sinhalese are the earliest arrivals in the Indian subcontinent. Later waves of immigrants pushed Sinhalese descending tribes the most southern coner of the Indian subcontinent now known as Sri Lanka. Tamils descend from later arrivals. Before formation of Sinhala or Tamil identity, they had a shared ancestor, that doesn’t mean Sinhalese descend from Tamils.

Southern Sri Lankan coast has more Javanese/Malay cultural influence. The reason why Tea plantation Tamils, tobacco plantation Tamils of Jaffna and Marakkala Muslims speak Tamils is because they are all from South India.

          The ancestors of the Sinhalese Karawa, Salagama, Durawa, Berewa, Hunu and many other minor castes arrived from South India, largely from what is modern Tamil Nadu and Kerala, which was also Tamil at the time they migrated. This is a historical fact. Ever heard of language replacement and changing religion and identity? Go and ask your South Indian origin Tamil great grandmother. These people may be around 30-40% of the present-day Sinhalese but recent post 15Th century South Indian Tamil migration does not end with these so-called low caste coastal Sinhalese but many so-called upper caste Govigamma and aristocratic Sinhalese both from the Kandyan and low Country areas have a recent South Indian Tamil immigrant ancestry. Infact lots of Sinhalese Govigama family names are like a Chola Pandian Tamil who is who. All the Sekeras, Ratnams, Koon/Koone, Tunga, Wardenes, Perumals, Hetti, Mudali, Pilli, the list goes on, as most of the Sinhalese ruling classes and aristocracy arrived from South India or were from the local Tamil Naga. Like the Neela Perumal ancestry of the Bandaranayke and the Thambi Mudaliar ancestry of the Jayawardene’s and many other leading Sinhalese families. East Asia does not have a caste system and do not post rubbish. The Javanese/Malay cultural influence is very minor and only found in pockets of deep south, definitely the Rajapakse’s have it, you can see it in their facial features.

            The Sinhalese are largely descended from the Tamils and other Dravidians, both native and South Indian and they form the base or foundation of the Sinhalese people and other influences from North India, SE Asia and other parts of the world are minor, Even the word Govi or Goviya is derived from Tamil/Dravidian from the word Koiyuthal or Kor meaning to reap or to pluck which a farmer does. Go and tell your fairy tale to others. Sinhalese is basically a highly Prakritzed Dravidian Tamil. Other than the huge amount of Prakrit/Pali now Sanskrit derived vocabulary, thanks to Buddhism, it is Tamil or Dravidian in every way.

              Nanayakkara in Tamil means money keeper or revenue collector. Kurup is Malayala name. Any Sinhalese having Kutty in their family (Ge) name is from Kerala.

        Please investigate the conduct of Premadasa Udugampola, Gotabaya, Sarath Fonseka, Janaka Perera, …….. Green Tigers, ….. JVP, DJVP, ….. between 1987 and 1991, you might find answers, as the Sri Lankan state had already compensated families of 60,000 Sinhala victims according to JVP, AKD, …

        Why haven’t the Sinhala victims’ kith and kin protested LTTE killing of Sinhala Speaking people? Are you aware of the mass killing of Muslims in the East?

          The LTTE were estimated to be responsible for 3,700 to 4,100 civilian deaths in over 200 separate attacks. Even adding 28,000 military (according to Gota himself) doesn’t make 100,000.

            The Sri Lankan Government is well known for either not providing statistics, or misinformation (lies). I have been looking at how many Sri Lankans have left the Country in the recent past. I also tried to find anything on Excess Deaths, which most Countries compile, to no avail.

            The state won’t or can’t provide the correct numbers of innocent victims between 1971 and 2009 as functionaries, armed forces, politicians ….. Safforanistas do believe they are smart, therefore they do not need to have/provide accurate figures.

            Truth has become a trading commodity now since powerful countries are there to protect the war criminals at any costs at international forums.

They are still searching/waiting for accountability. Years have passed and all accountable are dead with their victims.

      RBH59: This incident took place in Aluthgama. A man and a woman walked into the shop and claimed to be from the Inland Revenue, (not insurance) and asked the shopkeeper to pay the arrears in taxes. The shopkeeper on suspicion called his son, who checked the identities provided were fake. He alarmed the neighbors took both the man and the woman to their custody and handed them to the Police.

      A few days back Tax Authorities cautioned the public about such a hoax and the people are now aware and know what to do in such instances.

      Now, please don’t bring the “Muslim” factor into this.

          RBH59, there was a racist incident reported from Trincomalee committed by Muslims. In a propaganda meeting of Sajith in Trincomalee, he had a Tamil person on stage. Muslims objected to it saying that they organised the meeting and they do not want any Tamil on stage. Sajith did not have the guts to stand up to the racists and asked the Tamil to get down form the stage. There are several meetings organised by Sinhalese in the south which had Muslims on the stage. In none oof them Muslims were asked to get off. Why are you silent about this incident in Trincomalee. If Muslim had been off loaded, by now several Muslims would have howled in protest. This shows that Muslims are the worst racists.

    This UNHRC talks so much about “Human Rights Violations” that took place in Sri Lanka.

    First, look at our “Representative” to the UN in Geneva. Her name is Ms. Himalee Karunathilaka. Before, she was the Deputy High Commissioner to Australia. Recently an Australian Federal Court ordered to pay AUS$ 543,000.00 to a domestic aid in unpaid wages and forcibly keeping the passport belonging to this employee.

    Isn’t the UN in Geneva aware of this landmark decision? Why is the UN not demanding her to be removed from that portfolio?

    This appointment was made by Ranil W our President. So was the appointment of our IGP – a draconian stupid policeman found guilty by the SC for HR violations, who applied “Siddalepe” – (Balm) into the genitals of a man in custody.

      As an interim measure, upon hearing a few applications to the courts, by a decision of the SC, Deshabandu Thennakone was temporarily removed from the function of the IGP. So far Ranil W has failed to make an Acting Appointment as per the directions of the courts. Ranil W has ignored this court order (there are several other such decisions Ranil W has completely disregarded) and continues with his political terrorism. Mark my words, Ranil W will face the music after the 21st i.e. once he cannot further hold on to that notorious “Imunity” clause in the Constitution.
